New Zealand is blessed with an abundance of secluded and scenic spots ideal for freedom camping. In order to maintain the privileges of freedom camping, and ensure the protection of our environment, it is important everyone camps responsibly and observes local freedom camping-related rules.

Some Council's are creating new bylaws under the Freedom Camping Act 2011. In July 2012, the NZMCA commissioned public law firm, Chen Palmer, to prepare a guidance document to assist Councns and other interested parties in better undestanding the requirements of the Act. Westshore Beach Reserve is a special place to notjust Napier residents, but also visitors' Westshore Beach Reserve has it all, a childrens' playground, flat beach access for launching boats, kayaks and jet skis, picnic spots, large flat areas for launching kites or for family and group impromptu cricket and rugby games and of course a safe swimming beach.

It is the fact that such activites have a home that helps to give Westshore, and Napier, that community feeling that so many people live in and visit the region for.

Since the introduction of the 2014 Freedom Camping though, th's feeling of joy and community togetherness has massively declined

There has been a dramatic reduction in day visitors for several reasons. Firstly, they can't get into the car park because it is full of campervans; as such access to the reserve and the beach has been greatly hindered. Secondly, many visitors feel intimidated by the sheer size and number of the motorhomes, with many commenting that they felt like they are intruding on a camping ground. This intimidation is not limited to visitors, and many local residents also feel they cannot use parts of their own community because of the number of people camping here.

Freedom Camping is something special to New Zealand, and offers tourists a chance to explore different parts of our wonderful country in a different way. However, this should not be done at the expense of rate paying locals. There are places within Napier which would lend themselves nicely to freedom campers, which would not have such a drastic and negative impact on the community.

There are 420 commercial holiday parks in New Zealand that annually provide in excess of 7.4 million guest nights 33% of which are international visitors

An average of just 23% of daily expenditure by Holiday Park visitors goes toward holiday park accommodation costs. The balance, which totals approximately $769 million annually, is typically spent outside of Holiday Parks in areas such as hospitality (cafes, restaurants, bars), activities and attractions, transport (rental vehicles, fuel, buses, taxis), retail goods and services, a rid entertainment.

Holiday Accommodation Parks Association Position of Freedom Camping

As an Association we support freedom camping in New Zealand in appropriate locations. We believe that Councils where necessary should develop bylaws that state:

. Freedom camping is prohibited in urban areas. . Outside of urban areas freedom camping is restricted to self-contained vehicles which meet NZS5465.

There is no such thing as free camping -there is a cost whether it is to local ratepayers, Doc or tax payers. We fully support the concept that the user should pay.

As part of local communities our members take an active part in the development of policies and bylaws which apply to freedom camping. Our members provide feedback on suggested freedom camping areas. In some cases we will support freedom camping areas and in others we will oppose them; these decisions will be linked to the appropriateness of the location and the mood of the community. We do not consider urban locations as being appropriate for free camping.

While we do not seek special protection for our members from the bylaws it is sensible that some buffer around commercial Holiday Parks be put in place. This can assist in discouraging the unlawful use of facilities e. g. showers toilets and dump stations, which occur at many parks, but also remove the inevitable tension that will arise from campers overnighting for free in close proximity to commercial holiday parks.

HAPNZ has been an active participant in the NZ Responsible Camping Forum and fully supports the key messages and information that has been agreed and promoted by group members.

We believe that strong, consistent national messages, backed by comprehensive regional information will help remove much of the tension that has existed over vehicle-based camping and result in better experiences for campervan holiday-makers and communities.

Hawkes Bay Regional Expenditure Information The following table shows that in the Year ended August 2016,233,952 guest nights were spent in commercial holiday parks in the Hawkes Bay RTO region. Campervan/motorhome/sleepervan Fleet

The rental campervan fleet is estimated at 5,500 vehicles. In addition to these rental vehicles many Young international visitors purchase private vans and other vehicles and travel the country for periods up to six months.

The NZMCA members own in excess of 40,000 vehicles

Urban Areas Many TLA's are choosing to prohibit freedom camping within Urban Areas and we would encourage council to take this approach in the BYlaw. It is not appropriate for visitors to be sleeping in vehicles overnight in residential urban areas

Nori - Self-contained Vehicles Over the past Year there has been a shift to restricting freedom cain ping to vehicles which are fully self-contained which meet the New Zealand Standard NZS5465. We encourage Councilto adopt this as a region wide condition.

Enforcement It is essential that no matter what decisions as are made regarding the Freedom Camping BYlaw that Council provides sufficient resources to enforce them. As has been seen in Queenstown Lakes District Council area, the enforcement can provide sufficient funds to cover all enforcement costs

In conclusion . I further note that freedom campers must be self contained.

I have noticed over the past 6 months 2 incidences of tents being set up and consistent use of the public toilet facilities by freedom campers who are far from self contained. This can hardly be consistent with protecting the area

The current prime areas used by freedom campers are totally monopolised by them during the warmer seasons to the exclusion of many rate paying Napier families. These areas are the best for family access to the beach. Hardly fair considering the fact that freedom campers make no contribution to the mainenance of the area or the toilet facilities

I further note the the NZ Bill of rights needs to be considered irisofar as it may infringe on the rights of freedom campers. The are approximately I87 rate paving residents in Fergusson Drive and The Esplanade who by my estimate contribute $600-700,000 in rates used in part to maintain our reserves and facilities. Freedom Campers make no contribution to our reserves or facilities but expect the right to (almost) camp where they like for free Where do the rights of Westshore and Napier ratepayers rank in relation to freedom campers

I therefore fully support the proposed bylaw prohibiting freedom campers from areas specified

Submission to the Napier City Council FREEDOM CAMPING BYLAW 2016

I fully support the 2016 Freedom Camping bylaw prohibiting Treeoom camping at Westshore Beach and other areas the Council have designated as a no vehicle or camping zone. Infoct I support prohibiting freedom camping in all or any residential areas.

I bought a property and moved to The Esplanade in March and was astounded by the number of freedom campers parked up. I dread to think what it is like in summer. I note they must be self contained vehicles capable of meeting all sanitary needs of the occupants without requiring external services. My property is almost adjacent to the toilet block and I witness every morning a steady stream of campers using these facilities.

I also witness them taking their dogs on the beach and not picking up their dog faeces. This is a real concern as I believe a serious health & safety hazard as children and adults play and picnic along this coastline.

I coinmend the Council for addressing the concerns of the residents and others with issues raised, such as providing unfettered access to the beach for Napier residence who regularly use this area as their recreational playground. Wind surfers, canoeists, swimmers, cyclists, children on trikes, scooters, picnickers.

I feel the extra pressure on this location from freedom campers is having an adverse effect in this public space and interfering with the natural environment.

Under the New Zealand Bill of Rights all citizens have the same rights, but I feel that some rights have to be considered greater than others' The permanent residents and tax paying citizens of Napier who makeup and take pride in their neighbourhoods and community surely must have greater rights than the rights of transient campers who contribute verylittle to our community.

The Westshore Residents' & Development Association support the proposed 201.6 Freedom Camping bylaw

This submission is for the benefit of submitters who cannot understand why the small limestone car park at Westshore Beach, opposite Domain Rd, is proposed to become a prohibited area for overnight freedom camping.

The Freedom Camping Act 2011 states very clearly that a Council can make a bylaw that controls freedom camping where access to a public parking area is hindered by freedom camping vehicles

Because freedom campers can park at this limestone car park for 3 nights in a row, they tend to stay put for up to 3 days and 3 nights, because if they move they may lose their possie, especially if it is in the front row nearest the beach

Last summer, the limestone car park was effective Iy a camping ground, not a public car park, as depicted in the following photos

Firstly I would like to compliment Your working party on putting together such an easy to understand and fair draft freedom camping bylaw. This is a model by which many other local authorities could learn

You have correctly recognised that freedom camping is not an exclusive term applying solely to those in self contained vehicles. All Points Camping NZ was formed in December 2015 to support and represent inclusive Iy, NZ family and active campers including those who use tents and trailer campers and have been marginal ised over the past few Years,

These are our future campers and include our vulnerable Youth, our lower income families. Camping has significant health and social benefits and we should be encouraging opportunities for this. It is notjust overseas tourists and and motor homers that we should be welcoming and acknowledging

I would like to refer to the following clauses which I believe are incorrect

"5.3 Freedom Camping is restricted in areas identified in Schedule Two: Restricted Area for Freedom Camping (non- self-contained vehicles). Vehicles are restricted to a maximum of three consecutive night stays and freedom campers must comply with the conditions listed In 6.1. " clause 5.2 refers to certified self contained whereas clause 5.3 refers to non-Self contained vehicles. A vehicle may be fully self contained but not certified. Therefore in context clause 5.3 should state "(nori certified self contained vehicles) to be correct in law or clause 5.2 should be amended

Note: many campers are self contained, for example pop top campers, Australian style OZTENT, OZTrail campers. these are becoming very popular in NZ but will often not meet the technical requirements of being certified self contained'

Clause 7.2. "Sealed or unsealed parking areas forming part of any grassed reserve are excluded from this prohibition in 71 (with the exception of Westshore Beach

Reserve, or MCLean Park where freedom camping is prohibited both within the area and any associated parking areas) but freedom campers must still comply with the conditions listed in 5.1. " is open to misinterpretation and confusion For example the prohibited area, grassed reserve, of Tamatea would allow freedom camping in the adjacent sealed area - carpark. the carpark itself is however prohibited

In such cases of freedom camping on the sealed or unsealed area, per clause 2, on interpretation it would be open to all freedom campers notjust those self contained.

Submission on Freedom camping bylaw 2016 Napier City Council

Thank you for the opportunity to comment on the proposed freedom camping bylaw.

I agree with the proposed changes to the freedom camping bylaw, in particular the addition of Westshore Beach Reserve, and northern Ocean Spa Carpark as prohibited areas. However, I believe the rules may be better implemented with several minor changes, as described below:

Issue I : Freedom camping at Perfume Point restricts access for other users.

The issue with the current regime is that freedom camping at Perfume Point causes restricted access for many visitors to this carpark. Observations over the past years indicate that, prior to freedom camping being allowed here, many people would park here and then walk on the beach or pathways, fish, or enjoy the area in some other way. In addition, there were a great number of people who would park facing east or west, and remain in their vehicle to enjoy the view. My family often did this with our 92 year old father who is not very mobile. Being able to park and watch the surfers, yachts or the ships entering or leaving the port is an enjoyable activity, and can only be achieved at this carpark.

Over the past summer, when freedom camping became a much more common activity, there were many occasions where most of the car parks were taken up with large campervans, or the vans were parked in such a way to take up more than one spot. I rioted that many camper vans stayed for several days and nights, obviously reluctant to give up the prime spot they had picked. Even with just several large vans, it is not possible to park between two camper vans and enjoy the view, as it is similar to parking in a tunnel.

I note also that there may be a perception that campervans simply arrive late at night, and vacate the space in the morning. This may be the case in some areas, however, observations indicate that in places like Perfume Point, many campers arrive and stay for several days, then when they vacate the spot, another camper comes along and fills the spot. This results in a continuous occupation of the spots, which then prevents other people from accessing the area.

The current freedom camping area is shown below, and includes all parking spaces in the carpark.

I believe rules which enable of freedom campers to use the entire carpark results in a conflict with condition 6.1 (e) of the Napier City Council Freedom Camping Bylaw 2016, which states campers must. .. ensure parking of vehicle does not restrict access to public areas. ..

I note that the Freedom Camping Act 2011 (Section 11(2)(a)(iii) - see below) allows a local authority to make a bylaw to protect access to the area.

The allowing of freedom campers to park in the entire car park has certainly restricted the access for many people who frequent this carpark. 10

As an alternative, I believe a solution to this would be to allow freedom camping at the 14 carparks facing the south, as shown in the following figure.

This would enable freedom camping to continue to take place without restricting other users' access to the carpark and beach.

I understand there may be difficulty in enforcing such a rule, however, with adequate signage this may be overcome. Other councils enable such a rule to be easily understood by the use of two signs each stating "Freedom camping allowed in parking spaces between these signs", with appropriate arrows indicating the direction to the companion sign.

Suggestion to resolve issue I : Restrict freedom camping to the selected south facing spots at Perfume Point. I, 0 )

Issue 2: Length of Stay

Section 6.1 (9) of the Napier City Council Freedom Camping Bylaw 2016 states no person may freedom camp for more than 10 nights in any calendar month.

I believe imposing a maximum stay is a good practice to encourage freedom campers to enjoy the area, but to also not overstay their welcome, and to vacate the space and allow others to enjoy similar benefits.

However, the current proposed bylaw could result in people staying for 20 days in a row (10 days at the end of one month, then 10 days at the beginning of the next month). I believe this length is inconsistent with Local Government New Zealand (LGNZ) recommendations, which in their example shown below, suggests a 3 night maximum in any 4 week period.

The decision to use a calendar month as opposed to a 4 week period results in the consecutive length of stay effective Iy being able to be doubled from what is intended.

Issue 3: Presentation colour in Maps

The prohibited areas and the permitted areas are the same red colour in the maps presented in the Napier City Council Freedom Camping Bylaw 2016. This could be confusing to some people.

Many people cut and paste maps from publications, which could easily result in the maps being misinterpreted since the wording may not be included. Simply making the permitted areas green (or at least some colour other than red) would clearly differentiate the permitted areas.

An example from another council is shown below, which uses yellow for permitted and red for prohibited.

I support the removal in the proposed revision of the bylaw of the two areas currently designated as freedom camping areas at Westshore.

However, I am very disappointed that as currently proposed, the revision of the bylaw will impose a total prohibition on freedom camping at Westshore, because both the Westshore foreshore reserve and the Meeanee Quay reserve are listed as prohibited areas

To clarify my viewpoint, I am a member of the committee of the Westshore Residents' and Development Association, which as a body, last Year requested that Council look again at the freedom camping bylaw because of concern communicated to the WRDA by residents in the vicinity of the designated sites on The Esplanade. Throughout the process that has evolved since then I have consistently argued that it is not in the best interests of the future of

Westshore, to coin PIetely prohibit self-contained freedom cain ping.

Other committee members have favoured total prohibition on the grounds that

- We don't have to have a freedom camping site at Westshore and that

- Freedom camping should not be allowed in urban areas

Whether or not freedom camping should be allowed in urban areas is beyond the scope of the bylaw review, and I will not, therefore make any comment, other than to note in the report on the proposed review of Napier s freedom camping bylaw tabled at a meeting of Council's Regulatory Committee on 7 September, it is specifically stated that Napier is a popular destination on the freedom camping circuit, and freedom campers are described as "a high value tourist market that is set to increase over time"

In regard to whether or not a freedom camping site should be located at Westshore, I note that the bylaw review sets out more specific clarification of where non self-contained freedom camping is and is not permitted in the city. As it has been the litter problems and other inconsiderate behaviour of those in non self-contained vehicles that have triggered the wish to be totally rid of freedom campers at Westshore, this clarification should resolve these issues

However, it was not litter or behavior generally that led to the complaints voiced by residents of The Esplanade in regard to the public carpark designated as a self-contained freedom camping site at that location. Their stated problem was that it had become, ipso facto, inaccessible to other members of the general public, particularly (but not only) during the summer months when the area wasjampacked with motor homes.

2 ,v I 102, , . I consider that prohibiting the self-contained freedom camping vehicles from all of Westshore is an unnecessarily

extreme solution to this problem. In the September report Council officers describe Westshore as an area of Napier

that is of "special recreational, environmental, and social significance, high in amenity values" and it is, as also

highlighted in the report, one of only a very few swimmable beaches in Napier. Westshore is attractive to visitors, as

evidenced by the number of motels, the holiday park, and the hotel already providing accommodation in the suburb.

Freedom campers are another significant sector of that visitor market and it makes no sense not to provide for them at

Westshore.

I also question the prohibition of self-contained freedom camping on the grounds of whether Council will be able to

provide the level of resourcing necessary to carry out surveillance to enforce that prohibition. In the September report

it is stated that "monitoring of freedom camping to ensure compliance requires daily surveillance because of the

transient nature of campers. " Last summer, the perception of Westshore residents was that the surveillance was

inadequate. In addition, the September sound the warning that the creation of a new prohibited area at Westshore is

likely to lead to an increase in after hours calls that trigger Armouguard callouts.

I would like to see an alternative site provided for self-contained freedom campers only, of a similarly modest size to

the one on The Esplanade, at some other suitable location in Westshore

I note that in the September report to the Regulatory Committee it is envisioned that the proposed revision of the

bylaw "is not an end point, with further freedom camping options to be explored in the future" and that "Council

intends to monitor the situation and assess the suitability of other sites that could be used to accommodate self-

contained vehicles within the city. "

I therefore request that, in consultation with residents and the WRDA, Council continue to seek out and designate an

area to cater only for self-contained freedom camping at Westshore.

As a final comment, I have also read recently that in some other parts of New Zealand, residents who live near to

freedom camping areas are consulted on an annual basis to ensure that they have not experienced any problems

arising from the activity of freedom camping during the past I2 months. I see this as a very positive move, and one

that would reassure the residents of Westshore that they are not having a problem activity dumped on them without

any defined channel of communication with Council.

BYLAW 2016

Introduction

The New Zealand Motor Caravan Association Inc. (the NZMCA) appreciates the opportunity to submit on the draft freedom camping bylaw (the by law). Formed in 1956, the NZMCA today represents over 68,500 individual New Zealanders who enjoy travelling our country at leisure in the purpose built motorhomes and caravans.

The NZMCA is a strong advocate for freedom camping in certified self-contained (CSC) vehicles and recently commissioned a partial review of the NZ Standard for Self-Containment (NZS 5465), with support from Local Government and the Department of Conservation. Freedom camping is an important, traditional activity for our large and rapidly growing membership base. For this reason the NZMCA invests significant resources each Year protecting the privilege to freedom camp, while giving back to communities and encouraging decision-makers to pass fair and reasonable bylaws. A summary of the NZMCA's efforts and contribution to communities is attached

Since Napier received motorhome friendly accreditation last year, we have enjoyed furthering our strategic partnership with council and other local event organisers by promoting Napier as a friendly destination to NZMCA members and other responsible tourists travelling in certified self- contained (CSC) motorhomes. We acknowledge the council is also reviewing its strategies and investigating further opportunities to support responsible freedom cain ping in Napier, thank you.

For its part, the NZMCA has provided Napier with free tourism advertising on the understanding council decisions will both enable and support responsible camping in (at least) self-contained vehicles, without undue or disproportionate restrictions around freedom camping. In terms of this bylaw review, while we respect the council has a duty to respond to community concerns we, , 173

like everyone else, also expect considered decisions will be made in line with the guiding legislation, including the councils commitment to the motorhome friendly programme.

Please note that if it appears the council- or any local authority for that matter -is attempting to subvert the spirit and intent of the Freedom Camping Act 20TT (FCA), or is endeavoring to use the Act for improper purposes (e. g. prohibiting freedom camping to surreptitiously protect property values or private views over public land), the NZMCA will consider taking matters further.

Economic benefits

Motor caravanning is worth over $650 million to New Zealand's economy and the latest research reinforces how significant the industry is to local economies. For example;

. An independent report' published in October 2012 found campervan hirers in the year 201.1 spent on average $1.95 per day during their travels. Tourism Industry Aotearoa pu blically su pported these findings stating campers were contributing to communities throughout New Zealand, supporting local business andjobs, and their spending was not limited to tourism operators rather spread across a wide range of businesses in the coin m u nity;

. In February/March 2014 the Council surveyed 1,000 campers at popular freedom camping spots across their district. According to their results: the average camper spent $9T a day while visiting the district, 78% were domestic visitors, and 64% over 60 Years of age. The Council's Parks and Recreation Manager, Mathew Begg, noted that this spend was quite significant to their community'-

A survey carried out in March/April2012 at Ferry Road, Taupo (a restricted freedom camping area) showed the average motorhome visitor spent $401 per visit. Also of note, over 1.00 local businesses signed a petition to the supporting the preservation of freedom camping at this site; and

Results from a 2012 survey by CB Marketing Consultants, Nelson showed the average NZMCA couple spent $117.00 per day in local businesses while visiting the small town of Murchison.

The domestic market is undergoing a significant growth phase with the NZMCA forecasting over 80,000 individual members in the next 2-3 years' That equates to approximately 50% more domestic motorhomes on the road by the year 2020. NZMCA members travel throughout the Year, especially over the off-peak season, and therefore provide much needed economic benefits to small business communities outside the peak holiday periods.

SOCiol benefits

Places that permit CSC freedom camping generally suffer less from vandalism and other undesirable social behavior as self-contained campers provide free security forthe area. Many community clubs and associations nationwide have formed reciprocal relationships with the NZMCA allowing our members to park overnight for the security it provides to their facilities. This positive benefit from allowing responsible freedom camping is frequently overlooked.

Environmento1benefits

In addition to the benefits associated with CSC freedom camping, NZMCA members value the places they stay and take special care to look after and improve them. Members regularly volunteer their time with local organisations and authorities to tidy up sites, pick up litter, and plant vegetation. Again, this positive benefit is frequently overlooked.

Definition of a 'certified self-contained vehicle'

A few local authorities have encountered problems with small 'sleepervans' purporting to be CSC. Usually the portable toilet provided is not easily accessible within the vehicle and in many cases the vehicle occupants have no intent on using them. Although these vehicles may technicalIy comply with the toilet requirements stipulated under section 6.1 of NZS 5465, the NZMCA believes the set up and e tr'cted use of the toilet ails to achieve the overriding intent of the CSC Standard. This view is shared by other stakeholders.

The NZMCA acknowledges this problem is not widespread and is confined to a relatively small group of low-end sleepervans. However, with the projected growth in tourism and anticipated increase in freedom campers next summer, the NZMCA firmly believes the industry and local government need to take proactive action now. Therefore, with the support of Local Government New Zealand, the NZMCA has commissioned Standards New Zealand (SNZ) to review NZS 5465 . 103

with a view to, inter alia, 'raising the bar' around the minimum requirements for on-board portable toilets. In the meantime, the NZMCA has adopted the proposed amendments internally.

According to SNZ, the impending review of NZS 5465 may take up to 1.1 months from beginning to end. The project is expected to conclude during winter 2017. Therefore, this bylaw review provides council with an opportunity to adopt the anticipated changes now in order to manage the aforementioned problems over summer (as other local authorities have done). We therefore recommend amending the definition of 'certified self-contained vehicle' as follows:

Furthermore, to clarify the NZMCA's position on freedom camping, although the Association is a strong advocate for responsible freedom camping in CSC vehicles, where necessary we are not opposed to local authorities developing bylaws that accominodate other freedom cain pers, e. g those travelling in non-Self-contained vehicles and/or tents.

Clause 9.1 of the bylaw enables the Chief Executive to temporarily close or restrict freedom camping in any area or part of any area where the closure or restriction is considered necessary to (inter alia) :

(e) protect residents from signjfitont odverse effects OSsocioted with freedom coinping in publ^t spoces.

While we support in principle local authorities empowering themselves with provisions similar to 9. T, sub-clause 9.1(e) is vague and would potentially enable the council to close an area(s) to freedom camping for reasons that fall outside the scope of the FCA. For example, the council may be inclined to use 9.1(e) if/when residents feel their property values or private views over public land are being significantly affected by freedom campers. The council may rely on these arguments to justify closing an area to freedom camping. We submit this would be unlawful behaviour and recommend deleting sub-clause 9.11e) from the bylaw.

Westshore Beach Recreation Reserve

We acknowledge the restricted car park area is a controversial issue. However, council reports suggest that it is necessary to prohibit all forms of freedom camping across the entire reserve in order to protect access, and notes the car park (representing a very small portion of the entire " 102^^ 5

reserve) can be congested with motorhomes and other visitors during peak times of the Year. We have received additional reports from other local sources noting only some (certainly not all) Westshore residents are opposed to freedom camping at the car park. These residents are primarily concerned with vehicles blocking their private sea views; despite the fact the specific area of concern is a formed public car park.

From the evidence received to date, we disagree outright prohibition along the entire reserve is necessary. We also disagree outright prohibition is the most appropriate and proportionate response to the perceived problem. We do, however, agree there is a need to review and potentially tighten up the existing restrictions at this site in order to protect access to the area. With that in mind we recommend the following alternative solutions, which the NZMCA will elaborate on at the bylaw hearing:

. Restrict the number of permitted freedom camping parking spaces at the Westshore Beach car park during peak periods only, orthroughout the Yearif necessary. Currently there are no such restrictions in place, which may alleviate existing congestion issues

. Work with the NZMCA to expand the car park area, noting reserve land immediately south of the formed car park is included in the existing bylaw (although no vehicle access is available). The vacant reserve land offers a large overflow area (at least 4x the current car parking area) that could be utilised during peak periods to help protect access for all legitimate visitors, including motorhomers as either day visitors or freedom campers.

. If this car park must be prohibited then prohibit that area only and continue to allow restricted freedom camping at other vehicle-accessible sites along the reserve. The councilwould rely on the proposed default rules under sections 5 to 7 of the bylaw to manage the activity. This approach may resolve the issues expressed by some Westshore residents; continue to enable some responsible freedom camping along the reserve; and minimise the influx of campers during peak periods by not advertising the site as a 'designated area'

The NZMCA is recommending alternative solutions in an attempt to resolve the issue amicably for all interested parties. While we do agree outright prohibition along the reserve is necessary, we it may be appropriate to alter the existing restrictions with a view to enabling more controlled, uriadvertised freedom camping. If, however, the council prohibits the entire Westshore Reserve as is proposed, the NZMCA will have little choice but to take matters further.

MCLean Park

As noted in the Sop and the Regulatory Committee Agenda, dated 07 September 2016, the council recommends prohibiting MCLean Park, all associated car parks and surrounding streets, to protect public vehicle access during rugby and cricket matches. The agenda also notes the Hawke's Bay Rugby Union and Central District Cricket Association lease the car parks from council. , 103 6

Firstly, from the information made available to the public, the NZMCA does not agree that it is both necessary and appropriate to prohibit freedom camping around MCLean Park in order to protect car park access during rugby and cricket events. If necessary, the council can rely on sub- clause 9.1(d) to temporarily prohibit freedom camping during planned events, and outside of these events continue to permit restricted freedom camping as per the default provisions under sections 5 to 7 of the bylaw. Secondly, if the councilleases car parks to the rugby union and cricket association, then the council no longer has management or controloverthose car parks. The car parks are no longer considered local authority areas for the pu rposes of the FCA. For this reason alone it would be inappropriate for the council to regulate freedom camping over leased car park areas.

The NZMCA requests the opportunity to speak at the hearing and will require a projector.

The Hawkes Bay Area committee of the New Zealand Motor Caravan Association (NZMCA) appreciate the opportunity to submit to the draft freedom camping bylaw. The Hawkes Bay area has some 1500 members residing within the region most of whom enjoy the benefit of being able to enjoy the freedom camping activity that "Certified self-contained motor caravans" are able to provide under NZS 5465.

With Napier now recognised as motorhome friendly our local resident members have enjoyed the ability to park at local recreational reserves as do many members from all over New Zealand when visiting the city.

Summary

We support the bylaw but only support the proposal in part only. We recommend the following

I Amend the description of certified self-contained vehicle to match the intended amendment to NZS 5465. 2 Remove clause 9.1. e as this clause is extremely broad and uncertain in definition.

3 Amend map 8 prohibiting freedom camping within Westshore Reserve.

4 Amend map 9 prohibiting freedom camping at MCIean Park.

Certified self-contained vehicle

With proposed changes to the NZS 5465 to restrict the use of toilets in smaller vans where there is insufficient room to access and operate the toilet with a bed permanently made up, these smallvans will no longer qualify for Certification.

Closing areas to freedom camping

We feel that the clause 9.1 e is very loose to interpretation and that it could be used in circumstances that would be opposed to the Freedom Camping Act. Westshore Reserve Area.

With regard to the Westshore Reserve this is very large area and we believe that a lot more area could be opened up for vehicle parking with MotorhomesICampervans restricted to no more than six vehicles in any one area parked up at the same time, re parking could be spread over a much wider area of the reserve in three or four different locations. This would result in reducing the pressure on the existing parking area.

MCIean Park

To MCIean Park we object to the possible loss of parking in this area, we would be understanding of the need for council to restrict on occasions due to large sporting events. However if we are to loose any parking in this area we would respectfully request that council find a replacement area of similar capacity within the city.

Introduction

The attendees of the New Zealand Motor Caravan Association Inc. Annual "Lower North Island Rally" held at Fielding over Labour weekend 2016 thank council for the opportunity to submit on the draft freedom camping bylaw. The provinces represented at this rally included , Mariawatu, Wariganui, Wairarapa and Hawkes Bay as well as visitors from other regions. Many of these people are regular visitors to Napier & have enjoyed the welcome from the city as a motorhome friendly destination.

Summary

We support the bylaw but can only support the proposal in part only. We recommend:

I Amend map 8 Prohibiting freedom camping on Westshore Beach Reserve.

2 Amend map 9 Prohibiting freedom camping at MCIean Park.

3 Amend definition of "Certified Self Contained vehicle" to match the changes proposed to the NZS 5465:2001: self-containment standard.

4 Remove clause 9.1 e) this clause is vague and uncertain and council could invoke this clause in an unfair situation outside of the intention of the Freedom camping Act.

Westshore Beach Reserve

The members felt that the proposed prohibition was a step too far from what is presently allowed, there are several other areas within the reserve that could be utilised for freedom camping in smaller groups, which would alleviate the concentration of motorhomes in the northern carpark a rea.

MCLean Park

Members do not agree that this area should be closed to freedom campers however they do accept that council could require to temporarily restrict freedom camping during large events. I request the option to speak at the hearing for and on behalf of the listed attendees attached.

- I do not have any issue with removing the Northern end of Ocean Spa Car Park or Westshore Toilet Block Park from the 'Permitted" park over list.

- I am however, greatly concerned at the proposal to remove other areas from the approved "Permitted" park list, especially so, as no alternatives are being offered

I cannot agree with Council advisor comment as to reasons to close Westshore "Permitted" park. I can only imagine at the thought process that came to bear on the three criteria to enable Council to ban Freedom Camping in the Area using the guidelines of the Freedom Camping Act

That is

IIto protect the area.

21 To protect the health and safety of those who visit the area.

31 To protect access to the area.

Given the dimension of the Westshore Reserve, the multiple entrances along its length and its under utilised grassed areas I find it difficult to understand that points I, 2 or 3 can reasonably be justified as a reason to close the area off.

To protect a view is not an option under the Resource Management Act.

- I would like to suggest that the area at Westshore Beach Reserve Car Park, map 4a of the Freedom Camping BYlaw

2015 be kept open and further opened to the dimensions approved in that map. Some of the area to be designated

Freedom Camper only parks. For example a maximum of 20 certified self contained vehicles.

This particular site meets several criteria in my view

I I Good and safe access off a low traffic flow street.

21 Ground slopes down from street level so minimal view obstruction for the few affected residents, and that covering a very small arc in the overall picture.

31 Excellent separation from houses, street and cycleway

41 situated away from the main swimming and child play area.

51 Easily accessed from the Public Dump Point in Domain Road

- I also suggest the inclusion of the centre parks only, not the whole area, (approximately 8 spaces) in the car park at Nelson Street, Ahuriri Estuary (North of the Sport Fishing Club) which would be suitable for motorhomes up to 12

The Pohutukawa trees at the entrance would screen vehicles from the road and also the apartments across the street.

- I do not consider any other alterations to the existing bylaw are crucial at this point in time and that the whole

process requires a settling down period to really be able to evaluate its effectiveness and any perceived flaws. Perhaps with Central Government considering Tourism and Freedom Camping at this point in time maybe we should be waiting for their thoughtsjguidance on the matter

- Meanwhile, Policing the main parking areas and issuing fines where appropriate will very quickly sort any non

complying Campers.

- To suggest visiting travellers use a Camp Ground or the NZMCA site at Eriksen Road I believe is NOT consistent with

Clarification Required: Section 5.1 (by of the proposed bylaw states that the period of stay shall be no longer that one consecutive night. On the other hand section 5.2 and 5.3 refer to vehicles being restricted to to a maximum of three consecutive night stays.

This apparent contradiction is confusing. Which is correct or how can it be better explained?

Other Issues:

I MY uderstanding is that residents of The Esplanade in Westshore are concerned that camper vans parked on the foreshore restrict their sea view as do other related activities such as hanging out laundry. I note that these concerns are not covered by the bylaw and hence do not provide a valid objection to freedom camping in that area.

2 The proposed bylaw appears to significantly restrict the number of areas available for freeedom camping in Napier. Given that there appear to be some legitimate concerns about carpark and access congestion caused by freedom campers the proposal to reduce the number of available sites is therefore likely to increase congestion in the remaining areas.

On this basis it seems unrealistic to reduce the area available for freedom camping and the aim should be to provide alternative or additional sites to the areas where it is proposed to prohibit freedom camping.

It seems unresonable to completely prohibit freedom camping in Westshore which is a popular swimming, picnicing and recreation area for residents and visitors'

My suggestion is that additional or alternative freedom camping areas could be created in the beach reserve in selected areas between Fenwick Street and James Street. In these area the beach reserve is below the level of the street which should avoid camper vans causing any estiction to the sea view.

A further altenative below street level would be the BOYdstown area o Meeanee Q y.

Conclusions: I am seeking clarifaication of the wording of sections 5.1,5.2 and 5.3 of the proposed by law.

I am concerned that cutting down the available areas for freedom camping will only cuse greater congestion in remaining areas. The proposed bylaw therefore needs to provide for alternative or additional freedom camping areas particularly in the Westshore area. 10^

The Hawke's Bay Housing Coalition thank you for the opportunity to submit on the proposed changes to freedom camping bylaw.

The Hawke's Bay Housing Coalition is a very broad range of agencies involved in supporting the region to achieve healthy housing for all. This coalition works to a strategy with the aim to deliver "appropriate, healthy, affordable homes in Hawke's Bay through leadership, advocacy and action". With housing becoming increasingly uriaffordable, the coalition also aims to address issues and support work for those people that currently have issues in being housed.

The aim of this submission is to provide feedback about the proposed changes to freedom camping and the impact this will have on our most vulnerable people who are homeless and who utilise freedom camping spaces.

The New Zealand definition of homelessness has been defined by four categories. The proposed by law change impacts on the definition category of "without shelter" which means, no shelter or makeshift shelter and examples include; living on the street and inhabiting improvised dwellings, such as shacks or cars'.

There is no official count of how many homeless people reside in Hawke's Bay. Following a community hui in Napier on August 2015 a cross-sector group was formed to address issues and concerns around homelessness in Napier. The research idenitfied there are 18-20 people 'sleeping rough' in Napier CBD, others sleep in cars and tents, or in temporary accommodation such as camping grounds with the numbers increasing'. The Ministry of Social Development assess families for social housing need and for June 2016 Social Housing Register waiting list for Napier, indicates that there are 95 people in Priority A and 34 people in Priority B.

With increasing numbers of homelessness in Napier, freedom camping sites can be viewed as being a safe place to sleep for people who are without shelter with access to toilets. Agencies that help the homeless are noting anecodotally that those people without shelter congregate at freedom camping sites. We want to raise the awareness of the homelessness highlighting that there are multiple agencies working together to address this issue. We acknowledge the regulatory capacity and monitoring that occurs from the Napier City Council at the freedom camping sites. BY reducing the number of sites made available to freedom camping will place additional pressure on the remaining sites, and in particular along the Marine Parade. This could reduce access to a **safe" option for those using temporary accommodation.

We recommend usage be monitored to ensure local and visitor needs are being met continue. Also support strategies to reduce local demand for Napier people without shelter. Reducing the places available will increase the density of people in remaining areas and will place an additional strain on toilets and rubbish in these areas. \^*^ ^Q\'\. ,^\^^... Cary and I are NZMCA members and regular visitors to the Bay for cycling and shopping. We are just on our way back to our home in Dannevirke after another 48 hour stint in Westshore for 2 days of cycling. This is a central point for us to cycle to the city and beyond and the next day the Wetlands. I thoroughly enjoy the down time watching the port activity and the wildlife while Cary fishes. The highlight this trip was watching 2 Killer Whales for an hour exploring the inner sanctum of the Westshore harbour. Magical. This trip we spent $390 at Supercheap, New World, Aquarium Cafe,

Caltex and bulk Bird Seed all in a 48 hour period so we do spend when we are here. We always consider the residents and do not hang washing etc out. We consider our stay there a priviledge not a right. In our opinion the Council have it right at the moment with a 2 night limit. We are happy to move on to another access point for the cycle way after 2 days. If You do block W estshore from us I would be bitterly disappointed but would understand. What I ask in return is for You to open a larger site down the Awatoto end with a sea view where we are not obstructing residents views. We do not want to be in a position of leaving the Bay off our cycle destinations as we feel part of the Bay and spend many happy hours there. As local residents of Napier and members of the Motor Caravan Associaton we were very disappointed to hear that the

Westshore self contained camping area could possibly close.

That would be a great shame for Napier visitors and tourists. And also the Westshore shopping village.

We have stayed there frequently and along with many others enjoy the peace and being close to the sea.

Most campervaners are very respectful of the places they stay, we have never encountered disrespect or lack of consideration to others. The only rudeness we experienced was from a resident who was 'hurling abuse from her balconyjust as we arrived. .and completely uncalled for

There is a real need for a good camper van site in Westshore, and we feel there is considerable potential to design a unique and welcoming place, that could include more tree planting We see no reason to reduce the number of nights if we wish Napier to be motor home friendly city.

We do not believe the Freedom Campers should be stopped from using the beach reserve area. Our beaches are for everyone and in the context of the size of the whole reserve this is a very small parking area. And herein lies part of the problem...... there are not enough suitable sized parking areas. If You want to protect the area what is the difference what type of vehicle You have parked there, freedom campers or cars? People picnic all along the reserve and in front of our house at number 24 The Esplanade and park in different places along the Esplanade, notjust in that one area. We would have thought the safest area to swim in would be down by the Surf Club, where there is parking and life guards.

When a member of The Westshore Residents' & Development Assoc visited a while ago to ask us to sign a petition banning these freedom campers, not one word was mentioned about the points made about protecting the area etc, it was all about the people living in the homes over the road looking at these vans. What is the difference. .... cars or vans.

We have people park over from us all the time...... that is what using the beach areas is about.

As a Napier-based motorhome owner who sometimes makes use of the Westshore Beach Reserve to spend a night or two to recreate at the parking area at present designated as an area where campers are permitted to stay for three consecutive nights I object to a blanket prohibition on camping for the entire length of the Westshore Beach Reserve.

The parking area near Domain Road is not in close proximity to residents who should not unduly suffer from motorhomes parking there.

I consider a blanket prohibition of freedom camping along the entire length of the Westshore Beach Reserve, as an unreasonable limitation of my right to enjoy this area in the way that it has in he past been able to be enjoyed

I do NOT support the closing of the Westshore and the parking alongside Ocean Spa. Napier has attracted numerous people to visit Napier, andjudging by the number of motorhomes I have seen, the financial benefits to Napier in general, but particularly to petrol stations, supermarkets, cafe's and retailers must be substantial. Leaving only the smallest parking at Perfume Point seems to be the incorrect decision

Also, the council need to appreciate the difference between fully self-contained (SCC) and certified overnight parkers and the smaller rental vehicles, many of which are not SCC certified. In my view these campers add a little extra security at night, especially at Perfume Point, where prior to campers being allowed to park there, the toilets were being vandalised

I agree that motorhomes should not be parked wherever they block ratepayer's views of the sea, but that's not the case at the parking along Marine Parade of Perfume Point, and I doubt other then the largest of motorhomes would block views at Westshore.

With ovei' 60,000 members of the Motorhome Cub, who are, in the main, totally law abiding and aware of regulations and restictions, Napier should encourage these members to visit and spend money and time here. Parking during working hours can be handled as a separate issue, but at night, most of the existing Freedom camping areas are deserted. And let's be fair, why does the council want to restrict campervans from parking in these areas, they pay

Road Users charge ( most are diesel vehicles), rego fees, etc. etc. so why should they be restricted where they can park

- essentially they enjoy the same rights as every vehicle on the road.

Instead of closing the parkings to overnight parking, why not seize the opportunity of raising a bit of extra revenue for

Napier by introducing a small overnight parking fee, say around $5 - $10 per night.

All I ask is Napier is not portrayed in the same negative view that the Coromandel was when they enforced anti freedom parking laws which were subsequently overturned. Many campers, myself included, did not travel to the

Coromandel due to their unfair policies at that time.

I am a Hastings resident and I don't support the changes as prescribed in the document however I do support controls

so freedom camping is managed. I support freedom camping in principle

I attended the Art Deco weekend as a freedom camper and was amazed at how well the weekend was organised. I

noticed that hotels and motels appeared sold out so that freedom camping was not adversely affecting accommodation bookings and I noticed the vibrancy and volumes the freedom campers brought, plus the

entertainment venues were very well attended and a very positive experience was had. I came away believing Napier

was was a progressive city, working with freedom campers rather than against it.

Restricting freedom camping will restrict these items and turn people away, They won't be happy given that Napier has

so far appeared very progressive on this issue.

However I do respect that freedom campers can be troublesome, but don't support the idea of having a few troublemakers leading to an adverse experience for everyone else and restrictions being imposed. Instead of restricting freedom camping, I would be supportive of retaining Napier's progressive and supportive stance- but of introducing fairly hefty immediate fines, bans, tows and penalties being placed on troublemakers to ban and discourage them from attending and very clear notices and policing to support that. The issues come from only the big events, where security for such occurances could be budgetted for and funded by the fines and penalties imposed.

This would keep troublemakers out of the picture, but retain the positives of encouraging freedom camping

Freedom Camping Submission by Ann Bowes. We live on Te Awa Avenue directly opposite the Southern camping area on State Highway 2. We have many concerns as we are looking out in this direction from our living room. Do we have to witness a tragedy before the powers that be do something to alleviate these problems?

My submission is that it is urgent that plans for further spaces are in place immediately, considering the overcrowding in the previous summer season.

Points to consider are; Right turning traffic when coining from Hastings. Now that we have the wires each side of the road there is nowhere for following traffic to go when there is a queue in the middle of the road. There has been a pile up here some time ago and we are surprised that there haven't been more. On Sunday (23/10/16) two large vans went past the entrance heading south. They backed up against the look traffic in order to turn in and they had two nights taking up 4 spaces. I understand that traffic flow on State Highway 2 does not come under Napier City Counciljurisdiction but the camping area has been set up by them. Overcrowding. On Tuesday morning (25/10/16) the campers were already parked in the driveway. Last summer there were often cars parked both sides of the driveway right out and including parking on the road. If there is an emergency no large vehicle would have access. These people are not in camper vans but in old converted people movers. They have their mattress on top of a shelf and they cook with a small gas cooker on top of the bedding with the back doorlifted. Many of the vans arrive around 10.00pm which Ithink must be after the last check by security and these are the ones that park wherever they can. We have had up to 70 vehicles in a park designed for 35 spaces and they are using two toilets. We see men urinating behind the toilet block, in the grassed area and we imagine the bushes are also being used as toilets. 3 Day Rule. So far this is not being adhered to at all. We recognise people who have flouted this rule since the area opened. Why put up a notice informing about fines when they all know nothing happens? Why a Sea View? The Motor Caravan association has a paddock behind the golf course in Eriksen Road. Is there a similar area available to be easily developed immediately for this use? Cost to Napier Ratepayers. The toilet block was constructed to give facilities for this camping area. The capital cost of the block and then the truck arriving regularly (every second day in summer) are a drain on the ratepayers. Apart from the major construction cost the emptying fee will be approximately $400 each time for the foreseeable future. I^ ^

Closing of other camping spaces. I am aware that there are other popular areas about to be closed and to my knowledge there no definite plans to replace them which will lead to further overcrowding.

I submit that it is urgent that there is attention to the following points 1.1 Turning traffic from State Highway 2. 21 Overcrowding 31 Rules for length of stay 41 No need for a sea view. 51 Cost to Ratepayers. 61 Closing of other camping areas. I^\

The bylaw proposes to prohibit freedom camping for the whole of the Westshore seafront and to also remove the Northern Ocean Spa carpark as a freedom camping site, but to leave the Perfume Point carpark as a designated site. This will only divert all the current Westshore and Northern Ocean Spa freedom campers to then use the already highly

occupied (by Motorhomes) Perfume Point site

The issues identified by Council to back the bylaw change are:-

I - Protection of the area

2 - Health and Safety

3 - Protection of access to popular areas These also all apply to the Perfume Point site. In fact they are even MORE pertinent to the Perfume Point site than the

Westshore and the Northern Ocean Spa carpark sites. This is because Perfume Point site is:-

- a place of recreational, social and significant to Napier

- Provides access to "Ahuriri Beach"

- Provides access for surfers to Rangatira Reef - A VERY popular picnic spot and also a site where citizens and workers of Napier Lunch and eat dinner

- A site where peoplejust come and park to enjoy the unique views which no other sites have

- Used for sporting events, drink stops, watching and controlling sea events - Is a premium site, but is restricted in size and hence should be reserved for residents and citizens of Napier (and

Hawkes Bay) and not be overtaken by Freedom Campers.

The residents of the Quayside Apartments situated in Nelson Quay, Ahuriri, are opposed to the proposed closure by the NCC of 3 of the 5 Napier restricted areas presently available to Self- contained Freedom Campervans. ( See below ) This proposal takes no consideration of the impact on the Perfume Point Carpark, which has already suffered a " More than minor change to the environment " under the present Bylaw. :

During last summer, afte, constant overcrowding of the Perfume Point site by large campervans and buses, a complaint was made to the then Ahuriri Ward Coundllor, Mark Herbert, requesting that something be done to restore the original usage of the site to cars during the day. He replied that the problem was created by the Government and that NCC had no ability to redress the situation anywhere. This was patently untrue in view of the present Bylaw change being tabled. We submit the following points from the NCC documentation. Some quoted are as relevant to Perfume Point Carpark as they are to Westshore.

STATEMENT of PROPOSAL

Item I Protect the area

Perfume Point carpark, Quote : is a place of recreational, social and environmental significance to Napier Historically it is a scenic beauty viewing point which encompasses views to West , North and North East, and the marked sealed carpark is utilised by the rate-paying public of Napier, and by tourists, who swim on the nearby East Pier Beach, fish from the rocks, picnic on the reserve, watch the yachting ,boating or other water activities, orjust enjoy a wonderful vista of sea and hills. Item 2 Protect the health and safety of people who may visit the area. The public toilet block on Perfume Point carpark should be safely available to users of the walkway adjacent, to swimmers for changing, and for anyone in need! It is frequently blocked after use by Campervan owners to do their personal washing. Note: There is no Effluent Discharge Tank available at Perfume Point.

The size of the Campervans often exceeds the marked carparks and access on the footpaths is impeded for wheelchair users, and there is danger for small children or the elderly with the overhang of the vehicles. The size of the Campervans and Buses frequently means that they occupy 3 or 4 marked parking spaces. * I^+ *

The road entry and egress to the Carpark and its proximity to the East Pier Hotel constitutes a traffic hazard when both sides of the road and round the corner are completely parked up because of functions at the Conference Facility requiring more space than the Hotel carpark provides. This is also a hazard during summer when vehicles plus boat trailers are also lining both sides of the approaches on a blind corner.

Item 3 Protection of access to popular areas. Perfume Point, Quote "is a special area to both daytime visitors and local residents. At the moment the continual presence of freedom campers over the popular summertime peak season is restricting people's enjoyment of this area. Thereforeitis appropriate for Councilto introduce restrictions on freedom camping in this area to manage these issues We would like to submit the following option for the NCC to consider in relation to the Perfume Point Carpark and the proposed FREEDOM CAMPING BYLAW 201.6

That Freedom Camping as a Restricted Area on the Perfume Point Carpark during Daylight Saving Summertime be between 8pm and 9am only ; and during the rest of the year Spin and 9am only. Campervans be required to adhere to all NCC rules regarding parking re within marked spaces and riot overhanging footpaths for public safety. Owners also to use their on board toilet facilities. Freedom Camping bylaw 6.1. .e - Does riot restrict access to public areas.

I am opposed to certain areas being allowed for freedom camping - Westshore, Perfume Point and Marine Parade Ocean Spa end. We appear to give freedom campers choices to park in our most popular public leisure areas without any contribution to their upkeep. I do riot however want to see them having to pay to park up, but would rather them be able to park for free on the outskirts - one area which seems ideal and working well is at the end of the Marine Parade by the children's pump park and then further on to the next parking area, and gets used regularly - great!! !

I have observed over the past couple of years an invasion of camper vans. I am not opposed to freedom campers on the outskirts of Napier, but at key areas where the general public enjoy public spaces, that is where I draw the line.

Last summer at perfume point which is a small parking area - numerous camper vans and buses would clog the area deeming it, at times, unsafe as driving views were restricted.

This area is a high volume area for walkers and cyclists, young families enjoying the views of the bay and seating areas and the elderly who can enjoy a short walk and sit. Many times the buses/vans obstruct the pathways, as they park over the path, because their vehicles are too long for the carpark space.

Some vans/buses take up more than one carpark.

I have witnessed a couple parked up with their bus, and in the next space set up their picnic table and cooking stove and blithely eating their meal - do they contribute to Napier's economy in any way?

I took photos of one incident recently - I wanted to take my elderly mum out, who cannot walk far and parked at Perfume Point - a bus was two parks away but the park next to us was also being used by them, as they had their steps set up, to come and go from the bus - on the other side was a picnic chair in front of what I assumed was their private car. Their dog was tied up and enjoying the bushes along with its feeding bowl.

What I found most offensive was the fact they had placed another picnic chair in front of the bus and were reading their book, right on the pathway, blatanly or obliviously blocking access to all who were wanting to use the cycle/walkway. Everyone had to walk around them or onto the grass. Why they couldn't move it a short distance onto the grass I don't know. This was at lunchtime on a Sunday afternoon, where many of the public were enjoying the walkways. Could they riot park in the fishing carpark and walk along the cycle/walkways as we all do??? And then move on to the end of the Marine Parade??
