His contender may feel inclined to challenge the legitimacy of the vote, an effort in all probability doomed to failure. In the coming months Yanukovych is expected to oust Tymoshenko as Prime Minister and form a favouring government. With 48.95% of the popular vote, Yanukovych outdid rival Tymoshenko who scored slightly fewer votes, closing at 45.47%. The total of 4.4% of the ballots were cast against the two main contenders, thus giving the winner less than 50% of the votes. The insignificant difference in the number of ballots cast for each of the candidates may push Tymoshenko to seek an appeal requesting the courts to nullify the election result. In her election night address she failed to acknowledge Yanukovych’s victory. Even before the ballot her campaign team warned of Yanukovych’s fraudulent plans and advertised irregularities in the elections statute. What may underlie the potential attempt to undermine the election result will not be the desire for the ballot to be run again (a scenario having little chances of success in light of positive appraisal of the vote by monitoring teams) but rather the hope to persuade Yanukovych and his Party of Regions to seek compromise with the PM currently in office. -

Hrusthevskoho 5 01008, Kyiv, Ukraine Dear President Yanukovych and Chairman Lytvyn: I write on behalf of the Association of the Bar of the City of New York (the “Association”) to express our condemnation of Draft Law No. 8711 passed by the Verkhovna Rada on October 2, 2012 (the “Draft Law”) and currently scheduled for a second reading on October 16, 2012.1 In the Association’s view, the Draft Law threatens the fundamental rights and freedoms of individuals who are lesbian, gay, bisexual and transgender (“LGBT”) and Ukrainian individuals and organizations that support LGBT rights. Moreover, because the explanatory note to the Draft Law claims that the “promotion” of homosexuality is tied to the spread of HIV/AIDS,2 the Draft Law not only will stigmatize the Ukrainian LGBT community but also will hamper rather than help public health efforts with regard to HIV/AIDS. In their view, Ukraine could move closer to integration in Euro-Atlantic institutions, real democracy and the rule of law, and a genuine free market economy, or it could move toward a Russian sphere of influence with “managed democracy” and an oligarchic economy. For the past decade, Ukraine’s political scene had been dominated by President Leonid Kuchma and the oligarchic “clans” (regionally based groups of powerful politicians and businessmen) that have supported him. The oligarchs chose Prime Minister Viktor Yanukovych as their candidate to succeed Kuchma as President. The chief opposition candidate, former Prime Minister Viktor Yushchenko, was a pro-reform, pro-Western figure seen by many observers as a man of high personal integrity. International observers criticized the election campaign and the first and second rounds of the election as not free and fair, citing such factors as government-run media bias in favor of Yanukovych, abuse of absentee ballots, barring of opposition representatives from electoral commissions, and inaccurate voter lists. Nevertheless, Yushchenko topped the first round of the vote on October 31 by a razor-thin margin over Yanukovych. -

FOREWORD FOREWORD It is an honour for me to present this compendium which includes papers, practical information and proposals for combating fraud and corruption based on experience of the Supreme Audit Institutions (SAIs) in Central, Eastern Europe and Asia. The book was prepared upon the results of the EUROSAI International Conference “The Role of Supreme Audit Institutions in Fighting Against Fraud and Corruption” hosted by the Accounting Chamber of Ukraine on September 1921, 2006 in Kyiv. The EUROSAI event was attended by 61 participants from 24 SAIs among which were present Presidents of 16 SAIs. The participants discussed the following subthemes: • Subtheme I: The Role of SAIs in the National System Development of Fighting Against Fraud and Corruption; • Subtheme II: Peculiarities of SAIs Cooperation with the Law Enforcement Bodies during Exposure and Prevention of Fraud and Corruption; • Subtheme III: The Practice of SAIs in Implementation Transparency and Publicity in the Field of Fighting Against Fraud and Corruption. The Conference was supported by the Parliament of Ukraine, the Cabinet of Ministries of Ukraine and by the number of Ukrainian government authorities which participated in this event. I would like to pass special thanks to all of my colleagues, Heads of the SAIs for their interest in the Conference and willingness to share experience and modern techniques in fighting against fraud and corruption. I am very pleased that the initiative of the Accounting Chamber of Ukraine received great feedback among the EUROSAI community. I am deeply convinced that this event stimulated and consolidated efficient collaboration between SAIs and that approved Recommendations will further facilitate applying common actions towards combating such negative phenomena as fraud and corruption. -

No other European country suffered as much as TUkraine, whose currency was devalued by more than 60 percent since its peak of 4.95 hrv per $1 in August 2008. In addition, the country’s industrial production fell by 31 percent in 2009. Prime Minister Yulia Tymoshenko con- fronted the challenge of minimizing the crisis fallout, while at the same time campaigning for the 2010 presi- dential elections. Her critics attacked her for pursuing populist policies, such as increasing wages and hiring more government staff, when the state treasury was broke as early as the spring. Ms. Tymoshenko herself admitted that her gov- ernment would not have been able to make all its pay- ments without the help of three tranches of loans, worth approximately $10.6 billion, provided by the International Monetary Fund. Her critics believe that instead of borrowing money, Ms. Tymoshenko should have been introducing radical reforms to the Ukrainian economy, reducing government waste, eliminating out- dated Soviet-era benefits and trimming the bureaucracy. Those who have followed Ukrainian politics for a relatively long time might recall the notorious "Group 239" in the 1st parliament (1990-1004), also known as a group "For a Soviet Sovereign Ukraine". The influential block consisted mainly of high- ranking Communist party apparatchiks and "red directors" that lobbied the election of former chief Ukrainian ideologist Leonid Kravchuk to replace Volodymyr Ivashko in July 1990. Among other possible candidates for the position was Ihor Yukhnovsky, MP, nominated by the democratic People's Council. At that time member of the parliament Anatoly Kinakh, 35, was not a member of the Group 239, but belonged to the oppositional People's Council - which was rather exotic for a politician from Southern Ukraine and an industrialist. On May 29, 2001, 239 votes were cast in favor of approving Kinakh, member of the 3rd parliament and chairman of the Ukrainian Union of Industrialists and Entrepreneurs, in the position of Prime Minister of Ukraine. The new government is the tenth since Ukraine gained its independence in August 1991. Having approved the nomination of Kinakh the Ukrainian parliament, apparently, passed a test for being "democratic", "pro-market" and "society-conscious". Noteworthy, at the height of debates about potential candidates to occupy the top executive position President Leonid Kuchma warned publicly that the voting would "let us see who is who in the parliament, whether those who declare market reforms are really democrats" and that "we will see who really stands on the basis of democracy and market reform and who is just a salesman who speculates on the situation, cares about his own interests and interests of his clan" (UNIAN, May 25, 2001). -

UKRAINE: Gongadze convictions are selective justice Tuesday, March 25 2008 EVENT: The Gongadze file is not closed until the instigators of his murder have been held to account, Council of Europe rapporteur Sabine Leutheusser-Schnarrenberger said on March 19. SIGNIFICANCE: The three-year trial of three former policemen accused of killing journalist Georgii Gongadze has ended in jail terms of 12-13 years, but inside and outside Ukraine there have been calls for the investigation to move onto those behind the murder. One of the main factors why former supporters are so disillusioned with President Viktor Yushchenko -- who now has approval ratings of just 10% -- rests on his poor handling of the investigation of a murder that he promised as a matter of honour to resolve. ANALYSIS: The origins of the November-December 2004 wave of protests against election fraud that became known as the Orange Revolution lie in the 'Kuchmagate' crisis of four years earlier. In November 2000, Socialist Party leader Oleksandr Moroz, an opponent of President Leonid Kuchma while Moroz was parliamentary speaker in 1994-98, revealed to parliament tapes made in the president's office. They were part of hundreds of hours recorded by a Security Service (SBU) officer in the presidential guard, Mykola Melnychenko, in 1999-2000. Melnychenko was working for former SBU Chairman Yevhen Marchuk, who had a poor relationship with the then SBU head, Leonid Derkach. Marchuk accused Derkach and the SBU of involvement in Ukraine's illegal arms trade, and campaigned in the 1999 elections on an anti-Kuchma platform. The compromising intelligence on the tapes could have been used to force Kuchma to step down early and appoint a strongman, such as Marchuk, just as power was transferred in Russia from President Boris Yeltsin to Vladimir Putin in 1999-2000. -

Can Ukrainian Communists and Socialists Evolve to Social Democracy? OLE:XIY HARAN' n the Ukrainian political lexicon, the term "Left" usually refers to parties that I are to the left of both social democracy in its traditional understanding and to the left of several Ukrainian social democratic parties. In fact, one of the prob- lems for Ukrainian politics is the absence of a real and strong social democratic party; the quite influential Social Democratic Party of Ukraine/United- SPDU(o)-represents the interests of the oligarchs and could discredit the very idea of social democracy; and the three other social democratic groups are not influential. The main parties of the Ukrainian Left are the Communist Party of Ukraine (CPU), reborn in 1993 (with around 140,000 members, mostly from the older generation), and the Socialist Party of Ukraine (SPU), created in the autumn of 1991 (with a current membership of sixty thousand). In addition to these, both the Peasant Party of Ukraine (SeIPU, 1992) and the Progressive Socialist Party of Ukraine (PSPU, 1996) were relatively active in the second half of the 1990s (see figure 1). Regarding its future stance, the Left in Ukraine has choices to make: between commumism and social democracy., and between pro-Russian and pro-European choice. In this article, I will maintain that although the non-modernized Com- munists seem to have no chances oí` coming to power, the more moderate Social- ists could come to power in coalition with other forces (mainly centrist), but that would require more flexibility from them as well as their transformation into a center-left force.
