From among the myriad expressions of Muslim and non-Muslim identities, churches and synagogues provide unique insight into the complex interactions between Islam and other religious and spiritual traditions. The design and construction processes undertaken by various inhabitants of those communities often reflect the competitive tensions and reconciliations within and between member groups. Whether constructed by non-Muslims in a predominantly Muslim society or preserved in their original froms and/or functions after the arrival of Islam, it is in such sites, structures and spaces that one may find some of the most potent applications of architecture to the articulation of cultural identity. He was the youngest of 3 brothers and 5 sisters. In Hyderabad, Dr. Hamidullah was educated at Darul-Uloom secondary school, Nizam College and Osmania University from where he obtained his MA and LLB degree in International Law. From 1933-35 he studied at several universities in Europe and obtained a doctorate from Bonn University in Germany. In 1936, he obtained a degree from the Sorbonne University, France. From 1936-46 he served on the faculty of Osmania University teaching International Law. In 1946, he was appointed as member of the delegation sent by the Nizam of Hyderabad at the League of the Nations. After the 1948 invasion of Hyderabad by the Indian army, Hamidullah chose to live in exile in France. -

132 rudolph peters MURDER IN KHAYBAR: SOME THOUGHTS ON THE ORIGINS OF THE QAS¤MA PROCEDURE IN ISLAMIC LAW * RUDOLPH PETERS (University of Amsterdam) Abstract The institution of qas¨ma has intrigued both Muslim jurists and western scholars. The first were puzzled by its violation of essential legal principles, the latter by its apparent pre-Islamic origins. Because of its archaic and irrational character, western scholars assume that the institution was not applied in practice: Ò[I]t does not appear that this institution functioned much, even in the past, when the penal law of Islam had a certain practical application.Ó1 However, the evidence of fatwa collections shows that the qas¨ma was indeed enforced by courts as late as the nineteenth century, 2 and the rules connected with it have now found their way into some modern Islamic criminal codes. 3 The qas¨ma, it appears, was a living institution in Islamic law and not just theory. In this essay I will try to shed some light on the origins of this institution and its reception into Islamic law. I will attempt to chart the earliest developments of Islamic jurisprudence by analyzing the available hadith material and the statements of the first generation of jurists. In the conclusion I will suggest that my analysis of the material on qas¨ma corroborates MotzkiÕs 4 and I thank Harald Motzki and Gautier Juynboll for introducing me to the unfamiliar field of isn¨d analysis and for their critical remarks on earlier versions of this essay, from which I have greatly benefited. -

To proceed: My honoured sister, Indeed for you is an important and great role; and you must rise and fulfill your obligatory role in Islam 's confrontation of the new Crusade being waged by all the countries of the world against Islam and the Muslims. I will address you in these papers, and I will prolong this address due only to the importance of the topic; [a topic] that is in need of double these papers. So listen, may Allah protect and preserve you. The Muslim Ummah today is suffering from types of disgrace and humiliation that cannot be enumerated; [disgrace and humiliation] that it was not familiar with in its previous eras, and were never as widespread as they are today. And this disgrace and humiliation is not a result of the smallness of the Islamic Ummah or its poverty - it is counted as the largest Ummah today, just as it is the only Ummah that possesses the riches and elements that its enemies do not possess. And the question that presents itself is: what is the reason for this disgrace and humiliation that the Ummah suffers from today, when it is not in need of money or men? We say that -

“The Qur’an and the Modern Self: A Heterotopia,” Social Research: An International Quarterly, Volume 85, No. 3, Fall 2018, pp. 557-572. No book has been so vilified in the Christian West, while at the same time remaining so almost completely unread, as the Qur’an. Those who did at least delve into it put it to numerous and contradictory purposes. Churchmen such as Martin Luther cited it as the ultimate heresy. Enlightenment intellectuals such as Thomas Jefferson valued it for its post-pagan monotheism. In the early decades of the twenty-first century it has been libeled as a font of terrorism. Yet it is the scripture of a quarter of humankind. Prominent writers have often engaged with it as a staccato “heterotopia,” one continually constructed and forgotten, since for all its importance, it has never been part of the literary canon. We have come to the book by diverse and winding pathways. Author Al Young, whom Arnold Schwarzenegger as governor appointed California’s poet laureate, spoke of the profound influence on his craft of the music of jazz legend Yusef Lateef, whose performances he used to attend while growing up in Detroit. He wrote, “That he was Muslim intrigued us. Eventually, to understand a little about where Yusef was coming from, I read British Muslim Marmaduke Pickthall’s translation of the Qur’an: The Glorious Koran. And I was moved” (Young 2013). Between the utopia and the dystopia Michel Foucault positioned the heterotopia, a place in- between, juxtaposed to but not part of the world. He mentioned as examples “the garden, brothel, rest home, festival, magic carpet, Muslim baths” and even “Persian gardens” and “the cemetery” (Johnson 2013). -

This paper attempts to challenge the approach focused on comparison between international humanitarian law (IHL) and Islamic law on the basis of the rules adopted in each system and argues that both legal regimes are governed by certain theoretical and ideological paradigms that are distinct from each other.
