TEXAS-DIVISION, SONS OF CONFEDERATE VETERANS, INC.: SPECIALTY LICENSE PLATES, CONFEDERATE FLAGS, AND GOVERNMENT SPEECH * EDWARD J. SCHOEN I. INTRODUCTION In a previous article1 this author traced the history of the government speech doctrine from the time it first appeared in a concurring decision in Columbia Broadcasting System, Inc. v. Democratic National Committee,2 to its prominent role in Pleasant Grove City v. Summum,3 in which the U.S. Supreme Court ruled that the city’s decision to display permanent monuments in a public park is a form of government speech, which is neither subject to scrutiny under the First Amendment, nor a form of expression to which public forum analysis applies. This review demonstrated that the intersection between government speech and the First Amendment is very tricky terrain, because of the inherent difficulties in determining what is government speech, mixed private and government speech, or private speech in a limited public forum. -

Parashat Chukkat 2 sermon, 6/23/2018 Dr. Bard C. Cosman Congregation Beth El Last year we city Jews made a driving trip to Madras, Oregon for the solar eclipse. I thought how different Madras was, out on the high desert of central Oregon, from its tropical namesake in southern India—and I thought that only in America, where pioneers felt they were starting history afresh, would you find a place named like that. But then I recalled that Oregon’s pioneers gave their capital a Hebrew name—Salem. It was a long drive, so there was time to think about all the Hebrew place names in the United States. Only in America are there so many. Bethpage, Bethesda, Bethlehem, Moriah, Tabor, Pisgah; Galilee, Carmel, Moab; Ephraim, Utah; Rehoboth, Massachusetts; Shiloh, Siloam, Gilboa, Bethel Park—there’s an American town sporting the name of almost any place in the Bible. Even names that just don’t work in English, like Shittim Gulch, Washington; I couldn’t find Gehenna anywhere in the Dakotas or Texas, but maybe I didn’t look hard enough. As we drove by Mount Hebron, California, I thought that only in America are they preserving a map of iron-Age Israel, our ancient heritage, in the names of contemporary small towns. One wonders what else they might be preserving. Another feature of small-town America is the rural-urban political divide, which up in NorCal and Oregon means State-of-Jefferson separatism. Throughout the region we saw the gold-on-green flag of Jefferson with its double cross, often paired with the Gadsden flag, the yellow one with the snake. -

BILLS: CS/CS/SB 412 FINAL HOUSE FLOOR ACTION: 112 Y’s 0 N’s GOVERNOR’S ACTION: Approved SUMMARY ANALYSIS HB 1135 passed the House on March 4, 2020, as amended. The bill was amended in the Senate on March 11, 2020, and March 12, 2020, and returned to the House. The House concurred in the Senate amendments and subsequently passed the bill as amended on March 13, 2020. The bill includes HB 27, CS/SB 108, HB 385, SB 568, SB 860, HB 873, and CS/SB 1454. There are over 120 specialty license plates available to any motor vehicle owner or lessee who is willing to pay the annual use fee for such plate. The Department of Highway Safety and Motor Vehicles (DHSMV) distributes the collected fees to statutorily designated organizations in support of a particular cause or charity. DHSMV must discontinue the issuance of an approved specialty license plate if it fails to meet certain statutory requirements. The bill authorizes the election of a permanent registration period for certain for-hire vehicles provided the appropriate license taxes and fees are paid annually. The bill makes several changes related to specialty and special license plates, including establishing a cap of 150 specialty license plates, providing a process for the discontinuation of low performing specialty license plates and the addition of new specialty license plates, and creating 32 new specialty license plates. The bill authorizes DHSMV to issue specialty license plates for fleet and motor vehicle dealer vehicles. -

MINUTES WAR MEMORIAL BOARD OF TRUSTEES PRESENTORS LIAISON COMMITTEE MEETING WAR MEMORIAL BOARD OF TRUSTEES SPECIAL MEETING Thursday, May 12, 2016 The Presentors Liaison Committee of the Board of Trustees of the War Memorial of San Francisco met at 1:00 p.m. on Thursday, May 12, 2016, in the Trustees’ Board Room, War Memorial Opera House, Committee Chair Bechtle presiding. ROLL CALL Present: Chair Bechtle, Trustee Lui, Trustee Moscone, Trustee Wilsey, President Horn, Ex officio Absent: Trustee Shultz Staff Present: Elizabeth Murray, Managing Director; Jennifer Norris, Assistant Managing Director Patina Restaurant Group request for Food and Beverage Price Increases: Chair Bechtle reported that in advance of today’s meeting, Committee members received the February letter from Patina requesting price changes to offset increases to the cost of doing business; a chart of Patina’s food and beverage pricing from 1998 to present; and a chart of beverage pricing comparisons at various San Francisco venues. Chair Bechtle stated that Committee members have today received a letter from the San Francisco Opera, Symphony and Ballet commenting on the proposed price increase and a copy of Patina’s presentation concerning proposed pricing adjustments. She said she was pleased to see so many representatives of the Symphony, Opera and Ballet present at today’s meeting. Chair Bechtle called on Patina representatives Susan Serpanchy, Patina’s General Manager at the War Memorial Complex, and Christian Muniz, Patina Vice President of Operations for Museums and Performing Arts Centers, to review their presentation. Mr. Muniz presented a packet identifying cost factors that contribute to the need for price increases including labor, union health welfare and pension, and costs for food and commodities. -

STAFF REPORT FOR CALENDAR ITEM NO.: 9 FOR THE MEETING OF: September 14, 2017 TRANSBAY JOINT POWERS AUTHORITY BRIEF DESCRIPTION: Adopt rules and regulations for the TJPA’s park on the roof of the transit center, and authorize staff to proceed with requesting proposed amendments to the San Francisco Municipal Code to make TJPA’s park a “park” subject to certain rules and regulations under the Municipal Code. EXPLANATION: The 5.4-acre park and botanical garden on the roof of the Salesforce Transit Center (named “Salesforce Park” and referred to herein as “TJPA’s park”) will be a unique open space and amenity in an area of the City with few parks. TJPA’s park is expected to be a destination for visitors that will include area residents, workers, transit riders and tourists, with programs and events (activation) designed to ensure that the open space is populated throughout the daytime and evening hours of operation. The TJPA is developing a park security program that will support the following goals: • Create an exceptional visitor experience • Preserve the park’s unique ecosystem • Enable full activation of the park • Provide a safe and secure park for all users Most San Francisco parks are owned by the City and County of San Francisco; are under the control, management, and direction of the San Francisco Recreation and Park Commission and the Recreation and Parks Department staff; and are subject to the rules and regulations in the San Francisco Park Code and other provisions of the Municipal Code. The TJPA’s park, like all other San Francisco parks, requires rules and regulations to ensure the enjoyment and safety of all visitors and preservation of the public resource. -

The Story of the Stars & Stripes By the US Marine Corps The story of the origin of our national flag parallels the story of the origin of our country. As our country received its birthright from the peoples of many lands who were gathered on these shores to found a new nation, so did the pattern of the Stars and Stripes rise from several origins back in the mists of antiquity to become emblazoned on the standards of our infant Republic. The star is a symbol of the heavens and the divine goal to which man has aspired from time immemorial; the stripe is symbolic of the rays of light emanating from the sun. Both themes have long been represented on the standards of nations, from the banners of the astral worshippers of ancient Egypt and Babylon to the 12-starred flag of the Spanish Conquistadors under Cortez. Continuing in favor, they spread to the striped standards of Holland and the West Indian Company in the 17th century and to the present patterns of stars and stripes on the flags of several nations of Europe, Asia, and the Americas. The first flags adopted by our Colonial forefathers were symbolic of their struggles with the wilderness of a new land. Beavers, pine trees, rattlesnakes, anchors, and various like insignia with mottoes such as “Hope”, “Liberty”, “Appeal to Heaven” or “Don’t Tread on Me” were affixed to the different banners of Colonial America. The first flag of the colonists to have any resemblance to the present Stars and Stripes was the Grand Union flag, sometimes referred to as the “Congress Colors”. -

This new financial system replaces the over 20-year old FAMIS system and completely changes the way the department processes and reports on financial transactions and procurement. As such, there have been some changes in the standard monthly capital report.
