The British Infrastructure Group (BIG) is led by The Rt Hon Grant Shapps MP and brings together cross-party Members of Parliament dedicated to promoting better infrastructure across the entire United Kingdom. BIG is about ensuring every opportunity for growth is seized with bold new ideas and recommendations, backed by authoritative research and evidence. At its core, the British Infrastructure Group firmly believes that Britain should lead the world in cutting edge policy developments and infrastructure investment in order to drive forward our economy for the benefit of both this and future generations. It is in this spirit that the British Infrastructure Group publishes its second report, ‘Sunday Trading: Saving the Great British High Street’. This research highlights the overwhelmingly positive benefits that relaxing Sunday trading laws will have for high streets across the UK. It argues that the current situation of limiting the hours that shops larger than 280 square metres can open for is archaic and preventing high street retailers from competing more fairly against online shops. It also limits consumer choice and reduces flexibility. With UK shoppers turning ever more to the internet to satisfy their flexible and convenient shopping needs it no longer makes sense for large shops to be restrained by limiting their opening hours. -

THE LAW REFORM COMMISSION OF HONG KONG REPORT LAWS GOVERNING HOMOSEXUAL CONDUCT (TOPIC 2) LAWS GOVERNING HOMOSEXUAL CONDUCT WHEREAS : On 15 January 1980, His Excellency the Governor of Hong Kong Sir Murray MacLehose, GBE, KCMG, KCVO in Council directed the establishment of the Law Reform Commission of Hong Kong and appointed it to report upon such of the laws of Hong Kong as may be referred to it for consideration by the Attorney General and the Chief Justice; On 14 June 1980, the Honourable the Attorney General and the Honourable the Chief Justice referred to this Commission for consideration a Topic in the following terms : "Should the present laws governing homosexual conduct in Hong Kong be changed and, if so, in what way?" On 5 July 1980, the Commission appointed a Sub-committee to research, consider and then advise it upon aspects of the said matter; On 28 June 1982, the Sub-committee reported to the Commission, and the Commission considered the topic at meetings between July 1982 and April, 1983. Introduction by Minister The Government recognises the importance of respecting human rights and is committed to preserving the rights of individuals in their homes and businesses from unnecessary intrusion. The intention of Government is very clear: It is essential that powers of entry achieve the right balance between the need to enforce the law and ensure public protection and to provide sufficient safeguards and rights to the individual. As a result of this public authorities should have fewer powers to enter people’s homes and the privacy and rights of homeowners and businesses should be protected and strengthened wherever possible. -

10 INTRODUÇÃO Historicamente, tratando-se dos Estados, a matéria das imunidades é regida por regras costumeiras de direito internacional. O direito das imunidades foi, em seguida, enriquecido por algumas convenções. A primeira foi a convenção de Bruxelas de 1926 sobre as imunidades dos navios de Estado. Depois, surgiu a convenção de Basiléia de 1972 sobre as imunidades dos Estados, negociada sob a égide do Conselho da Europa. Posteriormente, diferentes Estados da common law, como os Estados Unidos, Reino Unido, Canadá, e, ainda, a África do Sul, adotaram legislação interna sobre as imunidades. Inicialmente, a imunidade de jurisdição dos Estados era absoluta, evoluindo mais tarde para uma imunidade relativa, havendo algumas exceções em que não se aplicava a imunidade de jurisdição. Assim, as leis internas desses Estados previram exceções nos casos de lides trabalhistas ou de acidentes automobilísticos. O direito brasileiro, seguindo a tendência mundial, também adotou a imunidade relativa, a partir da Magna Carta de 1988, com uma nova interpretação do art.114, I da mesma, no caso de questões trabalhistas. Atualmente, no entanto, o direito das imunidades de jurisdição continua a evoluir, havendo doutrina e jurisprudência que sustentam a sua ausência no caso de violação dos direitos humanos. Dessa forma, o leading case seria o caso Pinochet, no qual a Câmara dos Lordes entendeu que Pinochet não teria imunidade de jurisdição perante a corte inglesa em função de atos funcionais violadores dos direitos humanos praticados durante o tempo em que foi presidente do Chile. Dessa maneira, dentre as exceções à imunidade de jurisdição dos Estados, poder-se-ia acrescentar uma nova exceção no caso de violação dos direitos humanos. -

Sunday Trading: Consultation on Sunday trading rules ADVICE 1. I have been asked to advise on the likely impact of proposed changes to Sunday trading laws and in particular the effect in Scotland. It is necessary to consider two separate issues: a. the length of Sunday trading hours b. what rights an employee has not to work on a Sunday. There is different legislation about these two aspects, the first being a trading hours issue and the latter reflecting on employment protection rights. This distinction casts a shadow over the position in Scotland. The present position 2. Section 45 Employment Rights Act 1996 now reflects a very delicate balance which was negotiated between the interested parties in the Sunday Trading Act 1994 and provides certainty that a protected shop worker or betting worker as defined “has the right not to be subjected to any detriment by any act, or any deliberate failure to act, by his employer done on the ground that the employee refused (or proposed to refuse) to do shop work, or betting work, on Sunday or on a particular Sunday”. There are complex opt-out rights. These employment protection rights are available in Scotland even though there is no restriction on the actual hours of opening there. Paragraph 1.13 of the Consultation Document makes it clear that the Government is not proposing any changes to this part of the legislation. 1 3. It is significant that this protection extends now (and always has) only to shop and betting shop workers (so that it does not for example cover internet shopping1). -

But devolution to Scotland and Wales has been delivered and the Scottish Parliament and Welsh Assembly are already making a difference to our members’ lives. The elections in Scotland and Wales on 1 May 2003 will mark another milestone when the Parliament and Assembly are elected for another term in office. But those elections will be very important ones. The people of Scotland and Wales have the power to decide whether they want the Parliament and Assembly to continue to concentrate on improving public services and the way of life, or do they want them to focus on fighting for more power to be devolved? This paper sets out the choices for our members: the powers of the Scottish Parliament and Welsh Assembly, the difference that they can make for our members and the ways we can use these powerful devolved institutions to fight for the issues that matter to us.
