a. An application (copy at Appendix 1) under section 17 of the Licensing Act 2003 for a Premises Licence to be granted in respect of Lliswerry and Nash Constitutional Club was served on the Licensing Authority of on 01st June 2015.

b. In accordance with statutory provisions, copies of the application were served on each of the responsible authorities and details of the application were advertised on the premises and in the South Argus, giving the responsible authorities and any other persons until 30th June 2015 to make written representations.

c. The premises is a detached two storey building located at 5-7 Nash Road, Newport which is in a mainly residential neighbourhood. (Appendix 4 demonstrates the location of the premises). The ground floor comprises of a Members Bar, Members Lounge and Function Room. There is access to a beer garden and smokers area from the lounge bar and function room. The first floor has a function room and bar and access to the private residence of the Club Steward.

d. The premises are a long established members club and hold a Club Premises Certificate issued on 29th July 2005 which became effective on 24th November 2005 with the introduction of the provisions of the Licensing Act 2003.

e. It is understood that the premises will primarily continue to function under its Club Premises Certificate and that the grant of a Premises Licence is sought so that they will be authorised to facilitate the premises on occasions of special events when persons who are not members of the club are likely to be in attendance.

f. This application however should be treated as any application for the grant of a new Premises Licence and determined according to the proposals of the application and its operating schedule to promote the four Licensing Objectives together with representations at this hearing of the applicant and any other person making representations or objections.

g. This application seeks permission to commence licensable activities earlier than what is currently permitted by the Club Premises Certificate but cease licensable activities no later between Sunday to Saturday and the proposed terminal hour for licensable activities provided during Christmas and New Year is later than what the Club Premises Certificate permits.

h. A representation was received in respect of this application from Mr Brian Smith. The representation was determined to be valid under the provisions of the Licensing Act 2003 and the application requires determination by the Licensing Sub-Committee of Newport City Council.

2. Licensable Activities

a. The application seeks authority to provide the Licensable Activities of:

. The performance of plays: Monday to Sunday from 10:00 until 19:00 . The showing of films: Monday to Sunday 10:00 until 23:00 . The performance of Live Music: Monday to Sunday 19:00 until 2300 and Christmas Eve 19:00 until 00:00, Boxing Day 19:00 until 00:00, New Year Eve 19:00 until 01:00 . The playing of Recorded Music: Sunday to Wednesday 10:00 until 23:00, Thursday to Saturday 10:00 until 23:30, Christmas Eve 10:00 until 00:00, Boxing Day 10:00 until 00:00, New Year Eve 10:00 until 01:00 . Performance of dance: Monday to Sunday 10:00 until 2300 and Christmas Eve 10:00 until 00:00, Boxing Day 10:00 until 00:00, New Year Eve 10:00 until 01:00 . The supply of alcohol: Sunday to Wednesday 10:00 until 23:00, Thursday 10:00 until 23:30, Friday and Saturday 10:00 until 00:00 and Sunday prior to a Bank Holiday 10:00 until 00:00, Christmas Eve 10:00 until 00:00, Boxing Day 10:00 until 00:00, New Year Eve 10:00 until 01:30.

3. Promotion of the Licensing Objectives

The applicant has described the steps that will be taken to promote the four licensing objectives if the application is granted. These are contained in section P of the application form at Appendix 1 to this report.

4. Representations

Responsible Authorities There are no representations from any of the ‘Responsible Authories’.

Other Persons A valid representation was received in respect of the application from Mr Brian Smith of 9, Nash Road, Newport. He wrote a letter ( Appendix 2) detailing his objections to the granting of a Premises Licence which was received by the Licensing Authority on 19th June 2015. A hand delivered acknowledgement letter was left at his address on the same date together with a ‘representation form’.

On 26th June 2014 the representation form completed by Mr Brian Smith (Appendix 3) was received by the Licensing Authority.

5. Policy Considerations

Relevant extracts of the Statement of Licensing Policy as regards this application include:

IMP 1 The Council will normally grant applications for premises licences and club premises certificates subject to conditions which are consistent with the Operating Schedule and any mandatory conditions prescribed within the Act. Where relevant representations are received the Council may impose additional conditions as considered necessary in order to promote the licensing objectives which arise out of those representations.

IMP 2 The Council will strike a fair balance between the benefits of a licensed premises to a and the risk of disturbance to local residents. Consequently in certain areas, upon receipt of representations by any Responsible Authority or any other person, the Council may restrict the hours of operation of licensable activities.

IMP 3 The Council will normally grant premises licences for a time period of not earlier than 10.00 a.m. and a terminal hour of no later than 11.30 p.m. for those premises licensed to sell alcohol for consumption on the premises and which are located in primarily residential areas. However, hours beyond11.30 p.m. may be permitted:

a. for premises located in predominantly commercial areas, such as the City Centre and where there is a high level of accessibility to public transport services; or b. the licensable activities would not be likely to cause adverse impact especially on local residents, and that, if there is a potential to cause adverse impact, appropriate measures will be put in place to prevent it; or c. there will not be any increase in the cumulative adverse impact from these or similar activities, on any neighbouring residential area and the activity will not be likely to lead to a demonstrable increase in car parking demand in surrounding residential streets or on roads.

G2 The Council will attach conditions to licences, which are tailored to the individual style and characteristics of the premises. Such conditions will normally be drawn from the Council’s pool of conditions. Where appropriate, additional conditions will be formulated based on an individual case following receipt of relevant representations.

6. Legal Considerations

The decision must be taken following consideration of the representations received with a view to promoting the licensing objectives which are:

a. Prevention of crime and disorder b. Public Safety c. Prevention of Public Nuisance d. Protection of Children from Harm

In each case the Sub-Committee may make the following determination:

a. To grant the application. b. To modify the conditions of the licence, by altering, omitting or adding to them, where relevant. c. Reject the whole or part of the application.

All decisions taken by the Sub-Committee must

a. be within the legal powers of the Council and its Committees; b. comply with any procedural requirement imposed by law; c. be undertaken in accordance with the procedural requirements imposed by the Council eg. standing orders and financial regulations; d. be fully and properly informed; e. be properly motivated; f. be taken having regard to the Council’s fiduciary duty to its taxpayers; and g. be reasonable and proper in all the circumstances.

M Describe the steps you intend to take to promote the four licensing objectives: a) General – all four licensing objectives (b, c, d and e) (please read guidance note 9) The Club shall maintain its primary function as a members only club and continue to operate in accordance with the permissions and conditions attached to the Club Premises Certificate number 06/02656/LAPVC.

On occasions when the club permits the use of the facilities for functions, events and other meetings the DPS and/or officers of the club committee shall be present at the premises to ensure that the activities are conducted in accordance with club rules and some conditions that are attached to the Club Premises Certificate. b) The prevention of crime and disorder CCTV shall be in place which records the entrance, the upstairs and the exterior of the premises, and shall be fully operational at all time during which the premises is trading. All recordings shall be kept for a minimum of 31 days and shall be made available to an authorised officer on request.

Zero tolerance will be exercised concerning drugs, violence or any other anti-social behaviour and any person thought to be engaged in such activities shall be identified and police assistance requested.

c) Public safety An accident / incident book shall be used and updated by the DPS or officer of the club recording details of accidents or incidents that occur within the premises, this book shall be available to any officer of a responsible authority upon reasonable request.

d) The prevention of public nuisance Signs shall be on display within the premises reminding users of the premises to have consideration for the neighbouring properties of the premises and to leave the premises and surrounding areas quietly.

Signs shall be prominently displayed in the beer garden area informing users that the use of foul and abusive language or demonstration of disorderly behaviour will result in their immediate removal from the premises.

The concert hall shall be sound proof to ensure that any noise emanating from the club shall not be such as to cause annoyance or disturbance or discomfort to residents or occupiers in the locality or to be otherwise unreasonable.

During the provision of regulated entertainment whether the performance of ‘Live Music’ or the playing of ‘Recorded Music’ all doors and windows shall be kept closed to reduce the likelihood of noise escaping and causing a nuisance.

All glazing shall be double glazed throughout the premises.

e) The protection of children from harm Staff working the bar shall be given training in respect of the supply of alcohol and sign an acknowledgement record that such training as been received. These records will be retained at the premises and produced to any officer of a responsible authority upon reasonable request.

In respect of age related sales and the premises will exercise the national scheme of ‘Challenge 25’ and persons who appear to be under this age will need to provide satisfactory evidence of age in the form of a Passport, Photocard Driving Licence or PASS holographic ID card prior to any such sale of alcohol.
