CECIL MALONE OVER FLOOD RELIEF CONTROL CHANNEL PROJECT: PHASE FUNDING REALLOCATION

The Planning Committee of the Ithaca-Tompkins County Transportation Council (ITCTC) approved a Transportation Improvement Program (TIP) Administrative Modification on March 16, 2021, during a regularly scheduled meeting. The action on the 2020-2024 TIP and the current State Transportation Improvement Program (STIP) affects one (1) project as described below.

Description: The City of Ithaca is requesting an administrative modification to the Cecil Malone over Flood Relief Control Channel Project-PIN 375589. The modification moves $3,160 in unobligated funds from the ROW Acquisition to the Construction phase. Total project funding remains unchanged.

• $3,160 from the FFY 20/21 ROW Acquisition phase transferred to the FFY 20/21 Construction phase.

The tables in Attachment A include the project as it will appear in the TIP (note: changes shown in bold). This administrative modification will not affect the funding of projects within any other jurisdiction. The TIP and STIP will remain fiscally constrained.

Report: The City of Ithaca, in collaboration with NYSDOT, is requesting an administrative modification to the to the Local PSAP Project-PIN 375650. The administrative modification adds an additional construction phase composed of 100% local funds for FFY 20/21 to meet changing project funding requirements. Total project funding is increased by $175,000. Proposed changes are shown in the tables below.

EXISTING: TIP date 2018 PIN 375650 BIN Project Name Local PSAP Project, City of Ithaca, Tompkins County Sponsor City of Ithaca Description HSIP Funds - 2018. This project will make improvements to pedestrian facilities at uncontrolled crosswalks and signalized intersections in the City of Ithaca, Tompkins County. This effort is part of the New York State Pedestrian Safety Action Plan (PSAP) program managed by NYSDOT. The systemic approach outlined in the PSAP is intended to proactively address widespread safety issues and minimize crash potential by implementing countermeasures at locations that have been shown to be high risk based on crash type. Funding is mostly federal using 10% toll credit. Total Federal Award Amount - $589,000. Local contribution totals $175,000.

Report: On February 1, 2021 Tompkins County, in collaboration with NYSDOT, requested an administrative modification to the Central Chapel Rd over Boice Creek Bridge-PIN 375652. Report: Tompkins County requests the ITCTC approve a 2020-24 TIP amendment to the FTA Tables. The proposed amendment adjusts funding in FFY 2020-21 and is needed to conform with FTA grant-making requirements. More details included in the amendment request form below.

2020-2024 TRANSPORTATION IMPROVEMENT PROGRAM **Amendment**

Update of FTA Tables – Sect. 5339 FFY2020-21

The Policy Committee of the Ithaca-Tompkins County Transportation Council (ITCTC) approved an amendment to the 2020- 2024 Transportation Improvement Program (TIP) on April 20, 2021. The amendment was reviewed and approved by the ITCTC Planning Committee on March 16, 2021. The action on the 2020-2024 TIP and the current State Transportation Improvement Program (STIP) affects Section 5339 in the FTA Tables as described below and in the attached table.

Description: Tompkins County requests the ITCTC approve a 2020-24 TIP amendment to the FTA Tables. The proposed amendment adjusts funding in FFY 2020-21 and is needed to conform with FTA grant-making requirements. The amendment accomplishes the following:

FTA Section 5339 – Bus and Bud Facilities Program • The amendment programs $851,965 from the Section 5339 Bus & Bus Facilities Program, from the years 2017 ($123,754), 2018 ($408,827), and 2019 ($319,384) for two capital projects.

The proposed amendments to the 2020-2024 TIP and the STIP are shown in the Attachment A tables. The tables show the projects as they will appear in the TIP and STIP. The TIP and STIP will remain fiscally constrained.

I. Public Comment Period Report: There were no public comments.

II. Approval of Planning Action Summary – December 15, 2020 Action: The Action Summary from December 15, 2020 was Moved by Michelle E. Wright, seconded by C.J. Randall, and approved by the ITCTC Planning Committee without modification.

III. Review Draft 2021-2022 UPWP, Resolutions 2021-1 and 2021-2 Report: A draft of the Simplified Statement of Work/UPWP for the April 1, 2021–March 31, 2022 fiscal year was sent to committee members prior to the meeting. Fernando de Aragón reviewed the emphasis areas in the draft UPWP and reported the following: • No action is required; this is a first draft of the UPWP. • It has been submitted to NYSDOT for review and comments have been received. • The auditable budget tables will be inserted into the next draft. • The ITCTC anticipates the continuation of dealing with the impacts of Covid19 through 2021. • An ongoing project for staff has been assisting to get bike share back in the Ithaca and urban area. The deadline for responses is Friday, December 18th. The goal is to have a bike share service in place by next spring or summer. • The agency is prepping for a TIP update, perhaps for next fall. Mark Frechette added that the normal TIP cycle would be for an update next fall, however, due to the unknowns around the federal transportation bill, conversations will be had after the new Congress goes in. NYSDOT will keep the ITCTC updated. • Committee members were asked to send any comments/questions about the draft UPWP to Fernando. • Committee approvals will be sought in January and February 2021.

APPROVAL OF THE 2021-2022 ITHACA-TOMPKINS COUNTY TRANSPORTATION COUNCIL OPERATING BUDGET

WHEREAS, the Ithaca-Tompkins County Transportation Council was designated by the Governor of the State of New York as the Metropolitan Planning Organization for the Ithaca-Tompkins County Metropolitan Area; AND

WHEREAS, as the designated Metropolitan Planning Organization for the Ithaca-Tompkins County Metropolitan Area the Ithaca-Tompkins County Transportation Council receives certain federal and state grants for the purpose of conducting transportation planning activities in a “comprehensive, continuing, and cooperative” manner; AND

WHEREAS, the Ithaca-Tompkins County Transportation Council is provided with administrative services, including budget and financial services, by its Host Agency, Tompkins County; AND

WHEREAS, the Ithaca-Tompkins County Transportation Council has reviewed its proposed 2021-2022 Operating Budget for the period of April 1, 2021 through March 31, 2022;

NOW THEREFORE BE IT RESOLVED, that the Ithaca-Tompkins County Transportation Council does hereby adopt the 2021-2022 Operating Budget for the period April 1, 2021 through March 31, 2022 and directs the Host Agency to implement said budget;

BE IT FURTHER RESOLVED, that the Ithaca-Tompkins County Transportation Council does hereby authorize its Staff Director to take the necessary administrative actions to implement and administer said budget, as represented in “ATTACHMENT A”, which is hereby made an integral part of this resolution;

BE IT FURTHER RESOLVED, that the Ithaca-Tompkins County Transportation Council does hereby request that the Host Agency take the appropriate actions necessary to cause this adopted budget to be fully implemented without interruption prior to March 31, 2021.

APPROVAL OF THE 2021-2022 UNIFIED PLANNING WORK PROGRAM

WHEREAS, the Fixing America’s Surface Transportation Act (FAST Act) requires that Metropolitan Planning Organizations be established in each urbanized area of over 50,000 in population; AND

WHEREAS, the Ithaca-Tompkins County Transportation Council has been designated by the Governor of the State of New York as the Metropolitan Planning Organization for the Ithaca-Tompkins County Urbanized and approved Metropolitan Planning Areas; AND

WHEREAS, the Fixing America’s Surface Transportation Act requires Metropolitan Planning Organizations to carry out a "continuing, cooperative, and comprehensive" urban transportation planning process that addresses all modes of transportation; AND

WHEREAS, in order to implement a continuous, cooperative, and comprehensive transportation planning process in the Ithaca-Tompkins County Metropolitan Area, it is a requirement to develop an annual Unified Planning Work Program (UPWP); AND

WHEREAS, the Ithaca-Tompkins County Transportation Council, in accordance with the requirements of the FAST Act and its corresponding regulations (23 CFR §450.308(d)), has developed a Simplified Statement of Work for fiscal year 2021-2022 that serves as the Unified Planning Work Program; AND

WHEREAS, in order to support the elements of the 2021-2022 Unified Planning Work Program, the Ithaca- Tompkins County Transportation Council continues its designation of the New York State Department of Transportation to be the grant applicant on its behalf; AND

WHEREAS, the New York State Department of Transportation has agreed to apply for necessary regular program funding under the Federal Transit Administration Section 5303 program, under the Federal Transit Administration Section 5307 program, and under the Federal Highway Administration "PL" transportation planning program in amounts consistent with this approved 2021-2022 Unified Planning Work Program;

NOW THEREFORE BE IT RESOLVED, that the Ithaca-Tompkins County Transportation Council hereby approves the 2021-2022 Unified Planning Work Program and directs the submission thereof to the appropriate Federal and State agencies and directs the filing of the appropriate grant applications to support the program;

BE IT FURTHER RESOLVED, that the Transportation Policy Committee of the Ithaca-Tompkins County Transportation Council hereby authorizes and directs its Staff Director to execute and administer the 2021- 2022 Unified Planning Work Program in cooperation with and with the assistance of the Transportation Planning Committee.

IV. Director’s Report Report: Fernando de Aragón reported the following: • Public Involvement Procedures (PIP). The 45-day public comment period continues to the end of February; changes to the PIP reflect the addition of remote technology utilized during the pandemic. Comments should be emailed to Fernando de Aragón. • TIP Sponsors Meeting. A meeting of TIP sponsors has been scheduled for February 19th from 1:00 – 2:00 p.m. Sponsors are asked to review their projects, and their status, before the meeting; under discussion will be projects in the TIP, especially those with implementation in 2021. TIP actions will be taken in the spring and summer as needed. NYSDOT will be participating in this meeting. Members who do not have projects in the current TIP are welcome to attend the meeting to become familiar with the process. • County Covid Meetings. He has been asked to attend the county meetings dealing with the Covid response to help form solutions for the transportation aspect of getting people to vaccination sites. • Transportation Alternatives Program (TAP). Neither the ITCTC nor NYSDOT have any new information on TAP.

V. Member Reports Report: 1. Brent Cross (Village of Cayuga Heights). • What is NYSDOT anticipating for the TAP this year? John Reichert replied that NYSDOT is not sure if this program will have announcements next spring, summer, or fall; there is no information available now and NYSDOT does not expect to hear anything soon. • What is the status of the federal transportation program funding with the new administration in Washington D.C.? Fernando de Aragón replied the current legislation has been extended through the current year; there is a lot of talk about using transportation to stimulate the economy but, this is an unknown. Carlos Gonzalez confirmed that the funding will go through 2021 but nothing is known beyond that. Joe Wetmore said that nothing new should be expected from Congress until February or March as they are busy setting up right now. Jay Lambrix reported that he heard there could be another $20B proposed for transportation Covid relief.

2. Sue Ritter (Town of Ithaca). • Gateway Trail bids came in over $200,000 above the estimate; the Town Board will be looking at this to decide the forward.

3. Dan Klein (TCAT Board Chair). • TCAT did not get a BUILD grant in 2020, but they did get good feedback on the application and are looking into another proposal in 2021. TCAT will be contacting the City of Ithaca, Tompkins County, and Cornell for information on how they proceeded when applying for the new facility at the airport.

4. Reed Huegerich (Cornell University Transportation Services). • Cornell’s in-person fall semester wrapped up successfully. The spring semester is scheduled to start in-person classes February 8 with move-ins beginning this weekend. On-campus students will be quarantined and required to take multiple coronavirus tests during the semester. Students living off-campus are not included in the quarantining but will be subject to frequent coronavirus testing.

5. Eric Hathaway (City of Ithaca). • Thanks to Carlos Gonzalez for his assistance with trying to find out the status of the grant for the transit signal priority project; the City of Ithaca is not sure but, is not expecting to receive the funds. • The Green Street garage will be coming down in late February/early March; there will be no parking at the garage through November 2021.

6. Tim Logue (City of Ithaca). • Ongoing projects are progressing; other projects are getting close to bid, such as paving Route 13/Elmira Road and the S. Cayuga Street Bridge over Six Mile Creek. Projects expected to go to construction in late 2021/early 2022 are currently going through the design phase.

7. John Reichert (NYSDOT Region 3). • Prior to the 2/19/2021 TIP Sponsors meeting, NYSDOT will be sharing a report with sponsors showing any phases their projects have for the current federal fiscal year and will be speaking directly to that report during the meeting. Sponsors are asked to review this report carefully before the meeting.

8. Brent Cross (Village of Cayuga Heights). • The Village’s TAP project is in design; a sidewalk is planned through Wycoff, Kline, and the cemetery, to the school. The cemetery section has been deemed ineligible for the federal aid portion of the project because it is not part of the public right-of-way. The portion of funding has been returned to the project design report submitted to NYSDOT; the Village is hoping for a summer 2021 construction date so it can move forward with a project that will connect the village center to the school district.

9. Teresa Linde (ITCTC). • Are there any updates to dropping of the Route 34B over Salmon Creek Bridge? John Reichert replied that the decking is being prepped for removal; there is no date set for the drop but, he will check and get back to her. C.J. Randall reported that, in the Town of Lansing’s discussions with the controlled demo company, the bridge drop could occur in early February depending on weather conditions during the prep.

10. Fernando de Aragón (ITCTC). • He announced that Carlos Gonzalez will be leaving his FHWA post in New York for one in and thanked him for his accessibility and assistance while working with the ITCTC; members wished him well and expressed their appreciation. Mr. Gonzalez thanked everyone, saying he enjoyed his time in the area; he explained that he was moving south to be closer to family and told committee members to keep his email address and feel free to contact him.
