A Forbes article, 10 Workplace Trends You’ll See In 2016, by Dan Schawbel, forecasts that within two decades “machines might be able to do half of our jobs. Automation is impacting all types of jobs from bank tellers to cashiers to receptionists to mail carriers and even telemarketers. Employers benefit by creating a more efficient production line and lowering the cost of talent, while workers have fewer jobs and more pressure to produce or be replaced.” The author attempts to allay fears of worker expendability by saying, “While many people think that automation is bad for workers, like in every era, old jobs will be lost and new jobs will be created.” This may or may not be true. The World Economic Forum released a report that by 2020 automation will do away with seven million jobs, while creating two million, for a net loss of five million. Sectors that are projected to be hardest hit are healthcare, energy, and financial services. Besides the growth in workplace technology and automation, a second factor is putting U.S. jobs in jeopardy, health care and labor law. Per Tradingeconomics.com, “In 2016, Obamacare penalties will go into full effect and force more companies to hire freelancers over full-time employees. For individuals who don’t have health insurance, they will be fined $695, which is much greater than the $95 penalty in 2014. Next year, 95 percent of companies with 100 or more employees will need to be insured, and companies with 50 to 99 employees will have to insure full- time workers. This could lead companies to lay off workers to save money, which puts more pressure on current workers to do more with a smaller headcount. It also adds more work for the HR benefits department. Talent is the greatest cost to companies, and expensive healthcare benefits will

To assist DACC members, this is the second of a three-part series on the changes to the Act that businesses need to be aware of by Dan Educational, Informative Seminars Sinas, PRemployer’s vice president of human resources and risk management, and Attorney Pamela Hallford, Carr Allison. Over the past couple months, the Dothan Area Chamber of Commerce has hosted several seminars of interest to DACC members including one Part II: Can Your Business Afford FLSA on the U.S. Department of Labor’s New Overtime Rules, LinkedIn and Non-Compliance? You, and Video Marketing Is The Future. Most employers are familiar with the Fair Labor Standards Act and are aware the Act requires employers to pay employees a minimum wage and overtime if the employee qualifies for overtime pay. What many employers don’t realize is how costly FLSA non–compliance can be. To pass the salary basis test and potentially be exempt from overtime pay, the recent changes to federal regulations require an employee classified as “exempt” to earn $913 per week ($47,476/year), instead of the present threshold of $455 per week ($23,660/year). Employers who fail to adjust to this change and comply with the FLSA could be liable for Dan Sinas (PRemployer) and Pamela Hallford (Carr Allison) talk with DACC chamber back pay, liquidated (double) damages and the payment of the plaintiff’s members about the changes to the U.S. Department of Labor’s new overtime rules. attorney’s fees, as well as defense counsel fees. An employer’s failure to comply with the FLSA could potentially cost hundreds of thousands of dollars. What Is the Penalty For Non-Compliance? The answer to this question requires us to look back at past examples of businesses’ non-compliance with the FLSA. In 2006, a class-action lawsuit filed in Alabama Federal District Court against Family Dollar Stores by Janice Morgan, on behalf of herself and other managers throughout the , resulted in an award of $33,200,000 by the court. Merrill Lynch Wealth Management sponsored a “LinkedIn and You” seminar recently to help DACC members become familiar with the program and its benefits. Morgan alleged that she and other managers had been misclassified as managerial employees because the majority of their time spent at work was spent performing non–managerial functions like running cash registers, cleaning and stocking merchandise. A jury awarded Morgan and the 1,424 Save The Date! other managers $16,600,000 and the judge awarded $16,600,000 in Small Business Seminar liquidated damages for a total verdict award of $33,200,000.
