Bihar Power System Improvement Project (BPSIP). Project

The Executing Agency (EA) for the Bihar State Power Holding Executing Agency Company Limited. The Bihar State Power Transmission Company Limited, North Bihar Power Distribution Company Limited, and South Bihar Power Distribution Company Limited are the implementation of the project. The Implementation Agency (IA) has established the Implementation Program Management Unit (PMU) to execute, manage and Agency monitor the implementation of the Investment Program, and provide overall policy directions. PMU has the mandate to closely supervise and monitor every component under the Program. Monitoring Period January 2015 to November 2018. Covered

A. Introduction

1.1 Overall project description –

1. Bihar Power System Improvement Project (BPSIP) is improvement of electricity supply through the relief of generation and network capacity constraints and the reduction of technical and commercial losses in the state of Bihar. The project is being funded by the Asian Development Bank (ADB). ADB has sanctioned a loan of USD million 132.2 under its loan no. 2681-IND towards improvement of Bihar’s power transmission and distribution sector. All contract packages for distribution and transmission works have been awarded. The original scope of work under the different component is – (a) Transmission component – (i) construction of new 132 kV sub-stations at Gangwara & Dhanaha and erection of additional 132 kV bays at the existing sub- stations (ii) construction of new 220 kV substation at Pusauli and erection of additional 220 kV bays; (iii) construction of 128.674 KM of 132 kV lines from new 132 kV sub-stations; (iv) construction of 87.9 KM of 33 kV lines from new 132 kV sub-stations; (v) construction of 55.986 KM of 220 kV lines; (vi) Augmentation of 02 nos. 220/132/33 KV & 05 nos. 132/33 KV existing Grid sub-stations; (vii) Re- conduct ring of 1011.30 KM of existing 220 kV & 132 KV transmission lines; (viii) Supply and installation of enterprises resources program (ERP) software including supporting hardware at BSPTCL HQ, 14 nos. of field offices and about 106 nos. GSS with project management support; (ix) Construction of 33 KV line bays in form of indoor VCB/GIS panel at 83 nos. of 220/132/33 KV & 132/33 KV AIS substations. (b) Distribution component: (1) NBPDCL - Reconstruction & Modernization of distribution system at four towns covers four works- (i) Construction of new PSS at , Betiiah, and (ii) Installation of 195 nos. of 200 KVA & 116 nos. of 100 KVA distribution transformer at Motihari, Betiiah, Samastipur and Begusarai (iii) Re-conductoring work of 267 Kms of 33KV, 885 Kms of 11KV and 1244 Kms of LT line at Motihari, Betiiah, Samastipur and Begusarai (iv) Replacement / Installation of 35614 nos. of Meter at Motihari, Betiiah, Samastipur and Begusarai, and (2) SBPDCL - Reconstruction & Modernization of distribution system at three towns covers three works- (i) Construction of new PSS at Biharsarif, Arah and Buxar (ii) Installation of 208 nos. of 200 KVA & 75 nos. of 100 KVA distribution transformer at Biharsarif, Arah and Buxar (iii) Reconductoring work of 72.5 Kms of 33KV, 277 Kms of 11KV & 314 Kms of LT line at Biharsarif, Arah and Buxar (iv) Replacement/Installation of 52993 nos. of Meter at Biharsarif, Arah and Buxar.

B. Purpose of the Report 2. The purpose of semi-annual social monitoring report (SMR) is to analyze periodically over the total implementation period of the project to comply with the approved safeguard documents 3. This report covers resettlement and social safeguard monitoring results to comply with the spirit of ADB policy to ‘enhance stakeholders’ trust ‘in and ability to engage with ADB, and thereby increase the development impact (of projects) in which disclosure of safeguard monitoring is a prominent aspect. This report covers status of resettlement implementation and addressing all the issues related with social safeguards, with reference to the progress achieved and current status of reporting period.

C. Duration of the Report 4. This consolidated report outlines monitoring implementation of social safeguard activities during January 2015 to November 2018 in accordance with the ADB Safeguard Policy Statement (SPS), 2009.

D. Social Safeguards Categorization 5. The sub-projects under Loan 2681-IND do not have any significant involuntary resettlement impacts and the project overall has been categorized as ‘B’ for involuntary resettlement and ‘C’ for Indigenous People (IP) in accordance with the ADB’s Safeguard Policy Statement (SPS), 2009, which applies to this project.

E. Institutional Arrangement: 6. As per Norms, ESMU is established in NBPDCL, SBPDCL & BSPTCL. NBPDCL has nominated Mr. Aditya Kumar, SBPDCL has nominated Mr. Md. Pravej aalam and BSPTCL was nominated Mr. Chaitanya Kumar. Now, BSPTCL has been changed the nominated person into Mr. Vineet Kumar Bageria and Mr. Kumar Anand. Mr. Radha Mohan, Land Acquisition Officer (LAO) has been nominated as the Resettlement Officer (RO) for the project.

7. The Project of comprises of 21 sub-projects (02 substations and 10 transmission lines 272.47 km long) The list of the sub-projects along with their scope, agreed milestones, progress, implementation schedule and physical progress is presented below in Table 1

G. Status of Land Acquisition and payment of compensation for temporary loss of crops/trees:

I. Sub-stations 8. During the Project implementation, the Private land acquisition was required at 220/132 kV GSS at Pusauli, 132/33 kV GSS at Gangwara and Dhanha and at bay extension works at Shekhpura and Lakhisarai. In addition, construction of transmission lines (consisting of 55.98 km of 220 kV, 128.67 km of 132 kV, and 40 km of 33 kV) will cause the temporary damages to the standing crops/trees along the transmission line corridor. As per social impact assessment conducted during the process of revising the RP, the land acquisition process for all the sites was completed. The land for all the three new GSSs sites i.e 132/33 KV GSS Gangawara, 132/33 KV GSS Dhanha (Thakaraha) & 220/132 KV GSS Pusauli have been acquired and handed over to the contractor. The additional land for 132/33 KV bay extension at Lakhisarai & Sheikhpura has also been acquired. 9. As per the assessment, a total of 16.5543 acres of private land is to be acquired for the project affecting 101 Nos. households. Out of a total of 16.5543 acres of private land, 4.22 acre at Thakrahan GSS, 4.75 acres at Gangwara GSS 5.75 acres at Pusauli GSS, 0.7043 acres at Lakhisarai bay extension and 0.63 acres at Sheikhpura Bay extension subprojects were acquired. Details of land acquisition are given at Table-2.

11. Temporary damages to crops and trees under the corridor of impact of transmission lines occurred during the erection of towers, stringing of conductors. About 206 km transmission lines- 55.96 km of 220 kV, 128.67 km of 132 kV, and 40 km of 33 kV, will pass through the private and government land. The compensation towards temporary damages to standing crops/trees during the construction of lines is governed by the provisions of the Indian Electricity (Supply) Act, 2003 and Indian Telegraph Act, 1885. As per these Acts, no land acquisition is required for construction of transmission line 12. Originally the scope of TLs works included 220 kV two new TLs of55.986 Km having 173 towers, 132 kV six TLs of 128 .674 Km having 429 towers and 33 kV two TLs of 40 Km having 88 towers. The proposed additional scope of TLs works under the savings from the ADB funding included reconductoring works of 132 kV 16 TLs of 973.91 Km and 220 KV one TL of 37.39 Km. The reconductoring of TLs has caused no impact on crops and/or trees. 13. Provide sub-project wise number of AHs, Compensation paid during stringing, erection and foundation and vulnerable assistance in the paragraph. Also provide how many are yet to be compensated. Provide details in Table 4 below

H. Public Consultations 14. DPs have been fully informed and closely consulted during the assessment tor updating and revising of the RP and during the implementation of RP. While conducting the census and socio-economic surveys, consultations were held to inform DPs about the project's impact, entitlement matrix, etc. Consultations were undertaken in the subproject area with the affected families and other stakeholders to get their opinion on the Project and its positive and negative impacts. All relevant aspects of project were discussed with executing agency and DPs. 15. The main objective during community consultation was to (a) get a basic understanding of the DPs on the subprojects/areas and their socio- economic status ; (b) ascertain the views of the DPs, with reference to land acquisition and project impacts; (c) ascertain the views of the DPs on the project, its relevance in their lives, its benefits and adverse impacts; (d) understand their views on resettlement and rehabilitation (R&R) issues and (e) provide an overview and explain the project and the purpose of the assessment and survey. Numerous consultations were arranged during project preparation stage to ensure peoples' participation in the planning phase of this project and to treat public consultation and participation as a continuous two- wa y process. 16. Considering the local needs, problem and prospects of resettlement, various sections of DPs and other stakeholders were consulted through focus group discussions and individual dialogues.

I. Grievance Redress Mechanism The Project Grievance Redress Mechanism has been placed and made responsible for handling public complaints regarding Environmental related matters. The Project Grievance Redress committee has been conducted regularly. However, no complaints received so far. The contractor will promptly investigate and review environmental complaints and adopt appropriate corrective actions to arrest or mitigate the cause of the complaints. All the complaints received will be placed before the Project Grievance Redress committee and the decision of the committee will be implemented. The complaint register will be placed at a convenient place, easily accessible by the public.
