Rodrigo Diaz, Chief Counsel (1) MUNCY CREEK TOWNSHIP Municipal Petition for Case No. 16-NE-09 Exemption from Statute Regarding Amplified Sound Note: Board Minutes are not officially approved until all required signatures are affixed. Motion Made: Board Member Negra Seconded: Board Member Newsome Board Decision: Unanimously agreed (3-0 vote) to Approve Noise Exemption for a Period Extending from July 2, 2016 to July 2, 2021. (2) CITY OF LANCASTER Municipal Petition for Case No. 16-NE-10 Exemption from Statute Regarding Amplified Sound Board Member Newsome asked Rod Diaz, Chief Counsel, if it is common for a municipality to request a noise exemption for the entire geographic area comprising a municipality like is being done in this instance. Mr. Diaz explained that municipalities have the discretion to determine the geographic parameters of the areas for which they request noise exemptions. He further indicated that municipalities do occasionally request noise exemptions to cover their entire geographic areas. Motion Made: Board Member Negra Seconded: Board Member Newsome Board Decision: Unanimously agreed (3-0 vote) to Approve Noise Exemption for a Period Extending from July 15, 2016 to July 15, 2021. (3) WITHDRAWAL OF FINAL REGULATION # 54-85 Proposed withdrawal of LIMITED WINERIES regulatory changes Board Member Negra asked Rod Diaz, Chief Counsel, to explain the action being requested. Mr. Diaz explained that the PLCB had previously started the process of pursuing a regulatory change in order to make the PLCB’s Regulations regarding limited wineries consistent with the Liquor Code. However, the Legislature subsequently passed Act 39 of 2016, which among other things, amended the Liquor Code’s provisions governing limited wineries. As such, the regulatory changes that were being pursued are no longer consistent with the Liquor Code. Thus, Mr. Diaz indicated that it is necessary to withdraw the proposed regulatory changes, and then start the process over with different regulatory changes that are consistent with Act 39. Motion Made: Board Member Negra Seconded: Board Member Newsome Board Decision: Unanimously agreed (3-0 vote) to Approve Withdrawal of Final Regulation #54- 85. (4) WITHDRAWAL OF PROPOSED REGULATIONS Proposed withdraw of both #54-86: MANAGEMENT CONTRACTS; AND regulations from IRRC. #54-89: DISTRIBUTORS ACCEPTING CREDIT CARDS FROM LICENSEES 2 Note: Board Minutes are not officially approved until all required signatures are affixed. Board Member Negra asked Rod Diaz, Chief Counsel, to explain the action being requested. Mr. Diaz explained that the PLCB had previously started the process of pursuing regulatory changes regarding management contracts and distributors accepting credit cards from licensees. However, the Legislature subsequently passed Act 39 of 2016, which among other things, amended the Liquor Code’s provisions regarding management contracts and distributors accepting credit cards from licensees. Mr. Diaz further explained that the Act 39 amendments effectively accomplish the same changes that were being pursued through the regulatory process. Therefore, the proposed regulatory changes are no longer necessary.
