Introduction This pricelist contains supplemental provisions to the shippers’ capacity contracts for which also the “General Terms and Conditions En- try / Exit Contracts (entry / exit system) – GT&C-EEC of Gasunie Deutschland Transport Services GmbH (“GUD”) as amended (“GT&C-EEC”) apply. Furthermore this pricelist contains supplemental provisions to the contracts on a capacity ordering of the downstream transmission system operators for which also the “Kooperationsvereinbarung zwischen den Betreibern von in Deutschland gele- genen Gasversorgungsnetzen” (“KoV”) as amended applies.

This pricelist implements in particular the provisions based on the following decisions of the Federal Network Agency (Bundesnetz- agentur): - decision concerning the periodic decision making regarding the reference price methodology and the other points listed in Article 26(1) of Regulation (EU) No 2017/460 applicable to all tramsmission system operators (“REGENT 2021”, BK9-19/610) - decision concerning the determination of the level of multipliers, the determination of a discount at entry points from LNG facilities and at entry points from and exit points to infrastructure developed with the purpose of ending the isolation of Member States in respect of their gas transmission systems and the determination of the level of discounts for interruptible standard capacity products at all interconnection points for the calendar year 2021 (“MARGIT 2021”, BK9-19/612) as well as - regarding requirements for conversion of annual demand charges to demand charges for capacity rights for periods of less than a year and reguirements for proper determination of transportation tariffs in accordance with Section 15, Paragraph 2 to 7 GasNEV („BEATE 2.0“, BK9-18/608)including the - amendment of this order concerning the discount of capacity fees for interreuptible capacitiy products in the H-Gas network to be calculated in accordance with operative part 2 lit. b) (BK9-20/608).

Due to regulatory requirements (decisions “REGENT-GP” (BK9-18/611-GP) and “AMELIE”(BK9-18/607)), a postage stamp RPM is in place since 01.01.2020 and reference prices of GUD have been calculated accordingly. The regulatory requirements REGENT and AMELIE have been appealed by third parties. The Higher Court OLG Düsseldorf dismissed the appeals in 16th September 2020. The complainants have appealed to the Federal Court of Justice (BGH) against the decision of the OLG Düsseldorf. For the new german Market area Trading Hub Europe (“THE”) two new descisions REGENT 2021 (BK9-19/610) and AMELIE (BK9-19/607) were enacted by the BNetzA. These decisions have been appealed by third parties, too. As a result of possible legal disputes it cannot be excluded that regulatory requirements could be changed and thus the reference prices could be increased both for the future and retroactively. This is why GUD reserves the right to amend the reserve prices on the basis of legal / regulatory decisions. In addition, GUD reserves the right to request the difference between the reference price paid by the shipper and the new reference price established on the basis of a legal / regulatory decision.

Explanation a) „net point type (Type)“: GÜP cross border interconnection point NKP net connection point to downstream network operators BIOGAS biogas connection point STORAGE storage connection point NAP net access point, end consumers OTHERS other connection point b) „complex point“: Complex points according to section 13 (paragraphs 6 and 7), GT&C-EEC are particularly characterized by special services in the course of a matching procedure by third parties which are required or by the necessity of manual processes for the implementation of the matching on at least one side, foreign network operators are affected or at least on one side of a net connection point a pipeline is affected, which is in the ownership of several network operators (“Bruchteilseigentum”). The respective points are marked in in column „remarks“ of the pricelist. The implementation period according to section 13 (paragraph 5) GT&C-EEC has to be considered.

c) transport charge: The claim to payment of an entry and/or an exit capacity charge (transport charge in accordance with the present Number 1 to 10 of this pricelist) arises at the beginning of the initial day of the transmission customer’s relevant capacity contract in accordance with Sections 1, 3, 4 GT&C-EEC, or of the contract or-dering capacity (IB) for a downstream network operator in accordance with Section 11 of KoV as amended applies. The definitions contained in the GT&C-EEC of GUD are applicable. Unless otherwise expressly stipulated or evident from the relevant con- text, terms used in the singular form also apply to the plural form and vice-versa.

2. Capacity charge on storage connection points

For capacity bookings at storages a uniform discount of 75 % on the capacity charge for firm freely allocable capacity will be granted in accordance with REGENT 2021 Tenor no. 2. This discount is applied to the capacity charge for the booked capacity product.

Divergent are storages which allows access to a market of a cross-border country. At such storages GUD is obliged to offer a capacity charge without discount. Only if the storage operator can prove beforehand and in due time the compliance with the conditions listed in BK9-19/610 (REGENT 2021) Tenor no. 2 GUD is obliged to offer a discounted tariff. If one or more of the conditions named above are not being fullfilled anymore within the year 2021, GUD is obliged to only offer a non discounted tariff at the affected network point with im- mediate effect.

If a discounted capacity shall subsequently used for exit to a market of a neighbouring country, no separate capacity bookings are required according to the REGENT 2021-decision, boundary-number 547-551. Instead of such bookings, GUD may, on application of the Shipper, subsequently charge the corresponding specific capacity fees and transfer the capacity into a non-discount account. The shipper shall inform GUD of this with a lead time of 5 working days using using the storage re-booking data sheet, published in the download area. The duration a rebooking must be at least one gas day.

The following table shows the discounted and non-discounted specific capacity fee at storage network points for firm freely allocable capacities (FZK) based on an order period of 365 consecutive days (366 days in a leap year). The discounted capacity charge is only shown if the conditions named in Section 2 are fullfilled.

3. Interruptible capacity charge (interruptible)

In general the interruptible capacity charge in accordance with Section 9, chapter 1 GT&C-EEC for network points in the L-Gas transmission system is ninety (90) percent of the specific charge stated in Article 1 and 2 of this pricelist. For interruptible internal order according to Section 11 Paragraph 8 of the KoV the same apply for L-Gas. For H-Gas, in general the interruptible capacity charge in accordance with Section 9, chapter 1 GT&C-EEC is eighty (80) percent of the specific charge stated in Article 1 and 2 of this pricelist. The same applies for interruptible internal order according to Section 11 Paragraph 8 of the KoV for network points in the H-Gas transmission system.

By way of derogation from Section 1 different discount factor for interruptible capacities according Section 9, Paragraph 1 GT&C-EECof the specific capacity fee stated in Article 1, 2 and 6 apply at the network points listed below.

4. Dynamically-allocable capacity charge (DZK)

The dynamically-allocable capacity charge in accordance with Section 2, chapter 1 GT&C Supplementary Terms and Conditions is ninety (90) percent for L-Gas and eighty (80) percent for H-Gas of the specific charge stated in Article 1 and 2 of this pricelist. Dynamically- allocable capacities are marked in Article 1 and 2 of this pricelist.

5. Charges for products with a duration of less than one year and for withinday products

The share value of the charge for products with a duration of less than one year is calculated by the multiplication of the capacity charge according to Sections 1 to 4 of this pricelist and the share value of 1/365 for every booked day (1/366 in leap years).

The share value of the charge for withinday products is calculated by the multiplicaton of the capacity charge according to sections 1 to 4 of this pricelist and the share value of 1/8760 for every booked hour (1/8784 in leap years).

Depending on the runtime of the booked capacity the share value, determined accourding to Section 5, sentence 1 and 2 of this pricelist, needs to be multiplicated with the following multipliers according to “MARGIT 2021” and “BEATE 2.0”:

The capacity charge for internal orders with a durtaiton of less than one year, especially in case of adjustments according to Section 15 KoV, can be calculated analogue.

6. Increased charge in case of capacity-overruns incorporated and ordered capacity (Section 30, Paragraph 4 GT&C-EEC) If the allocated hourly gas quantities at an entry or exit point exceed one hundred (100) percent of capacity incorporated to the balancing group for an entry or exit point or one hundred (100) percent of the ordered capacity, an hourly capacity overrun occurred. In case of one or several hourly capacity overruns during a gas day, a claim of GUD to payment of a higher charge arises according to Sec- tion 18 Paragraph 7 KoV or Section 30 Paragraph 4 GT&C-EEC respectively. The higher charge shall amount to the maximum hourly overrun (difference between the capacity actually used, on the one hand, and the capacity incorporated to the balancing group or the ordered capacity, on the other hand) multiplied by three (3) times the applicable entry capacity charge or exit capacity charge for withinday- capacities in case the respective booked or ordered capacity incorporated to the balancing group or the ordered capacity is a withinday product. If the runtime of the booked or ordered capacity is a day or longer the applicable entry or exit capacity tariff on a daily-basis is applied for the abovementioned calculation.

7. Invoicing charge for meter operation and metering Pursuant to Section 13, Paragraph 3 and Section 15, Paragraph 7 GasNEV, no separate invoicing charge in accordance with Sec- tion 25, Paragraph 1 GT&C-EEC for meter operation and metering will be levied.

8. Biogas levy Pursuant to Section 7 KoV and Section 25, Paragraph 1 GT&C EEC, the biogas levy is levied in addition to the charges listed in Article 1 to 6 of this pricelist for all bookable and orderable exit capacities at exit points with the exception of cross border interconnection points (GÜP)and storage connection points (STORAGE). The uniform nationwide biogas levy for the calender year 2021 is 0.6250 [€/(kWh/h)/a].

9. Market Conversion Levy („Marktraumumstellungs-Umlage“) Pursuant to Section 10 KoV and Section 25, Paragraph 1 GT&C EEC, the specific levy for market conversion is levied in addition to the charges listed in Article 1 to 6 of this pricelist for all bookable and orderable exit capacities at exit points with the exception of cross border interconnection points (GÜP)) and storage connection points (STORAGE). The uniform nationwide market conversion levy for the calendar year 2021 is 0.7291 [€/(kWh/h)/a.

10. Conditions concerning transport tariffs charges and payments (Section 25, Paragraph 11 GT&C-EEC) Shippers shall pay invoice amounts, plus VAT at the applicable rate, by credit transfer to the bank account stated on the invoice within ten (10) days of receipt of invoice or not later than the 15th day of the same month, whichever is the earlier. Payments are due in Euro (€) according to SEPA procedures. Banking fees in relation to payments without SEPA will be passed on to the customer otherwise. The foregoing due dates for payment are the dates of credit of the amounts to the stated account..

11. Invoicing and payments on account (Section 26, Paragraph 1 First Sentence GT&C-EEC) 1. GUD will invoice the shipper monthly the charges in accordance with Article 1 to 7 plus the other charges in accordance with Article 8 to 9 of this pricelist and taxes in accordance with Section 27 GT&C-EEC. Number 2 of this article remain unaffected. 2. Higher tariffs due to capacity overruns in accordance with Section 4 of the Supplementary Terms and Conditions (Appendix 2 GT&C- EEC), are invoiced as soon as the necessary billing data are available. 3. All invoice amounts are calculated in Euro (€) to two decimal places in accordance with customary business practice (being rounded up if the third decimal place is five or more and rounded down if the third decimal place is four or less). The rounding-off takes place at the end of the calculation per invoice line item. GUD reserves, at rounding which breeds to a fee of zero (0) Euro, to invoice a rounded fee of one (1) Euro.

12. Default interest If a day of payment is not keeped GUD is entitled to charge interest, without prejudice of other claims. The interest is calculated according to Sections 288, 247 BGB based on the German Interest Methode (30/360).

13. Additional Settlements for invoicing for downstream network operators according to Sections 18, 53 KoV

All fees and other charges are calculated in Euro (€) to two decimal places in accordance with customary business practice (being rounded up if the third decimal place is five or more and rounded down if the third decimal place is four or less). The rounding-off takes place at the end of the calculation. GUD reserves, at roundings which breeds to a fee of zero (0) Euro, to invoice a rounded fee of one (1) Euro.

1. GUD will invoice the downstream network operator the charges in accordance with Article 1 to 7 plus the other charges in accordance with Article 8 to 9 of this pricelist and taxes in accordance with Section 53 KoV monthly at the beginning of each calendar month. Number 2 of this article remain unaffected. 2. Charges for the overrun of ordered capacity are invoiced to the downstream network operators in accordance with Sections 18, Para- graph 6 KoV as soon as the necessary data measurements are completed. 3. The downstream network operator shall pay invoice amounts, plus VAT at the applicable rate, by credit transfer to the bank account stated on the invoice within ten (10) days of receipt of invoice or not later than the 15th day of the same month, whichever is the earlier. The foregoing due dates for payment are the dates of credit of the amounts to the stated account. Payments are due in Euro (€) according to SEPA procedures.
