TO KEEP YOU IS NO GAIN, TO KILL YOU IS NO LOSS* – SECURING JUSTICE THROUGH THE INTERNATIONAL CRIMINAL COURT Talitha Gray** I. INTRODUCTION “We who have witnessed in the twentieth century, the worst crimes against humanity, have an opportunity to bequeath to the new century a powerful instrument of justice. So let us rise to this challenge.”1 An incomprehensible number of people have died as a result of war crimes, genocide, and crimes against humanity in the last century. After World War II and the Holocaust, nations and their citizenry proclaimed that never again would something so horrendous happen. “We must make sure that their deaths have posthumous meaning. We must make sure that from now until the end of days all humankind stares this evil in the face . and only then can we be sure it will never arise again.”2 Despite this vow, from 1950 to 1990, there were seventeen genocides, with two that resulted in the death of over a million people.3 In 1994, 800,000 Tutsis died during a three-month genocide in Rwanda.4 Genocide, war crimes, and crimes against humanity are not only something that occurred in the distant past; sadly, they remain a vivid reality. If there is ever hope to end such crimes, they must be addressed by the law on an international scale. “We stand poised at the edge of invention: a rare occasion to build a new institution to serve a global need. This dissertation argues that recent moves by the Cambodian government to transform this site into an "historical-tourist area" is overwhelmingly dominated by commercial priorities. However, the tourism project simultaneously effects an historical narrative that inherits but transforms the government's historiographic endeavors that immediately followed Democratic Kampuchea's 1979 ousting. -

This research combines insights from the process and the context of thought reform informed by local cultural norms with the social type of the convert in a way that captures the KR phenome- non in both its general and particular dimensions. -

And in this instance, I'm confronting the man! That's what lawyers do. That's what I think is done at all international tribunals. And that's exactly what I intend to do. - Mr. Michael Karnavas, Ieng Sary’s international counsel * I. OVERVIEW Rochoem Ton alias “Cheam,”1 a former high-ranking cadre from the Ministry of Foreign Affairs (MFA), continued his testimony this week. He provided details on his decision to join the revolution, the evacuation of Phnom Penh, the interaction between Office 870 and the MFA, the administration of the MFA, and Ieng Sary’s powers and duties. The Defense Teams attempted to challenge Rochoem Ton’s credibility by confronting him with statements he made in previous interviews, as well as other witnesses’ statements, that were inconsistent with his testimony. After the conclusion of Rochoem Ton’s examination on Thursday, the Trial Chamber called another former MFA cadre, Mr. Suong Sikoeun, to the witness stand. Suong Sikoeun’s testimony covered several matters, including his early years as a revolutionary, some CPK policies, FUNK and GRUNK, and the roles Ieng Sary and Khieu Samphan played in these organizations. The committee for editing a Khmer dictionary established in 1915 consisted of both members who insisted on an etymological style of orthography and those who favored a phonemic style. A Buddhist monk Chuon Nath took the initiative from 1926 on and published the first Khmer-language dictionary in 1938. After the perfection of orthography based on an etymological style in the dictionary, the “Cul- tural Committee” began to create new vocabularies in 1947. Here again Chuon Nath assumed leadership with his best friend Huot Tat. The Cultural Committee rejected Sanskrit-originated words created in Siam and preferred the Pali language as elements of the modern vocabulary. Keng Vannsak objected strongly to these activities and claimed that the Khmer language had to exclude as many Sanskrit/Pali-originated words as possible in order to expand primary education.
