The Richardson City Plan Commission met on June 2, 2015, at 7:00 p.m. at City Hall in the Council Chambers, 411 W. Arapaho Road, Richardson, Texas.

Prior to the start of the regular business meeting, the City Plan Commission met with staff regarding staff reports and agenda items. No action was taken.

MINUTES

1. Approval of the minutes of the regular business meeting of May 19, 2015.

Vice Chair Bright requested a correction to the last page, last paragraph; and Commissioner Springs pointed out a scrivener error on the first page.

Motion: Commissioner Roland made a motion to approve the minutes as corrected; second by Vice Chair Bright. Motion approved 7-0.

2. Revised Site and Landscape Plans – First Baptist Church Richardson (companion to Item 6): A request forDRAFT approval of revised site and landscape plans to reflect a building expansion totaling approximately 57,820 square feet. The 18.9-acre site is located at 1001 N. Central Expressway, northwest corner of Central Expressway and Arapaho Road.

3. 4. Final Plat – Galatyn Urban Center, Lot 1, Block B: A request for approval of a final plat to create a single lot for the development of a four-story multi-family building totaling 388 units, and a parking structure. The 5.36-acre site is located at 1050 Galatyn Parkway, the southwest corner of Galatyn Parkway and Glenville Drive.

Motion: Commissioner Maxwell made a motion to approve the Consent Agenda as presented; second by Commissioner Frey. Motion approved 7-0.

VARIANCE

5. Variance 15-11 – DFC Dominion Gym: Consider and take necessary action on a request for approval of a variance to Chapter 21 of the Subdivision and Development Code for a reduction to the required parking for a martial arts facility. The site is located at 1600 N. Plano Road, the northeast corner of Plano Road and Collins Boulevard.

Mr. Bireima stated the applicant was requesting a variance to the required number of parking spaces for a martial arts facility located in a retail center at the northeast corner of Plano Road and Collins Boulevard.

Mr. Bireima pointed out that in 1991 the property received a twelve (12) space variance to allow circulation improvements for the bank on the north end of the property and with the additional requested reduction in parking the site would be deficient by 67 spaces. Based on comments from the applicant, Mr. Bireima said the gym would require 29 parking spaces.

Mr. Bireima concluded his comments by noting the applicant had provided a floor plan for illustrative purposes and the hours of operation would be 5:00 p.m. to 9:00 p.m. Monday through Thursday; 10:00 a.m. to 3:00 p.m. on Saturday; and closed on Friday and Sunday.

Chairman Hand and Vice Chair Bright asked if the floor plan would become a part of the variance.

Mr. Bireima replied that the floor plan was not an exhibit to the variance.

Commissioner Frey suggested the motion should tie the variance to DFW Dominion Gym.

Chairman Hand asked staff if the variance could be tied to the gym and Mr. Bireima confirmed that it could. DRAFT Vice Chair Bright asked if the applicant would have to come back before the Commission if they wanted to use the lease space for something other than a gym.

Mr. Bireima confirmed the applicant would have to come back before the Commission for another variance and if Dominion Gym vacated the property another tenant could not use the variance.

Mr. Chavez asked the Commission to also consider adding a condition limiting the hours of operation to those listed in the staff report, which would help with any parking concerns.

Motion: Vice Chair Bright made a motion to recommend approval of Variance 15-11 as presented with the additional condition the variance was tied to DFC Dominion Gym and the hours of operation were the same as those listed in the staff report; second by Commissioner Frederick.

Vice Chair Bright asked if the motion also contained a condition to tie the variance to the floor plan.

Commissioner DePuy said it did not and Mr. Chavez pointed out that if the floor plan changed the applicant would have to come back before the Commission.

Motion approved 7-0.

PUBLIC HEARINGS

6. Replat – Meadowglen Addition, Lot 1A, Block B (companion to Item 2): Consider and take necessary action on a request for approval a replat to abandon and dedicate easements necessary to accommodate a building expansion to the existing religious facility campus. The 18.9-acre site is located at 1001 N. Central Expressway, northwest corner of Central Expressway and Arapaho Road.

Mr. Roberts stated the proposed replat was being requested to abandon and dedicate easements necessary for the building expansion approved under Item 2 (First Baptist Church of Richardson), and the replat complied with the City’s subdivision design standards.

With no questions for staff, Chairman Hand opened the public hearing.

No comments or questions were received and Chairman Hand closed the public hearing.

Motion: Vice Chair Bright made a motion to approve Item 6 as presented; second by Commissioner Roland. Motion approved 7-0.

7. Replat – K-Mart Plaza Addition, Lot 1C, Block 1 (companion to Item 3): Consider and take necessary action on a request for approval of a replat to dedicate and abandon easements necessary to accommodateDRAFT a building expansion on the site. The 10.8 acre site is located at 110 W. Campbell Road, northwest corner of Campbell and Alamo Roads.

8. Replat – Telecom Park Addition, Lots 2B and 3A, Block A: Consider and take necessary action on a request for approval of a replat to relocate lot lines. The 18.08 acre site is located 2703 Telecom Parkway and 3200 Research Drive, at the southwest corner of Research Drive and Telecom Parkway.

Mr. Roberts reported the proposed replat would relocate a portion of two sections of the existing property line to allow the building on Lot 2B to gain more parking. He added there were no other improvements planned and the replat complied with the City’s subdivision design standards.

9. Zoning File 15-11 – Bridge Builder Academy: Consider and take necessary action on a request for approval of a Special Permit for a private school to be located at 1221 W. Campbell Road, south side of Campbell Road, east of Mimosa Drive. The property is currently zoned LR- M(1) Local Retail. Applicant:

Mr. Shacklett advised the applicant was requesting a Special Permit for a 3,400 square foot private school in the southeast corner of Building A at 1221 W. Campbell Road and was relocating from their current facility in the City of Plano to be more centrally located for their student population.

Mr. Shacklett stated the school teaches a variety of subjects (reading, spelling, history, etc.) and of the twenty-six students currently enrolled, more than half of that number were being taught in their homes by certified teachers. He added that as part of the applicant’s request, a zoning exhibit would be attachedDRAFT to the ordinance.

Regarding the parking for the site, Mr. Shacklett noted the current parking is at 1:250, an office parking ratio, and since the City does not have a standard parking ratio for schools, the applicant was requesting to maintain the current standards. In addition, staff conducted several parking studies and the most amount of cars parked on the site were ninety cars in a 227 parking space lot.

Mr. Shacklett concluded his presentation by noting one piece of correspondence in opposition had been received from a nearby homeowner; however, the author of the letter did not understand the dynamics of the school and the fact the school did not operate like a regular school with peak traffic times, daily student attendance, outdoor activities, etc. He added that staff also spoke with an adjacent business owner and that individual did not have any concerns with the proposed use.

No questions were asked of staff and Chairman Hand opened the public hearing.

Mr. Michael Bronsky, Director of Operations, Bridge Builder Academy, 1221 W. Campbell Road, Richardson, Texas, stated the diagram showing the proposed location of the school had it in the southwest corner, but the school would actually be located in the northwest corner of the site.

Mr. Shacklett suggested that if the item was approved, the motion should contain wording that the exhibit should be revised to show the location of school in the northwest corner of the Building B.

Mr. Bronsky advised that Bridge Builder Academy was celebrating its 10 year anniversary and the school takes students from kindergarten through 12th grade with students from kindergarten to 5th grade taught in their homes or an off-site setting therefore eliminating the need for any outdoor activity space.

Mr. Bronsky said that although Bridge Builder Academy was considered a private school and was going through the accreditation process, the school functioned more like an education center. He added that the proposed site, which previously operated as a doctor’s office, generated more foot and vehicle traffic than the school would generate.

Commissioner Frey asked what accreditation would do for the school. She also wanted to know if the accreditation would require a certain amount of office or school space.

Mr. Bronsky replied that the school currently uses accredited material from the University of Nebraska, but by receiving accreditation it will provide a financial savings for the family of the students. He added that the accreditation process would not require anything other than what the academy already had in place.

Commissioner DePuy asked about the student demographics and why they would come to the academy. DRAFT

Mr. Bronsky said the academy has students who want to get ahead in their studies, are struggling with their course work, and home schooled children where the parent/teacher does not have the expertise to teach a particular subject. In addition, students who have learning difficulties or are gifted, as well as students who are professionals (actors, dancers, etc.) are part of their student population.

Mr. Bronsky concluded his presentation by stating the academy worked closely with area school district to help students who are struggling with their school work and their main focus was to do what was best for the student.

With no further questions or comments in favor or opposed, Chairman Hand closed the public hearing.

Commissioner DePuy said she thought it would be a good use of the lease space.

Chairman Hand stated that moving the academy to the other corner of the building was a good idea and felt the academy would have a relatively low impact on traffic in the area.

Commissioner Springs concurred with both DePuy and Hand, but expressed concern that the Special Permit should be tied to the academy as opposed to the lease space.

Vice Chair Bright and Commissioner Maxwell agreed with Mr. Springs and Mr. Shacklett suggested asking the applicant if he had any concerns about tying the permit to him or the academy.

Mr. Bronsky said he had no problem with the suggestion and thought it was a good idea to tie the permit to Bridge Builder Academy.

Motion: Commissioner Maxwell made a motion to recommend approval of Zoning File 15-11 as presented with the correction to Exhibit B to show the school at the northwest corner of Building B, and to have the Special Permit tied to Bridge Builder Academy; second by Commissioner Springs. Motion approved 7-0.

Approximately 35 acres, located south of President George Bush Highway, between Plano Road and the DART Light Rail Line.

BACKGROUND

On March 4, 2014 the City Plan Commission approved an extensive Master Sign Plan for the CityLine development. The approved Master Sign Plan package establishes consistency, while allowing flexibility and creativity. The Master Sign Plan package identifies four major Sign Types—Site Signage, Building Signage, Major Tenant Signage, and Retail Tenant Signage. For each Sign Type, specific signs are described by stating their purposes, defining their standards, and providing examples.

APPLICANT’S REQUEST KDC has begun to secure retail tenants for the approximately 85,000 square feet of ground floor retail along State Street. In working with some of the retail tenants, it has become apparent the Master Sign Plan is overly restrictive and limits the ability to install creative signage that promotes the business. KDC proposes to amend the Master Sign Plan for the Tenant Wall (Building) Sign. The changes are:

1. Allow individual internally illuminated letters; 2. Increase the maximum height for individual letters from 3’- 0” to 3’- 9”; 3. Allow a subtext channel box sign (maximum height 1’ -4.25”); 4. Allow a channel box logo or individual letter sign (maximum height 5’);

Request for approval of a Special Permit for an amusement arcade to be located at 1730 E. Belt Line Road, south side of Belt Line Road, west of Yale Boulevard.

APPLICANT’S STATEMENT

(Please refer to the complete Applicant’s Statement.)

STAFF COMMENTS:

Background: The subject property was developed in 1976. The development includes a 61,400-square foot retail building along the south property line with a 6,700-square foot restaurant building located along the west property line and a 4,287-square foot restaurant building located along Belt Line Road. The retail center is part of a larger retail located on the south side of Belt Line Road, west of Yale Boulevard. The former Richardson Square Mall site (currently Sears, Lowe’s, Target, Ross and Anna’s Linens) is located to the west of the subject property.

Request: The applicant is requesting to occupy approximately 5,000 square feet in the retail building along the south property line as shown the attached zoning exhibit (Exhibit “B”) for an amusement arcade. Amusement arcades are allowed in any LR-M(2) Local Retail and C-M Commercial district upon approval of a Special Permit. An amusement arcade is defined as:

a building or part of a building in which more than ten percent of the floor area or in which five or more amusement devices, pinball machines, video games, electronic games, shuffle board, pool tables, or other similar player-operated amusement devices are present and maintained as the primary use.

The applicant has stated he is presently the largest retro arcade dealer in Texas. His intention is to open a dedicated retro arcade in which customers can play the arcade games as well as purchase the machines. The applicant has provided a floor plan (Exhibit “C”) depicting the anticipated layout of the lease space. The following is a breakdown of the area dedicated to each portion of the business:

• Arcade and arcade showroom space – 3,100 square feet • Arcade storage and repair space – 1,220 square feet • Concession space and storage space – 400 square feet • Prepackaged food and beverage storage – 200 square feet • Restroom area – 80 square feet

The applicant intends to allow customers to enter and have unlimited access to gameplay for a single entrance fee. The fee would also include some food items. The applicant proposes to provide additional food items, non-alcoholic drinks as well as a variety of beer and wine options for purchase. He expects the alcohol to account for approximately 5% of the sales of the facility with food and non-alcoholic drinks comprising 15% of sales. He states the majority of the revenue generated from the arcade would be from the entrance fees and arcade machine sales.

Elements Related to the Request: Hours of Operation and Age Restrictions – The applicant is proposing to limit the hours of operation of the arcade on a daily basis. Furthermore, he proposes to limit the hours at which times children under the age of 18 may be on the premises. The applicant’s proposed hours of operation are as follows:

• Monday through Thursday – 3:00 p.m. to 11:00 p.m. • Friday – 3:00 p.m. to midnight • Saturday – 11:00 a.m. to midnight • Sunday – 11:00 a.m. to 11:00 p.m.

The applicant has stated that anyone age 13 and under will not be permitted on the premises without an adult parent or guardian. Additionally, children ages 17 and under will not be permitted to remain on the premises after 9:00 p.m. The applicant intends to utilize a colored wristband system or hand stamps to not only ensure compliance with the age/time restrictions, but also to prevent the service of alcoholic beverages to minors.

Alcohol Sales – The applicant proposes to provide alcoholic beverages for purchase to customers. He expects a small portion of the facility’s revenue to be generated from the sales of alcoholic beverages; however, he feels it is necessary to offer alcoholic beverages to attract a wider customer base, many of whom may be purchasers of the arcade machines. The zoning on the property allows sales of alcohol. There is currently one (1) restaurant and two (2) bars on the subject property. As the applicant has stated, colored wristbands and hand stamps will be utilized to ensure alcohol is not being served to minors.

All lease spaces on the subject property, excluding the proposed arcade lease space, require 366 parking spaces based on standard City parking ratios. Therefore, eighteen (18) additional parking spaces would be available for the proposed arcade. The City’s Parking Ordinance does not provide a standard parking ratio for an amusement arcade so a ratio would be set through the Special Permit. The applicant is proposing to utilize a ratio of one (1) parking space per 333 square feet, which would require the use fifteen (15) parking spaces.

The applicant has stated he admits the proposed ratio is low based on their proposed occupancy; however, he has provided a parking study which depicts an abundance of available parking throughout the daytime and evening hours. He has provided nine (9) parking counts at various times on several days of the week. At no time did the applicant observe more than 132 parking spaces being occupied at a given time. He provided a parking count for a Friday night at 8:55 p.m. and for a Saturday night at 9:50 p.m. The occupied spaces for those two (2) times were 98 and 90, respectively. Although the applicant is proposing a ratio that is lower than the expected occupancy, it would allow the use to occupy the space without having to grant a parking variance to the overall property. Staff has observed parking at the subject property on multiple occasions, and the counts provided by the applicant are consistent with staff observations.

Correspondence: As of this date, no correspondence has been received.

Motion: The Commission will be making a recommendation to the City Council regarding this request. The Commission may approve the request, add or amend conditions, or recommend denial of the request.

Should the CPC recommend approval of the applicant’s request, the motion should include the following special conditions:

1. A Special Permit shall be granted to allow an amusement arcade which shall be limited to the area shown on the attached concept plan, marked as Exhibit “B” and made a part thereof.

2. The amusement arcade shall provide parking at a ratio of one (1) parking space per 333 square feet.

3. The amusement arcade shall be allowed to operate between the hours 11:00 a.m. and 11:00 p.m. on Sunday through Thursday, and between the hours of 11:00 a.m. and 11:59 p.m. on Fridays and Saturdays.

4. Children ages 13 and under shall only be permitted on the premises with an adult parent or guardian. Children ages 17 and under shall be prohibited on the premises after 9:00 p.m.

5. Alcohol sales in conjunction with an amusement arcade shall be permitted.

Council Hearing Date: The tentative City Council hearing date is July 13, 2015.

ZF 15-12 Applicant’s Statement

Applicant (Free Play, Incorporated) seeks a special permit in order to operate more than five (5) arcade game machines within the above-described premises. Applicant seeks said special permit pursuant to Article XXII-A, Section 2(b)(2) of the City of Richardson Comprehensive Zoning Ordinance. The above- described property address is zoned LR-M(2), as required by the City of Richardson Zoning Ordinance.

Applicant is presently the largest retro arcade dealer in Texas. Recently, retro amusement arcades have opened in numerous major metropolitan areas. To date, the DFW metroplex has no dedicated retro amusement arcades.

Applicant anticipates operating its business in approximately five-thousand (5000) square feet of space leased in the Richardson East Shopping Center, as defined above. The business will be a combination amusement arcade / arcade dealership. The space shall be renovated to contain ~1220 sq. ft. of storage and arcade repair space, ~200 sq. ft. of prepackaged food and beverage storage, ~400 sq. ft. of concession space and storage, ~80 sq. ft. of bathroom space, and ~3100 of arcade showroom space. The space will contain approximately seventy (70) retro amusement arcade machines - games such as Galaga, Ms. Pac Man, Defender, and the like.

There will be a single price ("entrance fee") that grants entrance to the premises and includes certain food and unlimited access to the arcade machines. The arcade machines in the space will be set to free play, allowing any person who enters the premises unlimited free gameplay. There will be additional food and beverage options at additional cost to the patrons of the business. As part of the food and beverage sales, Applicant shall seek the appropriate permits and licensing to sell beer and/or wine to its patrons.

Applicant's build out plans include a concession "snack bar", which will offer food products such as candy, pre-packaged snacks, and a variety of prepared food. Applicant's beverage options will include sodas, a variety of non-alcoholic bottled drinks, and a variety of beer and wine options.

Applicant anticipates eighty percent (80%) of its gross revenue will result from arcade machine sales or the arcade "entrance fee". Applicant anticipates fifteen percent (15%) of its gross revenue will result from the sale of non-alcoholic drinks, snacks, and other merchandise. Applicant anticipates the remaining five percent (5%) of its gross revenue will result from the sale of alcoholic beverages. Applicant does not anticipate operating as a "bar" or "barcade".

Applicant anticipates its hours of operation being as follows: Sunday, 11:00 AM to 11:00 PM; Monday, 3:00 PM to 11:00 PM; Tuesday, 3:00 PM to 11:00 PM; Wednesday, 3:00 PM to 11:00 PM, Thursday, 3:00 PM to 11:00 PM; Friday, 3:00 PM to 12:00 AM; Saturday, 11:00 AM to 12:00 AM. Applicant will allow no children aged 13 or under to enter the premises without an adult parent or guardian. Applicant will not permit any children age 17 or under to remain in the premises after 9:00 PM. Applicant will ensure all amusement arcade machines with mature content, if any, will contain appropriate warnings.

Beyond ongoing ID checks, Applicant will utilize colored wristbands and/or hand stamps to prevent the service of alcoholic beverages to any minor. Re: Ongoing Parking Study.

To Whom it May Concern:

This parking study is to be submitted concurrent with Free Play, Incorporated’s (“Free Play”) Development Application wherein Free Play seeks a special permit to operate an amusement arcade.

The amount of necessary parking spaces for an amusement arcade is not defined by the City of Richardson. As noted on the site plan submitted with Free Play’s application, there are 384 available parking spaces for the site in which Free Play’s proposed arcade will operate. Based on the updated parking data contained in the submitted site plan, not including any spaces for Free Play, there are 366 required spaces for businesses presently operating in the lot.

Of the remaining 18 parking spots, Free Play has requested that it’s parking requirements be set at 1 spot per 333 square feet of occupied space. Under Free Play’s proposed parking requirements, there will be a 3 space surplus for the site.

Admittedly, this is a low parking requirement based on Free Play’s proposed occupancy and use of the space. Beyond being a parking requirement that fits the available parking spaces for the site however, Free Play has proposed such a parking requirement based on the amount of the parking spaces actually used at the site. Free Play has begun a parking study on the available spaces for the site that will continue throughout the permit application process. To date, Free Play has observed the following parking uses:

At no point have we observed more than 132 parking spaces in use and we do not anticipate such an occasion. Free Play has taken photographs of the lot during each of these recorded times and will provide such photographs if requested. Free Play will continue to record parking uses for the foreseeable future and supplement this study as necessary.

Additionally, the site is bordered by two sites that contain directly accessible parking, including the Richardson Square site that routinely has more than 1000 available parking spaces. Though Free Play has requested a low parking space requirement for its usage, it is clear that, even if Free Play was operating at full occupancy, there will always be sufficient parking available at the site.
