Vision Statement: The Brothers of Lambda Upsilon of Sigma Nu Fraternity, have ordained and established this chapter of honorable gentlemen. Let it be known that all fraternal goals, whether scholastically, brotherly, or socially oriented shall be bound by a single common thread: the aspiration of creating a group of men whose every action reflects the principles of Love, Honor, and Truth.

ARTICLE I: STATEMENT OF AFFILIATION

Section 1: This organization is a chartered collegiate chapter of Sigma Nu Fraternity, Inc. under the name, style and title of Lambda Upsilon Chapter Number Two Hundred and Fifty (250).

Section 2: A copy of the Bylaws of Lambda Upsilon shall be filed in the Office of Student Life & Leadership at California State University, Fullerton every year during registration or within thirty (30) days after substantive change or amendments.

ARTICLE II: PURPOSE

The purpose of this organization is:

• To develop ethical leaders inspired by the principals of Love, Honor, and Truth;

• To foster the personal growth of each man’s mind, heart, and character; and,

• To perpetuate lifelong friendships and commitment to the Fraternity.

In an effort to lessen the disparity between fraternity ideals and individual behavior and to personalize these values in the daily undergraduate experience, the following basic expectations of Sigma Nu Fraternity membership have been established: 1. I will know and understand the ideals expressed in my fraternity ritual and will strive to incorporate them in my daily life. 2. I will strive for academic achievement and practice academic integrity. 3. I will respect the dignity of all persons; therefore, I will not physically, mentally, psychologically or sexually abuse or haze any human being. 4. I will protect the health and safety of all human beings. 5. I will respect my property and the property of others; therefore, I will neither abuse nor tolerate the abuse of property. 6. I will meet my financial obligations in a timely manner. 7. I will neither use nor support the use of illegal drugs; I will neither misuse nor support the misuse of alcohol. 8. I acknowledge that a clean and attractive environment is essential to both physical and mental health; therefore, I will do all in my power to see that the chapter property is properly cleaned and maintained. 9. I will challenge my members to abide by these fraternal expectations and confront those who violate them.

This organization accepts the Nine Basic Expectations of Membership as its expectations for Chapter membership.

ARTICLE III: DEFINITIONS

Section 1: ACTIVE BROTHER. Any student of California State University, Fullerton who has been initiated into the Lambda Upsilon Chapter, and has neither resigned nor been expelled.

Section 2: ALUMNI BROTHER. Alumni Status is granted to Brothers who have graduated from California State University, Fullerton. Temporary Alumni Status is granted to Brothers who transferred to another school to complete their Bachelor’s Degree.

Section 3: CANDIDATE. A prospective member who has been elected to connect himself with the Fraternity and who has accepted the invitation of the Lambda Upsilon Chapter at the formal Candidate Ceremony.

Section 4: CANDIDATE PROGRAM. A ten (10) week process held during the academic semester and used for the education and evaluation of a candidate of the Lambda Upsilon Chapter.

Section 5: QUORUM. Two-thirds of the active Chapter. In extreme circumstances, telepresent attendance (including, but not limited to Skype and Face Time) is included in this count only with consent of the Commander.

Section 6: QUORUM VOTE. A majority vote by roll call when Quorum is present.

Section 7: PROPER NOTICE. An announcement at Chapter convocations at least one week in advance of an event or Quorum Vote.

Section 8: GOOD STANDING. An Active Brother that is neither expelled nor on Suspension.

Section 9: SUSPENSION. The temporary removal of an Active Brother’s rights and privileges in the Fraternity. A suspended Brother remains a member of the Fraternity, subject to all the responsibilities and obligations to the Fraternity and his Chapter.

Section 10: CHAPTER MEETINGS. Defined as Chapter Convocations.

Section 11: This organization accepts Robert’s Rules of Order as its Rules of Order.

ARTICLE IV: MEMBERSHIP

Section 1: This organization has the right to determine both membership and the practice and procedures by which membership is conferred.

Section 2: General Member Expectations 2.1 Maintain Academic Standards set See Article IV: Section III 2.2 Maintain 70% attendance of recorded events 2.3 Every Active member succeeding class must be involved in at least one (1) outside organization. 2.4 Complete 6 hours of community service hours 2.5 Pay dues within one week of the approval of the budget Section 3: Meetings and events shall follow the rules prescribed below:

3.1 ATTENDANCE. Active Brothers shall attend Chapter Meetings, committee meetings, and other Chapter events regularly and timely.

3.2 ATTENDANCE FINES. Any Active brother that is absent from Super meetings (without an excusable reason) will be fined $50.

3.3 DRESS CODE. Attendees of Chapter Meetings and Ritual shall dress formally, unless otherwise decided by the Commander. Casual clothing such as, but not limited to, ball caps, jeans, tank tops, t-shirts, and tennis shoes, are not permitted.

3.4 DISTRACTIONS. At Chapter Meetings and Ritual, eating is not allowed. The use of cell phones, laptops, and other devices is not permitted unless permission is granted by the Commander.

3.5 ATTENDANCE FINES. Any Active Brother who fails to meet 70% of attendance (including Sunday meetings, Super meeting, initiation, candidate pinning, Sigma Nu Philanthropy events, Brotherhood retreats, Brother hood events, Sigma Nu Social Invite, Sigma Nu Social Mixer, Sigma Nu Social meet and greets, and Recruitment events scheduled by Recruitment chair) by the first half (first 8 weeks) of the semester will be fined $50 unless absences are excused by the recorder. Any Active Brother who fails to meet 70% of attendance (including Sunday meetings, Super meeting, initiation, candidate pinning, Sigma Nu Philanthropy events, Brotherhood retreats, Brother hood events, Sigma Nu Social Invite, Sigma Nu Social Mixer, Sigma Nu Social meet and greets, and Recruitment events scheduled by Recruitment chair) by the second half (remaining 8 weeks) of the semester will be fined $50 unless absences are excused by the recorder and Eminent Commander.

3.6 ATTENDANCE EXCUSES. Are listed as work, class, and personal. Work, class, and personal must be approved by Eminent Commander and Recorder.

Section 4: 4.1 ACADEMIC STANDARDS: If a brother’s cumulative and semester Grade Point Average is both above a 2.500 GPA, the brother is in good standing.

If a brother’s cumulative grade point average is above a 2.500 GPA, but his semester GPA is below a 2.500 GPA, for every .100 GPA below, he must complete one (1) study hour. However, if a brother’s grade point average falls below a 2.000 semester GPA, that brother will be suspended at the start of the following semester until that brother’s SEMESTER grades are brought above academic standard. A bi-weekly update on grades will be presented to the Scholarship Officer once the brother’s grades are brought above academic standard for the remainder of the semester.

If a brother’s cumulative grade point average is below a 2.500 GPA, that brother will be suspended starting at the beginning of the following semester until that brother’s SEMESTER grades are brought above academic standard. A bi-weekly update on grades will be presented to the Scholarship Officer once the brother’s grades are brought above academic standard for the remainder of the semester. Brothers that fall below a 2.500 cumulative GPA will be administered an academic coach assigned by the Scholarship Chairman and issued mandatory study hours determined by the Scholarship Chairman.

If brother’s cumulative grade point average falls below a 2.200 GPA, that brother will be sent to Trial Court.

Active Brothers who fail to meet these academic standards are automatically suspended starting at the beginning of the following semester until said brother’s grades are brought above academic standard of 2.5. A bi-weekly update on grades will be presented to the Scholarship Officer once the brother’s grades are brought above academic standard for the remainder of the semester. Suspension due to academics carries the following consequences:

A. No longer in Good Standing. B. Ineligible to hold office. C. Issued mandatory study hours as determined by the Scholarship Officer. D. Required to summit syllabi and test scores to the Scholarship Officer to show improvement.

Section 5: DUES AND FINES. Active Brothers owing an account of thirty (30) days in arrears are automatically Suspended until all debts are paid. Suspension due to financial debts carries the following consequences:

1. No longer in Good Standing.

2. Ineligible to hold office.

3. Prohibited from attending an event that is sponsored through the chapter treasury.

4. Ineligible to vote on budgetary matters.

5. unable to attend preference and/or formal

Section 6: BADGE. The Badge shall be worn on the shirt above the corner of the left-hand pocket, but shall not be worn on a sweatshirt, or undershirt. The only persons who may wear the Badge shall be a Brother or his mother, wife, sister, fiancé, or daughter.

• Section 7: LETTERS. The Greek letters, ΣΝ, shall only be worn by a Brother, his mother, wife, sister, fiancé, daughter or White Rose preceding Fall Semester 2015.

ARTICLE V: CANDIDACY

Section 1: The process of election of Candidates shall be those prescribed below.

1. ELECTION. A Chapter must elect all prospective members prior to becoming a Candidate.

2. VOTING BY THE CHAPTER. One adverse ballot by a Chapter member shall reject a Candidate, except as otherwise stated in this article. A Candidate may be proposed as often as any Brother considers desirable.

3. CHAPTER QUORUM FOR CANDIDATE ELECTION. When at least three- fourths of the Active Brothers are present, a Chapter may vote on the election of a Candidate. All Active Brothers should vote on the election of a Candidate.

4. LEGACIES. A legacy may be elected as a Candidate by the affirmative vote of three-fourths of the Active Brothers. For purposes of this paragraph, a legacy shall be any man, whose familial brother, lineal ascendant, uncle, or great uncle is a Brother, living or deceased. Written support for the candidacy of a man into Sigma Nu must be made by the ancestor to the Chapter command or his designee before these special provisions may take effect, if at all possible.

5. BALLOTS FOR ELECTION. The election of a Candidate shall be by secret ballot of the Active Brothers, unless by a four-fifths Majority Vote of such members an oral vote for the election of a Candidate is requested. Voting by proxy for Candidate election is not permitted.

Section 2: INITIATION. The process of initiation of Candidates into becoming Active Brothers shall be those prescribed below.

2.1 REQUIREMENTS. Any Candidate who conducts themselves congruently with the purpose of Sigma Nu Fraternity, is involved in at least one outside organization, completes the Candidate Program, and receives a 2.500 semester grade point average will be initiated as an active member of the Sigma Nu Fraternity.

2.2 DATE OF INITIATION. Candidates are initiated according to the Ritual once the grade point averages of all members of a Candidate Class are known by the Marshal. Delay of initiation to raise a Candidate’s grade point average during future semesters is not allowed. “Stand-by” status will not be given to Candidates who fail to meet the standards of initiation.

2.3 REMOVAL. Candidates who do not conduct themselves congruently with the purpose of Sigma Nu Fraternity may be removed from eligibility for initiation during his candidate semester. Any general member can bring up issues with candidates before meeting amongst the E-Board. If an issue is present, the Marshall shall present this issue to the Chapter. The Candidate will be removed from his candidacy process if the majority (50%) of the entire chapter votes for his removal.

2.4 HONORARY MEMBERSHIP. No Honorary Members shall be elected or initiated into Lambda Upsilon Chapter.

Section 3: Candidates are permitted to attend Chapter Meetings with the consent of the Commander.

Section 4: The hazing of Candidates is strictly prohibited.

Section 5: The Candidate Pin shall be worn on the shirt above the corner of the left-hand pocket, and only on clothes which compliments the pin and is of neat and gentlemanly attire. The Candidate Pin shall never, under any circumstances, be worn on ripped or any other unkempt clothing. The Candidate Pin must be worn at all times on campus or at any Sigma Nu event, except when exercising.

ARTICLE VI: OFFICERS AND DELEGATES

Section 1: The officers of this section shall be elected by a Quorum Vote. The officers of the Chapter, ranking in the order named, shall be:

Section 2: The following positions may be appointed by the Commander. Brothers must be in Good Standing to be eligible for appointment.

Section 3: The power and duties of officers shall be those prescribed by the Executive Committee, and those listed below:

3.1 COMMANDER The Commander shall have the following powers and duties:

A. To issue and enforce a Chapter summons commanding any member of the Chapter to attend Chapter Meetings. B. To preside at all Chapter Meetings. C. To preserve order and inflict fines for disorderly conduct. D. To decide all points of law and order. E. To appoint all Chapter committees. F. To countersign all orders on the Chapter treasury. G. To report to the Chapter any failure by the officers of the Chapter to properly perform their duties with recommendations for removal from office or such other action as may be considered proper. H. To perform those duties required by the Ritual. I. To appoint all non-elected Chapter positions. J. To expel any member from meeting at his discretion K. To maintain relations with the Greek Life Office

3.2 LIEUTENANT COMMANDER The Lieutenant Commander shall have the following powers and duties: A. To coordinate participation in all standards programs for the Chapter. B. To assist the Commander and in the Commander’s temporary absence perform the Commander’s duties. C. To perform those duties required by the Ritual. D. To organize the Pursuit of Excellence Program (P.E.P.) information and submit it to Headquarters in a timely fashion. E. To oversee all officers of lower rank. F. To oversee the revisions of these BYLAWS each semester, as necessary

3.2.1 LIEUTENANT COMMANDER INTERNAL/EXTERNAL AFFAIRS In the event that the chapter agrees to form a division within the Lieutenant Commander position, due to chapter size and volume, an Internal and External Position shall be created within the expected powers and duties as Lieutenant Commanders. It is the chapter’s decision to agree upon the division of Lieutenant Commander and the chapter’s decision to determine this division before every election. 3.2.1A LIEUTENANT COMMANDER OF INTERNAL AFFAIRS The Lieutenant Commander of Internal Affairs shall not only have the powers and duties of a Lieutenant Commander, but in addition: A. To perform with the same powers and duties as Lieutenant Commander (3.2). B. To oversee internal officers with positions that are obligated but not limited within the Fraternity (such as Treasurer, Recorder, etc.). C. To organize Committee meetings. D. To organize and chair Honor Board E. To perform those duties required by the Ritual. F. To oversee the revisions of these BYLAWS each semester, as necessary G. To coordinate participation in all standards programs for the Chapter. 3.2.1B LIEUTENANT COMMANDER OF EXTERNAL AFFAIRS The Lieutenant Commander of External Affairs shall not only have the powers and duties of a Lieutenant Commander, but in addition: A. To perform with the same powers and duties as Lieutenant Commander (3.2). B. To oversee external officers with positions that are obligated but not limited with relations outside of the Fraternity (such as Philanthropy, L.E.A.D., etc.). C. To organize Executive Board meetings. D. To organize the Pursuit of Excellence Program (P.E.P.) information and submit it to Headquarters in a timely fashion. E. To assist the Commander and in the Commander’s temporary absence perform the Commander’s duties. F. To oversee all programming efforts for the chapter.

3.3 TREASURER The Treasurer shall have the following powers and duties:

A. To promptly collect all dues, fees, taxes, fines and other monies owed to the Chapter. B. To pay out the Chapter’s monies only upon order of the Commander with consent of the Chapter. C. To remit to the Executive Director within ten days after collection the taxes, dues, fees and other monies payable to the General Fraternity. He shall be personally responsible to the Fraternity for all sums not remitted. D. To properly maintain the accounts of the Chapter pursuant to the books of uniform accounting published by the Executive Director. E. To make at the end of each fiscal year a complete report to the Executive Director of the financial condition of the Chapter. F. To make such other reports as may be required from time to time by the Executive Director. G. To promptly file all government taxes for the Chapter, maintaining its non-profit status. H. To prepare and submit a semester budget to be approved by the Chapter.

3.4 RECORDER The Recorder shall have the following powers and duties:

A. To send to the Executive Director within ten days after his election, a list setting forth in detail what Fraternity records have been received by him and stating that he has received from his predecessor the records of initiates and the Ritual.

B. To maintain a written record of all proceedings of the Chapter and, when requested, to send a copy of such record to the Executive Director or the Council. C. To make any other reports requested by the Executive Director. D. To perform the duties of the Corresponding Secretary for the Chapter. E. To send, on proper forms to the Executive Director, Reports of Candidacy or Initiation, affiliations, deaths, Expulsions and election of officers within three days after the occurrence of such events. F. To sign all orders upon the Chapter treasury. G. To collect and tabulate votes for amendments to the Chapter Bylaws. H. To accurately collect and maintain record of important data from Chapter efforts included, but not limited to, community service hours and fundraising hours. I. To maintain accurate attendance records.

3.5 MARSHAL The Marshal shall have the following powers and duties:

A. Direct and coordinate the Chapter’s Candidate education program. B. Present to the Chapter the Candidate education program prior to rush. C. Appoint all Assistant Marshals. D. The Marshal shall also perform duties required of him by the Ritual. E. Track Candidate attendance for mandatory campus programs for new members. (i.e. Greek Life 101) F. Maintain and update the Candidate Manual

3.6 CHAPLAIN The Chaplain shall have the following powers and duties:

A. Make plans for Divine Worship. B. Coordinate the Chapter’s use of the Ritual. C. Assist with the Candidate Education Program. D. Perform such other related duties as the Commander may direct. E. To be in charge of planning and executing at least one Brotherhood retreat on an annual basis

3.7 LEAD OFFICER The LEAD Officer has the following powers and duties:

A. Coordinate all LEAD phases for Active Brothers as needed to fulfill excellence in the Pursuit of Excellence Packet B. Assist the Marshal by coordinating Phase I of LEAD with the Candidates.

3.8 RECRUITMENT OFFICER The Recruitment Officer has the following powers and duties:

A. Organize and facilitate semester rush events. B. Implement a recruitment 365 plan. C. Maintain a master prospect list of potential new members. D. Invite alumni to partake in formal recruitment

3.9 ALUMNI RELATIONS OFFICER The Alumni Relations Officer has the following powers and duties:

A. Collect and report information relating to the Alumni Brothers of the Chapter and shall be the liaison between the Alumni Brothers and the Collegiate Chapter. B. Create and distribute an Alumni Newsletter that highlights Chapter events and achievements by the Active Brothers. C. Organize at least one (1) event per semester that brings Alumni and Active Brothers together. D. Communicates updated Alumni information with Headquarters each year.

3.10 CAMPUS INVOLVMENT OFFICER The Campus Involvement Officer has the following powers and duties:

A. To help motivate active members and candidates to become involved on campus during his term. B. To monitor and keep record of all active members and candidates campus involvements during his term. C. Officer must currently be involved in an outside organization on campus. D. Announce campus events to members on forums and at meetings. E. Coordinate a presentation every semester to each incoming candidate class at their first meeting to inform them on how to get involved on campus. F. To ensure each candidate is involved in at least one (1) outside organization on campus.

G. Bestows awards to active members at then end of each semester pertaining to on-campus involvement.

3.10 SENTINEL/RISK REDUCTION. The Sentinel has the following powers and duties:

A. Form practices and procedures that reduce the risk of Chapter activities. B. Organize at least one (1) risk reduction workshop per semester. C. Perform those duties required of him by the Ritual. D. To escort any person(s) from Chapter meetings as directed by the Commander. E. To create and preside over a Risk Reduction Committee to assist him with his responsibilities and duties.

3.11 REPORTER The Reporter has the following powers and duties:

A. The Reporter shall report to the Editor of The all news items and other matters suitable for publication in The Delta. B. Regulate all media, including but not limited to, Facebook and the Chapter website and any photographs posted. All changes to media must first approved by the Commander. C. Report to organizations any items that the Chapter wants to announce.

3.12 CHAPTER HISTORIAN The Chapter Historian shall have the following powers and duties:

A. To collect, file, and preserve papers, records, Chapter publications, pictures, souvenirs and miscellany likely to prove of interest and value as historical matter. B. To send to the General Office historical material that should be preserved for the future. C. To serve as liaison with the Grand Historian in an effort to utilize the Chapter’s historical effects to develop a sense of pride and loyalty toward the Chapter and the Fraternity.

3.13 COMMUNITY SERVICE AND PHILANTHROPY OFFICER The Community Service & Philanthropy Officer shall have the following powers and duties:

A. Hosts at least one campus wide philanthropy event each year. B. Ensures that the Chapter has an ongoing philanthropy (minimum of one per month) that includes direct community service and an established relationship with a local non-profit. C. Includes one of the organizations that are partners in the Helping Hand Initiative in its fundraising or community service projects at least once per academic year. D. Ensure each active member obtains at least six (6) hours of community service each semester. E. Ensures Chapter has incorporated education about the cause being supported into at least on fundraising event. (e.g. brochures about the cause, or a speaker on the issue.) F. Incorporates the values of Sigma Nu into all Service and Philanthropy event G. Leads the Chapter in periodic reflection after service and philanthropic activities to help members process the experience. This should help members better understand the impact of their service and philanthropic activities as it relates to the values and purposes of the Fraternity. H. To ensure members are involved with individual service in addition to chapter projects. I. To ensure that the chapter advocates for its non-profit partners in the community. J. To ensure that the chapter encourages others to support local non profits, including Lambda Upsilon’s own community service and philanthropic projects. K. Responsible to co-sponsor a community service or philanthropy project with another campus organization at least once per academic year. L. Collects electronically (on a shared Google folder with the Recorder, Commander, and Lieutenant Commander) the community service hours of each member (active and candidate) with updates at least monthly.

3.14 SCHOLARSHIP OFFICER The Scholarship Officer shall have the following powers and duties:

A. The Scholarship Officer shall direct and coordinate the Chapter’s academic activities. B. Collect and consolidate all grade data. C. Updates (along with the Faculty Advisor) the Chapter’s written academic plan within the first month of attaining the office. This plan will include all components of the Pursuit of Excellence Program. D. Coordinates and tracks the proctored study hours on a weekly basis. Reports to the Executive Committee the results on a weekly basis. E. Encourages members to pursue admittance to honors programs and academic groups (such as Order of , Delta , and other Honoraries). F. Appoints Scholarship Committee to provide individual support to brothers who have below a 2.0 cumulative GPA. G. Provides a written scholarship plan with defined goals that are well articulated and easy to measure each semester. H. Recognizes Brothers at Chapter meeting who are showing improvement as well as those who have done well historically.

3.15 SOCIAL OFFICER The Social Officer shall have the following powers and duties:

A. Direct and coordinate the Chapter’s social activities with sororities. B. Plan and execute an annual formal.

3.16 FITNESS AND INTRAMURAL OFFICER

A. The Fitness & Intramural Officer shall direct and coordinate the Chapter’s physical fitness activities.

Section 4: OFFICER CONTRACT. Officers shall sign and abide by an officer contract outlining their duties.

Section 5: OFFICER NOTEBOOK. Officers shall maintain a notebook containing information related to his office. This notebook shall be passed down to his replacement.

Section 6: ELIGIBILITY FOR OFFICE. Eligibility for office shall be those prescribed below:

6.1 INITIATED MEMBER. No member of the Chapter shall be eligible for any Chapter office unless he has been initiated into the Fraternity according to the Ritual.

6.2 GOOD STANDING. An Active Brother must be in Good Standing to be eligible for office.

6.3 ACADEMIC REQUIREMENT. An Active Brother must obtain at least a 2.700 semester and or cumulative grade point average. If this GPA is not met, this Brother can still be eligible to hold an position as long as he completes and proctors _X_ amount of study hours per week. For every .100 GPA below, he must complete one (1) study hour(s) per week. The lower of both grade point averages will be chosen to determine the amount of study hours per week.

Section 7: INSTALLATION OF OFFICE. The installation of officers shall be prescribed below:

7.1 TIME OF ELECTION. The Chapter shall take nominations for officers during the first Chapter meeting in May. Election of officers shall be during the second Chapter meeting in May.

7.2 TERM LENGTH. Terms last until the Chapter officer is removed, or on the May 31st immediately following elections, whichever is sooner.

7.3 INSTALLATION. Chapter officers are installed on the June 1st immediately following elections. The Commander, the past Commander, or if neither is present, an acting Commander chosen for the purpose, shall install the Commander-elect. The new Commander shall install the other officers.

7.4 VACANCIES. When there is a vacancy in an office, the Chapter, by a Quorum Vote, shall choose a successor to fill the vacancy for the unexpired term of office.

A. Vacancies shall be temporarily filled by an appointee as determined by the Commander, until such time as nominations may be taken and an election held for elected positions.

B. In the case of a vacancy in the office of Commander, the Lieutenant Commander or next ranking officer shall temporarily act as the Commander until nominations and an election can be held.

7.5 OATH. When installed, an officer-elect shall make the following oath: “I promise upon my honor as a Knight and a gentleman, to conform to and abide by The Law of Sigma Nu Fraternity, orders of the Grand Chapter, the High Council, Executive Director and the Division Commander of this Division, and the Rules of this Chapter, and to faithfully perform all the duties of the office to which I have been chosen.”

ARTICLE VII: REMOVAL OF OFFICERS

Section 1: AUTOMATIC REMOVAL. Any Chapter officer that is not in Good Standing is immediately and automatically removed from his position.

Section 2: AUTOMATIC REMOVAL. If an officer resides below a 2.700 grade point average and does not complete his assigned study hours on a week-to-week basis, he can be removed at the discretion of the Commander.

Section 3: If an elected officer does not complete his duties the Commander may bring a recommendation for removal of the officer to the Chapter.

Section 4: A Quorum Vote is necessary to remove an elected officer in Good Standing from his position for cause. This vote must be given Proper Notice.

Section 5: Brothers in appointed positions may be removed from their position at the discretion of the Commander.

ARTICLE VIII: COMMITTEE SYSTEM

Section 1: Lambda Upsilon will accomplish its objectives through the combined cooperative efforts of all members under the able leadership of a committee chairman. Committees will provide the opportunity for all members to be involved in a coordinate manner in the operations of the Chapter. The following sections are standing committees and committee members, and the Commander may alter them at his discretion.

Section 2: The standing committees of the Chapter shall be:

A. Executive Committee

B. Recruitment Committee

C. Risk Reduction Committee

D. Pursuit of Excellence (P.E.P) Committee

E. Finance Committee

F. L.E.A.D. Committee

Section 3: EXECUTIVE. The Executive Committee shall be chaired by the Lieutenant Commander and be comprised of at least the Commander, Treasurer, Recorder, Marshal, and each committee chairman (which varies at the discretion of the E.C or L.C). Any Brother may attend Executive Committee meetings. Brothers may be summoned by the Lieutenant Commander to attend. This committee shall meet at least once per week.

Section 4: RECRUITMENT. The Recruitment Committee shall be chaired by the Recruitment Officer. The Committee shall plan and execute Rush Week each semester as well as implement Recruitment 365. The committee shall meet at least once per month.

Section 5: RISK REDUCTION. The Risk Reduction Committee shall be chaired by the Risk Reduction Officer. The committee shall work with other committees and officers while planning all events to ensure the Risk Reduction practices and measures are being followed. The committee shall meet at least once per month.

Section 6: PURSUIT OF EXCELLENCE. The Pursuit of Excellence Committee shall be chaired by the Lieutenant Commander. The committee shall submit and compile data for the National and University Pursuit of Excellence Packets in a timely manner. The committee shall also report exemplary achievements, noteworthy information, and areas of necessary improvement to the Chapter. The committee shall meet at least once per month.

Section 7: FINANCE. The Finance Committee shall be chaired by the current Treasurer. The committee shall discuss current financial issues and to explore the possibilities of future financial issues. The committee shall also ensure Brothers and or Candidates are current on dues and report to the Treasurer those in financial difficulties. The committee shall meet at least once per month.

Section 8: L.E.A.D. The L.E.A.D Committee shall be chaired by the L.E.A.D officer and additional Brothers in the Chapter. This committee is in charge of planning and maintaining a schedule of L.E.A.D activities for the academic year along with the years in the future. Other duties of the committee include, but are not limited to, recruiting guest facilitators as well as everything that encompasses a successful completion of an expectable number of L.E.A.D sessions during the academic year, according to the Pursuit of Excellence program.

Section 9: The Commander shall create and dissolve additional committees and committee chairmen as needed.

Section 10: Each Brother shall actively participate in at least one committee every semester. Brothers are appointed to committees at the discretion of the Commander.

ARTICLE IX: HONOR BOARD

Section 1: Honor Board has dual purpose:

A. Act as an internal disciplinary body for situations that are not serious enough to warrant going to Trial.

B. Bestow honors upon Brothers and people closely affiliated with the Chapter.

Section 2: FORMATION. Honor Board shall be called into formation as need arises.

2.1 It consists of five (5) consenting Active Brothers in Good Standing chosen by the Lieutenant Commander. This service is a temporary position.

2.2 The Lieutenant Commander mediates Honor Board in an unbiased fashion and does not have a vote in its decisions.

Section 3: DISCIPLINARY PROCEDURES

3.1 REPORTING CONFLICTS. Conflicts should be reported to the Lieutenant Commander either verbally or by written complaint. The Lieutenant Commander must promptly investigate evidence and make written report of the complaint and his investigation.

A. If the Lieutenant Commander is named as a defendant, named as plaintiff, is disqualified, or is otherwise unavailable, complaints should be reported to the next ranking officer who takes the place of the Lieutenant Commander in all ways relevant to Honor Board.

B. The Lieutenant Commander has the right to recuse himself from investigation and chairing Honor Board to avoid semblance of partiality or bias. All responsibilities for Honor Board fall to the next ranking officer, who may also recuse himself.

3.2 Conflict may be adjudicated by Honor Board at the Lieutenant Commander’s discretion, and may instead be delegated to mediation by the Chaplain in less serious cases.

3.3 To allow for a proper defense, all evidence must be made known to both the accused and accuser at least seventy-two (72) hours prior to hearing.

3.4 Honor Board should be held in a timely manner, but no sooner than seventy-two (72) hours after the incident.

3.5 RIGHT TO COUNCEL. The accuser and accused have the right to be represented and counseled by a consenting Brother in Good Standing of their choosing.

3.6 ORDER OR PROCEEDINGS.

A. OATH. The Lieutenant Commander shall administer the following oath to all the members of the trial court including himself: “I, ______, swear on my honor as a Knight and a gentleman to judge the case now pending fairly and impartially, so help me God.”

B. The complaint shall be read and the plea of the accused stated.

1. PLEADING GUILTY. a. In the event that the accused pleads guilty to the complaint, the accused shall be offered the opportunity to present any facts pertinent to the consideration of sentencing.

b. The accuser shall be offered the opportunity to present any facts pertinent to the consideration of sentencing.

c. The accused shall be offered the opportunity to make a closing statement.

2. PLEADING NOT GUILTY. a. The accuser may make an opening statement and then shall provide evidence in support of his complaint.

b. The accused may then make an opening statement and offer evidence in his defense.

c. A rebuttal may then be offered by the accuser.

d. A rebuttal may then be offered by the accused.

e. The parties may present final arguments, the accuser having the opening and closing final argument.

3.7 VERDICT. Decisions by Honor Board are made by majority vote after private group deliberations. The accused and accuser shall be informed of Honor Board’s decision immediately. The Lieutenant Commander shall inform the accused of his right to appeal.

3.8 PUNISHMENTS. Honor Board may levy punishments at its discretion including, but not limited to, reasonable fines, community service, and Suspension for up to one hundred twenty (120) days.

3.9 APPEALS. Brothers may appeal decisions by Honor Board. Until an appeal is brought before Quorum, all punishments levied by Honor Board are temporarily suspended. Decisions by Honor Board may be overturned with a Quorum Vote after the accused has a chance to plead his case for appeal and the Chapter discusses the appeal. The right to appeal shall not be infringed.

3.10 FAILURE TO COMPLETE PUNISHMENTS. If the guilty brother fails to complete punishments set forth by Honor Board, he shall automatically be brought to charges pursuant of the Trial Code.

Section 4: Honors for Brothers

4.1 BROTHER OF THE WEEK. The Lieutenant Commander shall bestow this honor upon Brothers who have performed substantially well during the given week.

4.2 CAMPUS LEADERSHIP. Honor Board shall bestow honors for those Brothers who are involved on campus through other organizations. These honors include: - “The Most Attended Events by an Active of the Semester” * (Must pertain to on-campus organizations/events) - “The Most Involved Active of the Semester” * (Must pertain to involvement of on-campus organizations)

4.3 HALL OF HONOR. Honor Board shall induct one (1) Brother once every two (2) years. An inductee of the Lambda Upsilon Hall of Honor is the highest honor that Lambda Upsilon can bestow upon a Brother. 4.4 WAR EAGLE. Brothers that complete the following expectations will be deemed War Eagles: In the Fall semester, brothers that complete the following requirements will receive the blue War Eagle patch. • 3.0 GPA • 93% attendance • Involvement in one (1) outside organization • Paid dues on time and in full • 15 community service hours In the Spring semester, brothers that complete the following requirements will receive the black War Eagle patch. • 3.0 GPA • 93% attendance • Involvement in one (1) outside organization • Paid dues on time and in full • 15 community service hours Lt. Commander collects the data for the War Eagle Award.

Section 5: WHITE ROSE. White Rose is an honor bestowed upon women who have rendered significant support for the Chapter.

5.1 MINIMUM DURATION. Only women who have rendered significant support for the Chapter for duration of at least one (1) year are eligible.

5.2 ELECTION. Honor Board may convene to make recommendations for White Rose candidates. This recommendation is brought before the Chapter. When Quorum is met, a three-fourths affirmative vote is required to bestow the title of White Rose.

5.3 BADGE AND LETTERS. White Roses may wear the White Rose Badge and letters of ΣΝ. But not the Badge of an Active Brother unless she is also a Brother’s mother, wife, sister, fiancé, or daughter.

ARTICLE X: CHAPTER FINANCES

Section 1: BUDGET. A semester budget must be prepared by the Treasurer and presented to the Chapter prior to the first school day of the semester. This budget must be approved by a Quorum Vote.

Section 2: MODIFICATIONS. The semester budget may be modified at any time with a Quorum Vote.

Section 3: VOTING RIGHTS. Active Brothers owing an account of thirty (30) days in arrears are ineligible to vote on budgetary matters, but may participate in discussions.

Section 4: PENALTY When an Active Brother does not pay dues in full one weeks after the approval of the budget and/or enrolls in a monthly payment plan, he will be penalized 5% of his dues.

Section 5: PAYMENT PLAN. Payment plans for dues are up to the discretion of the Treasurer.

Section 6: ACADEMICS: Any Active Brother who obtains a Term GPA that is greater that the Chapter median for that term will receive a $25 discount on the following semester’s dues. Any Active Brother who is below the Chapter Term GPA median will pay an additional $25 in dues the following semester.

Section 7: ASI PRESIDENT/VICE PRESIDENT: If an active member in good standing is elected into ASI Presidency, then they do not have to pay dues for the entirety of their term. If an active member in good standing is elected into ASI Vice-Presidency, then they only have to pay half of their dues for the entirety of their term.

Section 8: DEBTS. If the Chapter owes a financial debt, repayment is made with the consent of Commander and the Recorder.

Section 9: TRIAL. Active Brothers owing an account of sixty (60) days in arrears may be sent to Trial, pursuant to the following procedure:

9.1 The Treasurer shall promptly inform the delinquent Brother that he may appeal to the Chapter at the next Chapter Meeting any hardships.

9.2 The Treasurer shall report the delinquency to the Chapter at the next Chapter Meeting.

9.3 While the Chapter discusses the delinquent Brother, he must vacate the room until discussions are closed and a decision has been made.

9.4 An anonymous, majority vote by the members present at Chapter Meeting decides if there is a proven hardship.

9.5 If the Chapter finds there is a proven hardship which justifiably prevents the delinquent Brother from making prompt payment, then the delinquent Brother may be permitted to execute a promissory note to the Chapter for the amount owed upon such terms as the Treasurer may determine, but payable no later than one (1) year from the date the Treasurer takes such action. During such time, the Suspension of the delinquent Brother shall continue. If the note is not paid when due, the Chapter Treasurer shall promptly initiate proceedings in accordance with the Trial Code.

9.6 If the Chapter determines that no such hardship is demonstrated, the Treasurer shall promptly initiate proceedings in accordance with the Trial Code. The Trial shall be scheduled no sooner than that time when the account of the Brother is expected to be ninety (90) days in arrears to the Chapter.

Section 10: General Member Expectation Fines 10.1 Attendance Brothers who fail to meet 70% attendance in the first half of the semester will be sent to Honor Board. Brothers who fail to meet 70% attendance in the second half of the semester will be sent to Honor Board.

10.2 Community Service Hours Brothers who fail to meet the mandatory six (6) hours of community service before the end of the semester will be fined $100.

10.3 All fines collected from the chapter treasury from Section 10.2 will be donated to CSUF Philanthropic Foundation: Greek Week – Sigma Nu.

10.4 Any Active Brother who fails to meet 70% of attendance (including Sunday meetings, Super meeting, initiation, candidate pinning, Sigma Nu Philanthropy events, Brotherhood retreats, Brother hood events, Sigma Nu Social Invite, Sigma Nu Social Mixer, Sigma Nu Social meet and greets, and Recruitment events scheduled by Recruitment chair) by the first half (first 8 weeks) of the semester will be fined $50 unless absences are excused by the recorder. Any Active Brother who fails to meet 70% of attendance (including Sunday meetings, Super meeting, initiation, candidate pinning, Sigma Nu Philanthropy events, Brotherhood retreats, Brother hood events, Sigma Nu Social Invite, Sigma Nu Social Mixer, Sigma Nu Social meet and greets, and Recruitment events scheduled by Recruitment chair) by the second half (remaining 8 weeks) of the semester will be fined $50 unless absences are excused by the recorder and Eminent Commander.

ARTICLE XI: METHOD TO AMEND BYLAWS

Approval by a three-fourths vote of the entire active Chapter shall be required to amend these bylaws. This process has four (4) stages:

1. An Active Brother must propose the amendment in writing and present it to the Chapter. This can be done at Meeting or via online media.

2. A period of one (1) week from the time of presentation must pass to allow the Chapter to discuss and reflect on the proposal. No votes are counted during this time.

3. Immediately after the one (1) week period, a two (2) week voting period begins. During this time the Recorder shall impartially collect and record votes from each Active Brother.

• Votes are confidential between the Recorder, Commander, and voting Active Brother. The voting Active Brother may choose to forgo this right. • Brothers may change their vote at any point during the two (2) week voting period. • All votes must be collected in person, over the phone, or by computer BY VOICE (i.e Skype, face time, etc.) and never by proxy, text message, or Internet poll.

4. At the end of the two (2) weeks and no sooner, the Recorder shall notify the Chapter of the result of the vote. The Recorder must then immediately update these Bylaws to reflect any approved changes.

ARTICLE XII: APPROVAL

Under the power and duties granted by The Law of Sigma Nu Fraternity, Inc. under Article 7, Section 2, we the Brothers of the Lambda Upsilon Chapter of Sigma Nu Fraternity adopt these Rules and Procedures for our Chapter to governance on this June 3, 2013. Its rules are effective immediately.

ARTICLE XIII: CSUF REQUIRMENTS

Section 1: Membership in the organization shall be open to all those regularly-enrolled California State University, Fullerton students who are interested in membership. There shall be no other requirements for admission to regular membership. Each regular member has equal rights and privileges.

Section 2: Membership in this organization shall not be denied to any student at California State University, Fullerton on the basis of race, religion, national origin, ethnicity, color, age, marital status, citizenship, sexual orientation or disability. Section 3: There shall be a minimum of five (5) CSU Fullerton students who are currently enrolled in at least one class with a maximum of 20 percent of the members who are not CSU Fullerton students.

Section 4: Voting membership is limited to regularly enrolled (non-extended education) students, The President and Treasurer of the student organization are required to meet the minimum requirements established for Minor Student Representative Student Officers by the CSU Chancellor’s Office.

A. Officers must be matriculated and enrolled (non-extended education) at Cal State Fullerton.

B. Officers must maintain a minimum cumulative 2.0 grade point average each term.

C. Officers must be in good standing and must not be on probation of any kind.

D. Undergraduates are required to earn six semester units per term while holding office. Graduate and credential students must earn three semester units per term while holding office.

E. Undergraduate officers are allowed to earn a maximum of 150 semester units or 125 percent of the units required for a specific baccalaureate degree objective, whichever is greater. Graduate and credential officers are allowed to earn a maximum of 50 semester units or 167 percent of the units required for the graduate credential objective, whichever is greater.

Section 5: A copy of this constitution/by-laws and/or amendments to this constitution must be filed in the Office of Student Life & Leadership at CSU Fullerton every year during registration or within 30 days after any substantive change or amendment.

Section 6: The President and Treasurer are required to meet the minimum requirements established for Minor Representative Student Officers by the CSU Chancellor’s Office.

A. Officers must be matriculated and enrolled (non-extended education) at Cal State Fullerton.

B. Officers must maintain a minimum cumulative 2.0 grade point average each term.

C. Officers must be in good standing and must not be on probation of any kind.
