WHEREASit is provided by section 36 (1) of the Constitution that wheneverthe President is absent from Botswanaorconsidersit desirable so to do by reasonofillness or any other cause he may, bydirectionsin writing, authorize the Vice-President to discharge suchofthe functionsofthe Office of President as he mayspecify, and the Vice-President may discharge those functions until the President’s return to Botswanaorthe revocation of such authorization, as the case maybe;

AND WHEREASI intend to be absent from Botswanafrom the 20th May, 1997 andI considerit desirable to issue directionsas aforesaid;

NOW THEREFORE,in exercise of the powers vested in me as aforesaid I authorize you, FESTUS GONTEBANYE MOGAE in yourcapacity as Vice-President and Minister of Financeand DevelopmentPlanning, to discharge with effect from 20th May, 1997all the functionsofthe Office of President, except —

(a) the powerto dissolve Parliamentin accordance with the provisions of section 91 of the Constitution; (b) the powerto appointto the office of Minister or Assistant Minister in accordance with the provisions of section 42 of the Constitution: Provided, however,that you can appointthe present Ministersor Assistant Ministersto act in place of any Minister who is otherwisenotavailable; (c) the powerto remove a Minister or Assistant Minister from office in accordance with the provision of section 43 of the Constitution; until my retum to Botswanaorthis authority is revoked by me whichever happensfirst. An Act to amendthe Botswana Defence Force Act. Date ofAssent: Date of Commencement: ENACTEDbythe Parliament of Botswana. 1. This Act maybe cited as the Botswana Defence Force (Amend- Shorttitle ment) Act, 1997. 2. Section 2 of the Botswana Defence Force Act(in this Act referred Amendmentof to as “the Act”) is amended by substituting for the definition of fnDs “appropriate superior authority” in subsection (1) thereof the following — new definition — “appropriate superior authority”, in relation to an officer charged with an offence, means — (a) in the case of officers of the rank of Colonel, any officer of the rank of Major-General and above; (b) in the caseofofficers of the rank of Lieutenant-Colonel, an officer of the rank of Brigadier; (c) inthe caseofofficers of the rank of Major and Captain, anyofficer not below the rank of Colonel; (d) in the case of officers of the rank of Lieutenant and below and warrant officers, any officer not below the rank of Lieutenant- Colonel whois not the commandingofficerofthe officer charged.”

Amendment 3. Section 73 of the Act is amended — page 7 (a) in subsection (1) thereof, by substituting for the word “Lieutenant-Colonel” which appears therein, the word “Brigadier”; (b) by substituting for paragraph (a) of subsection (3) thereof, the following new paragraph — “(a) in the case of anofficer of the rank of Brigadier and above, be remandedfortrial by the High Court.” Amendment of 4. Section 74(3) of the Act is amended — aie) (a) by substituting for subparagraphs (i) - (iv) of paragraph (a) thereof, the following new subparagraphs — (i) detention for a period not exceeding 45 days,or,if the accusedis on active service, field punishmentfor a period not exceeding 45 days, (ii) a fine of a sum not exceeding the equivalent of 45 days pay, (iii) severe reprimand or reprimand, (iv) where the offence has occasioned any expense,loss or damage, stoppages, (v) admonition;”; (b) by substituting for the figure “28” wherever it appears in paragraph (b)thereof, the figure “45”. An Act to amend the Extradition Act. Date ofAssent: Date of Commencement: ENACTEDbythe Parliament of Botswana. 1. This Act maybe cited as the Extradition (Amendment) Act, 1997. Short title 2. The Extradition Act (hereinafter referred to as “the Act’’), is Amendment amendedby inserting,in its proper alphabeticalplace, the following new of section 2 of Act 18 of 1990 definition — ““designated country” means a requesting country which is declared as a designated country under section 3A, and to which fugitive criminal may be extradited even though there exists no arrangement between Botswanaandthat country;”. 3. The Act is amended by inserting, immediately after section 3 Insertion of thereof, the following new section — new section 3A in the Act "Declarationof 3A, (1) For the purposesof this Act, and notwithstanding cons the provisions of section 3, the Minister may, by order published in the Gazette, declare any Commonwealth country to be a designated country. (2) An order made under subsection (1) may prescribe whatcrimesshall be deemedto be extradition crimes for the purposesof the order and of this Act, and may be made whetheror not the designated country has madeanyprovi- sion for the extradition of any fugitive criminal from its territory to Botswana. (3) The Minister may revoke any order made underthis section, or remove any country from the list of designated countries wherehe considers that it wouldbe in theinterest of Botswanato do so.”
