6 The developer shall (a) give not less than 10 working days notice in writing of the commencement of works to a professional archaeologist to be nominated by the developer and agreed with the Planning Authority and no works shall commence on site until the 10 working day notice period has expired, and (b) afford safe access within the site to the nominated archaeologist at all reasonable times and allow the archaeologist to observe any excavations and record finds and features of archaeological interest.

7 Before any materials are brought onto the site or any development is commenced, the developer shall erect chestnut paling or similar fencing in accordance with details previously submitted to and approved in writing by the Local Planning Authority, around the trees and shrubs to be retained as indicated on the approved plan. The developers shall maintain such fences to the satisfaction of the Local Planning Authority until all development, the subject of this permission, is completed. The level of land within the fenced area shall not be altered without the prior written consent of the Local Planning Authority.

8 Notwithstanding the provisions of The Town and Country Planning General Permitted Development Order 1995 (or any order revoking and re-enacting that Order with or without modification), no further windows shall be inserted in the approved elevations of the development hereby approved, without the prior written approval of the Local Planning Authority.

9 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no extensions, windows other than any expressly authorised by this permission shall be erected without the grant of further specific planning permission from the local planning authority.

10 Prior to the commencement of any other part of the development hereby permitted, the access(es) to the site shall be laid out and constructed in accordance with the following requirements:-

(i) any gates, barriers or other means of enclosure shall be erected a minimum distance of 6 metres back from the carriageway of the existing highway and shall open into the site;

(ii) provision shall be made to prevent surface water from the site/plot discharging onto the existing highway NOTE: You are advised that a separate licence will be required from the Local Highway Authority in order to allow any works in the adopted highway to be carried out. The local office of the Local Highway Authority will also be pleased to provide the detailed constructional specification referred to in this condition.

11 Prior to the first use of the development the vehicular access, parking and turning facilities shall be formed in accordance with the submitted drawing [Reference 2889- 05]. Once created these areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

12 Details of the precautions to be taken to prevent the deposit of mud on public highways by vehicles travelling from the site shall be submitted to and approved in writing by the Local Planning Authority. These facilities shall include the provision of wheel washing facilities where considered necessary by the Local Planning Authority. These precautions shall be made available before the development commences on the site and be kept available and in full working order until such time as the Local Planning Authority agrees in writing to their withdrawal.

13 Prior to the commencement of the development there shall be submitted to and approved by the Planning Authority after consultation with the Highway Authority proposals for the provision of an on-site parking area and on-site material storage area capable of accommodating clear of the public highway all staff and sub- contractor's vehicles and all materials required for the operation of the site. The approved compounds shall be available for use at all times building works are in operation.

14 No development approved by this permission shall be commenced until:-

a) A desk top study has been carried out which shall include the identification of previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. And using this information a diagrammatical representation (Conceptual Model) for the site of all

c) A site investigation has been designed for the site using the information obtained from the desk top study and any diagrammatical representations (Conceptual Model). This should be submitted to, and approved in writing by the Local Planning Authority prior to that investigation being carried out on the site. The investigation must be comprehensive enough to enable:

- a risk assessment to be undertaken relating to ground and surface waters associated on and off the site that may be affected, and - refinement of the Conceptual Model, and - the development of a Method Statement detailing the remediation requirements.

d) The site investigation has been undertaken in accordance with details

6 approved by the Local Planning Authority and a risk assessment has been undertaken.

e) A method statement detailing the remediation requirements, including measures to minimise the impact on ground and surface waters, using the information obtained from the Site Investigation has been submitted to the Local Planning Authority. This should be approved in writing by the Local Planning Authority prior to that remediation being carried out on the site.

f) The measures approved in the scheme have been implemented. Thereafter a verification report shall be submitted upon completion of any works.

15 The development hereby permitted shall not be begin until a scheme has been submitted and approved in writing by the Local Planning Authority for the provision of off-site public open space and/or village halls, in accordance with Local Plan Policy IMP2. The provision of off-site public open space/village hall facilities shall be provided in accordance with the approved scheme.

16 Prior to the start of the development, a verification report demonstrating completion of the works set out in the approved remediation strategy and the effectiveness of the remediation shall be submitted to and approved, in writing, by the local planning authority. The report shall include results of sampling and monitoring carried out in accordance with the approved verification plan to demonstrate that the site remediation criteria have been met. It shall also include any plan (a 'long-term monitoring and maintenance plan') for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action, as identified in the verification plan, and for the reporting of this to the local planning authority.

17 Reports on monitoring, maintenance and any contingency action carried out in accordance with a long-term monitoring and maintenance plan shall be submitted to the local planning authority as set out in that plan. On completion of the monitoring programme a final report demonstrating that all long- term site remediation criteria have been met and documenting the decision to cease monitoring shall be submitted to and approved in writing by the local planning authority.

18 If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, an

7 amendment to the remediation strategy detailing how this unsuspected contamination shall be dealt with.

JUSTIFICATION FOR GRANTING CONSENT

The broad principle of residential development is acceptable on this plot and has been established through the earlier approved scheme under 6.64.415.D.FUL. The development is considered to be in accordance with Harrogate District Local Plan Policy

9 H6 and would not harm the character of the conservation area or adjacent amenity open space and there are no material considerations to set aside the provisions of the development plan.
