Meddommere: Ernst Henning Eielsen, Diana Patricia Fynbo, Anne Elisabeth Wisløff. 8. juni - Rettens beslutning om kringkasting av vitnet Malt: Retten legger til grunn at vitnets gjenstående forklaring vil omhandle alternative fortolkninger av de observasjoner de sakkyndige har redegjort for i sine rapporter. Dette kan kaste lys over om tiltalte var psykotisk 22. juli 2011, og den privatengasjerte sakkyndige kan forklare seg om dette selv om det samtidig innebærer vurdering av alternative diagnoser. De alternative diagnosene synes behandlet i de sakkyndiges rapporter, i hvert fall i rapporten fra Tørrissen og Aspaas. Retten har ikke fått overlevert det notatet vitnet benytter under sin forklaring, og som partene har fått tilsendt. Retten anser vitnet som en privatengasjert sakkyndig etter straffeprosessloven § 149. Og som privatengasjert sakkyndig har han fremlagt en kopi av foilene i sin powerpointpresentasjon, som er å anse som et hjelpedokument for retten som kan sammenlignes med en disposisjon. Etter rettens mening vil kringkasting ikke få uheldig virkning for behandling av saken og den vil heller ikke medføre en urimelig belastning for tiltalte. Det er da ikke grunnlag for å endre rettens tillatelse til kringkasting. Beslutningen er enstemmig. TOSLO-2011-188627-22 Side 1.

Trond Lie Nilsen (Counsel Finn Eide) (1) Justice Arntzen: The case concerns financial settlement after the cancellation of an agreement for purchase of a flat in Spain. (2) In the spring 2014, Trond Lie Nilsen entered into an agreement with Propiedades Rott SL (hereafter referred to as Propiedades) for purchase of a flat in a planned building project in Villajoyosa, Spain. Propiedades is a company registered in Spain engaging in property development directed to the Norwegian market, among others. Ninety percent of the shares in the company are owned by Valor AS, which in turn is owned by the Norwegian Terje Rott and his family who have residence in Norway. Nilsen is a Norwegian citizen with residence in Norway. He bought the flat for private use. (3) On 7 March 2014, the parties signed a “binding purchase confirmation”. The purchase confirmation was written in Norwegian and signed in Norway. The purchase price was EUR 660 000 with the addition of 10 percent Spanish VAT (IVA). Upon signing, Nilsen transferred a “deposit” of EUR 11 000 to the seller’s Spanish bank account. (4) The agreement was revised twice in 2015, latest by a “binding purchase agreement” signed 25 September 2015 in Spain. The seller’s deadline for having the flat ready for takeover was set to 1 June 2016.

Breivik grew up in an expensive area in Oslo. But his home life must have been miserable from the start. His father, a diplomat, disappeared more or less completely from his life. And One of Us: The Story of a Massacre and its Aftermath mother was a depressive, self-destructive woman who thought of sending her boy and his sister to an orphanage. Attempts to join groups or make friends almost always ended in humiliation. He made up for his social failures by dreaming of personal grandeur. He did have one childhood friend, called Ahmed, the son of Pakistani immigrants. Norwegian kids laughed at these pretensions; Ahmed moved away. After finishing high school, Breivik tried various schemes to make One of Us: The Story of a Massacre and its Aftermath money, such as selling advertising space by telephone, and failed. He later succeeded for a while by peddling fake university diplomas on the internet, but this too ran into the sand when he was in danger of being exposed. At one point, joining the Freemasons seemed an attractive way to cut a figure in a secret society, but after being introduced to a lodge by a relative, Breivik got bored and never attended.

Tematekst Rettsprosessene Hvordan har det norske rettsvesenet behandlet gjerningsmannen? Etter terrorangrepene 22. juli 2011 ble gjerningsmannen dømt som tilregnelig til 21 års forvaring med en minstetid på ti år. Fornærmede og etterlatte har fått voldsoffererstatning. Både straffesaken mot terroristen og erstatningssakene for å avgjøre voldsoffererstatning var utfordrende for det norske rettsvesenet, på grunn av omfanget av sakene og den voldsomme interessen fra offentligheten. Under de første avhørene av Breivik på Utøya etter pågripelsen ga han inntrykk av at det var sannsynlig med flere nært forestående angrep. I løpet av avhør på politihuset den 23. juli 2011 – etter at Geir Lippestad var oppnevnt til Breiviks forsvarer – ble det etter hvert klart at trusselen om nye angrep ikke var reell. Det var Breivik som ba om Lippestad som forsvarsadvokat. For å ivareta rettsstaten – som Breivik hadde angrepet – tok Lippestad oppdraget. Hvorvidt gjerningsmannen var psykotisk (ofte omtalt som «sinnssyk» eller «gal»), eller om han kunne dømmes som tilregnelig, var et stort og betent spørsmål helt fra arrestasjonen og frem til domfellelsen. Det kan også fortsatt ansees som betent. Det henger sammen med at så godt som alle de som er enige med Breivik når det gjelder skepsis til et flerkulturelt samfunn og innvandring, mente terroraksjonen var en gal og forkastelig måte å gi uttrykk for denne skepsisen på. Dersom Breivik var utilregnelig, kunne handlingene hans forklares som psykotiske og ikke som voldelige uttrykk for ideologiske standpunkt. Terrorhandlingenes brutalitet fikk imidlertid mange – uavhengig av ideologi – til å mene at Breivik måtte være «gal» - altså utilregnelig. Aktorene Inga Bejer Engh og Svein Holden la i tiltalen ned påstand om utilregnelighet, med støtte i den første rettspsykiatriske utredningen, men ikke i den andre.

The 22 July Massacre in Norway was Fake part 5 1 What is history? The lie that everyone agrees on. —Voltaire by Aurora Alberios First published February 21, 2020 This is a follow-up paper to the series of papers that Miles wrote on the Norway massacre, which purpose is to provide a wider context for the 22nd of July events in 2011. In Norway, the Breivik massacre is simply known as 22/7 or 22nd of July. People will just give the date and everyone knows what you mean. Since we don’t have too many terrorist events in this country, 22/7 came as a shock to people and many used the word surreal to describe it. Such things happen in American cities or London or Paris and not here. Most people think of Norway as a quiet and peaceful corner of the world where nothing much happens and so 22/7 stood out as an oddity, something that didn’t fit in with the rest. We learned from Miles’ papers that this didn’t start in 2011 as we could follow the lines from several central figures of the event all the way back to WW2. In this essay, I will provide some extra background material that is less accessible. I won’t focus on just one event or person, rather I will try to weave a tapestry within which 22/7 will seem like less of an oddity. While most people who have looked at this event managed to spot the fake victims of the Oslo bombings, very few except for Miles, Cluesforum and some obscure blogs have suggested that the Island shootings were also faked.

Beatrice de Graaf Terrorism trials are an exceptional opportunity for better understanding and, hence, countering terrorism, since they are often the only place where most if not all of the actors of a terrorist incident meet again, and where the media report and broadcast their respective accounts. A nexus between terrorist violence, law enforcement and public opinion, terrorism trials showcase justice in progress and thus demonstrate to the world how terrorism suspects are treated under national law. editors This volume views terrorism trials as a form of theatre, where the “show” that a trial may offer can develop often unexpected dynamics, which at times might inconvenience the government. Seeing terrorism trials as a stage where legal instruments are used (and abused) to argue ON TRIAL TERRORISTS the validity of contested political constructs, this study presents a performative perspective to draw attention to the mechanisms and effects of terrorism trials in and outside the courtroom. With a special focus on how the power of these performances may in turn shape new narratives of justice and/or injustice, it offers vital insights into terrorism trials directed involving different types of terrorism suspects, from left-wing to ethno-nationalist and jihadist terrorists, in Spain, Russia, Germany, the Netherlands, and the United States. Beatrice de Graaf holds a chair in the History of International Relations & Global Governance at Utrecht University. She was co-founder of the Centre for Terrorism and Counterterrorism at Leiden University, TERRORISTS publishes on security-related themes and is currently working on secu- rity in the nineteenth century for an ERC Project SECURE.
