ABSTRACT Title of Document: ROBOTICS AND THE FUTURE OF INTERNATIONAL ASYMMETRIC WARFARE Nicholas Grossman, Doctor of Philosophy, 2013 Directed By: Professor George Quester, Department of Government and Politics In the post-Cold War world, the world's most powerful states have cooperated or avoided conflict with each other, easily defeated smaller state governments, engaged in protracted conflicts against insurgencies and resistance networks, and lost civilians to terrorist attacks. This dissertation explores various explanations for this pattern, proposing that some non-state networks adapt to major international transitions more quickly than bureaucratic states. Networks have taken advantage of the information technology revolution to enhance their capabilities, but states have begun to adjust, producing robotic systems with the potential to grant them an advantage in asymmetric warfare. Overall, this knowledge is not easy to understand. Therefore, they need an introduction to this knowledge that is very important because it can direct understanding towards Fiqh true. In addition, as a scientific discipline, Fiqh will continue and must develop. Even so, the changes in history show dynamics. Sometimes it changes very rapidly. Sometimes it also looks slow. In fact, it is not uncommon to seem static. In fact, the demand for its development is a logical consequence of the burden and demands of changing society and Muslims themselves. In this paper, we will discuss something related to the social life of society, that is habit or in the language of Fiqh "Urf". Keyword : Epistimology, Urf, Usulul Fiqh INTRODUCTION One branch of science in Islamic intellectual property is usul fiqh. As a science that discusses the foundations underlying the birth of fiqh law, the urgency of ushul fiqh is increasing, especially as a handle in answering various legal issues nowadays. Jurul fiqh is more a certain rules that are used as a handle or rules for the birth process of a law. Because of this kind of working area, it applies globally to both legal and other issues. As we know, giving birth to an answer to a legal problem is not easy, especially if the law is related to fiqh issues. -

PEMIKIRAN WAHBAH AL-ZUHAILY TENTANG AHKAM AL-USRAH Faridatus Syuhadak dan Badrun Fakultas Syariah UIN Maulana Malik Ibrahim Malang Email: [email protected] Abstrak This research is a normative judicial, with historical-analytic approach. Method of collecting data uses literature study, while the analysis of the data uses content analysis. The results showed that in applying ijtihad, Wahbah al-Zuhaily first review the texts contained in the Qur’an by using an approach related disciplines such as linguistics who heed the words mujmal, musytarak, ‘amm or Khass, haqiqah or majaz, haqiqah or ‘urf, muthlaq or muqayyad etc, then the Prophet hadith; qauliyah, amaliyah, and taqririyah. After that he used qiyas and maslahah consideration for the realities faced by using the general rules as istihsan, maslahah mursalah, urf, sadd adh-Dzari’ah and others. Wahbah al-Zuhaily begins discussion of family law with a preliminary discussion of marriage; shari’ah law marriage, marriage sermon, proposed marriage proposal of others, and see the woman who had been groom before marriage. Wahbah al-Zuhaily also explained that the marriage law is not always the Sunnah, but can change mandatory, permissible, forbidden even makruh, depending on the context. Penelitian ini merupakan penelitian yuridis normative, dengan pendekatan historis- analitis. Metode pengumpulan data menggunakan studi kepustakaan, sedangkan analisis data menggunakan content analysis (analisis isi). Hasil penelitian menunjukkan bahwa dalam melakukan ijtihad, Wahbah Al-Zuhaily terlebih dahulu melakukan kajian terhadap nash-nash yang terdapat dalam al-qur’an dengan menggunakan pendekatan disiplin ilmu yang terkait seperti ilmu bahasa yang memperhatikan kata-kata mujmal, musytarak, ‘amm atau khashsh, haqiqah atau majaz, haqiqah atau ’urf, muthlaq atau muqayyad dll, kemudian hadits Rasul baik yang Qauliyah, amaliyah, maupun taqririyah. -

Mehedi Ibne Rahim Barrister- at-Law of the Inner Temple Senior Partner at Kawa, Guimaraes & Associates Solicitors Bangor University, Wales, UK Email: [email protected] ABSTRACT This presentation considers Islamic laws on traditional insurance, which generally is considered unacceptable due to its nature. An alternative called takaful has been created but so far it is yet to meet its full potential. A comparison with well-known market such as English marine insurance considers the closeness that takaful share with traditional market. However, there is a tsunami raging on insurance validity in Islam. There is a significant gap in both practice and literatures’ regarding takaful as it is uprising concept so it has become important to consider its credibility for advancement to avoid interrupting the ethos of takaful and developed markets as English marine insurance. This presentation considers the core ideology of takaful with consideration of background leading to the introduction of takaful. However, it also looks into the various grounds shared between traditional insurance and takaful. However, more importantly, this paper aims to consider the various Islamic scholarly views on the validity of insurance under Islam. Takaful is seen as a lost ugly duckling in the present Islamic law, as would be witnessed from this paper. Whilst some scholars strongly support its execution, others strongly discourage even its existence. This led to the thinking, as this paper aims to handle, whether insurance is ever been viewed halal under Islam, in present era. -

Even though Kuwait does not permit the formation of political parties, and women received the right to vote and to stand in elections only in 2005, the country has a long-standing history of pluralistic and genuine elections. Generally, there is confidence in the work of the electoral administration. However, the equality of the vote is not respected because the size of the electorate in the five electoral districts, each of which is represented by 10 MPs, varies significantly. After the May 2008 elections, the election authorities experienced significant difficulties with the counting and aggregation of the votes, resulting in controversy and court appeals. Certainly, there is scope to introduce measures to enhance transparency, improve the counting and aggregation of votes (e.g. by requiring a prompt and detailed publication of election results at all levels) and reforming procedures for adjudicating election related complaints and appeals. Currently, the elections are managed jointly by the Ministry of the Interior, the Ministry of Justice and the judiciary. Representatives of the candidates also have a role in administering the election during polling. -
