AN ORDINANCE RELATING TO EDUCATION

BE IT ENACTED by the for Palestine with the advice of the Advisory Council thereof:—

Short Title. 1. This Ordinance mav be cited as the Education Ordinance, 1932.

Definitions. 2. In this Ordinance and any Regulations thereunder :—

" Schoolmeans any institution in which more than ten persons are taught systematically, and in which any person imparts education.

"Government School" means any school established and controlled by the Government of Palestine.

"Public School" means any school maintained wholly or in part either by the Revenue of the Government of Palestine or by the revenue of any local authority, and registered in accordance with the provisions hereof as a public school.

"Assisted School" means a school, other than a public school, to which, under the provisions of this Ordinance, a grant is made by the central or any local authority, or any share of a grant so made is allotted.

"Community School" means any school of which the . proprietor is a Community or local committee of a Community organised [under the Religious Communities Organisation Ordinance, 1926, or exercising jurisdiction in accordance with Article 51 of the Palestine Order-in- Council, 1922.

"Private School" means a school other than a public school, an assisted school, or a community school.

"Director" means the Director of the Department of Education.

"Manager", in the case of a school which is conducted by the proprietor, means the proprietor; and in the case of every other school, means the person for the* time being appointed to be the responsible representative of the proprietor.

"Proprietor", in relation to a school, means any person, association, community or corporation by whom or which a school is established or conducted.

"Village" includes any village in which there is not a a Municipality or a Local Council.

"Village Authority" means the village council, if such exists, and otherwise the mukhtar or mukhtars of the village. 16th February, 1932 OFFICIAL GAZETTE 121

PART I.

GENERAL

3.—(1) Public schools shall be classified according to the Public schools, principal language of instruction. schools established by the Government and such Hebrew schools as are included in the Schedule to this Ordinance shall be deemed to be public schools; and the Director may, subject to Regulations hereunder, at any time register any school as a public school.

(2) In the discharge of his functions in regard to any group of public schools established or maintained in part by a Local Authority [or an Association, the Director shall consult with such authority or Association.

4. Every school, other than a Government school, which Registration of at the date of this Ordinance has not been registered with the scnools• Department of Education shall within three months of the coming into force of this Ordinance be so registered. Every school which is opened after the date of this Ordinance shall be registered within a mouth of the opening of the school. Application for registration shall be made by the Manager to the Director, and such particulars shall be given as may be prescribed from time to time by Regulation under the Ordinance.

5. The proprietor of every school, other than a Government Appointment of •er־§school, which is not conducted by the proprietor shall notify Mana to the Director the appointment of some person connected with the school and resident in Palestine to be the responsible representative of the proprietor to whom any communication from the Government relating to the school may be addressed; and he shall at all times thereafter have a representative and shall notify the Director of any change either in the person or the address of his representative within 14 days after any such change is made. In default, the proprietor shall be liable, on conviction, to a fine not exceeding LP.10.

6. —(1) The Director of the Department of Health and any Sanitary Medical Officer of Health or Sanitary Officer authorised in conditions of writing by him may at all reasonable times enter any school and inspect the sanitary and hygienic conditions in the school premises, and may require the Manager or the person for the time being in charge of the school to furnish returns showing the number of the teachers and pupils and the accommodation provided.

(2) The Director may serve written notice on the Manager or the Proprietor of the school to carry out within three months of the date of the notice any requirement of a Medical or Sanitary Authority.

(3) If it is shown to the satisfaction of the High Commissioner that after the term of such notice has expired the requirements have not been executed and the school is being conducted in sanitary conditions detrimental to the health of the teachers or pupils, the High Commissioner may by notice to be served on the Proprietor or Manager order the school to be closed as from the date specified in the notice.

7.—(1) The Director or Deputy Director, a District Com- Inspection and missioner, an Inspector of the Department of Education, and vlslt of schools any other officer authorised in writing by the Director, may at all reasonable times enter and inspect any school other than a non-assisted school established or maintained by a Religious Association. The Manager or the person for the time being in charge of the school shall during the inspection and at other times furnish, in such form as may be prescribed by Regulation hereunder, any information which the Director or the Inspecting 122 OFFICIAL GAZETTE 46th February, 1932

Officer may require with regard to the care, tuition and attendance of pupils, the general management of the school, and the names and qualifications of the teachers. .

(2) The Director or the Deputy Director may at any time after reasonable notice has been given to the Manager, visit any non-assisted school established or maintained by a Religious Association, and the Manager or the person for the time being in charge of the school shall furnish at the visit or at other times any information which the Director or the Deputy Director may require with regard to the care and tuition of pupils, the general management of the school, and the names and qualifications of the teachers. The Director shall not be entitled to demand any change in the curriculum or the internal administration of the school;

provided that nothing in this Sub-section shall prevent the High Commissioner from exercising suoh supervision over any school as may be required for maintenance of public order and good government.

Registration and 8.—(1) No person shall act as a teacher in any school unless Licensing of he has registered with the Director within three months of the Teachers. date of the Ordinance or within one month of his appointment as a teacher, whichever shall be the later date, the particulars prescribed by Regulation under this Ordinance.

(2) No person may teach in a public or assisted school who does not possess a licence to teach issued to him by the Director in accordance with Regulations under this Ordinance.

(3) The Director may require the dismissal of any teacher, whether in a public or assisted school or in a non-assisted school, who has been convicted of a criminal offence involving moral turpitude, or who is shown to the satisfaction of the High Commissioner, after judicial enquiry by a Judge or Magistrate appointed for the purpose, to have imparted teaching of a seditious, disloyal, immoral, or otherwise harmful character.

Closing of 9 If it is shown to the satisfaction of the High Commissioner schools. that :—

(a) a school is being conducted which is not duly registered;

{b) a school is being conducted in a manner contrary to good order and morals;

(c) education is being imparted in a school by a teacher whose dismissal has been required by the Director in accordance with the provisions of Section 8 hereof; the High Commissioner may, by notice to be served on the Proprietor or Manager, order the school to be closed as from the date specified in the notice.

Offences and 10.—(1) The Proprietor or Manager of a school who: — penalties. (a) fails to register the school in accordance with the provisions hereof;

(b) knowingly allows education to be imported by a person who has not been registered as a teacher or whose dismissal has been required by the Director under Section 8 (3) of this Ordinance;

(2) The Manager or person in charge of a school who refuses to admit an officer duly authorised to enter and inspect the school or to visit the school, or refuses or neglects to give such officer any information which he is required to give under Sections 6 and 7 hereof, or gives information which he knows to be false, shall be liable on conviction to the same penalty. (3) The Manager of a school which has been ordered to be closed who (a) fails to close the school within the time specified in the notice; or (b) without the sanction of the High Commissioner reopens the school, or opens or conducts any other school;

shall be liable on conviction to a fine not exceeding LP.100; and if the offence continues after conviction, to imprisonment for a term not exceeding three months.

PART II.

LOCAL EDUCATION AUTHORITIES.

11.—(1) Every Municipal Council and any such Local Council Local Education as the High Commissioner shall appoint shall be a Local Education Authorities in Authority, and shall form a Committee or Committees for the Municipal, etc., areas. purpose of education in the area of the Council. A Committee shall be composed of members of the Council forming it, such Government officers and headmasters as may be prescribed by Regulation hereunder, and such other persons as the Council, with the approval of the District Commissioner, may think fit.

(2) In a village where there is no Local Council, but where at the date of this Ordinance a school other than a community or private school exists, or where at any time the Director is of opinion that a school should be established, the village authority shall be the Local Education Authority and shall establish a committee for the purpose of education in accordance with Regulations hereunder.

(3) Any Local Education Authority may enter into an agreement with any Committee of a Community for the purpose of maintaining a community school.

12. —(1) A Local Education Authority shall, when required by Local Education the Director, be responsible for opening a new school and for Authority may impose rate. maintaining wholly or in part existing schools in its area other than community schools or private schools.

(2) A Local Education Authority may impose a rate on the inhabitants of its area for the purposes of education according to Regulations to be prescribed by the High Commissioner in Executive Council.

(3) If a Local Education Authority fails to collect a rate adequate to maintain the school or schools within its area, the High Commissioner in Executive Council shall have power to impose and to enforce payment of the necessary rate as if it were a Government tax.

(4) Where a separate community school exists within the area of a Local Education Authority and no agreement has been made by such authority with the Committee of the Community with regard to the maintenance of the community school, the District Commissioner may, subject to the approval of the High Commissioner, allocate to such community school a part of the rate collected by the Local Education Authority, not being greater than the total amount of the rate paid by the rate-payers belonging to the community. Vesting-of 13. Any school building which may, after this Ordinance property in Local comes into force, be established or maintained by a Local Education Authority. Education Authority shall be vested in that authority; and, if the school building is owned by the authority, shall be registered without payment of registration fees in the Land Registers in its name, subject to a trust for the purpose of education.

PART III.

MISCELLANEOUS

Regulations. 14. The High Commissioner in Council may make Regulations for the purpose of giving effect to this Ordinance, and in particular, with regard to:—

(a) the form of registration of schools and the conditions under which a school shall be registered as a public school.

(b) The form of attendance registers and attendance returns.

(c) The form of notification to be given of the opening of a school.

(d) The application for and the allowance of grants to assisted schools.

(e) The inspection of schools.

(f) The instruction to be given at public and assisted schools other than religious instruction at assisted schools.

(g) The examination of persons to be employed as teachers other than persons imparting religious instruction ex• clusively at an assisted school or non-assisted school.

Power of High 15.—(1) The High Commissioner may by order exempt from Commissioner to all or any of the provisions of this Ordinance an Institution for exempt certain the higher education or the technical or other education of institutions from the whole or part adult persons. of the Ordinance. (2) The High Commissioner shall exempt from the provisions of Sections 7 (2) and 8 (1) hereof any non-assisted school at which religious instruction exclusively is given ; provided that application is made for such exemption, and the High Com• missioner is satisfied that no instruction other than religious instruction is given, and that nothing herein shall prevent the High Commissioner from exercising such supervision over the school as may be required for the maintenance of public order and good government.

Ottoman Law not 16. The Ottoman Law of Primary Education, dated 1332 to have effect. A. H. and any Ottoman Regulations concerning primary education; and Articles 140 and 141 of the Ottoman Penal Code shall no longer have effect in Palestine.

AN ORDINANCE TO PROVIDE FOR THE DENATURING OF SPIRITS FOR USE IN INDUSTRY AND OTHERWISE THAN FOR HUMAN CONSUMPTION

BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof:—

1. This Ordinance may be cited as the Methylated Spirits Short Title. Ordinance, 1932.

2. In this Ordinance:— Definitions.

" Director" means the Director of Customs, Excise and Trade.

'*Officer" means an officer of the Department of Customs, Excise and Trade.

" Licence" means a licence under this Ordinance granted by the Director or a person authorised by him.

'4Licensee" means a person to whom a licence has been granted under Section 3.

*4Methylate" means to mix spirits with such substance or substances as shall be prescribed, so as to render the mixture unfit for use as a beverage; and "methylated spirits" means spirits so mixed to the satisfaction of the Director.

" Mineralised methylated spirits" means methylated spirits with or in which there has been mixed or dissolved such kind of mineral naphtha as may be prescribed.

4*Industrial methylated spirits" means any methylated spirits, other than mineralised methylated spirits, which are intended for use in any art or manufacture.

3.—(1) No person shall methylate spirits unless he has Persons obtained a licence which shall be issued free of charge. authorised to ° methylate. (2) The following persons and no others, may be granted a licence: —

Persons licensed under the Intoxicating Liquors Ordinance, 1927, to manufacture spirits who methylate such spirits on the premises in which they are manufactured.

(3) A licensee shall give such security for the due performance of his obligations as may be prescribed.

4. The premises to be used for methylation shall form part Approval of of the premises licensed under the Intoxicating Liquors Premises- Ordinance, 1927, and shall be constructed to the satisfaction of the Director, and shall be used as prescribed. Each of the doors of the premises approved for methylation shall be secured by two locks. The key of one lock shall be held by the licensee and the key of the other by an officer.

5.—(1) A licensee shall make entry in the prescribed manner Entry of of the premises, vessels, and ,utensils intended to be used in Premises• his business, and shall cause the same to be marked in such manner, and shall provide such staples and fastenings as may be approved. (2) No alteration of any premises, vessels, or utensils shall be made without the approval of the Director.

(3) If any premises, vessels, or utensils used by a licensee are not entered or marked in the prescribed manner or if any alteration is made which has not been approved, he shall be liable in respect of each offence to a fine not exceeding LP.50.

(2) All vessels in which methylated spirits are stored, kept, or supplied by a licensee shall be marked or labelled in such a manner as to show whether the contents are industrial or mineralised methylated spirits. If a licensee fails to comply with this provision he shall, in respect of each offence, be liable on conviction to a fine not exceeding LP.50.

Permit to use 9.—(1) The •Director may grant a permit to any person industrial to receive industrial methylated spirits for use in any art or methylated spirits. manufacture carried on by him. The applicant for a permit shall give such security as may be prescribed that he will use the industrial methylated spirits only for the purpose specified, and that he will observe the provisions of this Ordinance and any Regulations made thereunder.

(2) A licensee shall not supply industrial methylated spirits to any person who does not produce a permit to receive such spirits. In default, he shall be liable to pay on any spirits so supplied the highest rate of duty applicable to spirits under the Intoxicating Liquors Ordinance, 1927.

Accounts of stock. 10.— (1) An officer shall keep an account of the stock of all ' spirits methylated by a licensee.

(2) [n addition, a licensee shall keep a stock book with distinct accounts in the prescribed form of industrial methylated spirits and mineralised methylated spirits respectively. He shall enter daily, and at any time when required by an officer, the quantity of any industrial methylated spirits and of any mineralised methylated spirits manufactured, stored and delivered by him. Such entries shall be made in such a way as to distinguish between the quantities of spirits manufactured, stored and delivered respectively.

(3) If the quantity of methylated spirits in the possession of a licensee exceeds by more than two per cent, the quantity which should be in his possession in accordance with his stock book, such excess shall be forfeited.

(4) If the quantity of methylated spirits in the possession of a licensee is less by more than two per cent, than the quantity which ought, by the stock account, to be in his possession, he shall pay on the deficiency the highest rate of duty applicable to spirits under the Intoxicating Liquors Ordinance, 1927, provided that the Director may remit the whole or any part of such duty if he considers that the deficiency is due to natural causes. 16th February, 1932 OFFICIAL GAZETTE 127

11.—(1) An officer may at any time enter and inspect the Powers of entry, premises of a licensee or a retailer of methylated spirits, 1118P^1^11 and or of any person authorised to receive methylated spirits, and samp ing' inspect, examine, and take samples of any such spirits on the premises.

(2) If any person obstructs an officer in the exercise of his powers under this Section, he shall, in respect of each offence, be liable on conviction to a fine not exceeding LP.50.

12. 13. (2) The High Commissioner in Council may from time to time vary the excise duties.

(3) The Director may suspend or revoke any licence, permit, or approval granted under this Ordinance or any Regulation made thereunder.

17. The High Commissioner may make Regulations for any Regulations, of the following purposes :—

(a) specifying the substances to be used for methylation, the proportions in which they are to be used, and the time and method of methylation: (b) as to the security to be given by a licensee or by a person authorised to use industrial methylated spirits;

(c) as to the sale, delivery, and removal of methylated spirits ;

(d) As to the conditions 4under which industrial methylated spirits may be used in any art or manufacture;

(f) as to the form of permits, licences, applications for a licence, and such other forms as may be found necessary by the Director; (g) generally for carrying out the purposes of this Ordinance.

Penalties. 18. Any person who contravenes any of the provisions of this Ordinance or any Regulation made thereunder for which no specific penalty is prescribed shall be liable on conviction to a fine not exceeding LP. 50.

Power of the 19. The Director and any other officer authorised in that Director to compound behalf by the High Commissioner, may compound any offence offences. or act committed, or reasonably suspected of having been committed by any person against the provisions of this Ordinance or any Regulation made thereunder, by accepting from such person a payment in money not exceeding the maximum pecuniary penalty incurred under this Ordinance for such offence or act, and in all cases whatsoever in which any property has been seized as liable to confiscation under this Ordinance, may release the same on payment of the value thereof as estimated by such officer. On the payment of such sum of money, or such value, or both, as the case may be, to such officer, the accused person, if in custody, shall be discharged, the property seized shall be released, and no further proceedings shall be taken against such person or property. All monies received under this Section shall be paid to the General Revenues of Palestine.

Rewards. 20. The High Commissioner may order to be paid in respect of each detection of any offence under this Ordinance, to the person or persons detecting the offence or giving the information which led to the detection such reward as he may think fit; provided that in no case shall a reward exceeding the sum of LP.200 be paid to any one person except with the prior approval of one of His Majesty's Principal Secretaries of State.

Application of 21. Save as provided in Sections 9 (2) and 10 (4), the Intoxicating provisions of the Intoxicating Liquors Ordinance, 1927, shall Liquors Ordinance, 1927. not apply to spirits which have been methylated.

(196) EXTRADITION ORDINANCE, 1926

PROCLAMATION BY THE HIGH COMMISSIONER

WHEREAS by Section 3 of the Extradition Ordinance, 1926, it is provided that where an arrangement is in force between His Britannic Majesty and a foreign State for the surrender of fugitive criminals from the to that State, the High Commissioner may apply the Ordinance in the case of that foreign State as though it was an arrangement between His Majesty and that foreign State for the surrender of fugitive criminals to that State from Palestine.

AND WHEREAS arrangements are in force between His Britannic Majesty and Mexico for the surrender of fugitive criminals;

Now, therefore, in exercise of the powers vested in me by the said Ordinance, GENERAL SIR ARTHUR GRENFELL WAUCHOPE, His Majesty's־I, LIEUTENANT High Commissioner for Palestine and Commander-in-Chief therein, do hereby proclaim that from and after the date hereof, the Ordinance shall apply in the case of Mexico.

And the Proclamation under the Ordinance which was given at Jerusalem by the High Commissioner on the 27th day of March, 1931, and published in the Gazette of the 16th April, 1931, withdrawing Mexico from the list of Foreign States to which the said Ordinance applies, is hereby cancelled.

(197) AIR NAVIGATION ORDER, 1927

AUTHORISATION

IN VIRTUE of the powers conferred on the High Commissioner by Section 27 (2) of the Air Navigation (Colonies, Protectorates and Mandated Territories) Order, 1927, I hereby authorise MR. HANS GRUSE, a citizen of the Republic of Germany, to fly over the territories of Palestine and Trans-Jordan and to land therein during •the months of February and March in an aeroplane D 2127, Modell Klemm L/26 H , in the course of a flight between Germany and Africa subject to the following conditions: (i) the said aeroplane shall alight at and remain in such aerodromes or other places only as the High Commissioner shall approve;

(ii) the occupants of the aeroplane shall deposit with the Local Police Authority all firearms in their possession at the time of their first arrival in Palestine, to be held in custody by the Police until the final departure of the aeroplane from Palestine;

(iii) during such time as the aeroplane shall remain in Palestine or Trans- Jordan it shall make no flights save with the prior approval of the High Commissioner;

(iv) permission to land at any aerodrome or landing ground controlled by the Royal Air Force is given on the understanding that the occupants of the aeroplane will observe any conditions which may be imposed by the Royal Air Force Authorities in regard to the carriage or use of cameras in aircraft. The conditions in force until further notice provide that no photographs shall be taken of any buildings, works or defences occupied by armed forces of His Majesty.

WHEREAS a town planning scheme known as the Jerusalem West Central Area Scheme was provisionally approved by the Central Town Planning Commission on the 10th June, 1930, and notice of the deposit of the said scheme was published in the Gazette of the 16th June, 1930;

AND WHEREAS all objections to the said scheme have been considered and the Central Town Planning Commission at its meeting on the 28th January, 1932, has applied to the High Commissioner to put the said scheme in force;

AND WHEREAS the said scheme with the plan annexed has been produced to the High Commissioner and has been signed by him;

WfDTH AND ALIGNMENT OF ROADS ORDINANCES, 1926-1927

IN EXERCISE of the powers vested in him by Sections 3, 4 and 5 of the Width and Alignment of Roads Ordinance, 1926, and with the advice of the Executive Council, the High Commissioner has ordered that the Ordinance shall be applied to the road mentioned below and that the said road shajl be widened to a width of 20 metres and that no permanent work of improvement shall be carried out within a distance of 10 metres from the centre of the said road:

The Acre-Safad road, from Km. 190.620 on the Acre-Ras en Naqura road to Km. 209.500 on the Rosh Pinna-Safad road, passing through the villages of Majd el Kurum, Er Rama and Ein ez Zeitun.

2. Registration of the following may be effected without regard to the area or breadth of a parcel:— Buildings. The site on which a building is erected, or which is reserved for a building. Private or party roads. The yard appurtenant to a house. Wells and land appurtenant to wells. Private streams and irrigation channels. Private threshing-floors. Private quarries. "Matrukeh" used for general public purposes or for the public purposes of the village. 3. Where the breadth of a parcel is less, but the area is not less than any of the prescribed minima, the Settlement Officer may at his discretion order the adjustment of the boundaries of a parcel or parcels with the boundaries of an adjoining parcel or parcels by the exchange of land of equal value. 4—(!) A fragment of land which under the terms of this Order may not be registered, shall be added to the land of an adjoining owner who shall pay to the owner of the fragment compensation which shall be assessed by the Settlement Officer. In default of payment or of other mutually satisfactory arrangements by the parties concerned, the Settlement Officer shall enter the amount of com• pensation or the unpaid portion thereof on the Schedules of Rights as a charge against the land in favour of any person or persons to whom any such com• pensation may be due. (2) Where there are two or more adjoining owners, the addition of the fragment shall be effected by the Settlement Officer in one of the following ways:— (a) where only one adjoining owner desires the transfer to him of the fragment, it shall be added to his parcel; (b) where more than one of the adjoining owners desire the transfer to them of the fragment, it shall be added to the parcel of such adjoining owner as "may be decided by lot; (c) where none of the adjoining owners desires the transfer of the fragment, . it shall be added to the parcel of such adjoining owner as the Settlement Officer may direct. Provided that no fragment shall be added to any parcel unless the parcel resulting from such addition is capable of registration under the terms of this Order. (3) Where two or more fragments of land are incapable of registration under this Order, the Settlement Officer may combine a sufficient number of such fragments to form a parcel which is capable of registration under the terms hereof. The person in whose name the parcel resulting from such addition shall be registered, shall be decided by the Settlement Officer in one .of the following ways:— (a) where only one of the owners of the parcels desires the combined parcel resulting from such addition, it shall be registered in his name; (b) where more than one of the owners of the parcels desire the combined parcel resulting from such addition, it shall be registered in the name of such owner as may be decided by lot; (c) where none of the adjoining owners desires the combined parcel resulting from such addition, it shall be registered in the name of such one of the owners as the Settlement Officer may direct. 5. (211) EVIDENCE FOR FOREIGN TRIBUNALS

Section 21 of RULES OF COURT MADE BY THE CHIEF JUSTICE WITH THE APPROVAL No. 21 of 1924. OF THE HIGH COMMISSIONER UNDER SECTION 21 OF THE COURTS ORDINANCE, 1924

Short Title. 1. These Rules may be cited as the Foreign Tribunals (Evidence) Rules, 1932.

Procedure on 2. Where any civil, criminal or commercial matter is pending

Letters of Request kefore a court or tribunal of a foreign country, if under the cTuntries61gn Foreign Tribunals Evidence Act, 1856, or any other law for the time being in force in Palestine,.a District Court is authorised to take the testimony of any person in relation to such matter and it is made to appear to the President of a District Court, by Commission Rogatoire, or Letter of Request, or other evidence • as hereinafter provided, that such court or tribunal is desirous of obtaining the testimony in relation to such matter of any witness or witnesses within the jurisdiction, the court may, on the ex parte application of any person shown to be duly authorised to make the application on behalf of such foreign court or tribunal, and on production of the Commission Rogatoire, or Letter of Request, or of a certificate signed in the manner, and certifying to the effect mentioned in Section 2 of the Foreign Tribunals Evidence Act, 1856, or such other evidence as the Court may require, make such order or orders as may be necessary to give effect to the intention of the laws above mentioned in conformity with Section 1 of the said Foreign Tribunals Evidence Act, 1856. 16th February, 1932 OFFICIAL GAZETTE 139

5. (1) Unless otherwise provided in the order for examination, Transmission of the examiner before whom the examination is taken shall, on examination its completion, forward the same to the President of the said District Court, and on receipt thereof the President shall append thereto a certificate, in the form numbered "11." in the Schedule to these Rules, with such variations as circumstances may require, duly sealed with the seal of the said "District Court, and shall forward the depositions so certified, and the Commission Rogatoire or Letter of Request, if any, to the High Commissioner, for transmission to the foreign court or tribunal requiring the same.

(2) Where a Commission Rogatoire or Letter of Request has been received from a foreign court or tribunal direct, without having been transmitted through His Majesty's Secretary of State for Foreign Affairs, then, notwithstanding anything contained in Sub-section (1) hereof, the President of the District Court may, after the Commission Rogatoire or Letter of Request has been complied with, return the depositions duly certified direct to the court or foreign tribunal from which the Commission Rogatoire or Letter of Request emanated, if in his opinion such course would tend to avoid undue inconvenience and delay.

6. An order made under Section 2 may, if the President Mode of conduct- of the District Court shall think fit, direct the said examination iQ£ examination, to be taken in such manner as may be requested by the Commission Rogatoire or Letter of Request from the foreign court, or therein signified to be in accordance with the practice or requirements of such court or tribunal, or which may, for the same reason, be requested by the applicant for such Order. But in the absence of any such special directions being given in the order for examination the same shall be taken in the manner prescribed for the taking of evidence before a Court in Palestine.

7. Where a Commission Rogatoire or Letter of Request, as Provision as to mentioned in Section 2 of these Rules, is transmitted to a Letters of Request transmitted to a District Court by the High Commissioner with an intimation District Court that it is desirable that effect should be given to the same by the High without requiring an application to be made to the Court by Commissioner. the agents in Palestine of any of the parties to the action or matter in the foreign country, the Chief Clerk shall transmit the same to the Attorney-General, who may thereupon make such application and take such steps as may be necessary to give effect to such Commission Rogatoire, or Letter of Request, in accordance with Sections 2 to 6 hereof.

RULES OF COURT MADE BY THE CHIEF JUSTICE WITH THE Section 21 of APPROVAL OF THE HLGH COMMISSIONER UNDER SECTION 21 OF THE NO* 21 OF '1924' COURTS ORDINANCE, 1924

1. These Rules may be cited as the Foreign Tribunals Short Title. (Process) Rules, 1932.

2. Where in any civil or commercial matter pending before Procedure with a court or tribunal of a foreign country a Letter of Request Letters of Request from from such court or tribunal for service on any person in foreign countries. Palestine of any process or citation in such matter is transmitted to a District Court by the High Commissioner with an intimation that it is desirable that effect should be given to the same, the following procedure shall be adopted:—

(1) The Letter of Request for service shall be accompanied by a translation thereof in the English language, and by two copies of the process or citation to be served, and two copies thereof in the English language. 142 OFFICIAL GAZETTE 16 th February, 1932

(2) Service of the process or citation shall be effected by a process server, whom the President of the District Court may appoint from time to time for the purpose.

(3) Such service shall be effected by delivering to and leaving with the person to be served one copy of the process to be served, and one copy of the translation thereof, in accordance with the rules and practice of the Courts of Palestine regulating service of process.

(4) After service has been effected the process server shall return to the Chief Clerk of the District Court one copy of the process, together with the evidence of service by affidavit of the person effecting the service verified by notarial certificate or by a magistrate, and particulars of charges, for the cost of effecting such service.

(5) The particulars of charges for the cost of effecting service shall be submitted to the Chief Clerk of the District Court, who shall certify the correctness of the charges, or such other amount as shall be properly payable for the cost of effecting service.

(6) The President of the District Court shall forward to the High Commissioner for transmission to the foreign court or tribunal the Letter of Request for service received from the foreign country, together with the evidence of service with a certificate appended thereto duly sealed with the seal of the District !Court for use out of the jurisdiction. Such certificate shall be in the form in the Schedule to these Rules.

Substituted 3. Upon the application of the Attorney-General the District service to be Court or a Judge may make all such orders for substituted effected on application of service or otherwise as may be necessary to give effect to Attorney-General. these Rules.

Fees payable. 4. In proceedings and matters under these Rules the same fees shall be leviable as would be leviable in similar proceedings and matters under the Rules of Court for the time being in force in Palestine.
