(Claims Conference) and the World Jewish Restitution Organization (WJRO) have as a central goal the return of assets looted during the Shoah to their original owners. Commencing in the 1950s, Claims Conference negotiations led to the establishment of the BRUEG – the German property restitution legislation for individual claimants. Since then, the Claims Conference and WJRO have sought to ensure the return of stolen assets to their original owners including real estate, businesses, insurance policies and bank accounts. Some of these efforts have also resulted in the recovery of unclaimed assets, others have not. In regard to looted art and cultural property, including Judaica, the current approach of the Claims Conference/WJRO is as follows: 1. The commitment to the restitution of looted cultural and religious property to their original owners is a continuation of the commitment in the past and present to restitution of other forms of looted Jewish property. 2. The Claims Conference/WJRO prioritizes at present two areas: (a) Provenance research – so that information regarding the location of looted items is publicly available; (b) Establishment of fair and just claims processes for claimants. 3. The Claims Conference/WJRO does not take on the representation of individual claimants. 4. The effort to ensure that Judaica is held by or used by appropriate bodies is of the utmost moral importance. Particular focus should be on tashmishey kedusha and tashmishey mitzvah. Prioritization regarding this effort is critical after completion of current research and review of existing research. The types of solution in any given case to be sought will vary from country to country and from case to case. This draft Descriptive Catalogue of Looted Judaica builds in part on research conducted in regard to looted Jewish cultural and religious property in individual countries generally. While this Catalogue does not claim to be complete or a definitive source concerning looted Judaica, it is, so far as is known, the only country-by-country “snapshot” of the current situation regarding looted Judaica. This catalogue represents the results of the current best efforts research of the Claims Conference and is based upon information obtained by the Claims Conference to date. The Claims Conference makes no representation as to its accuracy or completeness and the catalogue should not be relied upon or used as proof, legal or equitable, as to current or past ownership of the items described within. 7 PART A INTRODUCTION I. Goal And Purpose The focus of this Descriptive Catalogue is Judaica spoliated by Nazi Germany and its allies. However, there is a certain amount of extension, since in many cases it is not possible to separate Judaica looted during World War II from other confiscated Judaica. The listings therefore include such items as Torah scrolls and other sacred objects looted by the Bolsheviks from 1917 until the death of Stalin in 1953. Emphasis has been given to Eastern Europe and the former Soviet Union on the assumption that most Torah scrolls or other religious objects that carry a quality of holiness (tashmishey kedusha) that are thought to have been looted during World War II and may not be held by or used by appropriate bodies or may be improperly cared for are to be found in this region. This catalogue has been compiled based on: (1) Information from existing published and unpublished literature and archives; and (2) Information obtained from experts in various countries. In regard to (1), it is important to note that some information on looted Judaica exists on the individual-object level. For example, items of looted Judaica are listed in the databases of Austria, the Czech Republic, the Netherlands, the United Kingdom, the United States, etc. In addition, there are lists that have been compiled of Torahs in public institutions in Poland, Ukraine, and elsewhere. In a few cases there are specialized full-scale illustrated catalogs, such as for the manuscripts and archives of the Jewish Theological Seminary in Breslau held in Russia. In other instances there are more general descriptions of looted collections as a whole. For example, Project Judaica has published a guide to the Jewish collections in the Russian State Military Archive (the former Osobyi arkhiv) that were brought to Moscow by the Soviet Army. In still other instances, the location of looted Judaica is known but no overall description has been made (e.g., the Jewish libraries taken from France that are now in Minsk). This catalogue is not meant to repeat or duplicate already existing work on this subject. There are a number of researchers and organizations who have devoted themselves to researching questions pertaining to looted cultural and religious property. These scholars are cited prominently within the catalogue. Rather, this catalogue is intended to make accessible and piece together information already available into a more readily

The fact that these libels have been exposed repeatedly by the testimony of Jewish as well as Christian scholars has not deterred present day purveyors of these slanders from at- tempting to portray the Talmud as the fountainhead of an inferior and unethical morality. It may seem incredible to the average person that the Jewish religion, mother of all monotheistic religions of justice and mercy, should need de- fense against such accusations. But this study is less a defense and refutation than an analysis of the way these propagandists work, and the combination of unscrupulous distortion and crudity which characterizes their attack. It is also an ex- posure of the real motives for which these attacks are only an opening wedge. WHAT THE TALMUD IS The Talmud is a record of opinions and discussions on all phases of law and life culled from the utterances of those out- standing Jewish teachers who functioned in the academies of Palestine and Babylonia during the first five centuries of the 1939 TALMUDIC FORGERIES 7 common era. The earliest layer of the Talmud is the Mish- nah, a product of Palestinian scholarship and written in a clear, lucid Hebrew.

Originally organized as a private society affiliated to Himmler’s staff, the “Ahnenerbe” became one of the most powerful institutions in the Third Reich engaged with questions of archaeology, cultural heritage and politics. Its staff were SS members, consisting of scientific amateurs, occultists as well as established scholars who obtained the rank of an officer. Competing against the “Amt Rosenberg”, an official agency for cu ltural policy and surveillance in Nazi Germany, the research community “Ahnenerbe” had already become interested in caves and karst as excellent sites for fossil man investigations before 1937/38, when Himmler founded his own Department of Karst- and Cave Research within the “Ahnenerbe”. Extensive excavations in several German caves near Lonetal (G. Riek, R. Wetzel, O. Völzing), Mauern (R.R. Schmidt, A. Bohmer), Scharzfeld (K. Schwirtz) and Leutzdorf (J.R. Erl) were followed by research travels to caves in France, Spain, Ukraine and Iceland. After the establishment of the Protectorate of Bohemia and Moravia in 1939, the “Ahnenerbe” even planned the appropriation of all Moravian caves to prohibit the excavations of local prehistorians and archaeologists from the “Amt Rosenberg”, who had to switch for their excavations to Figure 1: Prehistorian and SS- caves in Thessaly (Greece).

In many respects it is the highpoint of the over fifteen years I have spent working on this issue of artworks looted by the Nazis. This is a vast topic, too much for any one book, or even any one person to cover. Put simply, the Nazis plundered so many objects over such a large geographical area that it requires a collaborative effort to reconstruct this history. The project of determining what was plundered and what subsequently happened to these objects must be a team effort. And in fact, this is the way the work has proceeded. Many scholars have added pieces to the puzzle, and we are just now starting to assemble a complete picture. Trigger, McGill University National Socialism provides a chilling example of what can happen when a modern nation state falls under the control of an organization that resembles a criminal syndicate more than it does a political party. Unfortunately, only a few papers are available in English that deal with how archaeology fared under this totalitarian regime. Now Heather Pringle has published a book which provides a narrative history of the Ahnenerbe, or Ancestral Heritage Foundation, a research institute founded in 1935 by Heinrich Himmler, Hitler’s minister of security who was also responsible for the implementation of Nazi racial and resettlement policies. In addition to being, like other Nazis, nationalistic and anti- Semitic, Himmler was an extreme romantic who planned to use the tall, blond-haired men of his security service (Schutzstaffel, SS) and selected women to re-breed a pure ‘Aryan’ stock, and to use knowledge collected by Ahnenerbe researchers to tutor these men in ancient German beliefs and farming practices so they might live as their noble ancestors had done.

Constructing Victimhood through Post -War Reparations in France, Germany and Switzerland 1 (CEES, 26 May 2005) My presentation today deals with the question of how post -war victim reparations have transformed the fact of victimization into normative ideas of victimhood and how these ideas have contributed to a particular understanding of Nazi persecution. I use the term “constructing victimhood” to characterize this specific relation, an expression that might sound awkward in the context of Nazi victimization since terms like ‘construction’ or ‘production,’ when used to describe social, cultural and political phenomena, tend to convey the notion that something is invented or even fabricated, therefore not a given reality. It is of course not my intention to leave this impression since there is no doubt about the true nature of Nazi persecution. But instead, I use the term in an attempt at capturing developments and phenomena of the immediate post -war era that testify to grappling with the extraordinary character of Nazi crimes. When we look at the treatment of Nazi victims over time, public sympathy and respect for the survivors of Nazi abuses are fairly recent historical phenomena. Immediately following the Second World War, the fact of victimization was instead highly confusing and for the victims often associated with blame and shame.
