Luckily, LWCF remains one of the rare issues that draws bipartisan support in today’s hy- per-partisan political environment. A group of Republican and Democratic lawmakers are working hard to permanently reauthorize the program, channeling the national sentiment that spurred the creation of LWCF more than five decades ago.2 In 1964, amid a growing en- vironmental public consciousness, Congress— with extraordinary bipartisan support—creat- ed the Land and Water Conservation Fund to protect and expand access to local, state, and national parks across the country.3

At the time, President Lyndon B. But the clock is winding down. If Congress fails to act, lands across the country could be permanently lost to private development. The time has come for Congress to perma- nently reauthorize and provide full dedicated funding for the Land and Water Conservation Fund to ensure that America’s most critical parks funding program is around for years to come.

5. 2 HOW THE LAND & WATER CONSERVATION FUND WORKS

Congress created the Land and Water Conservation Fund to meet the “present and future outdoor recre- ation demands and needs of the American people.”5 The act passed in 1964 with overwhelming biparti- san support—just a single member of each house of Congress voted against it.6

The premise is simple: the United States invests a small portion (up to $900 million annually) of the revenue generated from offshore oil drilling into land conservation, outdoor recreation, and public lands access.7 A small remainder of LWCF funding comes from federal motorboat fuel taxes and proceeds from the sale of surplus federal property.8

Each year, funding for LWCF is shared among several critical programs: U.S. public land projects and state and local grant programs, including Forest Legacy grants, Cooperative Endangered Species Conservation grants, American Battlefield Protection grants, High- lands Conservation Act grants, Outdoor Recreation Legacy Partnership grants, and State and Local Assis- tance Program grants.9 LWCF funds projects in every state in America, from baseball diamonds to nation- al parks.10 Based on available data, the Center for Western Priorities only considered U.S. public land and Forest Legacy LWCF projects in this analysis.

Funding for the Land and Water Conservation Fund’s U.S. public land projects is shared among four agen- cies: the Forest Service in the Department of Agri- culture, and the Bureau of Land Management, Fish and Wildlife Service, and in the Department of the Interior.11 From 1965 to 2016, the U.S. government spent approximately $10.7 billion in LWCF funds to permanently protect threatened lands as part of the national public lands system.12

National public lands—which range from the coun- try’s most visited national parks to the most remote wilderness areas, national monuments, trails, and rivers—often include or abut privately-owned lands. When high-priority parcels come under threat of de- velopment, are worthy of protection, and the land- owner is willing to sell, the Land and Water Conser- vation Fund is the primary funding source available to protect these lands for the future enjoyment of the public.13

Between 2011 and 2014, Land and Water Conserva- tion Fund investments in state and local cooperative grants, which include the Forest Legacy program, to- taled 58 percent of all LWCF distributions, protect- ing working forests, building local recreation centers, and preserving clean water sources. The remaining 42 percent of LWCF funding was directed towards U.S. public land projects.14

Between Fiscal Year 2007 and Fiscal Year 2016, LWCF appropriations ranged from a low of $255 million in Fiscal Year 2008 to a high of just $450 million in Fiscal Years 2010 and 2016.15

On September 30, 2015, Congress let the fund’s revenue stream expire despite broad bipartisan support.16 Scrambling to keep the popular rec- reation fund afloat, Congress passed a stopgap measure in late 2015 to reauthorize LWCF for just three years.17 Now the clock is ticking down. If Con- gress fails to reauthorize the fund by September 30, U.S. land management agencies, states, and local communities will be left without a critical source of money for improving public access to na- tional lands, preserving wildlife habitat, and build- ing close-to-home parks and recreational facilities.

THE FUNDING BREAKDOWN This analysis considered key recipients of LWCF funds—U.S. public land projects administered by the Bureau of Land Management, Fish and Wildlife Service, National Park Service, and Forest Service, as well as Forest Legacy state grants— that were readily available in annual agency budget requests on a project-by-project basis. Each year these programs rely on LWCF funding to improve outdoor recreation in America, with millions of acres of successful projects to show for it.

NATIONAL PARK SERVICE The National Park System—which includes 417 units18 ranging from national parks, monuments, recreation areas, and battle- fields to national lakeshores, wild and scenic rivers, and trails—spans 84 million acres.19 But within those boundaries, 2.6 million acres of privately-owned lands, known as “inholdings,” remain.20 Inholdings can be at risk of development, so, for the enjoyment of the public, the Park Service uses LWCF funds to protect the nation’s natural and cultural resources when willing landowners want to sell their inholdings. Since its inception, LWCF has protected 2.2 million acres of National Park System land.21

BUREAU OF LAND MANAGEMENT The Bureau of Land Management relies on LWCF funding to preserve lands in national monuments, conservation areas, wil- derness areas, wild and scenic rivers, and recreation areas, among others.22 By connecting or acquiring easements through the West’s checkerboard land ownership pattern of public and private lands,23 LWCF improves recreational access to Bureau of Land Management lands throughout the region and eases management challenges.24

FISH AND WILDLIFE SERVICE The Fish and Wildlife Service uses LWCF funds to conserve unprotected lands within National Wildlife Refuges and other pro- tected areas for the preservation of threatened fish, migratory birds, and other endangered species and for the recreational enjoyment of the public.25 LWCF has protected 1.4 million acres of System lands.26

FOREST SERVICE The Forest Service uses LWCF funds to protect land within national forests, grasslands, and other specially designated areas like wilderness and wild and scenic rivers.27 LWCF helps ensure the best possible management of an ecosystem or protected area, conserve threatened wildlife habitat, and improve access to Forest Service lands for hunting, fishing, hiking, boating, and other outdoor pursuits. LWCF has protected more than 1.5 million acres of Forest Service lands.28

FOREST LEGACY The Forest Service also administers the Forest Legacy program, which uses LWCF funds in partnership with state agencies and private landowners to protect “working forests,” often through conservation easements.29 The program relies on sustainable forestry to support local forestry jobs, enhance recreational opportunities, and preserve water sources and wildlife habitat. Since its creation in 1990, the Forest Legacy program has conserved 2.6 million acres of forest lands in 53 states and U.S. territories.30

12. 13. THE FULL PICTURE U.S. public land and Forest Legacy LWCF funding is only part of the story, the program also funds state and local cooperative projects in communities across the country.

Each year the National Park Service administers the STATE AND LOCAL ASSISTANCE PROGRAM, a grant-making program that matches state and local funds to acquire open space and build outdoor recreation facilities in towns and urban areas across the country.31 This critical part of the Land and Water Conservation Fund has granted $4.4 billion to 42,000 recreation proj- ects32 in all 50 states.33 From baseball diamonds to bike paths, climbing walls to community pools, many close-to-home oppor- tunities to get outside are thanks to stateside LWCF funding. Here are some urban parks that were created using LWCF money:

• Seattle’s iconic GAS WORKS PARK was once an abandoned industrial complex; now it is home to 19 acres of fields and public art.34

• Nashville used LWCF funding to help create RIVERFRONT PARK, the centerpiece of its downtown revitalization.35 • In Salt Lake City, LWCF grants helped connect SUGAR HOUSE PARK to multiple trails and a nearby business district; those connections have led to over $200 million in new economic development.36

The Land and Water Conservation Fund also provides funding for the Cooperative Endangered Species Conservation Fund, the American Battlefield Protection Program, Outdoor Recreation Legacy Partnership Program, and the Highlands Conserva- tion Act. Collectively, these programs have received $1.7 billion in LWCF funds.37

• COOPERATIVE ENDANGERED SPECIES CONSERVATION FUND: Through collaborative LWCF, state, and local grants, this fund supports voluntary state and landowner habitat conservation for threatened and endangered species.

• AMERICAN BATTLEFIELD PROTECTION PROGRAM: In cooperation with state and local partners, the American Battlefield Protection Program helps protect lands on the boundaries of America’s national battlefields and military parks.

• OUTDOOR RECREATION LEGACY PARTNERSHIP PROGRAM: Administered by the National Park Service, the Outdoor Recreation Legacy Partnership Program supports new outdoor recreation projects in urban areas.

• HIGHLANDS CONSERVATION ACT: The Highlands Conservation Act relies on LWCF funding to leverage state and local funding to protect sources of clean drinking water in Connecticut, New York, New Jersey, and .

Celebrated as one of the premier “salmon strongholds” along the Pacific Coast, the Smith River is the only major undammed river in the state of California. One of the main tributaries to the Smith is Hurdygurdy Creek, a vital source of clean, cold water for coho and Chinook salmon making their way from forest to ocean. With a stunning display of desert biodiversity, includ- ing over 674 species of plants and animals, the area hosts what may be the last viable population of indigenous desert bighorn sheep in the Tucson Basin. The parcel, which is nestled between the Silverbell and Ragged Top Mountains, is a popular destination for hikers and mountain bikers alike.

Known as New Mexico’s “land of fire and ice,” El Malpais National Monument is a unique volcanic landscape with pygmy pine forests, numerous spatter cones, and lava tube caves, like the infamous Ice Cave (a cave whose temperature never rises above 31 degrees). Ice Cave and Bandera Crater are part of a historic private inholding and popular tourist operation within the monument. The proposed acquisition would preserve the sites as part of our national public lands system, protecting them from future development while allow- ing for the creation of 4 new miles of the Continental Divide Trail. The Continental Divide Trail is one of the many national trails that relies on the Land and Water Conservation Fund to increase trail connectivity. Protecting this parcel would improve the experience for trail-goers, allowing through-hikers and segment-hikers alike a true trail to follow, safely away from state highways and country roads.

Each year the Land and Water Conservation Fund opens new trail- heads, paves new bike paths, and protects previously private lands in- side America’s most-loved parks and protected public lands. Every $1 of LWCF funds invested into the protection of new U.S. public lands generates $4 in economic value.38 The fund’s successes contribute essential infrastructure for the nation’s growing outdoor recreation economy, providing lifeblood for gateway communities by bringing new jobs and boosting revenue across the country. A recent study by the Outdoor Industry Association found that the outdoor industry contrib- utes $887 billion in consumer spending to the national economy each year and supports 7.6 million jobs nationwide.39 19.
