Cette étude est consacrée au droit privé fédéral et à l'interaction entre la législation fédérale et le droit privé des provinces. Elle porte plus précisément sur le rôle des tribunaux dans le cadre de cette interaction. Elle a pour objectifde vérifier comment les juges procèdent à l'unification du droit privé fédéral en évitant de recourir formellement au droit provincial à titre supplétif. Dans un premier temps, elle établit le cadre juridique gouvernant l'interprétation du droit privé fédéral, de même que l'exercice du pouvoir judiciaire dans ce contexte. Dans un deuxième temps, elle analyse à travers un ensemble de jugements les procédés employés par les juges pour réaliser l'unification du droit privé fédéral. Elle conclut que ces procédés peuvent effectivement permettre de réaliser, au plan pratique, une telle unification. Cependant, ces interventions judiciaires sont ponctuelles et sont limitées à certains aspects de la conception ou de l'application des normes de droit privé. Dans les cas plus problématiques, elles peuvent avoir pour effet soit de nier le vide normatifrendant nécessaire le recours aux sources supplétives provinciales, soit de nier la pluralité formelle de ces sources dans le contexte fédéral. 2 SUMMARY Federal Law - Private Law - Distribution ofPowers - Construction ofStatutes ­ Judicial Power - Uniformity oflaw - Bijuralism - Civil Law - Common Law. This study is devoted to federal private law and the interaction between federal legislation and provincial private law. In particular, it is devoted to the role ofthe courts in such interaction. Hs objective is to assess how judges proceed with the unification of federal private law by avoiding formaI reference to provinciallaw to supplement federal legislation. Firstly, the study considers the legal framework goveming the interpretation of federal private law, as well as the exercise ofjudicial power in this context. Secondly, the study reviews means employed by judges, through a series ofjudgments, to proceed with the unification offederal private law. The study concludes that unification can effectively be achieved through such means. However, these judicial interventions are limited to sorne aspects ofthe elaboration and application ofprivate norms. In more complex cases, the effect ofthese interventions may be to disregard normative gaps that make necessary to supplement federallegislation with sources ofprovinciallaw, or to deny the plurality ofthese sources in the federal context. Should it matter to Canadian travelers and Canadians in general whether any Canadian airline survives to provide domestic service? The unequivocal answer is: You bet it matters! The Study in Brief This Commentary focuses on recommendations set out by the Canada Transportation Act Review Panel on permitting foreign entry into the domestic airline market and on the competitive landscape in passenger aviation services in Canada. The paper concentrates on the scope for new entry into the Canadian market, the likelihood that new entrants might, in fact, occur if the Canadian market is opened to foreign airlines and investors and the potential market impact if that did happen. If the federal government succeeds in negotiating a more liberal agreement with the United States, the Commentary argues that there would be limited entry at best — there are a very small number of markets in Canada that provide entry opportunities — and the entry might end up displacing Canadian companies in terms of the routes they operate and the number of frequencies they provide on existing routes. Even limited entry would weaken the financial performance of Westjet Airlines Ltd., though it might actually benefit Air Canada because it could use modified existing rights to maximize the benefits of its Toronto hub within a North American market. While I fully support the recommendations of the Review Panel, I believe that the competitive consequences for the domestic Canadian market of a bilateral agreement with the United States are likely to be minimal.

The TSB has a mandate to advance safety in the marine, pipeline, rail, and aviation modes of transportation by: ! conducting independent investigations and, if necessary, public inquiries into transportation occurrences in order to make findings as to their causes and contributing factors; ! reporting publicly on its investigations and public inquiries and on the related findings; ! identifying safety deficiencies as evidenced by transportation occurrences; ! making recommendations designed to eliminate or reduce any such safety deficiencies; and ! conducting special studies and special investigations on transportation safety matters. It is not the function of the Board to assign fault or determine civil or criminal liability. INDEPENDENCE To encourage public confidence in transportation accident investigation, the investigating agency must be, and be seen to be, objective, independent and free from any conflicts of interest. The key feature of the TSB is its independence. It reports to Parliament through the President of the Queen`s Privy Council for Canada and is separate from other government agencies and departments. Its independence enables it to be fully objective in arriving at its conclusions and recommendations.
