The Romany community does not enjoy the status of a national minority in the Republic of Slovenia. It is an ethnic community or a minority with special ethnic characteristics (it has its own language, culture and other special features). The legal basis for the special rights of the Romany community in Slovenia is provided for in Article 65 of the Constitution of the Republic of Slovenia: “the status and special rights of the Romany community living in Slovenia shall be regulated by law”. In a review of constitutionality and legality of the Statute of the Novo Mesto Municipality of 22 March 2001, the Constitutional Court of the Republic of Slovenia established inter alia that the Local Government Act (Official Gazette RS, no. 70/2000) does not conform with the Constitution of the Republic of Slovenia since it does not set the criteria and conditions for the efficient implementation of Article 39, Paragraph 5 of the Act, which introduces a special Romany councillor to the local government. A Romany councillor had nevertheless been elected for two mandates (1994, 1998) in the Murska Sobota Municipality even before this Act was amended in 2002 and the municipalities defined in which Roma must have their councillor.

    ACFC/SR/IV(2017)001 Fourth Report submitted by Slovenia pursuant to Article 25, paragraph 2 of the Framework Convention for the Protection of National Minorities (Received on 6 January 2017) Fourth Periodic Report of the Government of the Republic of Slovenia on the Implementation of the Framework Convention of the Council of Europe for the Protection of National Minorities in Slovenia (10 November 2016) INTRODUCTION On 25 February 1998, Slovenia ratified the Council of Europe's Framework Convention for the Protection of National Minorities, one of the foremost international instruments on minority protection. The Convention contains no definition of the concept of national minority. Therefore, each State Party may decide which ethnic groups on its territory are to be given the status of national minorities as defined by the Convention. Upon ratifying the Framework Convention, the Republic of Slovenia, in compliance with the Constitution and its national legislation, declared in writing that the autochthonous Italian and Hungarian national communities in Slovenia shall be regarded as national minorities. Insofar as this does not contravene the Constitution or other legislative acts (the legal order), the provisions of the Framework Convention shall also apply to members of the Roma community living in Slovenia. Slovenia guarantees members of national minorities special constitutional rights, as follows: as well as to individual members of minorities, it guarantees rights to communities; it guarantees representation in state and local representative bodies, regardless of the number of minority members; it has explicitly committed to materially and morally support the exercise of these rights.1 The statutory rights of traditional minorities are stipulated in articles 5, 11, 61, 62, and 64 of the Constitution of the Republic of Slovenia (Official Gazette Nos.

Still, maybe it is not without a reason that we think that a somewhat similar notion of “confines” also existed in the Hungarian Kingdom and its partner country, Croatia, being in a simi- lar geopolitical region, as our countries were also considered to be the confines of Western civilization and the Eastern borders were often held to be a dangerous zone as far as the security of the country was concerned.1 As Csaba Gy. Kiss describes, Međimurje may be seen as a transi- tional region between Hungary and Croatia. Between 1102 and 1918, Croatia had a federal relationship with Hungary as a part of the Lands of the Holy Crown of Saint Stephen. The common state of Hungary and Croatia functioned as a personal, and also as a real union.2 Even tough Croatia was slightly restricted in the process of the national de- velopment in consequence of the union, it could preserve comprehen- sive autonomy within the frame of the Kingdom of Hungary.
