The Nasakom ideology was used by the Soekarno government since the Presidential Decree in 1959. Soekarno's middle way solution to stop the chaos of the liberal democracy period opened up new conflicts and feuds between the PKI and the Indonesian National Army. The compromise management style is used to reduce conflicts between interests. The method used in this research is the historical method. The results showed that the approach adopted by President Soekarno failed. Soekarno tried to unite all the ideologies that developed at that time, but did not take into account the political competition between factions. This conflict even culminated in the events of September 30 and the emergence of a new order. This research is part of a broader study to examine the management of the issue of communism in each political regime in Indonesia. Haley School of Law A sweeping proviso that protects basic or fundamental interests of a legal system is known in various names – ordre public, public policy, public order, government’s interest or Vorbehaltklausel. This study focuses on the concept of Indonesian public order in private international law. It argues that Indonesia has extraordinary layers of pluralism with respect to its people, statehood and law. Indonesian history is filled with the pursuit of nationhood while protecting diversity. The legal system has been the unifying instrument for the nation. However the selected cases on public order show that the legal system still lacks in coherence. Indonesian courts have treated public order argument inconsistently. A prima facie observation may find Indonesian public order unintelligible, and the courts have gained notoriety for it. This study proposes a different perspective. It sees public order in light of Indonesia’s legal pluralism and the stages of legal development. -

When Subandrio went to China in 1965, Nasution suggested that if China really wanted to help Indonesia, she should cut off supplies to Hongkong. According to Nasution, BK was serious about Maphilindo but Aidit convinced him that he was a world leader, not just a regional leader. In 1960 BK became head of Peperti which made him very influential in the AD with authority over the regional commanders. In 1962 N was replaced by Yani. According to the original concept, N would become Menteri Hankam/Panglima ABRI. However Omar Dhani wrote a letter to BK (probably proposed by Subandrio or BK himself). Sukarno (chief of police) supported Omar Dhani secara besar). Only Martadinata defended to original plan while Yani was 'plin-plan'. Meanwhile Nasution had proposed Gatot Subroto as the new Kasad but BK rejected this because he felt that he could not menguasai Gatot. Nas then proposed the two Let.Gens. - Djatikusuma and Hidayat but they were rejected by BK. -

PATTERNS OF MILITARY CONTROL IN THE INDONESIAN HIGHER CENTRAL BUREAUCRACY John A. MacDougall* Summary This article analyzes current military penetration of Indonesia's higher central government bureaucracy. Any civilian or military officeholder in this bureaucracy is referred to as a karyawan. The article focuses on the incumbent Cabinet and topmost echelon of civil service officials. Findings are based on public biographies of these persons and published specialized secondary sources on the Indonesian military. The principal conclusions follow below. The Higher Central Bureaucracy The Indonesian military has long played a "dual civil and military function." Military karyawan, active duty and retired officers in civilian assignments, comprise an increasingly visible, influential, and strategic segment of the dominant military faction, that of President Suharto and his 1945 Generation supporters. --The military karyawan in the higher central bureaucracy are especially critical actors in maintaining the Suharto regime. --Together with their civilian karyawan colleagues, virtually all of them wield decision-making powers of some considerable degree. --Some mix of military and civilian karyawan occurs in all Cabinet Departments except the Department of Defense and Security, now entirely military-controlled. --The Indonesian armed forces' doctrinal commitment to preventing civilian con trol of the military has resulted in the Department of Defense and Security be coming effectively equivalent to the consolidated armed forces' staff and command structure. Extent of Military Penetration Active and retired military karyawan now occupy half the positions in the Indo nesian higher central bureaucracy. --At the highest levels, military penetration remains near complete (the President and his principal immediate aides) or has increased (Coordinating Ministers) over the course of the New Order regime (1966 to the present). -

Southeast Asian Journal of Social and Political Issues, Vol. 1, No. 2, March 2012 | 126 Back in Asia: the US’s TPP Initiative and its Implications for China Zhang Zhen-Jiang 张振江 (Institute of Southeast Asian Studies, Jinan University, Guangzhou, China) Abstract Trans-Pacific Partnership develops from the Pacific Three Closer Economic Partnership (P3-CEP) initiated by Chile, Singapore and New Zealand in 2002 and joined by Brunei in 2005. The four countries finally finished their talks and singed the Trans-Pacific Strategic Economic Partnership Agreement (P4) on June 3rd, 2005. American President George W. Bush announced that the US would join TPP in late 2008. It was suspended by new American President Barrack Obama for his trade policy review. However, the US government restarted its joining efforts in late 2009 and was quickly joined by several other countries. This paper aims to investigate the origin, nature and development of TPP, analyze America’s motivations, and study its possible impacts upon the East Asian Regionalism in general and upon China in particular. Finally, the author calls for China to take the active policy to join the TPP negotiating process. The 1945 Constitution after the amendment, that the presence of state ministers as constitutional organs is part of the power of the President in running the government. This study aims to provide ideas about separate arrangements between state ministries placed separately in Chapter V Article 17 to Chapter III of the 1945 Constitution of the Republic of Indonesia concerning the authority of the state government or the power of the President, and also regarding the formation, amendment and dissolution of the ministries regulated in legislation. This study uses a normative juridical research approach. The results of the study show that the Minister of State is the President's assistant who is appointed and dismissed to be in charge of certain affairs in the government, which actually runs the government, and is responsible to the President. The governmental affairs referred to are regulated in Law No. 39 of 2008 concerning the State Ministry, consisting of: government affairs whose nomenclature is mentioned in the 1945 NRI Constitution, government affairs whose scope is mentioned in the 1945 NRI Constitution, and government affairs in the context of sharpening, coordinating, and synchronizing government programs. -

In Indonesia, for example, the range of activities of government functionaries, the pegawai negeri in local parlance, seems to be un- limited. There are, first of all and certainly most obvious, the large number of people occupying official positions in the various ministries located in the captital city of Djakarta, ranging in each ministry from the authoritative Secretary General to the nearly powerless floor sweepers. There are the territorial administrative authorities, all under the Minister of Interna! Affairs, from provincial Governors down to the village chiefs who are electecl by their fellow villagers but who after their election receive their official appointments from the Govern- ment through their superiors in the administrative hierarchy. These territorial administrative authorities constitute the civil service who are frequently idenitified as memibers of the government bureaucracy par excellence. There are, furthermore, as in many another country, the members of the judiciary, personnel of the medical service, diplomats and consular officials of the foreign service, taxation officials, technicians engaged in the construction and maintenance of public works, employees of state enterprises, research •scientists, and a great number of instruc- tors, ranging from teachers of Kindergarten schools to university professors at the innumerable institutions of education operated by the Government in the service of the youthful sectors of the population. -

The stereotype of the Partai Nasional Indonesia (PNI) as an opportunist, conservative party composed of Javanese prijaji elements remains despite basic changes which occurred within the party in the later years of Guided Democracy. Tljis undifferentiated image of the PNI arose in the early 1950's and, for that time, it represented a fairly accurate, though limited, description. As the party began to change under the impetus of Guided Democracy politics and the push of internal party dynamics, Indonesian and foreign observers either disregarded the party alto gether or tended to seek explanations for these changes in outside factors." Thus, the PNI's "turn to the left," in the 1963 to 1965 period, was termed variously as: an opportunistic response to the increasingly leftist politics of Guided Democracy; the result of strong pressure from President Sukarno; or the work of PKI (Communist Party) infiltration of the party leadership. The fact that Djakarta's political cognoscenti-- journalists and intellectuals--continue to espouse and disseminate this interpreta tion reflects biases born of their own political attitudes and in volvement. A similarly-limited view of the PNI in Western academic literature is in part the result of the paucity of work on the Guided Democracy period and in part a consequence of an excessive concentra tion on a few actors at the center. The generally-accepted framework for analyzing Guided Democracy politics1--a three-sided triangle made up of Sukarno, the Army and the PKI--only explains certain facets of Indonesian politics, that is, the major battles for ideological and institutional predominance. -

This organization had an important role in the form of Parliamentary Democracy system in Indonesia. During independence period, PNI Baru became a political party called Partai Rakyat Sosialis (Paras), Paras then affiliated with Partai Sosialis Indonesia (Parsi) to become the Received: Partai Sosialis in the late of 1945. Partai Sosialis appeared convincing as July 2, 2018 the dominating party in the course of Indonesian politics in early Accepted: independence, placing Sjahrir and Amir as cabinet leaders for five October 28, 2018 consecutive periods. After the name of Partai Sosialis changed into PSI on February 12, 1948, the party was unable to be considered as a potential political party anymore. PSI had no chance to contribute to the political dynamics of Indonesia at that time. It was only after the recognition of Indonesian sovereignty that the PSI was able to carry out effective party work, including their involvement in cabinet in the 1950s. The PSI members were responsible of serving the government as ministers in the structure of the Natsir Cabinet of 1950, the Wilopo Cabinet of 1952 and Burhanuddin Harahap Cabinet of 1955, the other figures who had special affiliation and sympathy with PSI also became party representatives to serve the government during that period.
