January 2021 (valid from 01.01.2021 6:00 to 01.10.2021 6:00) Introduction This pricelist contains supplemental provisions to the shippers’ capacity contracts for which also the “General Terms and Conditions En- try / Exit Contracts (entry / exit system) – GT&C-EEC of Gasunie Deutschland Transport Services GmbH (“GUD”) as amended (“GT&C-EEC”) apply. Furthermore this pricelist contains supplemental provisions to the contracts on a capacity ordering of the down- stream transmission system operators for which also the “Kooperationsvereinbarung zwischen den Betreibern von in Deutschland gele- genen Gasversorgungsnetzen” (“KoV”) as amended applies. The GT&C-EEC as well as the KoV are published at https://www.gasunie.de. This pricelist implements in particular the provisions based on the following decisions of the Federal Network Agency (Bundesnetz- agentur): - decision concerning the periodic decision making regarding the reference price methodology and the other points listed in Article 26(1) of Regulation (EU) No 2017/460 applicable to all tramsmission system operators operating in the GASPOOL entry-exit sys- tem (“REGENT-GP”, BK9-18/611-GP) - decision concerning the determination of the level of multipliers, the determination of a discount at entry points from LNG facilities and at entry points from and exit points to infrastructure developed with the purpose of ending the isolation of Member States in respect of their gas transmission systems and the determination of the level of discounts for interruptible standard capacity prod- ucts at all interconnection points (“MARGIT”, BK9-18/612) as well as - regarding requirements for conversion of annual demand charges to demand charges for capacity rights for periods of less than a year and reguirements for proper determination of transportation tariffs in accordance with Section 15, Paragraph 2 to 7 GasNEV („BEATE 2.0“, BK9-18/608). Due to regulatory requirements (decisions “REGENT-GP” (BK9-18/611-GP) and “AMELIE” (BK9-18/607)), a postage stamp RPM is in place since 01.01.2020 and reference prices of GUD have been calculated accordingly. These regulatory requirements have been appealed by third parties. The Higher Regional Court of Düsseldorf dismissed the appeals on 16th September 2020. The complainants have appealed to the Federal Court of Justice (BGH) against the decision of the OLG Düsseldorf. Therefore, it cannot be excluded that in the course of and as a result of these legal disputes the regulatory requirements could be changed and thus the reference prices could be increased both for the future and retroactively. This is why GUD reserves the right to amend the reserve prices on the basis of legal / regulatory decisions. In addition, GUD reserves the right to request the difference between the reference price paid by the shipper and the new reference price established on the basis of a legal / regulatory decision. January 2021 (valid from 01.01.2021 6:00 to 01.10.2021 6:00) Explanation a) „net point type (Type)“: GÜP cross border interconnection point NKP net connection point to downstream network operators MÜP market area interconnection point STORAGE storage connection point BIOGAS biogas connection point OTHERS other connection point NAP net access point, end consumers b) „complex point“: Complex points according to section 13 (paragraphs 6 and 7), GT&C-EEC are particularly characterized by special services in the course of a matching procedure by third parties which are required or by the necessity of manual processes for the implementation of the matching on at least one side, foreign network operators are affected or at least on one side of a net connection point a pipeline is affected, which is in the ownership of several network operators (“Bruchteilseigentum”). The respective points are marked in in column „remarks“ of the pricelist. The implementation period according to section 13 (paragraph 5) GT&C-EEC has to be considered. c) transport charge: The claim to payment of an entry and/or an exit capacity charge (transport charge in accordance with the present Number 1 to 10 of this pricelist) arises at the beginning of the initial day of the transmission customer’s relevant capacity contract in accordance with Sections 1, 3, 4 GT&C-EEC, or of the contract or-dering capacity (IB) for a downstream network operator in accordance with Section 11 of KoV as amended applies. The definitions contained in the GT&C-EEC of GUD are applicable. Unless otherwise expressly stipulated or evident from the relevant con- text, terms used in the singular form also apply to the plural form and vice-versa.
