E-mail: [email protected] Abstract This article examines the historical roots of juridical moral regulation in modern Egypt, assessing the relationship between modern law and shariʿa through the lens of the influence of the Islamic practice of h isba on courts and legislators. The article engages critically with scholarship on Islamic law and postcolonial theory regarding the impact of Western colonialism on law in Muslim societies and problematizes the understanding that shariʿa was secularized in the Egyptian legal culture through the translation of Western legal concepts. Instead, a different narrative is offered, one that recognizes the agency of local actors in the pro- cess of secularization and considers the influence of shariʿa in the legal development of contemporary Egypt. Keywords: colonialism; Egyptian law; h isba; Islamic law; shariʿa In the years following the 25 January Revolution in Egypt in 2011, there was a notable uptick in the num- ber of individuals sentenced for their sexual orientation, religious beliefs, political opinions, or moral standing. Cases based on both citizen complaints and law enforcement interventions—by the police or prosecution authorities—were brought against writers, activists, artists, and bloggers. The state’s prosecu- tion of individuals for their opinions, sexual behaviors, and religious beliefs has been couched using the Islamic principle of h isba, a religious concept enshrined in the Qurʾan and sunna and debated extensively by Muslim jurists. -

GUTIERREZ FOR SENIOR THESIS SPRING 2014 APRIL 28, 2014 2 3 Abstract This study seeks to clarify the identities of the Almoravid and Almohad Berber movements in the larger Crusade narrative. The two North African Islamic groups are often carelessly placed within the group identified as “Islam” in discussions about the series of military campaigns that took place not only in the traditional Holy Land but also throughout regions of the Mediterranean such as Spain; this generalized identifier of “Islam” is placed against a much more complex group of generally Christian parties, all of them seen as separate, unique groups under the umbrella identifier of Christianity. This foray into a late 13th century North African Arabic history of the two groups will attempt to build a more robust identity for the two groups. -

Riba Dan Bunga Bank Dalam Pandangan Ibnu Qayyim M. Khoirul Hadi al-Asy’ari Alumni Pasca Sarjana UIN Sunan Kalijaga Yogyakarta1 Abtraks Penelitian ini adalah penelitian berbasis library reseach yang fokus membahas dalam masalah yang sudah ada sejak zaman klasik, pem- bahasan ini adalah pembahasan tentang konsep Riba dan Bunga Bank dalam pandangan Ibnu Qayyim al-Jauziyyah. Ulama Kontem- porer ini merupakan Ulama yang sering berpendapat kontroversial, apalagi pada wacana-wacana berupa kajian yang kontroversial. Dalam masalah ini, paper ini berkutat pada bagimana pandangan Ibnu Qa- yyim tentang Riba pada masa Nabi Muhammad SAW sampai Riba pada masa Ibnu Qayyim hidup. Lalu bagaimana penafsiran Kata Riba dalam al-Qur’an yang sempai sekarang tetap dalam debateble diantara kalangan Ulama tafsir dan fiqh terutama oleh Ibnu Qayyim sendiri, kemudian, bagaimana apabila pendapat Riba dalam pandan- gan Ibnu Qayyim di sangkutkan dengan pandangan Bunga Bank yang berkembang pada dunia modern. Adapun hasil dari penelitian ini adalah pertama, bahwa yang dimaksud dengan Riba dan bunga Bank dalam pandangan Ibnu Qayyim mempunyai berbedaan yang mendasar. Kedua, bahwa bunga Bank yang sekarang berkembang bukan dikatakan murni sebgaia Riba dalam masa Nabi Muhammad SAW. Ketiga bahwa Ibnu Qayyim mempunyai pendapat satu dan dua itu berkaitan dengan pemahaman tafsir yang lebih kontekstual dalam kehidupan yang komplek pada saat ini. Kata Kunci : Ibnu Qayyim, Riba, dan Bunga Bank. A. Pendahuluan Pro dan kontra tentang sekitar hukum bunga Bank yang ter- kait dengan Riba bukan saja terjadi dikalangan sarjana muslim, akan tetapi juga pemikir non muslim, sebab itulah ada beberapa ilmuan ahli filsafat yang juga mengharamkan Riba. Plato misalnya, dalam bukunya The Law of Plato, menegaskan bahwa orang tidak boleh me- minjamkan uang dengan rente, dan aristoteles juga menyatakan den- gan hal tersebut. -

PEN ABU AL-AB AT-TAMIMI AL-QAYWANI DALAM PENGEMBANGAN HADIS DI TUNISIA Umma Farida STAIN Kudus, Jawa Tengah, Indonesia Abstrak Kuatnya dominasi madzhab Maliki di Tunisia menjadikan perhatian masyarakatnya terhadap hadis sangatlah besar, sehingga tidak mengherankan jika banyak ulama yang muncul dari negeri ini, salah satunya Abu al-Arab at-Tamimi. Tokoh yang dikaji ini memiliki kompetensi di bidang hadis dan sejarah. Ia banyak meriwayatkan dan mengajarkan hadis Nabi saw., di antaranya adalah hadis-hadis fadha’il Ifriqiyyah yang kontroversial dan menuai kritik dari beberapa ulama dan para pengkaji hadis berikutnya. Meskipun jika dikaji lebih jauh, periwayatan hadis tersebut menjadi sesuatu yang biasa bagi para muhaddits sekaligus muarrikh yang cenderung memberikan kelonggaran dalam hadis-hadis mengenai keutamaan suatu negeri, bangsa, bahkan bahasa. Selama hidupnya, Abu al-Arab tidak hanya berperan dalam meriwayatkan hadis Nabi saw. saja, tetapi ia juga mendokumentasikan pemikiran-pemikirannya yang terkait dengan rijal-hadits dan al-jarh wa at-ta’dil. Periwayatan dan gagasan-gagasan hadis Abu al-Arab selanjutnya dikembangkan oleh para ulama hadis berikutnya seperti Abu al-Hasan al-Qabisi, Atiq at-Tujibi, Abu Bakr Abdullah al-Maliki, Abd ar-Rahman ibn ad-Dabbagh, dan Abu al-Qasim ibn Naji, juga dinukil oleh beberapa pakar hadis terkemuka seperti Imam adz-Dzahabi dan Ibn Hajar al-Asqalani.
