BE IT ORDAINED by the Board of Port Commissioners of the City of Oakland as follows: Section 1. Section 5.134 is hereby added to Port Ordinance No. 867 to create a new position of Port Telephone Receptionist Clerk, which section shall read as follows: No. of Salary or Positions Title Schedule No. Sec. 5.134 1 Port Telephone Receptionist Clerk 70 Section 2. BE IT ORDAINED by the Board of Port Commissioners of the City of Oakland as follows: Section 1. That certain Terminal Use Agreement ("Agreement") dated the 4th day of December, 1990, between the CITY OF OAKLAND, a municipal corporation, acting by and through this Board, and PUGET SOUND TUG BARGE CO., a corporation, doing business as HAWAIIAN MARINE LINES, as User, covering Users nonexclusive right to use areas within the Ports Charles P. Howard Terminal, as the regularly scheduled Northern California port of call for the berthing of its vessels and the loading and discharge of containerized cargoes and operations supplemental thereto in Users West Coast/Hawaiian service, for a term commencing following the filing and effectiveness of said Agreement pursuant to Sections 5 and 6 of the Shipping Act of 1984 and Section 15 of the Shipping Act, 1916 and the expiration of thirty (30) days from and after the final adoption of this ordinance and terminating on the 31st day of December, 1995, subject to Users certain rights of termination and certain rights of User and the Port to transfer the Agreement to other Port facilities, with User to pay to the Port ninety percent (90%) of dockage and wharfage tariff charges on containerized cargo subject to an annual 35,000 revenue ton per acre breakpoint level therein specified with an alternate 65% wharfage tariff level applicable to certain unitized breakbulk general cargo and an alternate 80% wharfage tariff level applicable to certain other breakbulk general cargo, as therein specified, as consideration to User for the use of the assigned premises as their regularly scheduled Northern California port of call and otherwise upon the terms and conditions specified in said Agreement, is hereby ratified, confirmed and approved. Section 2. The President of the Board of Port Commissioners is hereby authorized to execute and the Secretary to attest said Agreement. Section 3.
