AIRLINE ROUTES AND SECOND HOME TOURISM. THE FRENCH MARKET IN THE ALGARVE Cláudia Ribeiro Almeida1 ABSTRACT The new routes and services provided by low cost carriers enable the emergence of new tourist destinations in Europe and the development of new market segments that value the cheap and easy air accessibilities. One of the best examples is second home tourism (normally associated with residential tourism) that grew in recent years, mainly in tourism destinations in the south of Europe and Mediterranean. One of them is the Algarve that receive nowadays new second home owners coming from several countries, mainly because of the region’ great weather conditions, security and air accessibilities. France is one of the new second home market in Algarve, mainly because of the new Non-Habitual Residents (NHR) regime, that provides to new residents a very attractive tax benefits for their 10 years living in Portugal, as well as the new routes provided by low cost carriers since 2016 to eleven airports of France. INTRODUCTION In recent years, air transport significantly increased the number of flights, routes, destinations and passengers, heavily contributing to the process of airspace liberalisation. This process led to a shift from a management model with heavy state intervention to a competitive market model, allowing the entry of low cost carriers. These carriers have enabled consumers to enjoy a wider range of supply and low airfares (Costa & Almeida, 2018). In Europe, this process began in 1987 in the United Kingdom and Ireland, and strong growth allowed these carriers to capture quickly a large market share (Costa & Almeida, 2018). -

The fundamental changes in ownership also led to a number of major challenges. Existing structures had to be completely reorganised, a task which Unique (Flughafen Zürich AG) successfully mastered. We were able to extract all the airside functions and infrastructures that are essential for airport business from the operations previously controlled by SAirGroup and now under new ownership, and bring them under our own control.This means that we have eliminated all inter- connections with and dependencies on external providers in the area of airside operations. We can therefore look back on a period of extremely intensive activity. But we still have a very busy time ahead of us, partly due to the step-by-step hand-over of components associated with expansion stage 5, but also in view of the political uncertainties throughout the world and their impacts on international civil aviation, and the ongoing debate on the home front concerning the function, size and operation of Zurich Airport. -

Finding a Cause of Action for Wrongful Death in the Warsaw Convention: Benjamins v. British European Airways I. INTRODUCTION The United States Court of Appeals for the Second Circuit decided in Benjamins v. British European Airways' that article 17 of the Warsaw Convention2 is self-executing. That is, the treaty alone, without additional legislative action, now creates a cause of action for wrongful death. The facts of the case are simple; on June 18, 1972, an airplane designed and manufactured by Hawker-Siddely Aviation, Ltd. and owned and operated by British European Airways departed for Brussels from London's Heathrow Airport. Soon thereafter, the plane crashed into a field, killing all 112 passengers. Abraham Benjamins, the spouse of one of the passengers, brought suit for wrongful death and baggage loss in the Eastern District of New York as representative of his wife's estate. Plaintiff was a Dutch citizen permanently residing in California. Defendants were British corporations with their principal places of business in the United Kingdom. The ticket on which the decedent was traveling had been purchased in Los Angeles. The original complaint alleged only diversity of citizenship as grounds for federal jurisdiction;3 because Benjamins, a resident alien, could not be diverse from an alien corporation,4 the complaint was dismissed. Benjamins' suit reached the Court of Appeals for the Second Circuit after the district court, in an unreported decision, dismissed an amended complaint asserting federal question jurisdiction.5 The Second Circuit 1. 572 F.2d 913 (2d Cir. 1978). 2. Social Rights and Ethics Charter Editorial By Alexandre De Juniac The epitome of the values and rights underpinning the AIR FRANCE KLM Group’s identity and cohesion, the Social Rights and Ethics Charter applies to all employees of the two companies and their subsidiaries. An ambitious action plan spanning the Group as a whole, this Charter tackles various issues such as labour relations, ethics requirements and the respect for the environment and sustainable development principles. It highlights our vision of an open, united world, based on both economic responsibility and social and environmental progress. Negotiated with and signed by the staff representatives within the AIR FRANCE KLM European Works Council, this Charter is a prime example of how successful our contractual policy proves to be when it comes to achieving fair, balanced development. Every employee is now encouraged to become acquainted with this Charter and proactively endorse it. 1 Preamble The AIR FRANCE KLM Group and the AIR FRANCE KLM European Works Council (AFKL EWC) have jointly set out in this document the values and fundamental rights which underpin the identity of these two companies, and guide their social and ethics policy. These values and rights are the foundation for social, economic and cultural cohesion within each company and within the Group, which is essential to be able to share in the benefi ts of growth. The purpose of this Charter is to foster a climate of enhanced mutual trust and respect in a work environment in which no form of discrimination or harassment may be tolerated. The development of a work environment favorable to the good economic and commercial performance of the Group and each of its companies, to progress in labour relations and personnel advancement requires continuous and extensive cooperation on the part of all.
