I received a phonecall saying it would be dealt with but nothing happened. this year the ragwort is already flowering. The A24 along this stretch is close to agricultural and grazing land as well as public footpaths posing a risk to livestock and people who may pick the flowers. Landowners are obliged to take steps to control ragwort and can be fined but their efforts are compromised by the lack of proper control by the Council for which it is responsible. Please could I have your assurance that this situation will be dealt with and the ragwort removed/killed? No Extra information supplied by the user

On my trip back from county council yesterday I could not ignore the huge ragwort problem we have exploding all over our verges this year - particularly along the A24 and A27. As a predominately rural county with responsibilities to the environment and all residents including our farming community I was wondering what wscc’s position was on the clearance of this potentially lethal plant.

I am aware of the govt’s code of practice which although does not seek to eradicate ragwort, it does seek to control it where it may be a threat to the health and welfare of animals. And While I appreciate that livestock does not graze our verges - this plant is very successful in spreading (the average seed number per flower head is 70 and the number of flower heads per plant can range from less than 200 to over 2,000. Thus A single plant can produce 150,000 seeds with a 70% germination rate.

As a horse owner and landowners myself I understand the duty the govt places on me and its particular emphasis on protecting horses whose digestive system makes them particularly vulnerable. The Code provides comprehensive guidance on when, where and how to control ragwort, as well as pays specific attention to the needs of the environment and the countryside as part of the process.

As you may know network rail has a annual program of spraying in an attempt to halt the spread to the countryside it’s network runs through.

I accept we have many financial and competing challenges on within highways but could you let me know If we have a policy on this matter. If so what are our contractors presently contractually required to do given the scale of the problem faced

Thank you for your report. The site has been inspected and the weeds have been cut back from overhanging the footway.

The laws on ragwort do not require ragwort to be automatically removed. The Weeds Act 1959 and the Ragwort Control Act 2003 are routinely misquoted.

Under the 1959 Act a landowner or occupier may be ordered to control the spread of ragwort. The 2003 Act allows for the creation of a code of practice. Neither Act makes ragwort control compulsory in the absence of an order. In short, there’s no compulsion on landowners to remove ragwort.

By contrast, here’s the other important legal bit: It is illegal to uproot any wildflower, including ragwort, unless carried out by the landowner, occupier, someone authorised by them, or by a specified official.

There’s little or no harm to humans and the main risk to animals is if dry ragwort gets mixed up in their dry food. But the law does not require removal of ragwort.
