Whistleblower protections are afforded to utility employees and contractors who report potentially unsafe or illegal practices. The inspector observed a track with 8 tank cars coupled together without any handbrakes applied. The inspector also identified another track with 11 tank cars coupled together without handbrakes applied. There were cars on each track loaded with hazardous materials. The findings in this yard were not in compliance with the Code of Federal Regulations (CFR) 232.103(n)(1) which states: Railroads shall develop and implement a process or procedure to verify that the applied hand brakes will sufficiently hold the equipment with the air brakes released. The inspector recommended a civil penalty against the railroad for this violation. The inspector spoke with the UPRR Senior Manager of Train Operations responsible for this yard who immediately took immediate action to secure the rail cars bringing them into compliance, which was verified by a subsequent reinspection. May 4, 2021: CPUC Railroad Safety Inspectors and a BNSF Track Supervisor participated in two days of focused inspections of the BNSF Railway between Hanford & Guernsey. The purpose of this focused inspection was to determine the level of FRA and CPUC General Order (GO) compliance being achieved by BNSF track personnel as they pertain to main line switches. 4 | P a g e M a y 2021 RSD Report During the inspection, several track and signal defects were discovered that required a slow order being placed on the track. Slow orders require trains to slow down to a prescribed safe speed, because the defective track conditions posed a danger to trains traveling at higher speeds. Slow orders must remain in effect until the defective conditions are corrected. Among the defects cited was a broken insulated joint. Track speed over this defective insulated joint was 79 mph on an Amtrak route, and this type of defect could lead to a broken rail that could cause a derailment. A 10-mph speed restriction was placed on this location until repairs were made. Another defective condition that was found was a broken bond wire that could lead to a false activation of a highway grade crossing. A false activation happens when the grade crossing becomes activated and there is no train on the approach to the crossing. False activations can degrade the public’s confidence in the grade crossing system and lead to a vehicle going around the activated crossing gates into a path of a train. All defects were reported to the BNSF track manager and repairs were made. The CPUC Inspectors performed a follow up inspection and verified that all defective conditions had been corrected and brought into regulatory compliance. May 12, 2021: CPUC Railroad Safety Inspectors conducted a hazardous materials inspection of the BNSF Railroad Yard in La Mirada. The inspection consisted of the following: review of required markings, placarding, stenciling, proper handling, securement of closures on tank cars containing hazardous materials, and paperwork requirements including emergency response information. During the inspection one tank car loaded with Acetone was discovered with a loose bottom outlet valve cap. Acetone is a colorless, highly volatile, and highly flammable liquid with a strong pungent smell. CFR 173.31.(d) (1) (iv) states that shippers must verify all closures on tank cars and determine that the closures and all fastenings securing them are properly tightened in place prior to release into transportation. The proper securement of the bottom outlet cap is essential to assure hazardous material is not inadvertently released during transit, placing the public and railroad employees at risk for exposure. The BNSF hazardous 5 | P a g e M a y 2021 RSD Report materials manager was notified of the defect and took immediate action to correct the defect which was verified by a staff reinspection. May 18, 2021: A CPUC Railroad Safety Inspector performed an inspection of the California Northern Railroad (CFNR) in Suisun to determine compliance with CPUC GOs. The inspector identified one non-compliant condition. Tree branches that impeded the side clearance for on track equipment were observed. The tree branches created a contact hazard for railroad employees riding the side of equipment. This is not in compliance with state GO 26-D, which establishes minimum clearances of 8’6” from the center of rail. The purpose of GO 26-D is to prevent injuries and fatalities to railroad employees by providing these standards. The inspector notified the CFNR Manager of the non-compliant condition. The railroad cut back the branches to bring the track into compliance, which was verified by the inspector during follow up inspection.     REQUEST FOR QUALIFICATIONS (RFQ) for 30%-Design Preliminary Engineering for the Downtown Los Angeles Streetcar LOS ANGELES STREETCAR, INC AUGUST 14, 2015 INTRODUCTION AND BACKGROUND Los Angeles Streetcar, Inc. (LASI) is seeking an Engineering Firm/Team (Design Consultant) to develop 30% Engineering Design for the proposed Los Angeles Streetcar (“Project”). The Project is currently undergoing environmental review pursuant to CEQA, to be followed by federal NEPA review upon certification of the Final Environmental Impact Report. The Project is also in the process of securing federal funding under the FTA Small Starts program, and exploring potential P3 partnerships for capital funding and operational support. The work of the Design Consultant will be overseen by LASI and the City of Los Angeles Bureau of Engineering (BOE), with close coordination with the Los Angeles Department of Transportation (DOT)—LASI, BOE, and DOT are referred to herein as the Streetcar Project Team. The Design Consultant’s day-to-day communications will be with the Principal Civil Engineer at BOE. To advance the Project, the Design Consultant will develop plans to 30% Design and Engineering concurrent with the Metro-led environmental review process. The Scope of Work (SOW) for the Design Consultant will focus on defining the project’s centerline, geometry, profile, and cross sections, and will identify utility conflicts and work with utility companies to identify potential solutions, address project risks and impacts, provide the basis for a refined cost estimate, and position the project for federal funding and potential public-private partnership(s). The SOW includes 30% Design and Engineering for each of the 4 Project Alternatives evaluated in the EIR: 1) 7th St alternative with Grand Ave extension; 2) 7th St alternative without Grand Ave extension; 3) 9th St alternative with Grand Ave extension; and 4) 9th St alternative without Grand Ave extension.

    Finding of No Significant Impact Grant Applicant: City of Los Angeles Project: Restoration of Historic Streetcar Service in Downtown Los Angeles Project Location: City of Los Angeles, California The Environmental Assessment (EA) for the Restoration of Historic Streetcar Service in Downtown Los Angeles (Project) was prepared in cooperation with the Federal Transit Administration (FTA) pursuant to the National Environmental Policy Act (NEPA) of 1969 (42 United States Code [U.S.C.] 4332); the Federal Transit Laws (49 U.S.C. 5301(e), 5323(b), and 5324(b)); Section 4(f) of the Department of Transportation Act of 1966 (49 U.S.C. 303); and Executive Order 12898 (Federal Actions to Address Environmental Justice in Minority Populations and Low-Income Populations). FTA is the federal lead agency for the Project under the NEPA. Development of the Project and its environmental review process are being managed through the joint cooperation of the City of Los Angeles (City) Department of Transportation (LADOT), Bureau of Engineering (LABOE), and the Los Angeles County Metropolitan Transportation Authority (Metro). Additional support is being provided by City Council District 14 and Los Angeles Streetcar Inc. (LASI), an independent non-profit agency. Streetcar Environmental Review Certified by City Council Final route selected and depot location identified LOS ANGELES, CA (November 29, 2016) –The Environment Impact Report (EIR) for the Downtown Los Angeles Streetcar was certified by the Los Angeles City Council Tuesday on a 12- 0 unanimous vote, marking another milestone for the project that remains on target to open in 2020. Today’s action comes just three weeks after voters approved the Measure M sales tax that includes $200 million to help complete the Downtown L.A. streetcar project’s funding plan. Measure M provides $120 billion in transit funding to hundreds of vital transportation projects for the Los Angeles region. The proposed Downtown Los Angeles Streetcar is a 3.8 mile fixed-rail modern streetcar system, serving Downtown Los Angeles along 1st Street, Broadway, 11th Street, Figueroa Street, 7th Street or 9th Street, and Hill Street. ``Today marks a very important milestone in bringing the beloved streetcar back to Downtown Los Angeles,” said, Councilman José Huizar, who has long championed the DTLA streetcar project through his Bringing Back Broadway initiative. “The Downtown Los Angeles Streetcar will be a vital transportation project linking our regional transit system with destinations throughout downtown.” Among its actions Tuesday, the City Council certified the environmental findings and selected the 7th Street alignment without an extension to Grand Avenue as the final route to be built, while preserving the option to build an extension to Grand Avenue if funding becomes available.

    2 Motion by Directors Bonin, O'Connor, Fasana and Ridley-Thomas Developing an Active Transportation Finance Strategy Planning &Programming Committee July 16, 2014 Metro is considering adopting a 10-year Short Range Transportation Plan (SRTP)that reiterates its commitment from the 2009 Long Range Transportation Plan (LRTP)to invest in a rapid expansion of fixed-guideway transit and modernization of our freeway system. The SRTP provides an investment strategy for all revenues controlled by Metro, including Propositions A and C, Measure R, and state and federal funds, to ensure the timely delivery of transportation projects throughout the county. The Highway and Transit programs in the SRTP undergo a rigorous planning and needs assessment process that aid Metro in defining both the projects and the resources necessary to meet identified needs. However, the same process is not applied to the active transportation program. Metro plans to spend close to a billion dollars on walk/bike projects in the next ten years absent a comprehensive planning process or an assessment of countywide needs. Further, the draft SRTP does not adequately reflect MTA's Countywide Sustainability Planning Policy and joint work program with SCAG to expedite active transportation funding and implement the recently adopted First-Last Mile Strategic Plan. While the SRTP does integrate sustainable principles and practices into planning activities using an evolving set of performance metrics, critical sustainability metrics, including safety and accessibility measures for walking and biking are not included in the plan. The SRTP as drafted demonstrates shortcomings in countywide walk and bike planning that Metro should address to ensure that the full range of sustainable mobility options are incorporated into countywide planning efforts.

As communities across the nation rediscover the charm and efficiency of this short distance transit option, they are investing in new streetcar lines or extensions of existing operations. This survey in support of The Community Streetcar Coalition (CSC) was commissioned to track important streetcar development projects, planned or underway, in major U.S. cities. Portland Streetcar Inc. funded this work with the partial proceeds of its 2005 Rudy Bruner Gold Medal Award for Urban Excellence. This survey report is a living, working document. It will be updated regularly, and shared with policymakers, opinion leaders, interested municipalities, and those involved in streetcar issues and technologies.
