The 249th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 06th – 07th February, 2018 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 249th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

Item No. 249.1(i).3 (1) The decision in respect of Upasana College of Education, Plot No- 129, 130, 132, Vill/PO- Khana Jn. Road, Dist- Bardhaman, - 713141 (D.El.Ed.) (Private) (West Bengal Board of Primary Education) (ERCAPP3913) in the 248th meeting is as under:

“After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after LOI, the Committee discussed the matter in detail and observed as under:

(i) The M.Ed. mark-sheets of Moitrayee Nandi and SK Benazir and B.P.Ed. marksheet of Rathin Saha need verification and authentication from the Vinoba Bhave University.

In view of the above, the Committee decided as under: Copies of above mentioned mark sheets in respect of faculties appointed by the institution be sent to the Registrar, Vinoba Bhave University for verification and authentication with a request to submit the report within 15 days”.

The above decision of ERC is rectified and may be read as under: After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after LOI, the Committee discussed the matter in detail and observed as under:

Item No. 249.1(i).4 (2) The decision in respect of Anjali Memorial College of Education and Training,PlotNo.-15,16, Vill - Damodarpur, PO - Karanjali, Tehsil/Taluka - Kusumpukuria, Town/City - Karanjali, Dist. - South 24 Parganas, West Bengal - 743348 (B.Ed.) (Private) (The West Bengal University of Teachers’ Training, Education Planning and Administration) (ERCAPP2701) in the 248th meeting is as under:

“That the recognition to B.Ed. Course of the institution was refused u/s 14(3)(b) vide ERC Order No. 53420 dated 26.05.2017.

That the institution filed AST No. 244 of 2017 before the Hon’ble High Court of Calcutta to quash the order dated 26.05.2017. The Hon’ble High Court disposed of the matter on 07.12.2017 with the following directions: “Considering the submissions as advanced by the learned Advocates for the respective parties and perusing the records, I direct the respondent Nos. 2 and 3 to take step to grant recognition in favour of the petitioner / institution thereby condoning two days’ delay, as has been prescribed in the statute, for obtaining NOC under clause 7(16) of the NCTE Regulation 2014 for B.Ed. course from the Academic Session 2018-19, within a period of four weeks from the date of communication of this order as in respect of Yeaqub Ali B.Ed. College, the NCTE has granted recognition hereby condoning the delay.

Needless to mention that this case would be treated as a special case by the respondent NCTE that will not create any precedence.”

In view the above, the Committee decided as under: Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent”.

The above decision of ERC is rectified and may be read as under: (i) It is observed that another application for D.El.Ed. Course (ERCAPP2595) was already refused on 27.12.2016 as decided in 227th ERC meeting and not getting any preference either from the Appellate Authority of NCTE or from the Hon’ble High Court of Calcutta, therefore, the refusal order still stands.

(ii) However, on the direction of the Hon’ble High Court of Calcutta in case of B.Ed. Course (ERCAPP2701), the matter was considered and processed to issue Letter of Intent u/c 7(13). But, as the D.El.Ed. Course is still in refusal stage. Therefore, the B.Ed. course is now considered as the standalone institution which is not accepted as per NCTE Regulation, 2014.

In view of the above, the Committee decided as under: The institution be directed to submit the compliance on or before 28th February, 2018 as the cut-off date for grant/refusal of recognition for the session 2018-2019 is 3rd March 2018.

Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within the stipulated time as mentioned above before the Committee takes final decision.

Item No. 249.1(i).5 (3) The decision in respect of S M Shoaib Hashmi Educational Trust Group of Institutions, Vill - Parsa Pakaria Pathanpati, Street/ Road - Narkatiya Bazar, Taluka/ Mandal - Chauradano, Town/City - Parsa Pakaria Pathanpati, Dist. - Champaran East, Bihar - 845301 (D.El.Ed. -Addl. Course) (Private) Bihar School Examination Board) (ERCAPP201646290) (ID No.9218) in the 249th (Part-1) meeting is as under:

“After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines

received from the NCTE Hqrs. from time to time, VTR and reply to LOI, the Committee discussed the matter in detail and observed as under:

(i) Ph.D. degree of Dr. Vijay Kumar awarded from CMJ University, Meghalaya which is not accepted.

In view the above, the committee decided as under: The institution be directed to submit the compliance on or before 28th February, 2018 as the cut-off date for grant/refusal of recognition for the session 2018-2019 is 3rd March 2018.

Formal permission order under clause 7(16) of the NCTE Regulation 2014 for applied D.El.Ed. programme with an intake 50 (one basic unit) from the academic session 2018-19 be issued to the institution.

ATTENTION!

1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. 8. The cutoff date for granting/refusal of recognition for the session 2018-19 is 3rd March, 2018; hence, the institution may submit the compliance on the basis of proceedings uploaded in the ERC NCTE website.

ER-249.2 [Court Case] Dr. B.R. Ambedkar College, Vill.- Mallighat, PO.-Mallighat, PS.-Debka, Dist.- Paschim Medinipore, West Bengal-721211 (B.Ed.) (Private) (The West Bengal 1. 249.2.6 University of Teachers’ Training, Education Planning and Administration) (APE00317) The institution was granted recognition for conducting B.Ed. Course vide Order No. 3835 dated 31.10.2006 with an intake of 100 from the academic session 2006-2007 by the ERC, NCTE, followed by revised order issued vide No. 31927 dated 23.05.2015 as per NCTE Regulations, 2014. On the request made by the institution, recognition to B.Ed. course was withdrawn under section 17(1) vide order No. 52412 dated 18.04.2017.

The institution filed W.P. No. 14507 of 2017 in the Hon’ble High Court of Calcutta. The Hon’ble High Court disposed of the matter on 01.02.2018 and set aside the order of ERC vide No. 52412 dated 18.04.2017.

The application has been processed in light of aforesaid order passed by the Hon’ble High Court of Calcutta and observed that the institution is required to submit the following as per NCTE Regulations, 2014:

(i) Land deed in the name of institution/trust/society. (ii) Land possession certificate issued from Land Revenue/concerned Govt. Department. (iii) Mutation certificate issued from Land Revenue/concerned Govt. Department. (iv) Non-encumbrance certificate issued from Land Registering Authority. (v) Blue print of building plan duly approved by the Govt. Engineer/Authority mentioning the details of plot number, total land area, total built up area etc. (vi) Building completion certificate issued by Govt. Engineer/Authority. (vii) Original FDRs of Rs.5 lakhs & Rs.7 lakhs towards Endoment and Reserve fund into joint operation mode along with Bank letter. (viii) Fire safety certificate issued from the competent Govt. authority. (ix) Faculty list duly approved by the concerned affiliating body. (x) Trust deed/Society Registration Certificate/Bye laws. (xi) Website of the institution with all updated information as per NCTE Regulations, 2014.

In view of the above, the Committee decided as under: A Show Cause Notice be issued to the institution under section 14(3)(b) of the NCTE Act 1993 to submit compliance within 21 days from the issue of this letter before the Committee takes final decision.

Moyna Vivekananda Mission Teachers Training College, Plot No- 27, 30, 35 & 36, vill - Gopal Chak, PO- Moyna, Tehsil/Taluka/Town/City- Tamluk, Dist- , 2. 249.2.7 West Bengal- 721629 (B.Ed. -Addl. Course) (Private) (The West Bengal University of Teachers’ Training, Education Planning and Administration) (ERCAPP2535) The institution was granted permission under clause 7(16) for conducting B.Ed. Course vide Order No. 46659 dated 02.05.2016 with an intake of 50 (one basic unit) from the academic session 2016-2017 by the ERC, NCTE.

The institution filed W.P.(C) No. 9543 of 2017 in the Hon’ble High Court of Delhi. The Hon’ble High Court disposed of the matter on 12.01.2018 with a direction inter alia:

“Learned Counsel for the petitioner submits that though the petitioner had applied for recognition of two units comprising 100 seats for the B.Ed. course, the respondent No. 2 has granted recognition for only one unit i.e. 50 seats and till date has not communicated any decision regarding the second unit compraising of 50 seats. He further submits that the respondent No. 2 has upto this date, not pointed out any deficieny/reason for not granting recognition for second unit.

Keeping in view the contentions raised by the learned counsel for the petitioner and the orders passed by this Court, the respondents are directed to treat the present writ petition as a representation and decided the same by passing a reasoned and speaking order within six weeks”.

The Committee considered the order dated 12.01.2018 of the Hon’ble High Court of Delhi and observed as under:

(i) The total built up area of the institution comes to 3646.068 Sq. Mts. in the building completion certificate issued by Assistant Engineer which is less than 4000 Sq. Mts. (for 100 intake in D.El.Ed. +

100 intake in B.Ed.) required under NCTE Regulation, 2014. Hence, the decision of ERC taken in 211th meeting granting permission for intake of 50 (one basic unit) in B.Ed. course remains unchanged.

In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position.

Netaji Teachers Training Institute B.Ed., Plot No- 127, 128 129, Street No- NH 60, Vill- kamla, PO- Baliara, Tehsil/Taluka – Onda, Town/City : , Dist- Bankura, 3. 249.2.8 West Bengal- 722164 (B.Ed.-Addl. Course) (Private) (University of Burdwan) (ERCAPP3216) The institution was granted permission under clause 7(16) for conducting B.Ed. Course vide Order No. 52742 dated 02.05.2017 with an intake of 50 (one basic unit) from the academic session 2017-2018 by the ERC, NCTE.

The institution filed W.P.(C) No. 10251 of 2017 in the Hon’ble High Court of Delhi. The Hon’ble High Court disposed of the matter on 12.01.2018 with a direction inter alia:

“Learned Counsel for the petitioner submits that though the petitioner had applied recognition of two units comprising 100 seats for the B.Ed. course, the respondent No. 2 has granted recognition for only one unit i.e. 50 seats and till date has not communicated any decision regarding the second unit compraising of 50 seats . He further submits that the respondent No. 2 has upto this date, not pointed out any deficieny/reason for not granting recognition for second unit.

Keeping in view the contentions raised by the learned counsel for the petitioner and the orders passed by this Court, the respondents are directed to treat the present writ petition as a representation and decided the same by passing a reasoned and speaking order within six weeks”.

(i) The total built up area of the institution comes to 34970 Sq. ft. or 3248.79 Sq. Mts. in the building completion certificate issued by Assistant Engineer which is less than 3500 Sq. Mts. (for 50 intake in D.El.Ed. + 100 intake in B.Ed.) required under NCTE Regulation, 2014. Hence, the decision of ERC taken in 239th meeting granting permission for 50 intake in B.Ed. course remains unchanged.

In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position.

Swami Vibekananda College of Education, Plot No.L.R.1859, R.S. - 1530, Vill - Aurangabad, Town/City - , P.O./Tehsil/Taluka - Keshiary, Dist - 4. 249.2.9 Midnapore, West Bengal - 721133. (B.Ed. -Addl. Course) (Private) (The West Bengal University of Teachers’ Training, Education Planning and Administration) (ERCAPP3967) The institution was granted permission under clause 7(16) for conducting B.Ed. Course vide Order No. 52099 dated 04.04.2017 with an intake of 50 (one basic unit) from the academic session 2017-2018 by the ERC, NCTE.

The institution filed W.P.(C) No. 223 of 2018 in the Hon’ble High Court of Delhi. The Hon’ble High Court disposed of the matter on 12.01.2018 with a direction inter alia:

“Learned Counsel for the petitioner submits that though the petitioner had applied recognition of two units comprising 100 seats for the B.Ed. course, the respondent No. 2 has granted recognition for only one unit i.e. 50 seats and till date has not communicated any decision regarding the second unit compraising of 50 seats . He further submits that the respondent No. 2 has upto this date, not pointed out any deficieny/reason for not granting recognition for second unit.

The Committee considered the order dated 12.01.2018 of the Hon’ble High Court of Delhi and observed as under:

(i) The total built up area of the institution comes to 32633.49 Sq. ft. or 3031.75 Sq. Mts. in the building completion certificate issued by Assistant Engineer which is less than 3500 Sq. Mts. (for 50 intake in D.El.Ed. + 100 intake in B.Ed.) required under NCTE Regulation, 2014. Hence, the decision of ERC taken in 234th meeting granting permission for 50 intake in B.Ed. course remains unchanged.

In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position.

Tapeshwar Singh Teachers Training College, Vill - Kayam Nagar, Street/Road - Kayam Nagar, Taluka/Mandal - Koilwar, Town/City - Kayam Nagar, Dist - Bhojpur, 5. 249.2.10 Bihar – 802314 (D.El.Ed. -Addl. Course) (Private) (Bihar School Examination Board) (ERCAPP201645064) (ID No.8334)

The institution was granted recognition under clause 7(16) for conducting D.El.Ed. Course vide Order No. 52808 dated 02.05.2016 with an intake of 50 (one basic unit) from the academic session 2017-2018 by the ERC, NCTE.

The institution filed W.P.(C) No. 8852 of 2017 in the Hon’ble High Court of Delhi. The Hon’ble High Court disposed of the matter on 12.01.2018 with a direction inter alia:

“Learned Counsel for the petitioner submits that though the petitioner had applied for recognition of two units comprising 100 seats for the D.El.Ed. course, the respondent No. 2 has granted recognition for only one unit i.e. 50 seats and till date has not communicated any decision regarding the second unit comprising of 50 seats. He further submits that the respondent No. 2 has upto this date, not pointed out any deficieny/reason for not granting recognition for second unit.

Keeping in view the contentions raised by the learned counsel for the petitioner and the orders passed by this Court, the respondents are directed to treat the present writ petition as a representation and decided the same by passing a reasoned and speaking order within six weeks”.

In view of the above, the Committee decided as under: In addition to 50 intake already granted from the academic session 2017-2018 earlier, the Committee decided that formal permission Order under clause 7(16) of the NCTE Regulation, 2014 for applied D.El.Ed. programme with another 50 intake from the session 2018-2019 be issued to the institution, thus making the sum total grant of 100 intake.

After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time and VTR, the Committee discussed the matter in detail and decided as under:

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution for one basic unit.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent.

(Private) (University of Burdwan) (ERCAPP3926) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply to LOI, the Committee discussed the matter in detail and decided as under:

(i) As the Letter of Intent u/c 7(13) has been decided for D.El.Ed. application (ERCAPP3903) of the said institution, hence the application for B.Ed. course be kept in abeyance .

Therefore, a letter be issued to the institution stating the above position.

(i) As the show cause notice has been decided for D.El.Ed. application (ERCAPP3523) of the said institution, hence the application for B.Ed. course be kept in abeyance .

Therefore, a letter be issued to the institution stating the above position.

After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply to LOI, the Committee discussed the matter in detail and observed as under:

(i) Submitted faculty list is not approved by the concerned affiliating body on each page.

In view of the above, the Committee decided as under: The institution be directed to submit the compliance on or before 28th February, 2018 as the cut-off date for grant/refusal of recognition for the session 2018-2019 is 3rd March 2018.

The institution filed W.P.(C) No. 10230 of 2017 in the Hon’ble High Court of Delhi. The Hon’ble High Court disposed of the matter on 12.01.2018 with a direction inter alia:

“Learned Counsel for the petitioner submits that though the petitioner had applied for recognition of two units comprising 100 seats for the B.Ed. course, the respondent No. 2 has granted recognition for only one unit i.e. 50 seats and till date has not communicated any decision regarding the second unit compraising of 50 seats. He further submits that the respondent No. 2 has upto this date, not pointed out any deficieny/reason for not granting recognition for second unit.

Keeping in view the contentions raised by the learned counsel for the petitioner and the orders passed by this Court, the respondents are directed to treat the present writ petition as a representation and decided the same by passing a reasoned and speaking order within six weeks”.

Thereafter, the institution preferred an appeal before the Appellate Authority against the ERC’s order and the Appellate Authority vide Order No. 57181 dated 21.08.2017 confirmed the recognition order of the ERC’s dated 07.03.2017.

That the institution filed CWJC No. 712 of 2018 in the Hon’ble High Court of Delhi. The Hon’ble High Court disposed of the matter on 24.01.2018 with a direction inter alia:

“Learned Counsel for the petitioner submits that though the petitioner had sought recognition of two units comprising 100 seats for the B.Ed. course, the respondent No. 2 has granted recognition for only one unit i.e. 50 seats. He further submits that the respondent No. 2 has upto this date, not pointed out any deficieny for not granting recognition for second unit to the petitioner institute.

Keeping in view the contentions raised by the learned counsel for the petitioner and the order passed by this Court, the respondents are directed to treat the present writ petition as a representation and decided the same by passing a reasoned and speaking order within six weeks”.

The Committee considered the order dated 24.01.2018 of the Hon’ble High Court of Delhi and observed as under:

(i) The total built up area of the institution comes to 1530 Sq. Mts. in the building completion certificate issued by Executive Engineer which is less than 2000 Sq. Mts. required as per NCTE Regulation, 2014. Hence, the decision of ERC taken in 234th meeting granting recognition for 50 intake in B.Ed. course remain unchanged.

In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position.
