Ukraine's Presidential Election Result

His contender may feel inclined to challenge the legitimacy of the vote, an effort in all probability doomed to failure. In the coming months Yanukovych is expected to oust Tymoshenko as Prime Minister and form a favouring government. With 48.95% of the popular vote, Yanukovych outdid rival Tymoshenko who scored slightly fewer votes, closing at 45.47%. The total of 4.4% of the ballots were cast against the two main contenders, thus giving the winner less than 50% of the votes. The insignificant difference in the number of ballots cast for each of the candidates may push Tymoshenko to seek an appeal requesting the courts to nullify the election result. In her election night address she failed to acknowledge Yanukovych’s victory. Even before the ballot her campaign team warned of Yanukovych’s fraudulent plans and advertised irregularities in the elections statute. What may underlie the potential attempt to undermine the election result will not be the desire for the ballot to be run again (a scenario having little chances of success in light of positive appraisal of the vote by monitoring teams) but rather the hope to persuade Yanukovych and his Party of Regions to seek compromise with the PM currently in office. -

No other European country suffered as much as TUkraine, whose currency was devalued by more than 60 percent since its peak of 4.95 hrv per $1 in August 2008. In addition, the country’s industrial production fell by 31 percent in 2009. Prime Minister Yulia Tymoshenko con- fronted the challenge of minimizing the crisis fallout, while at the same time campaigning for the 2010 presi- dential elections. Her critics attacked her for pursuing populist policies, such as increasing wages and hiring more government staff, when the state treasury was broke as early as the spring. Ms. Tymoshenko herself admitted that her gov- ernment would not have been able to make all its pay- ments without the help of three tranches of loans, worth approximately $10.6 billion, provided by the International Monetary Fund. Her critics believe that instead of borrowing money, Ms. Tymoshenko should have been introducing radical reforms to the Ukrainian economy, reducing government waste, eliminating out- dated Soviet-era benefits and trimming the bureaucracy. The Negative Consequences of Proportional Representation in Ukraine
THE NEGATIVE CONSEQUENCES OF PROPORTIONAL REPRESENTATION IN UKRAINE SERHIJ VASYLCHENKO POLITICAL GEOGRAPHER Abstract: Ukraine has changed its electoral law numerous times. The first two elections to the parliament in 1990 and 1994 employed a single-member district majoritarian system. The Verkhovna Rada elections in 1998 and 2002 used a mixed system with single- member districts and proportional representation. The parliamentary elections in 2006 and 2007 were purely proportional representation. Finally, the elections in 2012 went back to the mixed system. This article argues that the use of proportional representation has facilitated extensive manipulation in the Ukrainian political system through the creation of “party projects” and by severing the link between parliamentarians and their constituents. fter Ukraine gained its independence in 1991, it faced an urgent need Ato reform its electoral legislation to address new political realities – most importantly, the development of a multiparty system in place of the previous one-party system that had ruled the Soviet Union. Opinion to the President of the Parliamentary Assembly 1 1. On 23 January 2012, the still unratified credentials of the parliamentary delegation of Ukraine were challenged on procedural grounds, in accordance with Rule 7 of the Assembly’s Rules of Procedure, on the ground that the composition of the delegation did not satisfy the criterion of fair representation of the political parties or groups. 2. At its meeting on 24 January 2012, the Committee on Rules of Procedure, Immunities and Institutional Affairs examined the various objections raised and established that the Ukrainian delegation to the Parliamentary Assembly was appointed in compliance with Article 25 of the Statute of the Council of Europe and Rule 6 of the Assembly's Rules of Procedure, as regards the fair representation of political parties and groups in the delegation. 3. Consequently, the Committee concludes that the credentials of the Ukrainian parliamentary delegation should be ratified. 4. However, the Committee notes that the list of members of the Ukrainian delegation as transmitted to the President of the Parliamentary Assembly contains misleading information in particular as regards the political affiliation of three members: Mr Valeriy Pysarenko, representative, and MM Oleksandr Feldman and Volodymyr Pylypenko, substitutes, listed as members of the Yuliya Tymoshenko Bloc, actually sit in the parliament under other political labels. -

ELECTION OBSERVATION DELEGATION TO THE PARLIAMENTARY ELECTIONS IN UKRAINE (28 October 2012) Report by Pawel Kowal, Chair of the Delegation 1 Introduction Following an invitation by Mr Volodymyr Lytvyn, Chairman of the Parliament of Ukraine, the Conference of Presidents of the European Parliament authorised, on 6 September 2012, the sending of an enlarged delegation of 15 Members to observe the parliamentary elections in Ukraine on 28 October 2012. The Conference of Presidents also authorised the Bureau of this delegation to travel to Ukraine on a pre-electoral visit ahead of election day, in order to meet relevant interlocutors and prepare the ground for the election observation delegation itself. At its constitutive meeting on 27 September, the Delegation appointed Mr Pawel Robert KOWAL, Chair of the Delegation; Mr Michael GAHLER, Mr Juan Fernando LÓPEZ AGUILAR and Mrs Rebecca HARMS were appointed Vice-Chairs. Background Prior to the elections, the European Union has repeatedly emphasised that these would be an important test of Ukraine’s democratic credentials. In the latest resolution of European Parliament of 24 May and in the Final Statement and Recommendations of Nineteenth Meeting of EU-Ukraine PCC the importance of the parliamentary elections for further progress in realtions of Ukraine with the EU was underlined. Since the 2010 presidential election, the governing coalition formed by the Party of Regions, the Communist Party and the People’s Party/Lytvyn Bloc, has enjoyed a clear majority in parliament. These parties competed against opposition parties, primarily the United Opposition–Batkivshtchyna (Motherland) and the non-parliamentary parties United Democratic Alliance for Reform (UDAR) and Svoboda (Freedom). -

Ukraine: Current Issues and U.S. Policy Steven Woehrel Specialist in European Affairs March 2, 2010 Congressional Research Service 7-5700 www.crs.gov RL33460 CRS Report for Congress Prepared for Members and Committees of Congress Ukraine: Current Issues and U.S. Policy Summary On February 7, 2010, Viktor Yanukovych defeated Prime Minister Yuliya Tymoshenko to win Ukraine’s presidency. International monitors praised the conduct of the election. President Yanukovych will try to form a parliamentary majority from parties in the current parliament. If he cannot, new parliamentary elections will have to be held later this year. The global economic crisis has hit Ukraine hard. Ukraine’s real Gross Domestic Product fell by an estimated 15% in 2009. In November 2008, the International Monetary Fund approved a $16.4 billion standby loan for Ukraine to bolster its finances. The loan was conditioned on a commitment from Ukraine to allow its currency to depreciate in a controlled way, to recapitalize the banking sector, and to pursue more rigorous fiscal and monetary policies. Political infighting during the presidential election campaign hindered Ukraine’s implementation of the conditions of the IMF loan. A post-election struggle for a parliamentary majority could further delay Ukraine’s reforms. Under the leadership of former President Viktor Yushchenko, Ukraine sought integration into the global economy and Euro-Atlantic institutions. In the longer term, Yushchenko set the goal of Ukrainian membership in the European Union and NATO. Relations with Russia have been tense over such issues as Ukraine’s NATO aspirations and energy supplies. President Yanukovych has said he will pursue closer ties with Russia, especially in the economic sphere. -

ELIAMEP Briefing Notes 02/2013 January 2013 Report on Ukrainian Parliamentary Elections 2012 By Theocharis Grigoriadis, and Dimitrios Moschos1 Slavic, Eurasian and East European Studies Programme, ELIAMEP, Greece Introduction Ukraine has been the territorial core of Eastern Slavs. The nations of Russia, Ukraine, and Belarus emerged out of Kievan Rus and the principalities surrounding Kiev. Its history has been intertwined with the grand strategies of Russia and Poland, as it has been always treated as a land of contestation and imperial expansion for both countries. For Russia, Ukraine and particularly Kiev has symbolized the ancient roots of Russian culture, the cradle of its Orthodox heritage and its maritime exit to the Black Sea; For Poland, the locus of its imperial politics in the East and the expansion of Catholicism in the western borders of Russia. The violent annexation of Volhynia and Galicia (Western Ukraine) from Poland into the Soviet Union as part of the Ribbentrop-Molotov Pact in 1939 altered irreversibly the ethnic and religious map of Ukraine. More specifically, it paved the way for the clashes and conflicts that were observed in Ukrainian society and politics in the aftermath of the country’s post-Soviet independence. Ukraine’s Shift under President Yanukovych Since Viktor Yanukovych’s rise to the Ukrainian Presidency in March 2010, there has been a radical change in Ukrainian politics. The mottos of the Orange Revolution have been substituted with an effort to restore relations with Russia without alienating the European Union and, less importantly so, the United States. Even though Mr. Yanukovych openly committed himself to achieve a balanced stance in Ukrainian foreign policy, in reality what has been observed is a return to the Soviet style of Russian- Ukrainian relations.
