MOTIONS:

4917. Motion in the name of Councillor Seán Haughey

That trim the branches of trees which are growing in the Mount Dillon Court senior citizen complex but which are seriously encroaching on the privatised laneway between Mount Dillon Court and Ardbeg Park/Road. The branches are a bit too high for the residents to cut them and leaves falling from these branches are a nuisance.

4918. Motion in the name of Councillor Seán Haughey

That Dublin City Council repair the boundary wall between Mount Dillon Court senior citizen complex and the lane at the back of 102 Ardbeg Park which is entered from Ardbeg Road. This boundary wall was built for Dublin City Council as part of the Mount Dillon Court complex.

4919. Motion in the name of Councillor Seán Haughey

That tree planting take place in the Clans area of Donnycarney and that potted plants be provided around the estate.

4920. Motion in the name of Councillor Damian O’Farrell

That this Area Committee agrees to propose that the Carlton Hall be renamed after local community activist Tommy Condron who was instrumental in the re-development of the hall.

4921. Motion in the name of Councillor Alison Gilliland

Notwithstanding the aesthetic and natural value of our natural habitats but in acknowledgment of their use as a hiding place and coverage for those engaging in anti-social behaviour (in this particular local area), that Dublin City Council remove the hedgerow in front the playground in Edenmore.

4922. Motion in the name of Councillor Micheál MacDonncha

This Area Committee calls on the Parks Dept to remove or partially remove the hedge on the outer boundary of the playground in Edenmore Park as a means of deterring vandalism and anti- social behaviour, including drinking of alcohol, in the playground. This fine facility is constantly misused by anti-social elements to the extent that many parents now have ceased to bring their children to it. The work sought to be done is modest but the local community feels that it is one element that could help to alleviate the problem.

4923. Motion in the name of Councillor Deirdre Heney

That a detailed report be given on the removal of the large tree at the corner of St. Anne’s Park at its junction with Mount Prospect and James Larkin Road as local residents are very upset about the matter.

Re: Fairview Public Realm Propoals

On Tuesday 5th May we met the National Transport Authority to discuss approval to commence the pre- Part VIII for the Clontarf to City Centre Cycle Route. It has been concluded that additional input is required into public realm issues of the project, particularly relating to landscape architectural design, as the Clontarf to Amiens Street Cycle Route is the most important cycle route on the north side of the city, is a strategic public transport corridor and a potential Bus Rapid Transit route. In this regard, a landscape architect has been employed to prepare drawings indicating proposed tree and shrub planting along the route and increase connectivity between Fairview Village and Fairview Park.

This additional landscape design detail has impacted on the project programme in terms of the preparation of a Pre-Part 8 presentation to the North Central Area Committee, which we have now scheduled for the June North Central Area Committee meeting.

We regret the delay in preparing this presentation but would estimate that it will not significantly impact on the construction of the project which is scheduled for early 2016.

16 Parking 14258 DOLLYMOUNT PARK (NC- D3 Parking Prohibition In relation to resident Recommended Following the completion of building works on Dollymount Park, a 3 23/09/2014 Prohibitions EA) parking restrictions review of the existing parking and traffic flow was conducted on the on the road. afternoon of 25/3/1015. Double yellow lines have been provided on the northern side of Dollymount Park from the junction with Clontarf Road to Dollymount Rise and on the southern side of the carriageway from the existing ramp running north west for 15m opposite Clontarf Bay Apartments. Most of the available parking on the southern side of the carriageway was taken. At 6m in width it would be normal to allow for parking on one side of the carriageway and still maintain traffic flow with vehicles giving way to each other. However it was observed that vehicles entering Dollymount Park from Clontarf Road were giving way on Clontarf Road to eastbound vehicles on Dollymount Park. These occurances cause a disruption in traffic flow and pose a potential traffic hazard on Clontarf Road. It is therefore recommended that an additional 16m of double yellow lines be provided on the southern side of Dollymount Park running north westwards from the existing double yellow lines at the junction of Clontarf Road. This measure will allow for improved traffic flow and a few remaining parking spaces to the east of the speed ramp. The restrictions west of this ramp should allow for vehicles to to pull in and give way adjacent to the Clontarf Bay Apartments. The Gardaí and D.S.P.S. will be informed regarding non compliance of the existing parking restrictions on Clontarf Road and Dollymount Park.

A review of the existing guidelines is currently being examined by the Road Safety Division in the Department of Transport Tourism and Sport, (DTT&S). with a view to examining alternative measures where ramps would not be considered an appropriate solution. To the Chairperson and Members of the North Central Area Committee

Recommendation:

Addition of: St. Benedict’s Church (ruins), Kilmore Road, Artane, Dublin 5 to the Record of Protected Structures in accordance with Section 54 and 55 of the Planning and Development Act, 2000.

Addition Application Number: ADD 480

Introduction: It is proposed to initiate procedures under Section 54 and Section 55 of the Planning & Development Act 2000 to add St. Benedict’s Church (ruins), Kilmore Road, Artane, Dublin 5 to the Dublin City Council’s Record of Protected Structures (RPS).

Name and Address of Applicant: Conservation Section, Dublin City Council

Summary of Applicant’s Reasons for Seeking Addition:

46

During the review of the 2011-2017 RPS, it came to light that St. Benedict’s Church (in ruins), Kilmore Road, Dublin 5 was not on the Record of Protected Structures. It was also omitted from the 2005-2011 RPS. It had previously been listed in List 1 of the 1999 RPS as Artane Church, St. Benedicts. It was recommended that the site be investigated and assessed to determine whether or not it should be formally added to the RPS.

47

2011-2017 Development Plan Zoning & location map: The area is zoned Z9: To preserve, provide and improve recreational amenity and open space and green networks.

Location of former St. Benedict’s Church

Historical Background & Summary Description: According to National Monuments records the church is mentioned in 1275, 1532 and 1654. In 1275 the Crede Mihi noted that the chapel at Artaine was one of three attached to the Church of Finglas (Walsh 1888, 195). Archbishop Alen's Reportorium viride of 1532 also refers to a chapel dedicated to St Nicholas (ibid. , 201). The Civil survey (1654-6) mentions the chapel of Artaine (Simington 1945, 177). The National Monuments description of the site is still correct: Today the remains comprise a rectangular building (int. dims. L 11m, Wth 5.36m, wall T. 0.75m) on a raised site in a small public park. Built of roughly-coursed calp limestone rubble. The E and W gables are partly standing. There are opposed doorways in both walls E of the W gable. Burial has taken place in the interior. Internally, a flat masonry arch spans the W ope which is blocked and a pointed arch spans the E ope. Investigations in 1982 revealed opposed doorways in W and S walls incorporating sandstone jambs of 13th to 14th century date. Fragments of 16th century floor tiles were found in the interior (Mc Mahon 1998, 157, 155-162). Memorials which, date from 1711- 1827, have been attached to the exterior of the church. Compiled by: Geraldine Stout, Date of upload: 26 August 2011, Date of last visit: 08 June 1994. Unfortunately since the site visit of 1994, it appears that some rather inappropriate repairs have been carried out particularly to the gable ends using concrete breezeblocks. It is not know when this work was carried out.

Archaeological Protection: The former church (DU014-073001) and graveyard (DU014-073002) are archaeological monuments, protected under National Monuments legislation. They are listed in the statutory Record of Monuments and Places (RMP) (established under Section 12 of the National Monuments (Amendment) Act 1994). Monuments included in the statutory RMP are legally protected and are generally referred to as “Recorded Monuments”.

Section 7.3.2 of the Architectural Heritage Guidelines state that where a protected structure is a ruin and does not have an active use, it may nonetheless be of special interest. It may be a local landmark or contribute to the character of an ACA. In such cases, it may be more appropriate to allow it to continue to stand in a ruined state and be repaired or consolidated where necessary.

There is a precedent for structures on the RPS which also have archaeological protection. These can be standing buildings, walls and also ruins. In the case of this building type, ‘ruined church’ there are eight other examples of similar ruined churches which are also included on the RPS. These are: RPS Ref Description 1145 St. Kevin’s Church (ruins) & gate, Camden Row, Dublin 8 1255 Church ruins in grounds of Clontarf Castle, Castle Avenue, Dublin 3 1515 Ruins of Chapterhouse, Christchurch Place/St. Michael's Hill, Dublin 8 1552 Ruined church, graveyard & stone cross, Church Street, Finglas, Dublin 11 3967 St. Assam’s Church (ruin) & graveyard, Howth Road, Dublin 5 4225 Killester Church (ruin in graveyard), Killester Avenue, Dublin 5 5794 Medieval Church ruin, graveyard & surrounding ringfort, Old Naas Road, Dublin 12 5830 St. Nicholas’s Church, Nicholas Street, Dublin 8

Assessment of Special Interest under the Planning and Development Act 2000. 1. Archaeological: The former church at Artane is considered to be of Archaeological significance. The building in question is first mentioned in 1275. 2. Architectural: The simple design of the church is typical of early church architecture. Its elevated parkland setting and surviving calp limestone walls make it an attractive visual amenity in the context of the local area.

Significance/NIAH Rating: The National Inventory of Architectural Heritage (NIAH) has not been carried out for this area of Dublin; however, its categories of special interest (architectural, historical, archaeological, artistic, cultural, scientific, technical & social) and its rating system has been used to assess the building in question. The NIAH identifies five categories of rating in seeking to rank buildings. The NIAH rating values are International, National, Regional, Local and Record Only (I, N, R, L, O). Structures which are considered of International, National, and Regional significance are deemed worthy of inclusion on the RPS.

49

Using the NIAH System of rating, this structure is considered to be of Regional significance. These are structures or sites that make a significant contribution to the architectural heritage within their region or area.

Recommendation: Addition of: St. Benedict’s Church (in ruins), Kilmore Road, Artane, Dublin 5 to the Record of Protected Structures in accordance with Section 54 and 55 of the Planning and Development Act, 2000.

4917 Motion in the name of Councillor Seán Haughey

That Dublin City Council trim the branches of trees which are growing in the Mount Dillon Court senior citizen complex but which are seriously encroaching on the privatised laneway between Mount Dillon Court and Ardbeg Park/Road. The branches are a bit too high for the residents to cut them and leaves falling from these branches are a nuisance.

Reply:

Housing Maintenance Northside Mobile Crew cut back and pruned the trees in this location within the past year. We do not normally remove or prune back trees unless they are unstable or unsafe. Our Mobile Crew will assess the trees in our Older Persons complex at this location later in the year, however there are no plans to carry out this work currently.

4919 Motion in the name of Councillor Seán Haughey

That tree planting take place in the Clans area of Donnycarney and that potted plants be provided around the estate.

Reply:

The roadside in the Clans area of Donnycarney have been examined on a number of occasions in the past with a view to identification of suitable roadside tree planting pits. However, due to the widths of footpaths and the concentration of both underground and over ground services and utilities it has not been possible to identify such tree planting locations. Parks and landscape services are not in a position to supply and maintain the requested potted plants throughout the estate. Should any residents have an interest in forming a community environmental group in the area contact can be made with the Public Domain Officer of the North Central Area to identify how Dublin City Council can support such a group.

4922 Motion in the name of Councillor Micheál MacDonncha

This Area Committee calls on the Parks Dept to remove or partially remove the hedge on the outer boundary of the playground in Edenmore Park as a means of deterring vandalism and anti-social behaviour, including drinking of alcohol, in the playground. This fine facility is constantly misused by anti-social elements to the extent that many parents now have ceased to bring their children to it. The work sought to be done is modest but the local community feels that it is one element that could help to alleviate the problem.

4923 Motion in the name of Councillor Deirdre Heney

That a detailed report be given on the removal of the large tree at the corner of St. Anne’s Park at its junction with Mount Prospect and James Larkin Road as local residents are very upset about the matter.

Reply:

The tree on the corner or Watermill Road and James Larkin Road was made safe for health and safety reasons. The tree referred to was a mature specimen of Cupressus macrocarpa (Monterey Cypress). The tree had stood as a land mark for many years and the difficult decision to remove it and reduce its canopy was taken to prevent damage to persons or property.

The crowns of Mature Cupressus macrocarpa become brittle and shed branches, which is the nature of this particular tree species and in the wild in a remote landscape this of course is not an issue. However as this particular tree stood immediately adjacent to a major road junction and traffic lights, the risk to life and property was too great to keep the tree as it was.

As the tree has been such an important part of the landscape particularly for the local community it is Dublin City Council’s intention to mark this trees existence by commissioning an artist to sculpt the tree trunk and for that reason the tree was cut down to a height that makes it safe and leaving the rest in the hands of the artist.

The old dilapidated boundary wall immediately in front of the tree will be removed and a lower wall will be built behind the tree enabling the new art work to be a focal point at the Junction. Had this tree not been in an area of high risk and in another part of St Annes Park , it would not have been necessary to remove it.

4924 Motion in the name of Councillor Deirdre Heney

That the manager confirm the suggestion of establishing a choir for people suffering with dementia and their carers’ as part of the Raheny Age Friendly Village project is being taken on board as part of the project and updated report be made on the progress of the project to date.

Reply:

Raheny is part of the Age Friendly Towns initiative which is part of the wider national Age Friendly City and Counties programme , currently operational in all Local Authorities. The programme’s vision is“ to make every county in Ireland a great place in which to grow old. Various forms of consultations and discussions have taken place with people in Raheny based around the eight themes , Outdoor Spaces and Buildings, Transportation, Housing , Social Participation , Respect and Social Inclusion, Civic participation and Employment Communication and Information , Community Support and Health Services . The Raheny Age Friendly Action Plan has been developed based on the issues brought forward during consultations with older people. Some of the priority actions identified and agreed by the Steering Group include:

 Install flat, smooth footpaths with level gradient along Main Street area  Set up Community Club and create a place for people to socialise and share information on an ongoing basis.  Produce a local information leaflet relevant to older people.  Work with the Business Community to create a Universally Accesible Raheny  Investigate improving access to and /or relocation of the HSE medical centre on Main Street

Action Areas:

The Community Club - First session will begin on Wednesday 3rd June in Cara Hall , Raheny. An information session will be given by the Director of Nursing at St. Josephs Hospital, Raheny. To date we have received a keen interest in the club from Volunteers and members . It is planned to hold the meetings on a monthly basis.

Physical Improvements: - We have met the Management of Iarnrod Eireann with the objective of improving the Dart Station in Raheny.

- Dublin City Council Roads and Traffic Department will commence work on main street in July 2015. Additional seating has been ordered and will be put in place at key locations in Raheny over the next few months.

- The Gardai have secured funding to install a new lift at the Garda Station as the existing gradient on the ramp was unsuitable for all wheelchair users.

- Access improvements to be implemented at Super Valu shopping centre complex.

68

The Business Initiatives - The Business Community in Raheny have agreed to participate in the Age Friendly Business Programme and we would hope to see all business’ delivering new ways of assisting the older customers. - .The Banks in Raheny have received training from Dementia Ireland in dealing with customers who are suffering with dementia or showing early signs . The Community Garda, Sgt Jim Clavin has also been involved advising the Post Offices and Banks of procedures if they consider the older person may be in a vulnerable position or being placed under duress .

The Area Office is aware of an existing choir for dementia sufferers and their carers in Baldoyle, Forget Me Not Choir is actively seeking new members. Currently there are no plans to set up such a choir in Raheny. We are currently working to establish the Community Club in Raheny and to progress the actions listed above. Perhaps in the future when the Club is firmly established in the area members may give consideration to implementing other projects, such as the possibility of a choir.

Q.3 Question in the name of Councillor Larry O’Toole

“To ask the Area Manager to respond to this housing query (details supplied).”

Reply:

The applicant (details supplied) first applied for housing in 2008 and had her application cancelled in the 2013 Assessment of Housing Need and not in 2011 as she had advised the Councillor. The correspondence from the Allocations Section she provided to the Councillor is dated May 2012.

It is the responsibility of the applicant to notify the City Council of any change in their circumstances. When every new application is being made, applicants are required to sign a declaration to this effect and Allocations Staff emphasise the importance of notifying the Council of any change in circumstances particularly any change of address.

During each Assessment, in addition to the first letter being issued, a reminder letter is also sent and a final letter advising the applicant that failure to respond will result in the application being cancelled. When an Assessment is being carried out notices are also placed in national and local newspapers. The City Council does apply a grace period whereby if an applicant does make contact before the end of the Assessment year, their application is reinstated.

At the moment, this applicant has no application with the City Council and would be advised to complete a new application as soon as possible.

Q.8 Question in the name of Councillor Declan Flanagan

“To ask the Chief Executive to respond to the following (details supplied).”

Reply:

Under the Planning and Development Regulations, 2001, planning permission is required for the creation of, widening of a vehicular access to a domestic dwelling. A copy of the grant of planning permission should be submitted with any request for a dishing.

However, where no planning permission exists and the new entrance has clearly been in existence for a long time it will be necessary to prove by sworn affidavit that the entrance has been in use as a vehicular access for a period of seven years. Please note that a sworn affidavit is a letter of declaration signed / witnessed by a solicitor or peace commissioner. The standard domestic concrete dishing fee of €557 would apply for construction of a new dished driveway up to 7 square metres. An additional fee of €79 is charged for each additional square metre of concrete which may be required. Q.46 Question in the name of Councillor Alison Gilliland

“To ask the Area Manager whether a developer could request a partial taking in charge of an estate e.g. take the roads in charge initially and then then take the other elements of the infra- structure in charge at a later date and, if this is not possible, could partial requests be negotiated at a local level.”

Reply:

The circumstances under which a Planning Authority will consider a request to have a development taken in charge are outlined in Section 180 of the Planning and Development Act 2000.

The section makes reference to the elements of a development that may be taken in charge i.e. “ new roads, open spaces, car parks, sewers, watermains or drains” which form part of a planning permission. It also specifies that the development must be “completed to the satisfaction of the planning authority in accordance with the permission and any conditions to which the permission is subject”.

Therefore before an application for taking a development in charge can be considered all of the services outlined above must be completed.

There is no provision in the Act to take some services in charge or to take part of a development in charge.

Q.48 Question in the name of Councillor Michael O’Brien

“To ask the area manager to comment on the email attached (details supplied) from a resident complaining about the removal of a Cedar tree at the corner of St Anne's estate and Watermill Road.”

Reply:

The tree on the corner or (details supplied) was made safe for health and safety reasons.

Had this tree not been in an area of high risk and in another part of (detail supplied), it would not have been necessary to remove it.

Q.59 Question in the name of Councillor Micheál MacDonncha

“To ask the Area Manager (details supplied).”

Reply:

This strip of land referred to above is a part of the open space and was railed off to provide protection to the boundary wall of buildings which immediately abut the park directly. There are difficulties with access into the area and when the railing was installed it was proposed that the commercial premises would be responsible for cleaning the area..

Consideration is being given currently to modify the railing to improve access for cleaning purposes. It is considered that volume of litter generated from park use is minimal and most of accumulation arises from dumping.

Q.68 Question in the name of Councillor Deirdre Heney

“Can the Manager please refer to my constituent as per (details supplied) who is in need of housing and say if she and her six year old daughter can be considered for same by Dublin City Council and if not, if the Council can agree to accept her onto the list and recommend her for voluntary housing and say what other housing options are available to (details supplied).”

Reply:

People who own property are not eligible to be considered for social housing support. In some instances applicants who own property but are in financial difficulties with their mortgage provider and where the mortgage has been deemed unsustainable or a court order for repossession is in place may be considered for social housing subject to the submission of the relevant documentation.

This person who jointly owns a property with her sister may wish to seek independent legal advice on the matter. It would not be possible to consider accepting a housing application from any individual in the circumstances as outlined.

DUBLIN CITY COUNCIL NORTH CENTRAL AREA COMMITTEE 18th May 2015

Q.69 Question in the name of Councillor Deirdre Heney

“Can the manager please refer to derelict house which is now in a dangerous condition at location as per (details supplied) and

6. say what enforcement action has been taken in relation to this property to date 7. say if he is aware the building is in a dangerous condition and say what action from a dangerous buildings point of view can be taken to allay fears of nearby residents 8. say if he will arrange to have Dangerous Buildings Section visit the property as soon as possible as local residents fear the building may collapse and cause a danger to human life as very large cracks are now appearing all over it 9. arrange to have the pest control section treat the site for rodent infestation as local residents complain of a serious problem at details attached 10. say if he can arrange to have an official from the City Council contact my constituent to allay her fears about this derelict dangerous building.”

Reply:

Planning permission for the redevelopment of the building concerned expired in 2009 at which stage the redevelopment works were uncompleted. Under the provisions of section 40 of the Planning and Development Acts 2000-2014, any development carried out in compliance with planning permission during the ‘life’ of that permission remains authorised. Further permission is required to complete the development.

The Planning Authority has no power to oblige the property owner to seek such further permission. Nor can enforcement measures be taken as unauthorised development has not taken place. Any possible dangerous or derelict nature of the development must be addressed under the appropriate legislation.

This site has been on the Derelict Sites Register since 2011 and there is a charge on the land.

The Health Service Executive should be contacted with regard to rodent infestation on private property.

Following an extensive fire and subsequent inspection, Dangerous Buildings Section has engaged a contractor and temporary works engineers from the Dangerous Buildings panel of qualified contractors to carry out emergency works viz. to remove the second and first floors due to structural instability caused by the fire and the fact that the structure lies adjacent to a school playground.

The premises have been secured, and the works proposals are being examined. Ownership details are being sought and a DB1 Notice will issue.

Q.72 Question in the name of Councillor Deirdre Heney

“Can the manager please refer to my previous representations to senior officials re problem with crack in wall at side of house as per (details supplied) and say if direct contact can be made with my constituent in the matter.”

Reply:

The Dangerous Buildings Inspector reports that the wall is not regarded as dangerous under the Local Government (Sanitary Services) Act 1964 as amended at this time.

However the owner is being advised to engage an engineer to report on the cracks and submit to DB Section to prevent a danger arising.

Failure to act in a timely manner to report (21 days) will oblige DB Section to investigate independently under the Act, take whatever action (if any) is necessary and counter charge the Owner.
