Author & Composer Interview

Mr. Charas Fuangaromya

Well-known as artist, composer and MCT’s Director

“In abroad, each country has the society taking care of copyright for famous authors & composers. The society is an expert in administration of right as world class in terms of negotiation with trading partner, government sector, and other societies. Therefore, authors & composers can use their full potential of time to create quality pieces of work without worrying about managing their own copyright.

Mr. Maythee Noijinda

( Band’s Guitarist) Now is a manager and an artist & composer at Mowgli Records

“The important standards that used for evaluating each society are transparency, fairness, and world class.

•Fairness – rule and world class determine price and its rate of licensing fee is close to other societies around the world

•Transparency – able to check the process of distribution to copyright owner based on real usage

• Compliance with international principles – use negotiation method with customers rather than threaten and arrest the users”

Mr. Thawichaya Tungsaharungsee

A manager and an artist & composer at Classy Records

“Not only managing our rights in Thailand, the society ”MCT” is also licensed and contact with global music business companies that will expand their market in Thailand like iTunes. As we know, iTunes has launched its business in Asia last year which will be the way to support more on artists’ work. Unlike in the past that had to pay for public relation to create Mass Market and Niche Market to world market. Furthermore, if the musical work is used in other countries, the society can license from others country because of the Reciprocal Agreement that MCT signed with more than 39 sister societies cover over 70 countries around the world.”

The advantages are movies legally. iTunes is another way to gain more revenue and pay back to music creators. not only happen on the customers’ side but also on artists and record labels. From now on, the old pattern of selling Ringtone and Ringback Tone which calculate the artists’ revenue from Download Model will slightly change to Listening Model. In this way the artists will receive more royalty and have more spirit to create work continually.

Where are composer’s revenues come from?

Nowadays, braking intellectual property live performance, event or music has been use is a national problem. When there’s a buyer, as a backing track in advertisement, TV, etc. there’s a seller. When there’s a free product These will create substantial income. Since from lover (both good quality and non quality), the past, Thai composers usually didn’t receive there’s a provider. So the solutions like arresting royalty from these activities because signed illegal CDs seller or closing illegal music Monopoly Contract with record labels, except download websites are hard to solve. It’s a the composer is the same person with the artist solving problem not the root cause because and performing himself. Most of the record eventually the problem will arise again. labels pay only performing right but if they’re mercy, they might include divided royalty with So, where’re the composers’ revenues come performing revenue. On the other hand, from? Let’s find out. according to the international principal, the licensed revenue will be huge if the right is In the past, main revenue came from belonging to the composers. This is happening share of CDs, VCDs sold. However, the revenue with worldwide artists and composers, such as from this “Physical” format is decreasing but Mariah Carey, Elton John, and Lady Gaga or in higher in breaking copyright instead. So the Asia, Psy, a famous artist and the owner of composers should have the “future plan” for Gangnum style song. These artists are all gaining more revenue to replace the missing composers both for themselves and other part. Even though, this new way isn’t challenge artists. When there’re shows or concerts, these and the revenue isn’t high as used to but it’s artist, who also are composers, will gain income stable. This could compare with planting a from two ways; 1.Performing revenue from standing tree. At first it might not bloom but 2.Royalty from their own composed finally could collect its long term result for whole songs which receive from music licensing life without asking or buying from anyone. company that they’re membership. Please notice There’re many ways for “future plan” that it’s not the same income because whether a royalty from “Global Music Service” or performing revenue is not including in royalty, major music business company e.g. iTunes or unlike Thai composers whose revenues are still Deezer that just opened its business in Thailand included. last year. It’s expecting that this kind of “Global The one important rule, the artists have Music Service” prepare to launch more to make sure that whether the copyright is businesses in Thailand and Asia. The music belong to them or not by checking the contract service companies have the distribution system thoroughly. Nevertheless, if the copyright is still to distribute the money back to per stream’s belonging to the composers, there’s nothing to copyright owners. Per stream means each time concern. The only thing that has to do is to be music played, royalty is back to composers and careful when choosing organization. The good record labels.
