8 Pedestrian Visibility Splays There shall be no access or egress by any vehicles between the highway and the application site (except for the purposes of constructing the initial site access) until visibility splays providing clear visibility of 2 metres x 2 metres measured down each side of the access and the back edge of the footway of the major road have been provided. The eye height will be 1.05 metre and the object height shall be 0.6 metres. Once created, these visibility areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

9 Provision of Approved Access, Turning and Parking Areas No part of the development shall be brought into use until the approved vehicle access, parking, manoeuvring and turning areas approved under condition number:

10 Precautions to Prevent Mud on the Highway There shall be no access or egress by any vehicles between the highway and the application site until the measures to prevent mud, grit and dirt on the public highway by vehicles travelling to and from the site approved under application 15/02518/DISCON have been implemented in full, unless otherwise approved in writing by the Local Planning Authority. These precautions shall be made available before any excavation or depositing of material in connection with the construction commences on the site and be kept available and in full working order and used until such time as the Local Planning Authority in consultation with the Highway Authority agrees in writing to their withdrawal.

11 Doors and Windows Opening over the Highways All doors and windows on elevations of the building(s) adjacent to the existing and/or proposed highway shall be constructed and installed such that from the level of the adjacent highway for a height of 2.4 metres they do not open over the public highway and above 2.4 metres no part of an open door or window shall come within 0.5 metres of the carriageway. Any future replacement doors and windows shall also comply with this requirement.

12 ON-Site Parking, On-Site Storage and Construction Traffic During Development Parking for all staff and sub-contractors vehicles and material storage required for the operation of the site shall be carried out in accordance with the details approved under application 15/02518/DISCON unless otherwise approved in writing by the Local Planning Authority.

The approved areas shall be kept available for their intended use at all times that construction works are in operation. No vehicles associated with on-site construction works shall be parked on the public highway or outside the application site.

13 The site shall be developed with separate systems of drainage for foul and surface water on and off site.

14 Development shall be carried out in accordance with the foul and surface water drainage details approved under application 15/02518/DISCON, unless otherwise approved in writing by the Local Planning Authority.

15 Unless otherwise approved in writing by the Local Planning Authority, there shall be no piped discharge of surface water from the development prior to the completion of the approved surface water drainage works and no buildings shall be occupied or brought into use prior to completion of the approved foul drainage works.

16 Noise The dwellings proposed are in close proximity to an existing builder's yard and therefore may be subject to some noise disturbance from the operations and traffic to and from the yard. The scheme shall be submitted to and approved in writing by the LPA. The approved scheme shall be fully implemented and completed prior to occupation of the site. A suitable scheme may be provided by ventilation that complies with the performance specification given in Part 6 of Schedule 1 of the Noise Insulation Regulations 1975.

2. Before use of the development is commenced, a Validation Test of the sound attenuation works shall have been carried out and the results submitted to and approved by the LPA. Such Validation Test shall - be carried out by a competent person in accordance with an approved method statement - demonstrate that the above noise levels have been achieved.

If these levels have not been achieved, irrespective of the sound attenuation work already approved, a further scheme will be required incorporating the recommendations of an acoustic consultant to achieve the specified noise levels. The scheme of works shall be submitted to and approved in writing by the LPA, installed before use of the development begins and thereafter retained. The approved scheme shall be fully implemented and completed prior to occupation of the site.

17 Refuse In accordance with the approved plans suitable and sufficient provision shall be made for

a. the storage and containment of refuse prior to collection. b. access for collection of refuse

Thereafter this shall be maintained and retained for its intended purpose at all times.

All works shall accord with the approved details unless otherwise agreed in writing by the Local Planning Authority.

HI-03 INFORMATIVE - Condition HC-07 You are advised that a separate licence will be required from the Highway Authority in order to allow any works in the adopted highway to be carried out. The 'Specification for Housing and Industrial Estate Roads and Private Street Works' published by North Yorkshire County Council, the Highway Authority, is available at the County Council's offices. The local office of the Highway Authority will also be pleased to provide the detailed constructional specification referred to in this condition.
