MODE OF RECRUITMENT AND APPOINTMENT 1. RECRUITMENT RULES (For detailed study refer to Hand Book 'on Recruitment Rules, 1984 and its supplement, 19E5 published by Establishment Division of DOP&T).

1. Authority : 1.1 Subject to the provisions of the Constitution of India, Parliament may by law, regulate the recruitment, and conditions of service of persons appointed to public service and posts in connection with the affairs of the Union, but the President, or such person as he may direct in the case of services and posts in connection with the affairs of the Union, may make rules regu- lating the recruitment,, and the conditions of service of persons appointed to such services or posts, until provision in that behalf is made by or under an Act of Parliament, and any rules so made shall have effect subject to the provisions of any such Act. (Article 309, Constitution of India). 1.2 At present the three All India Services which arc common to the Union and the States and which have been duly constituted are the Indian Administrative Service, the Indian Police Service and the Indian Forest Service. 'Section 2A of the All India Serv. ices Act, 1951, however, alsO provides for the constitution of the following .Scrvim's as All India Services with effect from the dates to be notified by the Central Government : 1. The Indian Service of Engineers (Irrigation; Power; Building and Roads); 2. The Indian Medical and Health Service. Sub-section (1) of Section 3 of the said Act empowers the Central Government to frame rules in consultation with the State Governments, for the regulation of recruitment and the condi- tions of service of persons appointed to an All India Service. All rules so framed are required to be laid for not less than 14 days before Parliament and shall be subject to such modifications whether by way of .repeal or amendment, as Parliament may make on a motion made during the Session in which they are so laid. Detailed rules and regulations in this regard have accord-. ingly been made in respect of the three Services which have already been constituted. (Article 312, Constitution of India). 1.3 In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President has empowered Lt. Governors of Delhi and Pondicherry, to make rules, in regard to the following matters :— (i) 'the method of recruitment to the Central Civil Services and posts under their admi- nistrative control in connection with the affairs of the Union Territory concerned; (ii) the qualifications necessary for appointment to such services and posts; and (iii) the conditions of service of persons appointed to such services and posts for the purpose of probation, confirmation, seniority and promotion. NOTE-(1) Any rule made under the aforesaid direction, in so far as it relates to Central Civil Service or post, Groups A or B, shall be subject to previous consultation with the Union Public Service Commission; (2) In the case of a post, appointment to which requires the prior approval of the Central Government, prior approval of the -Central Government shall be obtained also in respect of the- Recruitment Rules for such post; 22 '2 13

(3) The above powers shall not be exercisable in respect of. services / posts borne on a cadre common to two or more Union Territories. • [MI-IA Notifications No. 27/59-Him,(i), dated 13-7-59; No. 24/78/68-DH(S), dated 24-9-68 and dated 18-8-703 1.4 The President has also empowered the Chief Commissioner, Andaman and Nicobar Islands and the Administrator, 'Lakshadweep' to make rules regarding methods of recruitment to Central Civil Services and posts, C and Group D, under their administrative control. [N1HA Notification No. 141/3/60-ANL, dated 11-4-60 and 2/7/63-LMA, dated 4-2-63]. 2. Procedure for framing recruitment rules : The procedure for framing recruitment rules for posts/services is as follows .:— (i) As soon as a decision is taken to create a new post/service, or to upgrade any post, or re-structure any service, action should be taken immediately by the Administrative Ministry/ Department concerned to frame recruitment rules therefor concerning all Groups A & B posts/ services and Groups C and D posts. Heads of Department of Attached/Subordinnte offices who are competent to create posts etc. under their own powers should endorse a copy of the relevant sanctions to the Administrative Minislry/Department concerned, indicating therein whether the posts are already covered by the existing rules or fresh recruitment rules need to be framed An officer not lower in rank than that of an Under Secretary/Desk Officer should inirim -P action for the framing of recruitment rules for the new posts/services. (RR), dt. 18-8-84] (ii) The Administrative Ministry/Department should send to the Department of Personnel and Training within a period of one month from the date of creation of the service/posts, a self- contained proposal concerning all Groups 'A' and 'B' posts/services, together with-- (a) the draft recruitment rules (for posts other than those in the established services) in the prescribed proforma (Annexure-I). (b)• the supporting particulars in the proforma in Annexure-II (DOP&AR OM No. 14017/24/76-Estt( RR) , dt. 22-5-79 and AB-14017/15 /84-Estt(RR) , dt. 18-8-1984). In respect of Groups C 4. I) posts concerned Administrative Ministries/Departments have been delegated powers to frame recruitment rules. [CD-14017/10/85-Estt.(RR), dt. 21-3-85 & 5-6-85] (iii) Ordinarily, the draft recruitment rules will be return by the Department of Personnel & Training with their comments, within a month from the date of reference to that Department or, if special circumstances of a case require more time for security/discussions, the Administra- tive Ministry/Department will be requested to discuss the case. Otherwise, after a period of one month, that Ministry/Department can presume concurrence of the Department of Personnel and Training and proceed further. (iv) While framing the draft rules the Career Management Officer in Administrative Ministry/Department should be consulted who should consult the Department of Personnel and Training informally, wherever necessary, before sending the advice to the Administration Section in the Ministry/Department in regard to the draft recruitment rules. (v) Model recruitment rules for several categories of posts framed, in consultation with UPSC, have been circulated. The recruitment rules for such posts may be processed on the lines of the model recruitment rules. [DOP&AR OM No. 14017/24/76-Estt.(RR) dt. 22-5-79 and AB-14017/15 '84-Estt(RR), dt. 18-8-84] 24

(vi) Where it is proposed to allow the benefit of service for pension admissible under Rule 30 of the CCS (Pension) Rules, 1972, clearance of the Dept. of Pension in the Min. of Pers., P.G. Pension may be obtained before sending the draft recruitment rules to Department of Personnel and Training (RR Section). [DOP&AR OM No. 14017/24/76-Estt(RR), dt. 22-5-1979 and AB-14017/15/84-Este (RR), dt. 18-8-S4-]. (vii) .After consulting the Department of Personnel & Training, the Administrative Ministry/ Department will refer•the draft Rules immediately to thell.P.S.C. along with complete informa- tion in Annexure-II and indicating the fact that the draft recruitment rules have been concurred in by the Department of Personnel and Training. Before such a reference is .made, the matter should be personally discussed by an officer not below the rank of Deputy Secretary, with the Secretary of the Commissoin or his nominee. (viii) If the Commission's advice is not received within four or five weeks, the matter should be settled by personal discussion with the officer concerned in the Commission. (ix) In case the provisions of the final draft as approved by the Commission are at variance with the draft rules, as concurred in by the Department of Personnel and. Training, the changes should be brought to the notice of that Department. (x) The procedure as indicated above will apply also to amendments proposed to be made to existing recruitment rules. Such proposals should however be sent along with the information in proforma given in annexure-III (and not Annexure II). (xi) Recruitment rules or .amendment(s) thereto 'as approved by the UPSC, should be notified within four weeks from the date of Commission's letter of approval. 3. 'Salient points regarding framing of recruitment rules :

3.1 Short title to rules : —It is absolutely necessary to give short tides to general statutory rules and statutory rules and orders framed by the Ministries/ Departments, for referencing and tracing of rules. All amendments to such rules /orders should also bear short titles and be given serial numbers in the short titles. [Lok Sabha Sectt. OM No. 58/CI1/68-X, dated 25-10-68 Department of Parliamentary Affairs OM No. SR.I1(20-21)LS/68-CB, dt. 7-3-69, and No. 32(2)LS.IV (25-28) /70- R&C, dt. 13-4-70.]

3.2 Commencement of rules : —All rules should be published before the date of their enforcement or they should be enforced from the date of their publication. If owing to any unavoidable circumstances, it is necessary to give retrospective effect to any particular rule, a memorandum explaining the reasons which necessitated the retrospective operation of the rule, should be published separately along with the notification whereby the rule is made, but such explanatory memorandum should not form a part of the rule. The explanatory memorandum should further recite that the interests of no one would be prejudicially affected by .reason of the retrospective operation of the rule. 3.3 Plural marriages : —The recruitment rules should incorporate a standard rule in the following form to provide for prohibition against bigamous marriages in the case of Govern- ment servants :- "No person :- (a) who has entered into or contracted a marriage with a person having a spouse living, or 26

(b) who, having a spouse living. has entered into or contracted a marriage with any person shall be eligible for appointment to service : Provided that the Central Government may, if satisfied that such marriage is permissible under the Personal Law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of the rule". [MHA OM No. 25/37/69-Estts.(A), dated 22-4-1970] 3.4 Savings Clause :—The recruitment rules in respect of all services/posts within the purview of the reservation orders should contain a separate rule on the following lines :- "Saving--Nothing in these rules shall affect reservations and other concessions required to be provided for Scheduled Castes and Scheduled Tribes ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard." Such a rule will ordinarily have to be inserted at the end of the rules, unless the draftsman considers any other place to be more appropriate in the context of a particular set of rules. If any provision exists in any recruitment rules regarding reservations/concessions whether generally or in regard to age, in the case of persons belonging to Scheduled Castes/Scheduled Tribes etc. in accordance with the orders issued by the Ministry of Home Affairs (now Depart- ment of Personnel and Trg.) the reference to "the Ministry of Home Affairs" may be replaced by .a reference to "the Central Government". [Department of Personnel OM No. 8-12-71-Estts.(SCT), dated 21-9-1971.1 3.5 Classification of Services/Posts :—Recruitment Rules should indicate classification of Services/posts concerned. In this connection, Chapter II may be referred to.

3.6 Reclassification of posts :—The' UPSC shuld be consulted on all propsals for uppad- ing .a Group 'C' post or downgrading a post, to which recruitment has already been made without consulting them. [MHA OM No. 18 /45/51-Estts., dated 29-9-1951.1

3.7 Manner of recruitment to a particular grade or group of posts :—The manner in which recruitment to a particular grade or group of posts should be made, has neces- sarily to be determined with reference to the qualifications, experience and previous training required for efficiently manning the post. It is also necessary to ensure that persons employed in the lower grades of the service or lower posts have adequate opportunities of pro- motion so that incentive to good work is maintained. Another point to be considered in this context is the availability in the open market of persons who can be appointed to the particular grade or post. The need for providing a certain amount of direct recruitment which would facilitate the introduction of fresh blood and incidentally provide an opportunity for Scheduled Castes and Scheduled Tribes employees to be appointed against a reserved quota, will have to be balanced against the other considerations mentioned above; and the controlling authorities of the various services and posts will, on a balance of these considerations, have to determine whether, and if so to what extent, direct recruitment can be introduced in grades or posts to which there is at present no direct recruitment. 3.8 Eligibility for promotion is necessary to fix suitable standards for promotion from one grade to another, including minimum length of service in the lower grade. As far as possible, the minimum length of service in the lower grade prescribed as a condition for promotion to the higher grade should not markedly be different from that prescribed by other Departments for promotion to similar grades involving the same nature of duties and responsibilities. f MHA 1M No. 1 '15/58-RPS. dated 26-2-19581. /6

3.9 Relaxation Clau.se :—(i) The: elaxation Clause of She .Recruitment Rtiles may be as follows :— "Power to Relax :—Where _the 'Central Government is opinion that it is necessary or expedientso to do, it may, by order for reasons to be recorded in writing, and in consultation with the Union Public Service Commission for & B posts only relax any of the provision of these rules with respect to any class or category of persons." (ii) A question was raised whether the rule mihich was 'promulgated in 1954 permits relaxa- tion of rules relating to recruitment, 'promotion, retirement or re-employment etc. for conferring •benefits on a particular individual to the exclusion of all other similarly placed persons; and if so, vliether the rule can be considered to be constitutionally in -order. In consultation with the Ministry of Law sit was held that the rule is constitutionally in order. It permits relaxation of those rules only which regulate conditions of service e:g. travelling allowance rules, leave rules, etc. Consequently, it :cannot be utilised to relax for conferring bents on an individual, the require- ments of the tales, which cannot be covered by the expression "Conditions of service", e.g. the rules relating to recruitment. promotion, grant of extension of service or re-employment. If necessary, such rules should be amended so as to remove hardship from, and confer benefits generally on, all similarly placed individuals; they should not be relaxed to confer benefits ‘otnn individual to the exclusion of other similarly placed persons. [MHA OM No. 70/2/61-E,stts(A), dated 26-6-1961] (iii) Whenever the Administrative Ministry/Department finds the ne=ssity to suggest relaxa- tion of any provisions of the recruitment rules, they Should after obining the approval of the Secretary in the case of Group 'A' posts 4. Rangachari (1961 Supreme Court journal 424) 'Supreme Court has pointed out that the equality of opportunity guaranteed by Article 16(1) of the Constitu- tion extends to all matters relating to employment and "the matters relating to employment" cover matters not only relating to initial employment or recruitment, but also salary and periodical incre- ments, terms as to leave, as to gratuity, as to pension and as to age of superannuation. Any other interpretation of this guarantee would make the Fundamental Right illusory and defeat the very aim and object by introducing discriminatory provisions in respect of employees. In fact Article 16 really gives effect to equality before law guaranteed by Article 14 and prohibition of discrimi- nation g,uaranteed by Article 15. As observed by Jusitce Gajendragadhkar :- 44 The three provisions form part of the same constitutional code of guarantees and supplement each other. If that he so, there would be no difficulty in holding that the matters relating to employment must include all matters in relations to employment both prior, and subsequent, to the employment which are incidental to the employment and form part of the terms and conditions of such employment." Having regard to this basic principles of equality of opportunity. any power to relax these rules in respect of any of these matters would amount to introducing discrimination by back door. But this does not mean that the State cannot prescribe different rules and conditions of service to different categories based on some reasonable classification germane to the nature of Service or to the Class of employees. "Equality" means equal treatment in similar circumstances. As laid down by Supreme Court in the State of Bombay Vs. F. N. Falsara (1951 Supreme Court Reporter 682) and many other cases, the principle of equality does not mean that every law must have universal application for all perSons who are not by nature, attainment or circumstances in the same position, and the varying needs of different classes of persons often require separate treat- ment The State or the Legislature which has to deal with diverse problems arising out of an infinite variety of human relations must of necessity have the power of making special laws to attain particular objects and for that purpose it must have large power of selection or classifica- tion of persons and things upon which such laws are to operate. 2 7

It is, therefore, recognised as legitimate for ,Government to reserve power of relaxation of exception in prescribed cases. Numerous laws provide for such powers to pant exceptions or make relaxation and these powers are upheld by the Court. The only principle is that such power should not be arbitrary but based on some principles and the law or the rule must provide guidance or prescribe some standards. it was on this basis that the rule permitting relaxation from conditions of service, referred to above, is justified and there is no reason, on principle, why any rule permitting relaxation in respect of other matters of employment like recruitment, promotion, etc. should nc be permitted. [Deptt. of Legal Affairs UO No. 3380/62-Adv. (B), dt. 10-8-621. (iv) It is for the authority competent to relax, to consider the facts anc. circumstances of each case and come to the conclusion whether under the circumstance:, the relaxation should be granted. The clause regarding relaxation reading. "qualifications relaxable at Commission's discretion in case of candidates otherwise well qualified" has been held to be valid. The Attorney General considered this and observed :- "On the face of the wording of the power so given to the Commission_ I am of opinion that it does not violate articles 16 and 14. But the discretion so liven to the Commission must be exercised bonafide and must satisfy an objective test which. on the face of it, would satisfy not only the Commission but any reasonable man in place of the Commission". So, it appears that the three guidelines suggested are :- (a) the discretion must be exercised bonafide; (b) such an exercise should satisfy an objective test; and (c) it would satisfy any responsible man in place of the authority competent to relax. In addition to the three points noted above, the power should be vested in a higher authority. [Ministry of Law UO No. 3263/69-Adv.(B), dated .6-8-69 and UO No. 16071/70 /Adv. (B) , dated 20-4-70.j 3.10 As stated in Para 2(H) above. The draft Recruitment Rules should be drawn as given in Annexure-I which consists of the following 14 Columns : Coluinn 1 : Name of Post. Column 2 : No. of Posts. Column 3 : Classification -of the Post/Service. Column 4 : Scale of Pay. Column 5 : Whether selection post or non-selection post. Column 6 : Whether the benefit of added years of service is admissible under rule 30 of the CCS (Pension) Rules, 1972. Column 7 : Age for direct recruits. Column 8 : Educational and other qualifications required for direct recruits. Column 9 : Whether age and educational qualifications prescribed for direct recruits will apply in the case of promotion. Column 10 : Period of probation, if any. Column 11 : Method of recruitment, whether by direct recruitment or by promotion or by deputa- tion/transfer and percentage of the vacancies to be filled by various methods. Column 12 : Grade from which recruitment by promotion/deputation/transfer /short term contract/re-employment is to be made. Column 13 7 If a DPC exists, what is its composition. Column 14 : Circumstances in which UPSC is to be consulted in makinE recruitment. 5-35Per & Trg/87 The coveringuothication 01 the draft recruitment rules should include the following. ''.fi!) Short title and commencement. (ii) The date from which the recruitment rules would come into force. (iii) Application. (iv) -Number of posts, classification and scale of pay. (v) Method of recruitment, age limit and other qualifications. (vi) Disqualifications (regarding plural -marriages).

.3.12 The recruitment rules or amendment(s) thereto as finally approved by the UPSC are required to he notified within .a period of ,4 weeks from the date of receipt of their advice. This time limit slimild be strictly adhered to.

3.13 Quarterly returns in respect of the recruitment rules for posts/services should "be sent to DOP&T and UPSC (for Group -A' and 'B' Posts) to enable them to keep .a watch on the progress made in these rules. 3.14 The recruimient rules should be approved at the level of the Minister-in-Charge unless the Minister has throuch general or 'special instructions, authorised such approval at a lower level at an appropriate slam and in any case before the rules are notified. 3.15 New Services -.—When an organised service is to be constituted, rules for the constitu- tion of a Service should not be framed in the proforma given in Annexure I, but separate rules should be drafted and processed by the administrative Ministry /Department concerned in the manner indicated in sub-para 2(i) above. The rules for the service should make provision inter-alia for the following : .e" (1) Short title and commencement. (2) Definitions Of the various expressions used in the rules. (3) Scope of the service. (4) Grades and authorised strength with classifications of grades included in the service. (:5) Controlling authority. (6) Initial constitution of the service. (7) Future maintenance of the service. (8) Probation and Seniority. (9) Powers of controlling authority. (1.0) Deputation. (11) Disqualification. (12) Liability for service in any part of. India. (13) Other conditions of service. (14) _Power to relax clause and Saving Clause. (15) Interpretation. 29

3.16 When a Ministry or Department indicates in the recruitment rules pertaining to any post /service, as a source of "deputation", a Service which is under the control of another Ministry or Deparnnent, the latter should be consulted before the draft rules are referred to the Union Public Service Commission. If the controlling Ministry or Department concerned with the Service concur in the proposal, this would, in effect, amount to an understanding being reached with them that a suitable person would ordinarily be made available- on deputation by them for the post/ service in question. Copies of the recruitment rules for the post/service in question, after they halve been notified, may also be endorsed to such controlling Ministry/Department for information. This would enable the controlling authority to have an idea of demands that. are likely to be made in the Service under its control for purposes of deputation.

For deputation from among the State Services, however, which concern all States, this proce- dure of prier consultation with the State Governments would, for obvious reasons, be unnecessary. [M HA OM No. 2125/60-Estt.(D), dated 19-13-60]

4. Concurrence of the Ministry of Finance to the alterations in the Service Rules.—As the pay scales to by the Ministry of Finance are on the basis of the qualifications and other require- ments laid down for the respective posts. any alterations in the Service Rules applicable to any cadre. which will have the effect of lowering the qualifications below those laid down when the Service Scheme was sanctioned and the pay scales were agreed to by the Ministry of Finance, should receive the prior concurrence of that Ministry. R--ial-rttion of standards in the case of Scheduled Castes and Scheduled Tribes :- (i In posts/services filled by direct recruitment (whether by examination or otherwise), if sufficien: numbers of Scheduled Castes/Scheduled Tribes candidates are not available on the basis of general standard to fill all the vacancies reserved for them, candidates belonging to these com- munities may be selected to fill up the remaining vacancies reserved for them provided they are not found unfit for appointment to such posts/services. (ii) The provisions in the recruitment rules/regulations for examinations for relaxation of standards in favour of SCs/STs candidates may be made as follows :— "Candidates belonging to any of the Scheduled Castes or the Scheduled Tribes may, to the extent the number of vacancies reserved for the Scheduled Castes and the Scheduled Tribes cannot be filled on the basis of the general standard, be recommended by the Commission by a relaxed standard to make up -the deficiency in the reserved quota, subject to the fitness of these candidates for selection to the post/service, irrespective of their ranks in the order of the merit at the examination." II. APPOINTING AUTHORITIES

. All India Services Appointments of persons to any of the Services included in the All India Services through recruitment on the basis of competitive examinations, or through promotions/selections of members of State Services to the corresponding All India Service shall be made by the Central Government. Appointment of officers directly recruited to an All India Service to posts in the senior time-scale of pay of that Service shall be made by the State Government concerned. [Rules 6 and 6A of the. 2. Central •Civil Serzyides yand Post. 2.1 All appointments to Central Civil Services. Group 'A' and Central Civil Posts, Group 'A' shall be made by the President, except where the President may, by .a ,general or special order, and subject to such conditions as he may specify in such order, delegate to any other authority the .power to make such appointments. [Rule 8 CCS (C.C.&A.) Rules, 1965]. 2.2 The President has delegated powers to the Lieutenant Governors of Delhi. Manipur. Tripura, Goa, Daman and Diu, and the Administrator of Dadra and Nagar Haveli to - make all appbintments to Central Civil Services and Posts Group A under the Delhi. Manipur. Tripura, Goa, Daman and Diu and the Dadra and Nagar Haveli Administrations respectively. But no appointment to the post of Chief Secretary or Finance Secretary or Inspector General of Police or Development ComMissioner or any other post which carries an ultimate IZninry Cif rupees two thousand per mensem or more shall be made except with the previous approval of the Central Government. [MHA Order No. 25/35/55-Estts.(A), dated 134-59 as amended by .No. F. 7/26/63- Estts.(A) dt...5-:8-63; No. 7/1/65-Estts.(A) .dt. 10.2.65.; No. 7/6/69-Esns..-(A) dt. 12-6-69]. 2.3 All appointments to Central Civil Services Group A and Central Civil Post:, Group A under the Arunachal Pradesh & Mizoram Administration shall respectively made by the Administrators of Union Territories of Arunachal Pradesh and Mizoram appointed under Article 239 of the Constitution. III. FILLING OF POSTS

1. Selection and appointment of officers to Secretariat posts of and above the rank of Under Secretaries to the Government of India and certain important non-secretariat posts : The Government have prescribed the following instructions on this sul3ject : 1.1 The Establishment Officer to the Government of India shall act as the Secretary and his office will provide the Secretariat, to the Appointments Committee which has been re- constituted under Cabinet Secretariat (Department of Cabinet Affairs) Memorandum No. 11 1V3/CF-70, dated the 4th August. 1970, with the following functions : (i) To consider all recommendations and take decisions .in respect of appointments specified in the Annexure to the First Schedule to the Government of India (Transaction of. The Committee shall also consider and decide cases of premature retirement arising under the- Civil Services Fifth Amendment) Regulations, 1969. as fall within its purview.

(a) The Board shall consist of five members including the Chairman and the Member Secretary. This would include posts in the public sector undertakings, but would not include cadre posts to which appointments are to be made only from among officers of the concerned cadre; and

B. THL CENTRAL ESTABLISHMENT BOARD Constitution (a) The Board shall consist of five Members including the Chairman and the Member-. (3) No Ministry or Department or autonomous body financed by the Central Government shall obtain or try to obtain the services -of an All-India Services officer by direct correspondence with any State Government. 1.4 Procedural Instructions (1) (a) All vacancies, actual or impending in posts lying within the purview of the respective Boards shall be reported forthwith to the Establishment Officer to the Government or India with full details as to the nature and duration of the vacancy, a detailed description of the specific duties and responsibilities of the post and the .qualifications required, and special qualifications. experience. etc. if any. needed in the incumbent 35

It will be open to Ministries and Departments to indicate at the same time the names of any particular officer or officers whose claims and suitability they wish the respective Boards or the Appointments Committee to consider. ('b) The Establishment Officer, acting on behalf of the Boards, shall in all cases consider the claims, merits and availability of all officers within the field of choice and recom- mended a panel of three names for each vacancy, keeping in view educational quali- fications, service, experience and special training required for effective performance of the job. Provided that where a sufficient number of officers possessing the qualifications and experience necessary for a particular post is not actually available, the Establish- ment Officer may red_uce the. number of officers so included in the.panel to two or one. (c) In considering the names suggested, every effort should be made by the Ministries to confine the final selection for a vacancy from among the names on the panel, and if in any particular case, the names on the panel are not acceptable, the Ministry concerned will inform the Establishment Officer of the detailed reasons as to why each officer suggested is not considered suitable. (d) The Establishment Officer, may then suggest another panel of names to the Ministry/ Department for making a selection. If the Ministry /Department fail to make a selection out of the two panels, the Establishment Officer shall report the matter to the Board concerned for further instructions. (e) The Establishment Officer will present all relevant material together with his own recommendations, if any, for the consideration of the respective Boards and/or the Appointments Committee, as the case may be. (f) In all cases which do not require the orders of the Appointments Committee, final selection shall he made by the Minister concerned on the 'basis of the recommenda- tions of the respective Board. All other cases shall be submitted by the Establish- ment Officer for the final orders of the Appointment Committee.

-42) The Senior Selection Board or the Central Establishment Board shall not be concerned with recommendations for appointment to posts at the level of Additional Secretary. Special Sec- retary and Secretary to the Government of India.

(3) In respect of cases referred to at (2) above, the Cabinet Secretary shall, after consider- ing the claims of various officers whether serving in the Government of India or in the States, submit his recommendations directly to the Appointments Committee for orders. In the dis- charge of his special responsibility for management tasks concerning senior management. the Cabinet Secretary shall be assisted by the Secretary. Department of Personnel. [(MHA OM No. 34/1 /59-Ests (A) , dt. 154-59; DP&AR No. 4-71 /5Q -Ests (A) , dt. 15-4-59.] (2) In the case of industrial workers employed in the Central Government undertakings, the probationary period would be as follows :- (a) in case of the industrial workers who are subject to the Industrial Employment (Standing Orders) Act, 1946, this period will be as prescribed, under the Rules or certified standing orders; and (b) in case of those who are not subject to the Industrial Employinent (Standing Orders) Act, this period will be six months. (Min. of Labour & Employment OM No. 4/4/59-LRIV, dt. 3-11-62).. (3) In the case of direct recruits to a post/service :— (i) Probationary period save as provided in clause (ii) below, shall be two years. (ii) Direct recruits to posts carrying a pay scale, the minimum of which is Rs. /000/- or above, or to posts for which the age of entry is 35 years or above and where no training is involved, shall be on probation for a period df one year only. (4) Persons who are inducted into a new service through promotion shall also be placed on probation for two years; but there will be no probation for a person promoted from. one grade to another within the same Service, except where the promotion involved a change in the Group of Posts in the same service, e.g. promotion from Group 'B' to Group 'A' in which case the probation shall be for two years. These provisions are also applicable to isolated posts. (5) Wherever promotion includes 'on the job' or 'institutional' training combined with actual performance on the job, probation for a period of two years should be prescribed in the recruitment rules. (6) In the case of those who are re-employed before the age of superannuation, e.g. ex-military personnel, there will be a probation of two years on their appointment/re-employ- ment to civil posts except in respect of cases covered by clause 3 (ii) above. 4. There will be no probation in the case of officers appointed to various posts on : 41

(b) Deputation; (c) Tenure basis; (d) Re-employment after superannuation: and (e) Permanent transfer. [MHA OM No. 44/1/59-Ests(A), dt. 15-4-1959 as amended by DOP&AR OM No. 21011/2/80-Estt(C), dt. 19-5-1983; OM No. 21011/3/83-Estt(C), dt. 5-12-19841.

5. Extention of period of probation.—(1) While the normal probation may be extended in suitable cases, it is not desirable that an employee should be kept on probation for years as happens occasionally at present. Therefore, save for exceptional reasons, probation should not be extended for more than a year and no employee should be kept on probation for more than double the normal period. (2) The decision whether an employee should be confirmed or his probation extended should be taken soon after the expiry of the initial probationary period, that is. ordinarily within six to eight weeks, and communicated to the employee together with the reasons in case of extension. A probationer who is not making satisfactory progress or who shows himself to be inadequate for the service in any way, should be informed of his shortcomings well before the expiry of the original probationary period so that he can make efforts at self- improvement. 6. Assessment of work and performance during probation : 6.1 Concentration of attention on the probationer's ability to pass the probationary, or the departmental examination tends to obscure the wider object to probation. In Judging the fitness for confirmation of employees selected on the result of a vigorous written examination, passing the probationary or a departmental examination should be essential but not the most important part of the qualification for confirmation. There should be a very careful assess- ment of the outlook, character and aptitude for the kind of work that has to be done in the service before a probationer is confirmed, and only those persons who possess qualifies of mind and character needed in the particular service and the constructive outlook and human sympathy needed in the public services generally should he confirmed. [MHA OM No. 44/1 /59-Ests (A), dt. 15-4-59]. 6.2 A probationer should be given an opportunity to work under more than one officer during the period of his probation and reports on his work obtained from 'each one of 'these officers. The reports for the whole period may then be considered by the respective D:P.Cs. for determining whether the probationer concerned is fit to be confirmed in service. Since consultation with the Union Public Service Commission for the purpose of assessing the satis- factory completion of probationary period by Group 'A' and Group 'B' Officers is not obligatory under the rules, the association of a member of the Commission with the D.P.C. is not necessary. (MHA OM No. 44/1/59-Ests(A). dt. 15-4-59; OM No. 44/10/61-Ests(A), dt. 29-8-63 and OM No. 44/2/64-Ests(A), dt. 30-7-64]. 6.3 In the case of temporary Government servants who are retained in service for more than two years. there should be a screening process analogous to that of persons appointed substantively. The object of this screening would be to terminate the appointments of those who appear to be inadequate for the service; but a person who satisfies the test would not acquire any special status, and would continue to be liable to discharge etc., in accordance with the original conditions of this employment. 6.4 On the expiry of the period of probation steps should be taken .to 'obtain the assessment reports on the probation and to :— (i) confirm the probationer/issue of orders regarding satisfactory termination of proba- tion, as the case may be. if the probation has been completed to the satisfaction of the competent authority; or (ii) Extend the period of probation [in terms 'of para 1(8) of the OM 44/1 /59-Ests(A), dt. 15th April, 1959] or discharge the probationer as the case may be. in accordance with the relevant rules and orders, if the probationer has not completed the period of probation satisfactorily. 6.5 For the purpose of assessment of the work, separate forms of report on the proba- tioners, as distinct from the usual confidential report forms. may be devised for each of the Services in consultation with the O&M Division of the Cabinet Secretariat (now Department of Personnel & Administrative Reforms). Each Ministry/Department prescribing a form in respect of its own service will be free to adopt it, and where necessary. define its own factors under each heading of the. form treating those listed in the model illustrative. If a probationer happens to serve under more than one officer during the probationary period, separate reports may be written by each of the con- cerned officers in these special forms. The usual annual confidential reports should also be written in their cases during the period of probation. IMHA OM No. 13/4/60-CS(A). dt. 21-6-62 & 16-10-62.1

6.8 The Union Public Service Commission are interested in the performance of candidates recruited through them. The Commission follow up the progress of officers, selected through interview, for a period of two years after appointment. In order to follow up the progress of officers selected through open competitive examinations (excluding Defence Services and Minis- terial Services Examinations) held by them. the Commission consider it necessary to watch their performance during the first five years of service. These .five ' years would in most case include the period spent in a training institution as, well, and the Commission are particularly interested in obtaining detailed reports from the Principals of the training institutions of the progress of each recruit in various directions, especially the development of his personality to equip him for the discharge of his duties. For this purpose, they call for Assessment Reports on the work and performance of candidates during the first five years of their service, with a view to reviewing periodically their examination methods, and ensuring that progressively a hater type of recruits is made available for the Service /posts, recruitment to which is made through them. Tn the case of candidates selected through interview, the Assessment Reports are required for a period of two years aft& appointment. [MT-TA OM No. 21/3/59-Ests(B), dt. 25-5-59 and 13-6-59: No. 23/11ff7_Ests (13) , dt. 14-7-67: No. 23/62 /68-Ests(B). dt. 15-3-69,1 6.9 Assessment Reports in respect of candidates recruited/ selected by the Union. Public Service Commission should be sent to the Commission in the proforma at Anncxure [MHA OM No. 23/62/68-E,stt(B), dt. 15-3-69 and No. 23/12/71-Estt.(B), at. 27-4-71]. 6.10 The Confidential Reports are written, because the cases of the officers for crossing of efficiency bar, promotion, grant of pensionar; benefits etc. are to be considered on the basis of those reports as and when the occasions for such consideration arise. The probation reports are, on the other hand, written to help the supervising officer to concentrate or the special needs of probation and to decide whether the work and conduct of the officer during the period of probation or the extended period of probation are satisfactory enough to warrant his further retention in service or post. The probation reports may thus not serve the purpose for which the confidential reports are written, and vice versa. It is, therefore, necessary that in the case of all probationers or officers on probation (including those in the Central Secretariat Service) separate probation reports should be written in addition to the usual confidential reports for the period of probation. [MHA OM No. 44/4/64-Ests(A), dt. 9-10-64]. 7. Date of confirmation of the probationer.—The date from which confirmation should be given effect to is the date following the date of satisfactory completion of the prescribed period of probation or the extended period of probation as the case may be. The decision to confirm the probationer or to extend the period of probation as the case may be, should be communicated to the probationer normally within 6 to 8 weeks. Confirmation of the proba- tioner after completion of the period of probation is not automatic but is to be followed by formal orders. As long as no specific orders of confirmation or satisfactory completion of pro- bation are issued to a probationer, such probationer shall be deemed to have continued on probation. [DOP OM No. 21011/2/80-Estt(C), dt. 19-5-1983 and DOP OM No. 21011/3/83- Estt(D), dt. 5-12-1984] 8. A set of model Rules on probation for organised services have been formulated in con- sultation with UPSC. (Annexure-XV). [DO? OM No. AB-14017/5/83-Estt(RR), dt. 7-5-1984]. In every case where there is at 9. Departmental examinations during probation.—(1) present no departmental examination, success in which is necessary before an employee can be confirmed, it should be considered whether it would not be appropriate to introduce suCh an examination. [MHA OM No. 44/1/59-Ests(A). dt. 15-4-59]. (2) The marks obtained by probationers at the probationary examination and those awarded to them by the heads of the respective training institutions on the basis of their total performance during the entire probationary period may be added to their marks in the competi- tive examination to determine their final ranking. But the ranking of the Central Service Group `A' probationers should continue to be made on the result of the competitive examination held by the Union Public Service Commission and the results of any departmental examination should not be taken into account. However, in the case of the probationers of Central Services Group 'A' who do not pass the end-of-the-course test at the Lal Bahadur Shastri National Academy of Administration at lvfussoorie, the drawal of the first increment will be postponed by one year from the date on which they would have drawn it or upto the date on which under their depart- mental regulations the second increment accrues to them. whichever is earlier. The failed candi- dates would not be required to take the test again. 1.2. For every 'Craz,etted. appointment, there should be a gazette notification, and for every other appointment a formal 'order of appointment' as distinct from offer of appointment. Where the appointing authority is President' or the 'Central Government' notification or appointment order should be— • (i) express in the name of the President; and (ii) signed by an officer empowered to authenticate the President's order under Articic 77(2) of the Constitution. Where the appointing authority is other than the President or the Central Government, notifi- cation or appointment order should- (i) expressly state that the appointment is made by that authority; and (ii) be signed by appointing authority, or where this is not practicable, by any other officer signing 'for' the appointing authority. The officer so signing— (a) should in no case be higher than the •appointing authority; and (b) should ensure that appointment has been formally approved by appointing authority and the fact recorded on the file. [MBA OM No. 7/43/57-Ests(A), dated 24-1-58]. 1.3 Forms of appointment orders/ notifications.--Spechrien of notification/order of appoint- ment are given in Annexures Xl -to XIV. VII. :ISSUE OF GAZETTE. NOTIFICATIONS

1. Object—The primary object of notifying any item in the Gazette is to .make it known to the public. The notifications relating to Government servants, however, also enable the audit authorities to regulate their pay, allowances. etc., as well as maintain history of services. Accord- ingly. every important event in the official career of a gazetted Government servant affecting his pay and other conditions of service, e.g., leave, reversion, suspension, removal, dismissal etc. • requires to be notified in the Gazette. [MBA OM No. 12/41 '53-Ests.. dated 4-8-541.

2. Leave and Transfer. 2.1 As a measure of economy. the practice of notifying leave and transfer of gazetted officers in the Gazette of India has been discontinued. Such notifications will, however, continue to issue in cases where statutory requirements make it necessary for every change in the incumbency of a post to be notified in official Gazette. [O&M Div. OM No. 40/18/62-0&M (5.7), dated 21-1-63]. 2.2 A question has been raised whether the instructions in para (1) above also apply to cases of deputation of ex-cadre posts and transfer to foreign service. It is. clarified. in consulta- tion with the Comptroller and Auditor General, that the word 'transfer' used in pant (1) above. includes deputation and transfer to foreign service also and that notification reearding these two events in the official career of Gazetted Officers need not be published in the Official Gazette. It would he sufficient if copies of the formal orders sanctioning deputntion and transfer to foreign service are endorsed to audit and other authorities concerned. [0. & M. Div. OM No. 18:1/63-O&M. dated 27-2-631 2.3 Since every case of 'transfer' or 'deputation' from one end results in 'appointment' at the other end a doubt has arisen whether such 'appointment' at the latter end should be notified in the Official Gazette. It is clarified, in consultation with the Comptroller and Auditor General. that appointments resulting from the folloWing. Gazetted Officer from one -Office 'to -another Shotild not, however, be notified in the Official Gazette if :- (a) the transfer does not involve any change either in the grade or service (including designation) or the cadre, e.g. transfer of an Under Secretary (Officer .of Grade I of the Central Secretariat Service) in the Ministry of Information and Broadcasting as Under 'Secretary in the Ministry of Labour and Employment. (Here cadre authority continues to be the same -even after transfer viz., Department of Personnel); or (b) the transfer involves a change in the cadre. but no change in the grade or service or designation of a post, e.g. transfer of a Section Officer, Ministry of Home Affairs as Section Officer, Ministry of Foreign Trade; or (c) the transfer involves a change in the designation of the post only, without invobOng any change in the grade or service or in the cadre, e.g. transfer of Section Officer. Department of Works and Housing as Assistant Director of Estates. - Since the decision is to discontinue ,gazette notification regarding leave and transfer only under certain conditions. all other events like first app6intment to a new post or grade and subs...- quent promotions would continue to be notified in the •gazette as heretofore. it may .also be noted that there in pursuance of the instructions issued by Government gazette notifications have to be discontinued, office orders should continue to be issued and their copies endorsed to all concerned. including, where necessary, to audit. OM No. 18/11,63-0EVIedt.23-4-63]. lt,• ptyretgbler. 2.4 Since the retirement of Government servants proceeding on leave preparato3n to retire- ment' or .`refused leave' takes effect from the 'date of -expiry of leave -in the first case anri from the date preceding the commencement of leave in the other case, the question arises whether the two types of leave and the event of retirement should be notified in the official gazette, and. (;ij. whether jointly or separately. In consultation with the Ministry of Finance (Department of Expenditure), it has been decided that the following procedure should be adopted in respect of the above (i) Leave preparatory to retirement —The two events namely, proceeding on leave pre- paratory to retirement, and actual retirement, should be combined into a single notifi- cation in the manner indicated below :- "On the expiry of his leave preparatory to retirement, Shri (name and designation) has retired/will retire from service w.e.f. Jii) Retirement and Refused leave.—In these cases also, the two events may he combined into a single notification in the manner indicated below :- "Shri (Name and Designation) has been granted refused leave for w.e.f...... being the date of his retirement". {O&M Div. OM No. 40/18/62-O&M (5.7), .dated 21-1-63 and Dept. of Administrative Reforms OM No. F.18/1/63-AR, dt. 31-12-64]. 2.5 it has been decided that the leave which may he granted to a Government servant while on foreign service, should be notified in th..' Gazette of India. irrespective of the fact whether the 47 leave is sanctioned by the foreign employer or the authority which sanctioned the transfer to foreign service. [MHA OM No. 13/2/59-Estt(A), dt. 25-2-60]. 2.6 The retirement of a gazetted officer should also be notified. In the case. however, of the notification of a case of leave preparatory to retirement, a second notification that the officer is retiring on a particular date after enjoying this leave will not be necessary. 1[MHA OM No. 33/6/56-Ests(A). dt. 9-4-57]. 3. Holding of current charge.- 3.1 Appointment of an officer to hold current charge of the routine duties of a gazetted post does not involve any change in his emoluments and from the audit point of view, a gazette notification may not strictly be called for. Such appointment should still be notified if it is considered desirable to publish it or ii the officer concerned is required to countersign bills as a controlling officer or exercise statutory or other powers conferred on holders of the post. (MHA OM No. 12/41/53-Ests, dated 4-8-54). 3.2 According to Finance Ministry's OM No. F.12.(2)-EII(A) /60, dated 5-10-60, (i) an order appointing an officer to hold the current charge of the duties of a post should, in the absence of any specific direction to the contrary, be deemed to clothe the officer with all the powers (including statutory powers) vested in the full-fledged incumbent of the post, and (ii) where the exercise of statutory power is involved, it is necessary that the appointment should also be notified in the Gazette. The Law Ministry has since advised that an officer appointed to perform the current duties of an appointment can exercise administrative or financial powers vested in the full-fledged incumbent of the post, but he cannot exercise statutory powers, whether those powers, are derived direct from an Act of Parliament (e.g. Income Tax Act) or Rules, Regulations and Bye-laws made under various Articles of the Constitution (e.g. Fundamental Rules, Classifica- tion, Control and Appeal Rules, Civil Service Regulations, Delegation of Financial Powers Rules etc.) The above legal position may, in supersession of the OM of 5-10-60, be borne in mind while appointing Government servants to hold the current duties, or while performing the current duties, a posts other than their own. [MHA OM No. F.7/14/61-Ests(A), dated 24-1-63]. 4. Redesignation of Gazetted post.—A question has been raised whether redesignation of a gazetted post amounts to the relinquishment of charge of the former post by its incumbent and also simultaneous assumption of the charge of the redesignated post and if so, whether notifica- tion regarding the transfer of charge is necessary. It has been decided that both the Gazette Notification and an intimation to the Accounts Officer concerned are necessary. As regards handing over/taking over charge, no formal charge report need be called for in such cases, but in endorsing the copy of the notification to the Accounts Officer, it should be made clear that the redesignation does not involve any change in duties or classification or scale of pay. This would enable the Accounts Officer to instruct the Treasury and other disbursing officers suitably. [MHA OM No. 13/2/58-Ests(A). dt. 1-10-58]. 5. Publication of notifications. Notifications of appointment should be published in the Gazette of India in : (1) Part I. Section 2. in the case of Ministries/Departments. other than the Ministry of Defence. (2) Part I. It must be understood that although the agreement as.required by law is in form an agreement with the Presi- dent of India, this appointment is made by the Government of India. A person selected to fill it will be subject in all respects throughout his service to the orders of that Government. ARTICLE OF AGREEMENT made the day of one thousand nine hundred and BETWEEN of .:of the one part and the President of India (hereinafter called "the Government") of the other part WHEREAS the Govern- ment have engaged the party of the first part and the party of the first part has agreed to serve the Government on terms and conditions hereinafter contained.

The party of the first part shall on arrival in India forthwith report himself for duty without avoidable delay as directed .by the officers of the Government and shall submit himself to the orders of the Government and the officers and authorities under whom he may from time to time be placed by the Government and shall date of his embarkation at a port in India, from the rerna.:a in the service for the term of years subject to provisions the date of his disembarkation for India, herein contained. He shall devote his whole time to his duties and at all times obey the rules, including the Govern- ment Servants Conduct Rules, prescribed from time to time for the regulation of the branch of the public service to which he may belong and shall whenever required, proceed to any part of India and there perform such duties may be assigned to him. as 3. (4) By six calendar months' notice in writing given at any time during service under this agreement (except during the first year thereof) either by him to the Government or by the Government or their authorised officer to him without cause assigned.

PROVIDED always that the Government may in lien of any notice herein provided forgive the party of the first part a sum equivalent to the amount of his pay for six months or shorter notice than six months if they pay him a sum equal to the amount of his pay for the period by which such notice falls short of six months, PROVIDED further that in the event of a notice being given under sub-clause (2) of this clause the word "three" shall be read in place of the word "six" in the preceding proviso. The term "pay" for the:purpose of this clause shall mean the pay (including special pay and personal pay, if any) the party of the first part is receiving under these presentslat the time, unless he is receiving officiating pay in which case it shall mean the pay (including special and personal pay, if any) of his substantive appointment. 5. The pay from time to time payable to him under these presents shall be paid for such time as he shall serve under this Agreement and actually perform his duties commencing from the aforesaid date and ceasing on the date of his quitting service in India or on the day of his discharge therefrom or on the day of his death if he shall die whilst in service. If at any time the party of the first part proceeds on .deputation out of India, pay .during the period of his deputation shall be regulated by the ordinary rules regarding deputation. 6. The party of the first part shall be eligible subject to the exigencies of-the public service for leave and leave salary under the rules contained in Appendix 10-B of the P-& T, Compilation of the Fundamental and Suonlemen- tary Rules, Vol..II as amended:from time to time.

7. If the party of the first part is required to travel in the interests of the public service, he shall be entitled to allowance on the scale provided for iu the rules supplementary to the Fundamental Rules framed by the GOVERNMENT from time to time in force and applicable to his case. 8. The party of the first part shall be eligible for any concession in relation to medical attendance and treat- ment that may be prescribed by Government for the class of officers serving in the same station to which the Govern- ment may declare the party of the first part to correspond in status or conditions of service. 9. During his service under these presents, the party of the first part *Shall be permitted to subscribe to tShall the Contributory Provident Fund (India) and shall he subject to the rules of that Fund from time to time in force. 10. In any payments made to the party of the first part in the United Kingdom under these presents the rate of exchange then applicable to the class of transaction concerned as decided by the GOVERNMENT from time to time shall be observed.

11. Notwithstanding anything hereinbefore contained, the party of the first.part shall unless otherwise decided by the Government be entitled to receive in whole or in part as may be authorised by the Government, the benefits of any improvement that may he sanctioned by the Government subsequent to the date of these presents in the terms and condition of service of members of the branch of public service to which he may for the time being belong and the decision of the Government in respect of such improvement in the terms and conditions of service of th e party of the first part shall operate so as to modify to that extent the provisions of these presents.

12. All acts authorised or required to be done by the Government may be done in the United Kingdom by the High Commissioner for India acting on their behalf. 13. Notwithstanding anything hereinhefore contained the pay and leave salary admissible under these pre- sents whether payable in India or elsewhere shall he subject to any emergency cut that may be ordered by the Govern- ment for the same period and on the same terms as for other officers under the administrative control of the Govern- ment. 14. In respect of any matter in respect of which no provision has been made in this agreement the provisions of the Civil Services (Classification Control and Appeal) Rules, any rules made there under and any rules nude or deemed to be made under Article 309 or continued under Article 313 of the Constitution shall apply to the extent to which they are applicable to the service hereby provided for and the decision of the Government. as to their applicability shall be final In witness whereof the party of the first part and to the Government of India in the Ministry of on behalf of the President of India have hereunto set their hands the day and year first above written.

NOTICE It must be understood that although the agreement as required by law is in form an agreement with the PRESIDENT OF INDIA this appointment is made by the Government of India. A person selected to fill it will be subject in all respects throtighout his service to the • orders of that Government).

ARTICLES OF AGREEMENT made the day of one thousand nine hundred and BETWEEN of of the one part and the PRESIDENT OF INDIA (hereinafter called "THE GOVERNMENT") of the other part. WHEREAS the party of the first part was engaged by thc GOVERNMENT to serve the GOVERN.. MENT under an agreement dated the day of one thousand nine hundred and AND WHEREAS the said agreement has terminated AND WHEREAS the Government have now re-engaged the party of the first part has agreed to continue to serve the GOVERNMENT on the terms and conditions hereinafter contained.

NOW THESE PRESENTS WITNESS and the parties hereto respectively agree as follows:- 1. The party of the first part shall submit himself to the orders of the Government and of the officers and authorities under whom he may from time to time be placed by the Government. He should devote his whole time to his duties and at all times obey the rules including the Government Servants ConductRules pre- scribed from time to time for the regulation of the branch of the public service to which he may belong and shall whenever required proud to any part of India and there perform such duties as may be assigned to him. 2.. Unless the service of the party of the first part is terminated as hereinafter provided he shah continue in the employment of the Government until he attains the age of fifty five years when be shall retire. PROVIDED that the Government may retain his service after he has attained that age for such period as may be agreed upon subject to the provisions of the rules from time to time in force and applicable to him and to the provisions here- in contained. 3. The service of the party of the first part may be terminated as follows t-- (I) By the Government without previous notice if the Government are satisfied on medical evidence that the party of the first part is unfit and is likely for a considerable period to continue until by reason of ill-health for the discharge of his duties in India. PROVIDED always that the decision of the Government that the party of the first part is likely to continue until shall be conclusively binding on the party of the first part. (2) By the Government or their officers having proper authority without any previous notice if the party of the first part shall be guilty of any insubordination, intemperance or other misconduct or of any breach or non-performance of any of the provisions of these presents or of any rules pertaining of the branch of the public service to which he may belong or is found unsuitable for the efficient performance of his duties. ' (3) By six calendar months' notice in writing given at any time during service under this agreement either by him to the Government or by the Government or their authorised officer to him without cause assigned. PROVIDED always that the Government may in lieu of any notice herein provided for give the party of the first part a sum equivalent to the amount of his pay for six months or shorter notice than six months if they pay him a sum equal to the amount of his pay for the period by which such notice falls short of six months. PROVIDED also that in the event of a notice being given under sub-clause (1) of this clause' the word "three" shall be read in place of the word "six" in the preceding proviso. The term "pay" for the purpose of this clause shall mean the pay (including special pay and personal pay if any) of the party of the first part is receiving under these presents at the time unless he is receiving officiating pay in which case it shall mean the pay (including special pay and the personal pay, if any) of his substantive appointment. 74 75

4. If the party of the first part be suspended from duty during investigation into charge of misconduct mentioned in sub-clause (97 of clause 3 hereof lie shall not be entitled to any pay during such period of suspen- sion but shall be entitled to receive a subsistence grant at such rate as the Government may decide to allow

• ANNEXURE XV

Model provisions on probation for inclusion in recruitment rules for organised Services. PROBATION 1. Every officer on appointment to the Service, either by direct recruitment or by promotion in Junior scale shall be on probation for a period of two years. Provided that the Controlling Authority may extend the period of probation in accordance with the ins- tructions issued by Government from time to time. Provided further that any decision for extension of a probation period shall be taken ordinarily within eight weeks after the expiry of the previous probationary period and communicated in writing to the concerned officer together with the reasons for so doing within the said period.

2. On completion of the period of probation or any extension thereof, officer shall, if considered fit for perma- nent appointment, be retained in their appointments on regular basis and be confirmed in due course against the available substantive vacancies, as the case may be,.

3. Ilf, during the period of probation or any extension thereof, as the case may be, Government is of the opinion that an officer is not fit for permanent appointment, Government may discharge or revert the officer to the post held by him prior to his appointment in the Service, as the case may be. 4. During the period of probation, or any extension thereof, candidates may be required by Government to undergo such courses of training and instructions and to pass examinations and tests (including examina- tion in Hindi) as Government may deem fit, as a condition to satisfactory completion of the probation
