MODALITIES OF ACCESSION TO THE AGREEMENT ON GOVERNMENT PROCUREMENT

Decision of 2 June 2006

The Committee on Government Procurement,

Recalling that, pursuant to the provisions of Article XXIV:2 of the Agreement on Government Procurement of 1994 ("the Agreement"), it is necessary to be a Member of the World Trade Organization ("WTO") in order to be eligible to accede to the Agreement;

Recalling further that, pursuant to Article XII:1 of the Marrakesh Agreement Establishing the World Trade Organization ("WTO"), membership in the WTO is open to any State or separate customs territory possessing full autonomy in the conduct of its external commercial relations and of any other matters provided for in the various WTO agreements;

Decides as follows:

With respect to the nomenclature and other terminology used in a decision of accession to the Agreement, including in appendices and annexes, that have been provided by any delegation representing a separate customs territory, the Parties note that the nomenclature and other terminology used have been provided only for the purpose of providing clarity in defining commitments in the framework of the accession to the Agreement. The Parties also note that none of the nomenclature and other terminology used have implications for sovereignty.

ACCESSION OF THE SEPARATE CUSTOMS TERRITORY OF TAIWAN, PENGHU, KINMEN AND MATSU

Decision of the Committee of 9 December 2008

The Committee on Government Procurement,

Having regard to the application for accession to the Agreement on Government Procurement by the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (hereinafter referred to as "Chinese Taipei"), contained in document GPA/IC/SPEC/1 of 17 March 1995, and the consultations held with the Parties to the Agreement on Government Procurement in pursuance thereof; and

Having regard to the relevant documents governing the modalities of accession to the Agreement on Government Procurement.

Decides as follows:

1. In accordance with the provisions of Article XXIV:2 of the Agreement on Government Procurement, Chinese Taipei may accede to this Agreement on the terms attached.

2. The Agreement on Government Procurement shall enter into force for Chinese Taipei on the thirtieth day following the date of its accession, i.e. the date on which the instrument of accession reproducing the attached terms has been received by the Director-General.

3. This Decision shall expire six months after the date of its adoption by the Committee on Government Procurement unless it is extended by that Committee by mutual consent between the Committee and Chinese Taipei.
