EXECUTIVE SUMMARY E.1 INTRODUCTION Shell Todd Oil Services Limited (STOS) is applying for Marine Consent and a Marine Discharge Consent for activities restricted under the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 (EEZ Act) associated with an existing petroleum mining activity. In 2015 STOS was granted a Marine Consent (EEZ000010) for a term of 35 years to encompass a wide range of activities relating to the extraction, production and transport of natural gas and condensate undertaken within the Māui Natural Gas Field in New Zealand’s Exclusive Economic Zone (EEZ). The 2015 Marine Consent includes provision for use of platform and semi- tender assisted drilling (semi-TAD) rigs to support side-track drilling; however, it does not include the use of a jack-up rig to undertake these drilling activities. STOS’ current application is intended to enable the placement of a different type of rig, a jack-up rig, in the Māui Field plus other associated activities that are not authorised by its existing consent. The effects associated with the placement of a jack-up rig (which are slightly different from a semi-TAD as described in the previous application) are assessed in this application. The Marine Discharge Consent that is the subject of the current application is to cover the potential discharge of harmful substances through deck drains (offshore processing drainage) from a jack-up drilling rig. The proposed activities are necessary to allow the continuing efficient use and development of natural resources authorised by STOS’ pre-existing Petroleum Mining Licence (PML) 381012 (Figure E.1). ERM New Zealand Limited (ERM) has been engaged by STOS to undertake a comprehensive Impact Assessment (IA) in accordance with the EEZ Act that addresses impacts that may arise as a result of the proposed activities. This Executive Summary includes a description of the activities that are the subject of the marine consent application, an overview of the existing environment and uses in the area, and the findings of the IA. ENVIRONMENTAL RESOURCES MANAGEMENT MĀUI IA 2017/FINAL/APRIL 2017 i Figure E.1 Location of PML 381012 and the Māui Facilities E.1.1 IMPACT ASSESSMENT PROCESS This IA has been undertaken in accordance with Section 39 of the EEZ Act and with consideration of the broader principles and requirements of the EEZ Act and addresses matters within Section 59 – 61 of the EEZ Act that the Environmental Protection Authority (EPA) must take into consideration in assessing the application. Accordingly, the IA process comprised of a number of key steps, namely: • Scoping; • Existing Environment Data Review; • Stakeholder Engagement; • Impact Assessment; • Environmental Management Measures; and • Reporting, Disclosure and Decision Making. E1.2 STAKEHOLDER ENGAGEMENT During the preparation of the IA STOS initiated consultation with a number of local and national groups identified as being interested parties with interests either within the activities Area of Influence (AOI, defined as the extent of PML 381012 within the EEZ of New Zealand) or the wider vicinity of the Māui Facilities. Consultation in relation to this application built upon STOS’ existing and ongoing community engagement programme as well as ENVIRONMENTAL RESOURCES MANAGEMENT MĀUI IA 2017/FINAL/APRIL 2017 ii consultation undertaken for the 2015 Māui Marine Consent application. Consultation was undertaken with a wide range of potential stakeholders by a variety of mechanisms including: • Meetings; • Provision of a Marine Consent summary brochure; • Email and telephone calls; • Sharing the draft IA with key stakeholders; and • Seeking input on specific sections of the IA. Specific meetings were held with a number of groups including: • Iwi and Hapū; • The Māui Community Advisory Group (CAG); and • The Environmental Protection Authority (EPA). E.2 LEGAL AND POLICY FRAMEWORK E2.1 THE EXCLUSIVE ECONOMIC ZONE AND CONTINENTAL SHELF (ENVIRONMENT EFFECTS) ACT 2012 (THE EEZ ACT) The primary piece of New Zealand legislation that seeks to manage the environmental impacts of offshore oil and gas activities being undertaken within New Zealand’s EEZ and continental shelf is the EEZ Act. The purpose of the EEZ Act is to promote the sustainable management of the natural resources of the EEZ and continental shelf. Sustainable management is defined in Section 10(2) of the EEZ Act as: …managing the use, development, and protection of natural resources in a way, or at a rate, that enables people to provide for their economic well-being while— a) sustaining the potential of natural resources (excluding minerals) to meet the reasonably foreseeable needs of future generations; and b) safeguarding the life-supporting capacity of the environment; and c) avoiding, remedying, or mitigating any adverse effects of activities on the environment. ENVIRONMENTAL RESOURCES MANAGEMENT MĀUI IA 2017/FINAL/APRIL 2017 iii E.2.1.1 Activities Covered by the EEZ Act Section 20 of the EEZ Act places restrictions on the types of activities that can be carried out in the EEZ, in or on the continental shelf, or in the waters of the EEZ. Section 20(1) of the EEZ states that: No person may undertake an activity described in subsection (2) in the exclusive economic zone or in or on the continental shelf unless the activity is a permitted activity, authorised by a marine consent, or authorised by section 21, 22, or 23. Section 20(2) specifies the activities that are restricted under Section 20(1). Section 20B of the EEZ Act places restrictions on discharges of harmful substances from structures within the EEZ unless the discharge is a permitted activity or authorised by a Marine Consent. The Marine Consent and Marine Discharge Consent applications lodged by STOS, and in support of which this IA has been prepared, are focussed on those restricted activities defined under Sections 20 and 20B that relate specifically to the use of a jack-up rig and associated activities. A narrow range of other activities relating to drilling and well servicing activities and the ongoing inspection, maintenance and operation of the Māui Facilities are also included where it is considered these were not described in the 2015 application. The Section 20(2) Restricted Activities are listed below in Table E.1 together with the applicable activities at the Māui Facilities for which Marine Consent is currently sought and the sections within the IA where these matters are considered.
