COMMERCIAL SPACE INSURANCE VOLUME II: Chapter 8/Summary he space insurance aspect of the Intelsat 708 launch failure focuses on the exchange of controlled technical information within the insurance community. Insurance underwriters and reinsurers for the Apstar 1A satellite program — the next scheduled T satellite to be launched on the Long March 3B after the Intelsat 708 failure — were concerned about the reliability of the Long March rocket, and the fate of future launch insurance programs in the PRC. Immediately after the Intelsat 708 launch failure, space insurance under- writers for the Apstar 1A insurance program pressured the PRC to create an international and Independent Review Committee (IRC). These underwriters and reinsurers insisted on this arrangement to ensure that an adequate assessment of the risks of future Long March rocket launches was made. Representatives from J & H Marsh & McLennan, an international space insurance brokerage firm, were adamant about obtaining a report from the Independent Review Committee for the benefit of the reinsurers of the Apstar 1A satellite insurance program. Members of the space insurance community were invit- ed to attend a meeting on April 15 and 16, 1996, in the PRC. The purpose of the meet- ing was to build confidence in the Long March rocket, and to discuss the status of the Apstar 1A insurance program. The space insurance acquisition and underwriting process includes the dis- semination of technical information, the consideration of market conditions, capac- ity, and participants, and the involvement of insurance brokers, underwriters, and rein- surers. This chapter identifies several issues relating to procedures for the disclosure and handling of sensitive information by the insurance community. -

The International Space Station and the Space Shuttle

Behrens Specialist in Energy Policy Resources, Science, and Industry Division The International Space Station and the Space Shuttle Summary The International Space Station (ISS) program began in 1993, with Russia joining the United States, Europe, Japan, and Canada. Crews have occupied ISS on a 4-6 month rotating basis since November 2000. The U.S. Space Shuttle, which first flew in April 1981, has been the major vehicle taking crews and cargo back and forth to ISS, but the shuttle system has encountered difficulties since the Columbia disaster in 2003. Russian Soyuz spacecraft are also used to take crews to and from ISS, and Russian Progress spacecraft deliver cargo, but cannot return anything to Earth, since they are not designed to survive reentry into the Earth’s atmosphere. A Soyuz is always attached to the station as a lifeboat in case of an emergency. President Bush, prompted in part by the Columbia tragedy, made a major space policy address on January 14, 2004, directing NASA to focus its activities on returning humans to the Moon and someday sending them to Mars. Included in this “Vision for Space Exploration” is a plan to retire the space shuttle in 2010. The President said the United States would fulfill its commitments to its space station partners, but the details of how to accomplish that without the shuttle were not announced. The shuttle Discovery was launched on July 4, 2006, and returned safely to Earth on July 17. -

INTRODUCTION 1. By this Order, we authorize AfriSpace, Inc. (AfriSpace)1 to launch and operate the AfriStar-2 satellite in the geostationary-satellite orbit (GSO) at the 21° East Longitude (E.L.) orbital location. AfriStar-2 is controlled from the United States and is capable of providing Broadcasting-Satellite Service (sound) (BSS (sound)) to Africa and Europe on a non-common carrier basis. We authorize AfriStar-2 to operate downlinks within 2.6 megahertz of spectrum in each polarization with a center frequency of 1479.5 MHz. We also authorize AfriSpace to utilize feeder links and telecommand links for the AfriStar-2 satellite in the 7025-7075 MHz frequency band, to operate its telemetry link for the AfriStar-2 satellite at a center frequency of 1491.7 MHz, and to co-locate the AfriStar-2 satellite at 21° E.L. with the AfriStar-1 satellite currently in orbit. In addition, we grant AfriSpace a waiver of the Commission’s rule regarding transponder saturation flux densities for the AfriStar-2 satellite.2 These authorizations give AfriSpace the capability to continue to provide service to existing customers despite unanticipated technical difficulties experienced by the AfriStar-1 satellite and to serve new customers, conditioned on AfriSpace complying with the applicable laws, regulations, rules, and licensing procedures of any countries it proposes to serve. -

This was the third launch failure in 38 months involving the PRC’s Long O March series of rockets carrying U.S.-built satellite payloads. It also was the first commercial launch using the new Long March 3B. These events attracted intense attention from the international space launch insurance industry, and eventually led to a review of the PRC launch failure investigation by Western aero- space engineers. The activities of the Western aerospace engineers who participated on the review team — the Independent Review Committee — sparked allegations of violations of U.S. export control regulations. The review team was accused of per- forming an unlicensed defense service for the PRC that resulted in the improvement of the reliability of the PRC’s military rockets and ballistic missiles. The Intelsat 708 satellite was manufactured by Space Systems/Loral (Loral) under contract to Intelsat, the world’s largest commercial satellite com- munications services provider. Loral is wholly owned by Loral Space & Communications, Ltd. China Great Wall Industry Corporation, the PRC state-controlled missile, rocket, and launch provider, began an investigation into the launch failure. On February 27, 1996, China Great Wall Industry Corporation reported its determination that the Long March 3B launch failure was caused by a broken wire in the inner frame of the inertial measurement unit within the guidance system of the rocket. -

The New American Space Age: A Progress Report on Human Spaceflight Lately, it seems the public cannot get enough of space! The recent hit movie “Gravity” not only won 7 Academy Awards – it was a runaway box office success, no doubt inspiring young future scientists, engineers and mathematicians just as “2001: A Space Odyssey” did more than 40 years ago. “Cosmos,” a PBS series on the origins of the universe from the 1980s, has been updated to include the latest discoveries – and funded by a major television network in primetime. And let’s not forget the terrific online videos of science experiments from former International Space Station Commander Chris Hadfield that were viewed by millions of people online. Clearly, the American public is eager to carry the torch of space exploration again. Thankfully, NASA and the space industry are building a host of new vehicles that will do just that. American industry is hard at work developing new commercial transportation services to suborbital altitudes and even low Earth orbit. NASA and the space industry are also building vehicles to take astronauts beyond low Earth orbit for the first time since the Apollo program. Meanwhile, in the U.S. National Lab on the space station, unprecedented research in zero-g is paving the way for Earth breakthroughs in genetics, gerontology, new vaccines and much more. -

Dear Ms. Dortch: At the request of FCC staff, we are submitting this letter in the docket for the above-named application (the “Application”) to supplement statements made in the Public Interest Statement of that Application. The Public Interest Statement explained that the AfriStar-1 satellite will be initially controlled by Intelsat pursuant to an agreement between Intelsat, Silkwave, and an affiliate of Silkwave. The affiliate of Silkwave referred to is New York Broadband LLC, a U.S. limited liability company (“NYBB”). NYBB is affiliated with Silkwave because Chi Capital, which owns 100% of Silkwave, also has a minority ownership interest in NYBB. NYBB owns an Australian-licensed satellite, AsiaStar, which is operated by Intelsat pursuant to an agreement between NYBB and Intelsat (the “NYBB Agreement”). The AsiaStar satellite was also acquired from Yazmi pursuant to a series of earlier transactions not requiring FCC approval. The AfriStar-1 satellite is currently being operated by Intelsat pursuant to a separate agreement between Yazmi and Intelsat (the “Yazmi Agreement”). The parties intend that, following the transfer of the AfriStar-1 license to Silkwave, Intelsat will continue to operate the AfriStar-1 satellite on Silkwave’s behalf, either through an amended Yazmi Agreement, or more likely through an amended NYBB Agreement that includes the AfriStar-1 satellite and adds Silkwave as a party.
