In its early years as a Crown Colony, it suffered from corruption and racial segregation but grew rapidly as a free port that supported trade with China. It took about two decades before Hong Kong established a genuinely independent judiciary and introduced the Cadet Scheme to select and train senior officials, which dramatically improved the quality of governance. Until the Pacific War (1941–1945), the colonial government focused its attention and resources on the small expatriate community and largely left the overwhelming majority of the population, the Chinese community, to manage themselves, through voluntary organizations such as the Tung Wah Group of Hospitals. The 1940s was a watershed decade in Hong Kong’s history. The fall of Hong Kong and other European colonies to the Japanese at the start of the Pacific War shattered the myth of the superiority of white men and the invincibility of the British Empire. When the war ended the British realized that they could not restore the status quo ante. They thus put an end to racial segregation, removed the glass ceiling that prevented a Chinese person from becoming a Cadet or Administrative Officer or rising to become the Senior Member of the Legislative or the Executive Council, and looked into the possibility of introducing municipal self-government. -

JORC Report 2007
JORC Report 2007 The Judicial Officers Recommendation Commission (“JORC”) Report 2007 has a new format. Previously, our Report contained information about the JORC, gave an account of its important work during the year and described the different levels of court to give a comprehensive picture of the judicial offices within the responsibility of the JORC. Such information is now separately provided in two reports. First, a new report entitled “Judicial Officers Recommendation Commission” has been issued. This provides an account of the JORC and describes the different levels of court. It has been uploaded on our website. Secondly, an annual report which will concentrate on the work of the JORC during the year will be issued. In an effort to contribute to the protection of the environment, we will no longer publish a paper version of the “Judicial Officers Recommendation Commission” Report or the annual report. Both will only be uploaded on our Website. We hope you will enjoy reading this Report and gain a better understanding of the JORC during 2007. HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. Appointment of committee and advisers on facilities for West Kowloon C... 第 1 頁,共 3 頁 WKCD-251 Appointment of committee and advisers on facilities for West Kowloon Cultural District ****************************************************** ****** The Government announced today (April 6) the Chief Executive has appointed members to the Consultative Committee and its three Advisory Groups on the Core Arts and Cultural Facilities of the West Kowloon Cultural District. The appointment commenced today (April 6) and will last till the end of 2006. The Chief Secretary for Administration, Mr Rafael Hui, said the main task of the committee was to re-examine and re-confirm if appropriate, the need for the core arts and cultural facilities for the WKCD as defined in the Invitation for Proposals (IFP) issued in September 2003 to meet the aspirations and needs of the local arts and cultural community and attract visitors. The committee would also advise the Chief Executive on the justifications for the core arts and cultural facilities and other types of arts and cultural facilities as appropriate and necessary to be provided at the WKCD and the financial implications for developing and operating these facilities. "The Consultative Committee and its three Advisory Groups comprise members from the arts, cultural, entertainment and tourism sectors," Mr Hui said. "They are mainly professionals or practitioners in relevant fields who would be in the best position to help re-examine the core arts and cultural facilities for the WKCD." The Chief Secretary will chair the Consultative Committee. The three Advisory Groups set up under the Consultative Committee, namely the Performing Arts and Tourism Advisory Group, the Museums Advisory Group and the Financial Matters Advisory Group, will be chaired by the Hon Selina Chow Liang Shuk-yee, the Hon Victor Lo Chung-wing and the Hon Marvin Cheung Kin-tung respectively. -

Can justice be done? Jurists and philosophers have been asking these questions for centuries. While there is a huge body of learned work on these questions, no theory can tell what justice is or whether justice has been done in any particular case. At the end of the day, justice perhaps just lies in the hearts of ordinary people. Like the concept of the reasonable man, justice may not be something that can be formulated in abstraction but by and large is something that we recognize when we see it in practice. I have long wanted to write a book to explore these themes through real cases. As an academic lawyer, I have the privilege of being involved in the two related but in fact quite separate worlds of academia and legal practice.
