The EUISS set out to produce two books: one – this volume – consists of a retrospec- tive examination of the last ten years, including a detailed account and analysis of each individual ESDP mission, while the other, What ambitions for European defence in 2020?, seeks to define what should be the ambition for European de- fence in the coming decade. European Security and Defence Policy: the first ten years (1999-2009), which has in- volved the in-house research team almost in its entirety and drawn in further contributions, has brought to light, with the methodological persistence and thoroughness of the archaeologist, working layer by layer, stone by stone, all past and current ESDP missions’ achievements and shortcomings. It examines in depth virtually all issues relevant to ESDP, its institutions and their work- ings, the available resources and their use, as well as the way it relates to other international organisations, mainly the UN, NATO, the OSCE and the Afri- can Union. With this multi-authored volume, the EUISS is now able to offer a manual of ESDP, that will hopefully serve as a reference book for the use of all those interested in the development of European security and defence policy, in both its civil and military aspects. What is striking is not so much that the main policy conclusions drawn from both exercises should practically be the same. What is rather more striking is that by looking closely at twenty-three EU missions one by one, from the first mission in Bosnia to the naval operation off the coast of Somalia, a larger pic- ture emerges of the future contours and development of ESDP. ESDP is al- ready maturing, and indeed in different ESDP missions elements of its future shape can already be inferred. Building on the last ten years’ best practice, as the present study suggests, will allow for substantially enhanced effectiveness . :jgdeZVcHZXjg^inVcY9Z[ZcXZEda^Xn/i]Z[^ghiiZcnZVgh&..."'%%. in the ten years to come, and make it easier to reverse the three major deficits both EUISS volumes identify in parallel: the political deficit or the Common Foreign and Security Policy (CFSP) gap, insufficient coherence and inadequate capabilities. Examining the EU monitoring mission in Georgia, Sabine Fischer demonstrates that an enormous gain of efficiency is achieved by integrating a mission into a well- defined strategy under ‘strong leadership’ unanimously backed by Member States. EU action to prevent a dangerous escalation of war on its doorstep was decisive also because it was swift, and part of the reason for this timeliness relates to unity of pur- pose. The need to bridge the political deficit is a main recommendation for the next ten years. The EU mission in Georgia proves that it is quite possible to overcome the political gap that has weakened the impact of other EU missions. Looking at the current mission in Kosovo, Giovanni Grevi concludes that more thinking needs to be devoted ‘to the connection between foreign policy and ESDP’, and expresses the hope the Lisbon Treaty will indeed help bridge the gap. Advantages in terms of coherence that can be gained by unifying EU external ac- tion emerge just as clearly from the detailed analysis of the various missions in the Balkans, where many European Commission projects are also being implemented alongside ESDP operations. As Eva Gross states, highlighting the EU’s excellent record as a crisis management actor in the former Yugoslav Republic of Macedonia (FYROM), the ‘linear application and devolution from a military to a civilian ESDP mission followed by Community programmes’ was crucial to the success of the EU’s intervention there. This is true even though, as has often been observed, strong inter-pillar coordination has in many cases been lacking, including in the Balkans. The double-hatted EU representation to the African Union in Addis Ababa is a fore- taste of things to come. Damien Helly points out that it ‘is seen as a very successful experience so far’, and one that must certainly be carefully studied in the process of establishing the European External Action Service. But the need for coherence does not merely refer to the ability to give a common thrust to EU diplomacy, but perhaps more decisively to the necessity to ensure that national policies are part of it as well. Examples of the failures of coordination between EU Members States both among themselves and within the Union are catalogued far too frequently in these pages, Afghanistan being a case in point. The Union needs to overcome the coher- ence deficit without weakening EU legitimacy for the sake of effectiveness. &% EgZ[VXZ The benefits of pooling are equally obvious when it comes to the universally recog- nised capability gap, and bridging this is certainly a major challenge for the future.

Understandably, there has been extensive commentary on the ESDP, most of which has focused on the ESDP’s institutional, industrial or military deficiencies. These commentaries have been illuminating but by concentrating on the manifest weaknesses of the ESDP, scholars have perhaps neglected to discuss explicitly how a coherent ESDP could develop. Drawing on recent work by Ben Tonra, this paper discusses the social conditions which are likely to be necessary if the ESDP is to develop into a robust policy. Above all else, a coherent ESDP depends upon the development of a binding sense of mutual obligation between France, Germany and Britain. These nations need to commit themselves to collective defence goals. The paper goes on to argue that for this collective commitment to be developed between these nations, the ESDP requires missions. Only through missions, in which these nations together experience a shared threat, will enduring shared interests and the collective will to address them be developed.

ESDP 2009 – State of Play Even if the European Security and Defence Policy (ESDP) seems for many observers a well-established field of activity of the European Union, it must not be overlooked that it is still a young and on many aspects quite unpractised endeavour of the EU. Only in 2003 – after a four-year period of institution building, strategic considerations and civil/military capability development – ESDP became officially operational, and started in Bosnia and Herzegovina its first field mission. Today, only six years later, the EU has already completed 11 ESDP missions: - five in Africa (Artemis, EUFOR and EUPOL Kinshasa in DRC, EUFOR in Tchad/RCA, EU Support to AMIS/AMISOM) - four in the Western Balkans (Concordia, EUPOL Proxima, EUPAT in FYROM and EUPT Kosovo) - one in Caucasus (EUJUST THEMIS in Georgia) and - one in Asia (AMM in Aceh/Indonesia). The ongoing missions in the framework of ESDP are diversified to the following regions: - three in the Western Balkans (EUPM and ALTHEA in BiH, EULEX Kosovo) - one border mission in Moldova/Ukraine - three in the Middle East (EUPOL COPPS in Palestine, EUJUST LEX in Iraq, EUBAM Rafah) - one in Central Asia (EUPOL Afghanistan) - one in Caucasus (EUMM Georgia) - four in Africa (EUSEC RD Congo and EUPOL RD Congo in DRC, EU SSR in Guinea-Bissau, ATALANTA/EU NAVFOR off the Somali coast).

This paper explores a variety of legal and political aspects of the EU’s efforts to stabilise the Western Balkans in an attempt to answer the question about what the EU should have learned in so doing. Attention is paid to the diplomatic efforts of the EU to prevent (the escalation of) confl ict in Macedonia, between Ser- bia and Montenegro, and in Kosovo. The role and impact of the EU’s fi rst-ever - and so far biggest - police and military operations are also evaluated. It is argued that lessons learned from these actions should be taken to heart before the EU decides to embark on any future mis- sions. Otherwise, history may prove that the Western Balkans offered the EU’s one and only chance to develop credible and lasting foreign policy, security, and defence arrangements. 1. Some Legal Issues Concerning the EU-NATO Berlin Plus Agreement MARTIN REICHARD* Max Planck Institute for Comparative Public Law and International Law, Heidelberg, Germany Abstract. The ‘Berlin Plus’agreement of 16 December 2002 now allows the EU to draw on some of NATO’s military assets in its own peacekeeping operations. The exact legal nature of the agreement, however, appears doubtful. Yet – given that political actors often resort to legal arguments in case of a dispute – the question of whether it is binding under international law is likely to be raised in the future. First, a short his- torical overview is given of the development of relations between the EU and NATO. In some respects, these are a mirror image of the co-operation NATO previously enter- tained with the Western European Union. However, since the French-British meeting of St-Mâlo these relations have assumed features of their own, for instance equal sta- tus for the EU. The text of the ‘Berlin Plus’agreement is then tested against the con- stitutive characteristics of a treaty in international law. In conclusion, the ‘Berlin Plus’is nothing but a non-binding agreement. The most important reason for this is that the EU manifestly lacked treaty-making competence, as the agreement was concluded by its High Representative for the Common Foreign and Security Policy, not by the statutory organ provided for in such cases in the Treaty on European Union. Nevertheless, as the parties proceed to implement the ‘Berlin Plus’according to its stated terms, legally binding force may arise for some of its contents through estoppel.
