EN The titles of all other acts are printed in bold type and preceded by an asterisk. 2.10.2020 EN Official Journal of the European Union L 319 I/1 II (Non-legislative acts) REGULATIONS COUNCIL IMPLEMENTING REGULATION (EU) 2020/1387 of 2 October 2020 implementing Article 8a(1) of Regulation (EC) No 765/2006 concerning restrictive measures in respect of Belarus THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Council Regulation (EC) No 765/2006 of 18 May 2006 concerning restrictive measures in respect of Belarus (1), and in particular Article 8a(1) thereof, Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy, Whereas: (1) On 18 May 2006, the Council adopted Regulation (EC) No 765/2006 concerning restrictive measures in respect of Belarus. (2) On 9 August 2020, Belarus conducted presidential elections, which were found to be inconsistent with international standards and marred by repression of independent candidates and a brutal crackdown on peaceful protesters in the wake of the elections. On 11 August 2020, the High Representative of the Union for Foreign Affairs and Security Policy issued a declaration on behalf of the Union, assessing that the elections were neither free nor fair. It was also stated that measures against those responsible for violence, unjustified arrests and falsification of election results could be taken. (3) In view of the gravity of the situation in Belarus, 40 persons should be included in the list of persons and entities subject to restrictive measures set out in Annex I to Regulation (EC) No 765/2006. (4) Annex I to Regulation (EC) No 765/2006 should therefore be amended accordingly, HAS ADOPTED THIS REGULATION: Article 1 Annex I to Regulation (EC) No 765/2006 is hereby amended as set out in the Annex to this Regulation. In 2020, Belarusians unexpectedly called Alyaksandr Lukashenka’s legitimacy into question in the country’s August presidential election. Lukashenka brazenly rigged the results, claiming that he took 80 percent of the vote, but neither the United States nor the European Union (EU) recognizes his victory. A months-long protest movement has coalesced that demands new elections under the supervision of the international community. Opposition to Lukashenka unified around Sviatlana Tsikhanouskaya, the likely winner of the August election. A former English teacher and a political rookie, initially chosen as a stand-in for her jailed husband, Syarhey Tsikhanouski, Tsikhanouskaya is growing on the job, has struck a chord with Western interlocutors, and has demonstrated an ability to rally the beleaguered people of Belarus. While forced to operate from exile in Lithuania, she has assembled a capable team under the banner of the Coordination Council. Recent years have seen no better chance for US leadership to facilitate lasting positive change in Europe than the crisis in Belarus. But how to secure democratic change in Belarus is not simple given internal resistance and Moscow’s determination to prevent another “color revolution.” Lukashenka is likely finished, unable to restore any authority or legitimacy. But he is seeking to hang on despite Moscow’s efforts to arrange a pliable replacement who would preserve Minsk’s pro-Russian orientation.

Introduction In accordance with the Constitution, the judiciary in the Republic of Belarus belongs to the courts. In administering justice, judges shall be independent and are expected to be governed by law. Any interference in the activities of judges in the administration of justice is unacceptable and entails liability under the law. All proceedings in all courts shall be public; hearing of cases in a closed court session is allowed only in cases determined by law, in compliance with the rules of judicial procedure. Justice shall be carried out on the basis of adversariality and equality of the parties in the trial. The parties and persons participating in the trial shall have the right to appeal rulings, sentences and other court orders. Twenty years have passed since 2000, when the Belarusian judicial system was subjected to a scrutiny and criticism by the United Nations Special Rapporteur on the independence of judges and lawyers, Mr. Param Cumaraswamy.1 Over the years, the Belarusian judicial system has been significantly reformed, resulting in the main aspects of its functioning having been transferred from the Ministry of Justice and the Presidential Administration to the Supreme Court. As a result, the guarantees of the independence of judges were strengthened by law. At the same time, the President of the Republic of Belarus still plays a key role in determining the legal status of judges, in the process of appointing judges to office, their promotion, and determining their financial position.
