IIV. PROPOSED TERMS OF REFERENCE FOR EIA STUDIES The EIA report will be made in line with EIA Notification 2006 as amended. The components of the EIA study will include: • Determination of baseline data using primary data generation for one full season other than monsoon and secondary data available from various government published reports on air, meteorology, water, soil, flora & fauna, socio-economics, infrastructure, sensitive areas (forests, archaeological, historical etc); • Detailed description of all elements of the project activities during the operational phase. The elements to be analyzed will include the infrastructures of the project including drainage features, roads, waste collection, disposal and management and utility requirements. • Identifying the sources of pollution and assessing the impacts on the environment due to proposed coal mining. • Preparation of EIA and EMP documents with recommendations on preventive and mitigative measures for limiting the impact on environment to the desired level during various stages of project.

BASELINE ENVIRONMENTAL DATA GENERATION Sl. Attributes Scope of Work No. 1 Ambient Air Quality The baseline air quality will be monitored at various locations twice a week for one season for PM10, PM2.5, SO2 and NOx (NO2). Design of ambient air quality sampling network with regard to topography, population, sensitive locations, emission sources, background concentrations and possible impact zones, through application of screening air quality models for assessing air quality prior to start of baseline study. 2 Meteorological data 1 Location - 90 days (one non-monsoon season) Micrometeorological survey will be carried out at project site for 3 months. Data will be generated for temperature, Wind speed, Wind direction and Relative Humidity (min & max) and rainfall. This will be further supported by the meteorological data for the area of interest collected from nearest IMD Station and Trend analysis of micrometeorological data generated at the site. 3 Water Quality Water samples will be collected covering 10-km radius area. The samples will be analyzed as per IS-10500 for ground water and CPCB classification for surface water. 4 Soil Quality Soil samples will be collected from different/various locations and will be analyzed for the parameters such as grain size, pH, salinity, electrical conductivity, organic carbon, NPK, TDS, Na, Mg, Ca, Cl-, F- etc. 5 Noise Levels Noise monitoring will be carried by using Integrated noise meter on hourly observations for 24 hours at different locations. The observed data will be compiled and statistical analysis will be done for Lday and Lnight.

Local and District administration will also be contacted for collecting the required data.

IDENTIFICATION OF SOURCES OF POLLUTION This includes the following: • Identifying the sources of pollution of air, water, land and noise; • Quantifying the emissions from the pollution generating sources; and • Quantification of solid wastes and likely disposal methods will be suggested. Sources of Pollution The likely sources of air and water pollution will be identified and quantified; • The proposed pollution control measures envisaged in project area for fugitive dust, noise pollution and other environmental effects of each project activities will be assessed ; • The present and proposed changes in land use pattern will be identified; and • Based on various project activities, the likely impact on the environment attributes in project area will be identified by:

➢ Estimating the air pollution levels for PM10, PM2.5, SO2 and NO2 in the study area ➢ Estimating the source emissions for each project specific pollutants; ➢ Predicting the noise dispersions for all the noise generating sources; ➢ Predicting the impact of wastewater discharges, if any; ➢ Studying the short-term and long-term effects on sensitive targets like endangered species, crops and historically/archaeologically important sites (if any).

ENVIRONMENTAL IMPACT ASSESSMENT The proposed project will have an impact on the environment. The parameters likely to be affected are air quality, water quality, soil quality and noise levels etc on account of gaseous emissions, liquid effluent discharges, resultant particulates, generation of solid wastes etc. Predictive models will be used for atmospheric dispersion and noise propagation. The baseline data generated from the above studies will be added to the predicted values, analyzed and compared with applicable standards prescribed by the CPCB. By this means, the impact whether positive or negative will be assessed and the environmental attributes requiring special attention for mitigating the negative impact, if any, will be identified. Also the areas, which fulfil the prescribed environmental norms and not requiring further improvements, will be specified. Both short-term and long term impacts particularly on sensitive targets such as habitat of endangered species of wildlife or mines, crops, historically/culturally important sites/monuments, centres with concentrated population in the study area will be established. The impacts of project on various components of environment and the possible mitigation measures for mitigating the negative impacts are described in the following sections. Impact on Land Use Impact Assessment The land use impacts due to proposed mining activity will be identified in terms of local land use planning efforts. The change in land use pattern of project site will also be identified. This includes visual impact, impact on forest and impact due to socio-economic factors. Mitigation Measures The mitigation measures will be addressed towards restoration of land disturbed by the proposed project activities to the extent possible. Impact on Ambient air Quality Impact Assessment Source inventory will be carried in the study area. A computer based internationally recognized mathematical air quality model will be used to predict the concentration of SO2, NO2 & PM due to proposed project. The results will be presented for short-term (24-hourly) concentrations in and around the project site. Mitigation Measures Potential mitigation measures include the control measures at the source level. The measures to control the fugitive dust emissions will also be suggested according to guidelines of CPCB. Impact on Noise Impact Assessment Sources of noise and its impact on the environment will be addressed. The noise level at varying distances for multi-sources will be predicted using Noise model. Baseline noise levels in different zones like industrial, residential and silence areas like hospitals, schools etc will be monitored. The potential noise level exposure will be determined and evaluate for acceptable limits of exposure. Mitigation Measures The potential mitigation measures will be addressed to reduce noise levels by control at source, isolation of high noise generating sources, use of protective measures especially in high noise areas and development of greenbelt. Impact on Ecology Impacts on aquatic species especially during dry season will be assessed particularly those which are endangered, if any. The parameters, which are of concern, are TSS, TDS, heavy metals, oil and grease, pH and temperature. The assessment will also include impacts of chlorinated organic chemicals. The impact of site preparation activities involving site clearing, excavation, earth moving, dewatering or impounding water bodies and developing burrow and fill areas will be assessed. Recommendations will be made to mitigate such adverse impacts as soil erosion and habitat loss. In addition, impact of fugitive dust emissions will be assessed on the surrounding species of economic/genetic/biological importance. Impact on Water Use Impact Assessment The impacts of the proposed project due to water usage and wastewater discharges will be addressed covering the following: • Habitat conditions; and • Recreation resources and aesthetics. Mitigation Measures The mitigation measures will be addressed ensuring the present and anticipated future water requirements for various purposes. The measures also address the need to maintain or improve the existing Class of Water (as per CPCB) to ensure that the current/proposed uses are not impaired due to deterioration of the water quality. Thus, this may be considered as new project. 1.2 BACKGROUND OF THE PROJECT AND PROPONENT Gujarat State Electricity Corporation Limited (GSECL) is a Government of Gujarat company, incorporated in August 1993 and is registered under the Companies Act, 1956 with the objective to initiate a process of restructuring of Power Sector and to mobilize resources from the market for adding to the generating capacity of the State and improving the quality and cost of existing generation. The Company was promoted by erstwhile Gujarat Electricity Board (GEB) as its wholly owned subsidiary in the context of liberalization and as a part of efforts towards restructuring of the Power Sector. The Memorandum and Articles of Association of GSECL envisage a wide spectrum of activities to improve the electricity infrastructure of Gujarat. GSECL has initiated its activities in the field of generation of power. The Government of Gujarat (GoG) has also given GSECL the status of Independent Power Producer (IPP) with approval to undertake new power projects. The Company commenced its commercial operation in the year

1998. However, the operations of GSECL were limited to Power Stations units Gandhinagar 5, Wanakbori 7, Utran GBPS & Dhuvaran CCPP till the complete unbundling of erstwhile GEB was undertaken, i.e. up to 31st March 2005. At present, GSECL is having existing generation capacity of 6156 MW as under: (a) Coal Based: 4190 MW. (b) Lignite Based: 290 MW. (c) Gas Based: 1105 MW. (d) Hydel : 547 MW. (e) Renewable: 24 MW. GSECL has proposals of capacity enhancement by adding another 6400 MW coal based TPP. To meet the demand of coal for its power plants, GSECL has ventured into the area of coal mining and Ministry of Coal have allotted the Gare Palma coal block in Raigarh District of Chhattisgarh to GSECL. The Gare Palma Sector-I Coal Mine is located in the south-eastern part of Mand-Raigarh coalfield and is about 35 km northeast of Raigarh, which is also the district head quarter. The block covers an area of about 57.39 km2 and fall within Survey of India Toposheet Nos. 64 N/8 & 12 (R.F. 1:50,000). The present proposal is for Phase 1 of Gare Palma Sector 1 Coal Mining project. The location plan (map) of the proposed mine is attached. Mineral Exploration Corporation Ltd., Directorate of Geology & Mines, Chhattisgarh and Shreeram Gemicon have carried out detailed exploration in Gare Palma Sub Block B, C, D, E, F and Sub Block A respectively, involving various activities like geological mapping, surveying, drilling, lithological logging, coal sampling, chemical analyses, sample generation to conduct special tests, geophysical logging etc. The topography of Gare Palma Area is mostly covered by softer horizon and in general represents an undulating terrain, more resistant sedimentary rocks stand out as ridges, rising as high as 580m (Silot Pahar) in the north west and 600m (Morga Pahar) in the north east. General topography of the block is highly undulating. The range of elevation in the area varies from 270.0 m to 318.0 m above MSL. The general slope is from south- east to northern-westerly direction. Kelo River is flowing in the western part of the proposed area and it constitutes the main drainage system. The coal evacuation area falls in the West of Kelo River. The main subsidiary stream channels draining in the block flow from north-west and south-east & joins the Kelo River at the extreme western part of the area. This subsidiary stream channel is fed by number of small tributaries rising from hills both from north and south. The drainage pattern of the coalfield is characterized by the southerly flowing perennial with its tributaries constitute the main drainage of the area. The Kelo River, a tributary of , drains the eastern part of the coalfield. A public road from village Kunjemura located in the Western side of the Kelo river to village Aamgaon located in the extreme East of the block has been proposed to be diverted along the Northern fringe of the block. At village Kunjemura the road connects to the road to Tamnar. Due to presence of power plant and other structures of JSPL in the Western part of the Kelo River, only the part of the block in the Eastern side of the Kelo River has been considered for mining in the Phase.1.

The Mining Plan for the project has been prepared by M/s Central Mine Planning & Design Institute Ltd, Ranchi. In Phase-1 of the Mining Plan of Gare Palma Sector-I coal block, the area east of Kelo River has been divided into two parts, namely Part-A and Part-B. The proposed quarry area is Part-A and the rest of the area in the East of Kelo River is Part-B. It has been proposed that opencast mining shall be done in Part-A of the block up to Seam VI - Local (with open pit floor being Seam VI-Local) and the overburden removed during mining operation shall be dumped in Part-B. All coal seams in Part-B of the block, major part of which will be covered by the overburden dump, and in future, coal seams lying below the proposed open pit are proposed to be mined by underground method. The area proposed to be covered by overburden dump will be around 14.48 km2. 1.3 BRIEF DESCRIPTION OF THE PROJECT The description of the project is summarized in Table 1.1 as salient features. The quarry has been proposed to be opened from the location where seams are located in the shallowest depth. This allows early revenue for the project. The proposed location of the box cut is almost in the middle of the northern boundary of the quarry, along the common boundary with Gare Palma Sector IV/III. After one year, the X-top seam is envisaged to be reached promoting revenue inflow to the project. The mined coal is proposed to be carried by trucks to the receiving hopper of conveyor to be installed in the North-West corner of the quarry. Initially the quarry is proposed to be advanced primarily in all three directions of East, West and North. Once the full strike of the seams is reached, the quarry is proposed to be advanced only towards south, along the dip of the seams. To carry coal to the surface from the advancing coal faces, after the full strike is reached, three high angled conveyors are proposed to be installed in three coal horizons. The uppermost high angle conveyor will be installed in the North-West corner at the end of 4th year of the mine operation at 190m RL. to cater coal from the upper coal horizon i.e seams X-top & X-bot, IXL2 and IXL1. The middle high angle conveyor will be installed at the end of 5th year of the mine operation at 130m RL. to cater coal from the middle coal horizon i.e seams Local-1, IX, Local-2, VIII and VII. The lowermost high angle conveyor is proposed to be installed at the end of 8th year of mine operation at 100m RL for lifting mined coal to the surface from all the splits & merged seams of seam VI and seam VI-local. As the face will advance, three conventional conveyors to be laid in the floors of seam X-bot, seam IX and seam VI(A+B+C+D) / VI-Local respectively and will be discharging to the above three fixed high angle conveyors. These conventional conveyors are proposed to be regularly be advanced in the direction of face movement, at intervals of five years.

2.2.2 Drilling and Blasting The site preparation will be carried out by the sufficient number of dozers provided in the project. The blast hole drilling is to be done in patterns decided in advance depending on the strata hardness. At intervals, site trials need to be carried on for revising the patterns to decide maximum charge (explosive) per delay. Blast hole drills of 311 mm dia will be used for top OB only. Drills of 160 mm dia will be used for drilling of partings. No drilling is required for mining of coal by Surface Miner. Blasting technology is the process of fracturing material by the use of a calculated amount of explosive so that a predetermined volume of material is broken. Improper or poor practices in blasting can have a severely negative impact on the economics of a mine. There are different types of explosives used today. Common explosives used in mine now are ANFO (ammonium nitrate/fuel oil), slurries, and emulsions. Selection of explosives depends on many factors, which primarily includes critical diameter, hydrostatic pressure, temperature, minimum primer weight, density weight strength, bulk strength, gap sensitivity, water resistance, loading procedures, coupling or decoupled properties, shelf life, reliability for bulk operations and overall drilling and blasting economics.. In opencast mining, the main objective of blasting is to extract the largest possible quantity at minimum cost. The blasting operation must be carried out to provide quality and quantity requirements of production in such a way that overall profit of mining are maximized. Drill diameter depends upon property of the rock, bench height etc. 2.2.3 Dumping Strategy Dumping has been proposed in the west of the quarry extending up to the Kelo River. Rear dumpers of 240T and 100T have been proposed to transport OB from uppermost strata and interburdens, respectively. As soon as sufficient void is created in the quarry, it is proposed to start back filling. In the initial years dumpers will play from both the east and west batters of the quarry for backfilling. This will reduce the lead of plying appreciably. It is to taken care of that high angled conveys are so installed, that sufficient space if left below it in the haul roads for movement of 240T/100T dumpers. Surface conveyor will feed coal to the washery. After coal being washed in the washery, it will be conveyed to the railway wagons in the proposed siding through Pipe Conveyor and Silo.

The region, where the project is situated people is mostly dependent on agriculture and mineral resources. The developments of mining in the area provide direct and indirect employment opportunities, infrastructure development, communication and development socio- economic infrastructure. The important benefits accruing from the project can thus be stated as - boost to local and regional economy, direct contribution to the state exchequer. 2.3.2 Importance to the Country and Region Coal mining industry plays an important role in economic sector in India. Coal mine is an important role play for major production of power. The coal is also use in different sectors according to their use as fuel like metallurgical, cement, brick kilns etc. Coal is an important feedstock in production of a wide range of chemical fertilizers and other chemical products 2.3.3 India and coal based power plants More than 62% of India's electricity demand is met through the country's vast coal reserves. Public sector undertaking National Thermal Power Corporation (NTPC) and several other state level power generating companies are engaged in operating coal-based thermal power plants. Moisture is an important property of coal, as all coals are mined wet. Groundwater and other extraneous moisture are known as adventitious moisture and are readily evaporated. Moisture held within the coal itself is known as inherent moisture and is analyzed quantitatively. Moisture may occur in four possible forms within coal: ▪ Surface moisture: water held on the surface of coal particles or macerals ▪ Hydroscopic moisture: water held by capillary action within the micro fractures of the coal ▪ Decomposition moisture: water held within the coal's decomposed organic compounds ▪ Mineral moisture: water which comprises part of the crystal structure of hydrous silicates such as clays Total moisture is analyzed by loss of mass between an untreated sample and the sample once analyzed. This is achieved by any of the following methods; 1. Heating the coal with toluene 2. Drying in a minimum free-space oven at 150 °C (302°F) within a nitrogen atmosphere 3. Drying in air at 100 to 105°C (212 to 221°F) and relative loss of mass determined Methods 1 and 2 are suitable with low-rank coals, but method 3 is only suitable for high-rank coals as free air drying low-rank coals may promote oxidation. Inherent moisture is analyzed similarly, though it may be done in a vacuum. Volatile Matter Volatile matter in coal refers to the components of coal, except for moisture, which are liberated at high temperature in the absence of air. This is usually a mixture of short- and long-chain hydrocarbons, aromatic hydrocarbons and some sulfur. The volatile matter of coal is determined under rigidly controlled standards. In Australian and British laboratories this involves heating the coal sample to 900 ± 5 °C (1650 ±10 °F) for 7 min. Ash Ash content of coal is the non-combustible residue left after coal is burnt. It represents the bulk mineral matter after carbon, oxygen, sulfur and water (including from clays) has been driven off during combustion. Analysis is fairly straight forward, with the coal thoroughly burnt and the ash material expressed as a percentage of the original weight. It can also give an indication about the quality of coal. Ash content may be determined as air dried basis and on oven dried basis. The main difference between the two is that the latter is determined after expelling the moisture content in the sample of coal. Fixed carbon The fixed carbon content of the coal is the carbon found in the material which is left after volatile materials are driven off. This differs from the ultimate carbon content of the coal because some carbon is lost in hydrocarbons with the volatiles. Fixed carbon is used as an estimate of the amount of coke that will be yielded from a sample of coal. Fixed carbon is determined by removing the mass of volatiles determined by the volatility test, above, from the original mass of the coal sample. The Coal at Project In the case of the project, the Moisture content of the seam varies from 3.90% to 10.70%. The Ash% of seam varies from 24.20% to 56.10%. The GCV varies from 2440 to 5220 kcal/kg. 2.4 DEMAND AND SUPPLY GAP 2.4.1 Coal Production Through sustained program of investment and greater thrust on application of modern technologies, it has been possible to raise the production of coal from a level of about 70 million tonnes at the time of nationalization of coal mines in early 1970's to 638.05 (Prov.) million tonnes (All India) in 2015-16. limited and its subsidiaries accounted for 538.75 million tonnes (including Gare-Palma block) during 2015-16 as against a production of 494.23 million tonnes in 2014-15 showing a growth of 9%. Singareni Collieries Company Limited (SCCL) is the main source for supply of coal to the southern region. The company produced 60.38 million tonnes of coal during 2015-16 as against 52.54 million tonnes during the corresponding period last year. Small quantities of coal are also produced by TISCO, IISCO, DVC and others. 2.4.2 Coal Distribution and Marketing The Marketing Division of CIL coordinates marketing activities for all its subsidiaries. CIL has set up Regional Sales Offices and Sub-Sales Offices at selected places in the country to cater to the needs of the consuming sectors in various regions. 2.4.3 Import of Coal As per the present Import policy, coal can be freely imported (under Open General License) by the consumers themselves considering their needs based on their commercial prudence. Coking Coal is being imported by Steel Authority of India Limited (SAIL) and other Steel manufacturing units mainly to bridge the gap between the requirement and indigenous availability and to improve the quality. Coal based power plants, cement plants, captive power plants, sponge iron plants, industrial consumers and coal traders are importing non-coking coal. Coke is imported mainly by Pig-Iron manufacturers and Iron & Steel sector consumers using mini-blast furnace. Stating the reasons for gap in demand and supply, it said, is the limited availability of requisite quantity and quality of the fossil fuel and constrained growth in indigenous coal availability and infrastructural and operational bottlenecks in coal transportation in major coal bearing states of Jharkhand and . Of the total supplies of 699.97 MT, 550 MT is likely from Coal India, 56 MT from Singareni Collieries Company Ltd and 93.97 MT from others, including captive coal blocks, the government data said. State-owned Coal India, which accounts for over 80% of the domestic coal output, missed the production target for 2014-15 by 3%, recording an output of 494.23 MT. The company’s output target was 507 MT for the last fiscal. The government may set a target of 550 MT coal output for Coal India in the current fiscal. It has also set an ambitious target of raising the output of state-owned Coal India to one billion tonnes by 2019-20. 2.6 EXPORT POSSIBILITY Indian thermal coal imports look to have peaked in mid-2015, and are now set to permanently and rapidly decline. The IEA’s forecast of sustained thermal coal import growth into India looks outdated even as the latest 2015 report was printed,” he said. The accelerating rate of decline in thermal coal imports into India is entirely consistent with Energy Minister Piyush Goyal’s target to cease thermal coal imports by 2017, with the exception of a few coastal power plants. In its June 2015 forecast, the Australian Government’s Office of the Chief Economist (OCE) predicted domestic Indian coal production would only grow in line with the 2% annual growth achieved in the five years to 2013/14. However, Coal India Limited has reported its April-December 2015 coal production rose 9.1% yoy and coal dispatches rose at a higher 9.8% yoy as the rail system roadblocks are progressively removed. Coal India (CIL) intends to export coal and is in talks with power companies in Bangladesh for striking supply deals. This is for the first time CIL would be exporting the fossil fuel on a commercial basis. Coal India subsidiaries and North plan to supply coal to Bangladesh power companies. Coal is likely to be transported to Haldia port in West Bengal from where it could be forwarded through sea route to ports in Bangladesh. 2.7 DOMESTIC/EXPORTS MARKETS Coal India (CIL) intends to export coal and is in talks with power companies in Bangladesh for striking supply deals. This is for the first time CIL would be exporting the fossil fuel on a commercial basis. Coal India subsidiaries Bharat Coking Coal and plan to supply coal to Bangladesh power companies. Coal is likely to be transported to Haldia port in West Bengal from where it could be forwarded through sea route to ports in Bangladesh. "CIL's coal is likely to be cheaper than the ones supplied from Indonesia because we would save on logistics. The coal produced by these two subsidiaries is of high quality that can compete with Indonesian coal," a Coal India official said. At present, power companies in the country are full-to brim with 22 days of fossil fuel stocked and are going slow on fresh procurement. Having grown at around 10% last year, Coal India is saddled with some 55 million tonnes of pithead stock.

PPRROOJJEECCTT DDEESSCCRRIIPPTTIIOONN 3.1 TYPE OF PROJECT INCLUDING INTERLINKED AND INTERDEPENDENT PROJECTS, IF ANY As per notification of Ministry of Environment, Forest and Climate Change (MoEF&CC), New Delhi dated 14.09.2006, as amended, it is mandatory to obtain environmental clearance of all coal mining projects >150 ha from Central Ministry of Environment, Forest and Climate Change as it falls under category A project. As the area considered for the mining project in Phase –I is 3583.81 ha (including Query excavation 1620.31 ha, external OB dump 1447.50ha, future underground mines 40.6ha and coal washery 40.0ha, Colony for Opencast and washery 47.57ha and other infrastructure 387.83ha) This falls under category ‘A’ of Schedule of EIA Notification 2006. 3.3 DETAILS OF ALTERNATE SITES CONSIDERED AND THE BASIS OF SELECTING THE PROPOSED SITE, PARTICULARLY THE ENVIRONMENTAL CONSIDERATIONS GONE INTO SHOULD BE HIGHLIGHTED. No alternative sites are considered because Gare Palma is a rich coal block and this specific mine block is allotted to Gujarat State Electricity Corporation Limited by Government of India, Ministry of Coal; the Nominated Authority vide order no.103/27/2015/NA dated September 14, 2015. 3.4 SIZE AND MAGNITUDE OF OPERATION The ultimate peak rated capacity from Open cast mine will be 15MTPA. An integrated Washery of 15MTPA capacity is also proposed at the pit head. Coal conveyed from the quarry through high angle conveyors are proposed to be discharged into receiving hoppers of surface conveyors. Surface conveyors will feed coal to the Washery through Ground Bunkers and Reclaim Feeders. After coal is washed, both washed coal and reject will be conveyed to the railway wagons in the proposed railway siding through Pipe Conveyor & Silo with Rapid Loading arrangements. 3.4.1 Coal Washing A two-product (viz. washed coal & rejects) non-coking coal washery has been conceptualized for washing of coal from Gare-Palma Sector-I Block. Washed coal for supply to thermal power plants and rejects for sale through MoU route have been considered. • Source & its Distance: proposed Central Sub-station 132/33 kV adjacent to washery site • Available voltage: 33 kV Methodology for Raw Coal Supply: • Supply of raw coal (-100mm) by belt conveyor from mine CHP to screen-cum-crusher house in the washery site. • Crushing of raw coal down to 50mm & storage of crushed coal in stack tube (32000 t). The total annual raw coal throughput capacity of the proposed washery has been considered as 15.0 MT. However, keeping in view the production programme of the opencast mine, it has been envisaged that construction of 15.0 MT washery will be done in a phased manner. Based on the average GCV value of 3628 kcal/kg, the overall quality of raw coal feed to the proposed washery, has been projected as Grade G-13. Thus, for projection of yield, the likely average ash of raw coal feed to the proposed washery has been considered as 43.5% considering average GCV as 3628 kcal/kg and moisture of 6.0%. The daily and hourly annual average raw coal input capacity of this washery as envisaged is given below: a) Annual: 15.0 MT b) Daily : 64000 T c) Hourly: 3500 T Methodology for Evacuation of Washed Coal: Conveying of washed coal from covered washed coal storage (45000 t) by pipe conveyors to 2 nos. Silos (4000 t each) at proposed Railway siding (about 2.1 km from washery site) for loading into Railway wagons through Rapid Loading System @ 5500 tph. Methodology for Evacuation of Rejects: Rejects produced from the washery will be conveyed to temporary reject storage site for sale through MoU route. In case the distance to which the rejects are to be transported is less than 10 km, provisioning of conveying of rejects by belt conveyor is to be envisaged. In case the same is beyond 10 km, then suitable arrangement for loading and dispatch of rejects through Silos, Rapid Loading System, Railway Siding etc. is to be envisaged. Provisioning of pipe conveyor from washery to a separate silo has been provisioned for dispatch of rejects through railway wagons for long distances. Environmental Aspects: • The process of the proposed washery is based on closed water circuit system. • Pumped out mine water will be used for industrial use of washery. • All the water fed into the system will be collected after use and re-circulated after treatment in various units and no effluent will be allowed to escape into the natural drainage system. • Provisioning of slime ponds for re-handling coal slurry in case of emergency and re-circulation of clarified water.

3.4.2 Equipment Configuration Open Cast Mining: Considering requirement of removal of huge volume of top OB, Electric Rope shovels of 42cum with 240T Rear Dumpers have been proposed for the purpose. Drills of 311mm diameter and dozers of 850-860 hp have been provided to drill blast holes in the top strata and doze the face & the waste material in the dump site, respectively. The partings between the seams have been proposed to be removed by hydraulic shovels of 10-12 cum in association with 100T dumpers. 850-860 hp Dozers fitted with ripper attachment have been proposed for removal of thin partings, wherever required. 160mm drills and 410 hp dozers have been proposed for drilling blast holes and dozing. For mining of coal, surface miner of 100t weight has been proposed. Front end loaders of 10-12 cum in association with 60T Rear Dumpers have been proposed for loading and transporting of coal to the conveyors in the batter. However, coal will be used as raw material for the washery. Finished goods are the Washed coal after washing. The marketing area for final product (coal) is the existing and upcoming power plants of GSECL. 3.7 RESOURCE OPTIMIZATION/RECYCLING AND REUSE ENVISAGED IN THE PROJECT, IF ANY, SHOULD BE BRIEFLY OUTLINED Reclamation by internal dumping is the objective of the project for sound environmental management and reuse of over burden. Before internal dumping becomes possible, external Dumping has been proposed in the lease area west of the quarry extending up to the Kelo River. The OC quarry will be backfilled with overburden as soon as sufficient void is created in the quarry. The backfilling will be carried out in a phased manner. Once the backfilling has reached a certain predetermined reduced level, the plots will be leveled, graded and cleared of large stone pieces lying on the surface. The slope of the ground will be made very gentle as far as possible (preferably less than 2%). The graded and leveled area will be divided into small sectors and small check bunds will be constructed to retain moisture and humus in the soil. The outer slope of each bench will be kept at the natural angle of repose of the spoil material and at overall slope angle of 20o considering all benches. Rear

In the initial years dumpers will ply from both the East and West batters of the quarry for backfilling. This will reduce the lead of plying appreciably. It is to taken care of that high angled conveys are so installed, that sufficient space if left below it in the haul roads for movement of dumpers. Dumping has been proposed up to a maximum height of 90 meters above the ground level both for external and backfilling to reduce degradation of less land. Height of 90 meters has been proposed with three decks of height of 30 meters each. During the construction stage water requirement will be met through the existing water bodies of the area and rain water harvesting within the project area. During initial operation stage, water will be accumulated in the existing water bodies inside the lease area by diverting rain water from the entire lease area by rain water harvesting as possible. After sufficient mine voids are created, rain and mine water collected in sumps will be used as a source of water needed for the various purposes at mine viz. plantation, dust suppression etc. 3.8 AVAILABILITY OF WATER ITS SOURCE, ENERGY/POWER REQUIREMENT AND SOURCE SHOULD BE GIVEN The total water requirement for the mines and washery is estimated to be about 10.538 MLD. This includes process water as well as domestic water. Water will be treated for both industrial and domestic use. The details of the water use is given in Table 2.13.

3.8.1 Source of Water Initially during the construction stage and initial operational phase water requirement will be met through the existing water bodies of the area by rain water harvesting. During the later stage, water requirement will be fulfilled through mine water. In general the source of water in the quarry is: ▪ Direct rainfall in the open excavated area ▪ Inflow of water from back filled area due to rainfall on it ▪ Inflow of water from area beyond excavation. ▪ Seepage of water from strata water / ground water

The rainwater intake to the open cast mine is non-uniform during the year. The maximum rainwater intake will be between June to September in a year. The average annual rainfall is about 1,587 mm. Considering run off co-efficient as 0.1 in the catchment area, which is mostly a green field area, the average annual run off from the lease area will be about 657 m3/h. The peak run off during highest hourly rain fall will be much higher. During working stage, the run-off will be collected from internal dump by foot drain for diverting to sump on mine floor for pumping. Pumped out mine water will mostly be used for mining purposes. Pumping provision of about 771 m3/h has been considered in the first year in the Mine Plan. This is sufficient to meet industrial and potable water requirement of open cast & future underground mine and the washery, which is about 540 m3/h. The mine water will be used after proper treatment. However, if permitted, water from Kelo River may be drawn to substantiate any emergency requirement. Application has been submitted to State Irrigation Department for the permission to draw water from Kelo River. The total Potable water requirement for drinking is envisaged as 2.048 MLD. Punjipathara village is situated half way on Raigarh-Gharghoda main road. The distance from Raigarh to Gharghoda is around 40 km. From Punjipathara the road leads to the Gare Pelma area via Tamnar village situated at a distance of 10 Km. on Punjipathara- Lelunga road, which passes through the block. Tamnar is situated in the southwestern part of the Gare Pelma Sector-I Coal Block. It is about 35 km north-east of Raigarh, the district head quarter which is also the nearest railway station on Mumbai-Howrah main line of SE railways. A small part of road is to be laid through the PF area to connect to the existing road. Washed coal will be reclaimed from covered washed coal storage (45000 tonne) and conveyed by belt conveyors to 2 nos. Silos (4000 tonne capacity each) at proposed Railway siding (about 1500 m from washery site) from where it will be loaded into Railway wagons through Rapid Loading System (@5500 tph) and dispatched to consumers. To cater to the needs of dispatch of washed coal, adequate number of silos, Rapid loading system, Railway siding etc. has been envisaged in the provisions of the CHP. 262.56m (borehole MGP-45) and maximum ground elevation is 311.13 m (borehole MGP-3) pertaining to sub block ‘B’. However, in phase-I side, RLs of maximum of 318.00m and minimum 244m can be seen in the surface contour plan of the block. Kelo River is flowing in the western part of the present area and it constitutes the main drainage system. The main subsidiary stream channels draining in the block flow from north-west and south-east & joins the Kelo River at the extreme western part of the area. This subsidiary stream channel is fed by number of small tributaries rising from hills both from north and south. The drainage pattern of the coalfield is characterized by the southerly flowing perennial Mand River with its tributaries constitute the main drainage of the area. The Kelo River, a tributary of Mahanadi, drains the eastern part of the coalfield. A public road from village Hukraodepa (Kunjumepa) located in the western side of the Kelo River to village Amgaon located in the extreme east of the block has been proposed to be diverted along the northern fringe of the block. At village Hukraodepa (Kunjumepa) the road connects to the road to Tamnar. 4.4 EXISTING LAND USE PATTERN (AGRICULTURE, NON-AGRICULTURE, FOREST, WATER BODIES (INCLUDING AREA UNDER CRZ)), SHORTEST DISTANCES FROM THE PERIPHERY OF THE PROJECT TO PERIPHERY OF THE FORESTS, NATIONAL PARK, WILD LIFE SANCTUARY, ECO SENSITIVE AREAS, WATER BODIES (DISTANCE FROM THE HFL OF THE RIVER), CRZ. IN CASE OF NOTIFIED INDUSTRIAL AREA, A COPY OF THE GAZETTE NOTIFICATION SHOULD BE INDUSTRIAL AREA; A COPY OF THE GAZETTE NOTIFICATION SHOULD BE GIVEN. The majority of the project area falls in East part of the block. The area for coal evacuation lies in the western part. Major part of the block is covered by cultivated land. Main cultivation is paddy. The soil of the area is having fair to medium range of fertility. A number of villages are found scattered in the block. The villages located within the block area are Budhiya, Baghbadi, Tehli Rampur, Aamgaon, Tapranga, Tangarghat, Telaipara, Dhourabhata, Nagramunda, Jhikabahal, Libra, Jharna, Raipara, Samkera, Mahloi, Khuruslenga, Bijna, Pata, Dolesera and Kunjemura. A strip of Protected Forest occupies the northern part of the project area. The forest constitutes Sal, Teak, Bija, Mango, Neem, Tendu trees etc. No wild animals are found in the study area. However, there is an Elephant Corridors within 10km radius study area. There is no national park, wild life sanctuary and eco sensitive areas within 15 km of the project boundary. Kelo river passing along the west boundary of the project and Nala along the Southern Boundary of the Project. 4.5 EXISTING INFRASTRUCTURE OF BLOCK Public road- A public road from village Hukraodepa (Kunjumepa) located in the western side of the Kelo River to village Amgaon located in the extreme east of the block has been proposed to be diverted along the northern fringe of the block. At village Hukraodepa (Kunjumepa) the road connects to the road to Tamnar.

Jindal Power Plant and Jindal Ash pond- This plant is located in the west side of the Kelo River. In the first phase the activity has only been proposed in the east side of the Kelo River. These structures have not, therefore, been disturbed in this Mining plan. Jindal Washery, Jindal colony fenced area- Part of these structures is located within the Northern boundary of the eastern part of the block. The portion of these structures within the block is to be removed before mining in the area. Piped conveyor connecting Jindal washery and Jindal Power Plant- A piped conveyor runs across the block from east to west for carrying washed coal from Jindal washery to power plant. This conveyor will need to be removed from the block area to allow external dumping and construction of infrastructure for the project. High Tension Power line- High Tension Power line passes diagonally from the central part of the block. This power line will need to be diverted away from the mining area. 4.6 SOIL CLASSIFICATION A major part of the block is covered by a thin layer of soil and alluvium horizon. The weathering has affected all the strata below soil to a varying extent. The thickness of soil ranges from 1.00 to 17.00 m (CMG-30). The depth of weathered zone varies from 3.20 m (MGP-271) to 27.40 m (CGGD-9). 4.7 CLIMATIC DATA FROM SECONDARY SOURCES The region has a tropical monsoon climate with long and humid summers and short winters. The rain fall is heavy during south-west monsoon and light during pre-monsoon season. The monsoon normally begins during June and retracts during mid-September. Meteorology is the key to understand the air quality. The essential relationship between meteorological condition and atmospheric dispersion involves the wind in the broadest sense. Relative Humidity: The maximum Relative Humidity was found during the monsoon season with the month of August recording the highest average at 84%. Wind Speed and Direction: The maximum average wind speed was found to be 5.9 kmph in the month of June. 4.8 SOCIAL INFRASTRUCTURE AVAILABLE The block is connected by road from Raigarh via Punjipathara by state Highway. Punjipathara village is situated half way on Raigarh-Gharghoda main road. The distance from Raigarh to Gharghoda is around 40 km. From Punjipathara the road leads to the Gare Palma area via Tamnar village situated at a distance of 10 Km. on Punjipathara- Lelunga road, which passes through the block. Tamnar is situated in the southwestern part of the Gare Pelma Sector-I Coal Block. It is about 35 km north-east of Raigarh, the district head quarter which is also the nearest railway station on Mumbai-Howrah main line of SE railways. During mining time, shelter, temporary office or other related building will be developed nearby by mine lease area or nearby village. The existing facilities in the proposed area are sufficient. All type of facilities such as Rest House, Hospital, Educational Facilities and communication etc are available in the nearest towns and village. 4.8.1 Health and Educational Facilities The nearest hospital, school and temple are available in Tamnar which are 1.5km, 1.5 km & 2.5km in W direction respectively. The site is well connected to the district headquarter.

5.1.4 PUMPING The pumping system of Gare Palma Sector-I block OCP has been designed to dewater the inflow of water due to precipitation falling within the active pit limit during the monsoon season to enable the mining activity to continue round the year. General topography of the block is highly undulating. The range of elevation in the area varies from 270.0 m to 318.0 m above MSL. The general slope is from south-east to northern-westerly direction. Kelo River is passing along the western periphery of the block. The monsoon in this area usually stretches from June to September. The planning of de-watering of the mine has been done in such a way that as far as possible the working faces remain dry. The layout of the quarry provides suitable gradient along the quarry floors and the benches to facilitate self-drainage of water to the sump at the lowest level of the quarry. The rainwater intake to the opencast mine is non-uniform during the year. The maximum rainwater intake will be between June to September in a year. The average annual rainfall is about 1429 mm as per Indian Meteorological Dept., Raigarh. 5.1.5 SOURCE OF WATER In general the source of water in the quarry is: ▪ Direct rainfall in the open excavated area ▪ Inflow of water from back filled area due to rainfall on it ▪ Inflow of water from area beyond excavation. ▪ Seepage of water from strata water / ground water. 5.1.6 BASIC DATA The following data have been taken into consideration for arriving at the capacity of additional pumps: a. Pumping capacity required on account of rainfall has been computed based on maximum daily rainfall, which will be pumped out in 5 days.

Workshops, stores, statutory facilities, magazine, sub-stations, office complex, different community buildings shall be provided as per technological requirement and a sound living condition for the project people. For the township land requirement has been assessed as about 48 Hectares. In addition there will be requirement of about 390 unskilled manpower for different activities who may be employed by outsourcing means. The unskilled workers may be appointed from the area depending upon the employment policy of the organization as regards outsourcing policy. No manpower has been provided for vehicles to be used in the mine, reclamation equipment, canteen etc. as these activities will be carried on by outsourcing means.

Provisions for colony roads, haul roads, road to for workshops, Magazine road and approach road to mines and colony shall be made as per requirement. 6.2 RESIDENT AREA (NON-PROCESSING AREA) A residential colony will be developed over 47.57 ha of land in project area for opencast mines and coal washery. 6.2.1 GREEN BELT Green belt over an area of 165.55ha will be created along the different corridors and spaces. Plantation will also be carried out on external as well as internal backfilled area. 6.3 SOCIAL INFRASTRUCTURE A residential colony will be set up with facilities of school, health center, community halls, clubs, shopping complexes etc. needed for modern living. An existing road going through the proposed mine boundary needs to be diverted. This Project is providing employment to local people indirectly. 6.5 DRINKING WATER MANAGEMENT (SOURCE & SUPPLY OF WATER) The total Potable water requirement for drinking is envisaged as 2.048 MLD. Drinking water will be sourced from Bore well to be installed after taking necessary clearances from appropriate authority. 6.6 SEWERAGE SYSTEM The sewage from mine, washery and colony will be treated in STP and reused for plantation and dust suppression purposes. 6.7 INDUSTRIAL WASTE MANAGEMENT 6.7.1 SOLID WASTE MANAGEMENT Overburden & soil will be the waste material, which will be generated during mining. Top soil is proposed to be removed and stacked in temporary storage areas. Soil is scraped separately, so that it is not mixed in OB rock. Topsoil from unbroken excavation areas will be scraped for progressive and concurrent utilization during physical/technical reclamation of backfilled area, thus obviating the necessity of large storage area of topsoil separately. Reclamation by internal dumping is the objective of the project for sound environmental management and reuse of over burden. Before internal dumping becomes possible, external dumping has been proposed in the west of the quarry extending up to the Kelo River. The OC quarry will be backfilled with overburden as soon as sufficient void is created in the quarry. The backfilling will be carried out in a phased manner. Once the backfilling has reached a certain predetermined reduced level, the plots will be leveled, graded and cleared of large stone pieces lying on the surface. The slope of the ground will be made very gentle as far as possible (preferably less than 2%). The graded and leveled area will be divided into small sectors and small check bunds will be constructed to retain moisture and humus in the soil. The outer slope of each bench will be kept at the natural angle of repose of the spoil material and at overall slope angle of 20o considering all benches. Rear dumpers of 240T and 100T have been proposed to transport OB from uppermost strata and interburdens, respectively. In the initial years dumpers will ply from both the East and West batters of the quarry for backfilling. This will reduce the lead of plying appreciably. It will be taken care that high angled conveys are so installed, that sufficient space if left below it in the haul roads for movement of dumpers. Dumping has been proposed up to a maximum height of 90 meters above the ground level both for external and backfilling to reduce degradation of less land. Height of 90 meters has been proposed with three decks of height of 30 meters each. 6.7.2 POWER REQUIREMENT Gare Palma is an important coal block of Mand-Raigarh coalfield having substantial coal reserve. Overall development of this block consists of coal mining operation covering both underground and opencast mines as well as coal beneficiation plant. It will require deployment of a number of large coal mining equipment and other auxiliary installations like dewatering pumps, coal handling plant, workshop, coal dispatch arrangement, water treatment plant, workshops, residential complex etc. It is estimated that total power demand from this block will be around 40-45 MVA.

To meet this demand, it is envisaged that one number 132/33 kV, Central Substation with an installed capacity of 2x40 MVA shall be installed. This substation shall receive power at 132 kV from Gherwani substation of CGPCL through a double circuit overhead transmission line. Approximate distance of Gherwani from the coal block is around 20 km. This central substation shall be used to feed power to all installations of the blocks including opencast quarry, underground mine and coal beneficiation plant. It is envisaged that proposed 2 X 40 MVA, 132/33 kV substation shall have provision for 2 nos. incoming 132 kV feeders and 8 nos. outgoing 33 kV feeders. The transformers for the substation have been selected considering maximum demand of the project and 100 % stand-by transformation capacity. 132 kV SF6 circuit breakers shall be used for primary control of the 132/33 kV transformers and incoming 132 kV feeders. Necessary CTs and PTs and other measuring and protective devices shall also be provided. Outdoor type 33 kV VCBs will be used for secondary control of transformers, control of 33 kV outgoing feeders and as a bus-coupler. Necessary protections against over current, short circuit and earth fault for all incoming and outgoing circuit breakers and transformers have also been envisaged. It is also envisaged to have an auxiliary bus at 33 kV side of the substation for improve reliability and maintenance purpose. The substation shall be installed at a suitable central for smooth and uninterrupted supply of power to different power consuming centers of the block. Functions of 8 nos. outgoing 33 kV feeders are envisaged as follows: 1. Opencast Project - 3 nos. 2. Coal beneficiation plant - 2 nos. 3. Residential Complex - 1 no. 4. Reserve - 2 nos. In the proposed opencast project of the block, large electrical driven equipment has to be deployed. These are main heavy earth moving machinery, dewatering pumps, coal handling plant, in pit conveying system, workshop, illumination system etc. With these electrical driven equipment, it is estimated that power requirement for the proposed opencast project in the block will be around 25 MVA. To meet this demand of the project, it is envisaged to install three numbers of 33/6.6 kV substations at the different suitable locations in the project. Out of these three substations, two substations each of capacity 2 X 16 MVA, 33/6.6 kV will exclusive to the quarry load of the project. These are mainly HEMMs, dewatering pumps, in pit conveyors and quarry illumination. One substation of capacity 2 X 10 MVA, Mining Plan for Gare Palma sector-I Coal Block, Mand 33/6.6 kV will exclusive to the surface load of the project. These are mainly coal handling plant, workshop, surface illumination and other miscellaneous load. All these three substations will receive power at 33 kV from 2 X 40 MVA, 132/33 kV central substation through three numbers of 33 kV overhead transmission lines. Normally each substation will receive power through one number of 33 kV feeder. It is envisaged that all three substations will be interconnected through a 33 kV ring main system. In case of breakdown of any feeder, substation can receive power with other feeder through the ring main system. Further, it is envisaged that all the three proposed 33/6.6 kV substations shall have provision for 2 nos. incoming 33 kV feeders and 10 nos. outgoing 6.6 feeders. The transformers for the substation have been selected considering maximum demand of the project at overall power factor of 0.98, and 100 % stand-by

The main transformers of the substations shall be provided with neutral ground resistor to limit the neutral current as required by statutory provisions. 33 kV VCBs shall be used for primary control of the 33/6.6 kV transformers and incoming 33 kV feeders. Necessary CTs and PTs shall also be provided. Outdoor type 6.6 kV VCBs will be used for secondary control of transformers, control of 6.6 kV outgoing feeders, bus-coupler and capacitor bank control. Necessary protections against over current, short circuit and earth fault for all incoming and outgoing circuit breakers and transformers have also been envisaged. To maintain power factor at 0.98, capacitor bank of suitable capacity with automatic power factor correction relay shall be provided. Necessary provision of automatic fire protection of transformers along with portable fire extinguishers has been envisaged for fire protection in the substations. These substations shall be installed near the quarry at suitable location for supply of power to different equipment of the project.

8.1 LIKELY DATE OF START OF CONSTRUCTION AND LIKELY DATE OF COMPLETION (TIME SCHEDULE FOR THE PROJECT TO BE GIVEN) The Schedule of Implementation for Gare Palma Sector I, Phase-I, Open Cast Mining Project and integrated Washery Project is proposed by CMPDIL is attached(Annex 3 and 4) here with and it is closely monitored by Ministry of Coal. Thereby as per Mining Plan, the proposed mining life is 34 years (including to 2 years for construction). The mine life may increase or decrease accordingly to the actual rate of production. The closure of mine involving technical aspects, environmental aspects, socio-political aspects and financial assurances for implementing post-closure activities will run for three years. 8.2 ESTIMATED PROJECT COST AND ALONG WITH ANALYSIS IN TERMS OF ECONOMIC VIABILITY OF THE PROJECT Estimated Capital Cost, for the project is Rs 15280.13 crores prepared prior to mining plan preparation. Detailed Project Report, for analysis in terms of economic viability of the project, is under preparation by M/s Central Mine Planning & Design Institute, Ranchi, after preparation of Mining Plan.

WHEREAS, the nominated authority has, in accordance with the provisions the Coal Mines (Special Provisions) Act, 2015 (the "Act") and the Coal Mines (Special Provisions) Rules 2014 (the "rules") conducted the allotment of the relevant Schedule I coal mine;

AND WHEREAS the allottee is eligible to receive this allotment order with respect to the mine, including, inter-alia -

(a) the coal bearing land acquired by the prior allottee and the lands, in or adjacent to the coal mines used for coal mining operations acquired by the prior allottee; and

(b) any existing mine infrastructure as defined in clause O of sub-section (l) of section 3 of the Act;

AND WHEREAS the allottee has furnished performance bank guarantees dated a) Aprl|22, 2015 for an amount equal to INR 2,00,00,00,000 (Indian Rupees Two Hundred Crore) issued by Indian Overseas Bank and b) April 23,2015 for an amount equal to INR 97,00,00,000 (Indian Rupees Ninety Seven Crore) issued by State Bank of India in accordance with the allotment document and in accordance with the provisions of sub-section (6) and sub-section (12) of section 8 of the Act;

AND WHEREAS the allottee has entered into an Allotment Agreement dated March 30, 2015 (as amended) with the nominated authority in accordance with the provisions of sub- rule (5) of rule 13.

NOW, THE NOMINATED AUTHORITY DOES ORDER:

l. on and from September 14, 2015 ("allotment date") and in accordance with sub- section (a) of section 8 read with sub-section (12) section 8 of the Act, with respect to

the mine, the following shall stand fully and absolutely transferred and vested in the allottee, namely: -

(a) all the rights, title and interest of the prior allottee in and over the land and mine infrastructure free from all encumbrances, (b) entitlement to a mining lease to be granted by the State Government with the terms and conditions of the Allotment Agreement forming a part of it on making an application; (c) all statutory licences, permits, permissions, approvals or consents as per rules, required to undertake coal mining operations in the mine, if already issued by the Central Government, to the prior allottee on the same terms and conditions as were applicable to the prior allottee, as listed in the Annexure 2; (d) entitlement to any statutory licence, permit, permission, approval or consent required to undertake coal mining operations in the mine, if already issued by the Central Government, to the prior allottee on making an application on the same terms and conditions as were applicable to the prior allottee, as listed in the Annexure 3; (e) entitlement to any statutory licence, permit, permission, approval or consent required to undertake coal mining operations in the mine, if already issued by the State Government, to the prior allottee on making an application on the same terms and conditions as were applicable to the prior allottee, as listed in the Annexure 4; (0 rights appurtenant to the approved mining plan of the prior allottee; (g) any subsisting contract in relation to coal mining operations, to which the prior allottee was a party and which is assumed, adopted and continued by the Allottee and listed in the Annexure 5 shall stand novated (by virtue of a deemed consent from the relevant party(ies)), in accordance with the provisions of sub-section (1) of section 11 of the Act in favour of the allottee for the residual term or residual performance of such contract;
