Aboriginal Housing Legislation Amendment Bill 2009* (No. 086)

The purpose of this Bill is to amend the Housing Act 1980; and the Aboriginal Affairs Planning Authority Act 1972, to provide for the first time an appropriate legal framework for improving housing management outcomes in Aboriginal communities. This will apply to an estimated 80 per cent of Aboriginal people living in remote communities in Western Australia.

Acts Amendment (Bankruptcy) Bill 2009 (LC No. 037)

The purpose of this Bill is to amend over 90 State Acts to reflect changes made to the Bankruptcy Act 1966 (Commonwealth) which made technical amendments to the agreement process between a debtor and a creditor regarding bankruptcy.

Acts Amendment (Safety and Human Rights of Persons in Custody) Bill 2009* (No. 072) (Hon E. Ripper)

The purpose of this Bill is for an Act to amend the Inspector of Custodial Services Act 2003, Prisons Act 1981, Court Security and Custodial Services Act 1999, Criminal Law (Mentally Impaired Accused) Act 1996 and the Young Offenders Act 1994, in order to enshrine into Western Australian law mechanisms to ensure that humane and safe custodial conditions are consistently and universally maintained.

Acts Amendment (Weapons) Bill 2009 (No. 088)

The purpose of this Bill is to amend The Criminal Code and the Weapons Act 1999 in order to provide a valuable tool for Western Australia Police to ensure that places where the public gather are safe and for the courts to apply appropriate penalties to punish those people in accordance with public expectations.

Approvals and Related Reforms (No. 1) (Environment) Bill 2009* (LC No. 094)

The purpose of this Bill is to amend the Environmental Protection Act 1986 to remove duplicative or unnecessary appeal rights, align appeal periods across regulatory processes and to permit decision making authorities to approve minor and preliminary works to which the Environmental Protection Authority has consented.

Approvals and Related Reforms (No. 2) (Mining) Bill 2009* (LC No. 102)

The purpose of this Bill is to provide that mine closure plans are required to be submitted with mining proposals and reviewed on a regular basis to ensure that they are up to date. The Bill also provides that mining tenement documents can be lodged at any office of the mining registrar, including Perth, rather than at the office where the mining tenement is located.

Arson Legislation Amendment Bill 2009* (No. 085)

The purpose of this Bill is to amend the Bush Fires Act 1954 and The Criminal Code in order to strengthen protection to persons and property provided by arson-related offences, it will introduce a new bushfires offence, clarify the applicability of existing offences against the person to harm caused by fire, and increase the maximum penalties available under existing offences.

Bookmakers Betting Levy Amendment Bill 2009 (No. 078)

The purpose of this Bill is to amend the Bookmakers Betting Levy Act 1954, abolishing the two per cent betting levy on horse and greyhound racing payable by Western Australian bookmakers to race clubs registered with Racing and Wagering Western Australia.

Building and Construction Industry Training Fund and Levy Collection Amendment Bill 2009 (LC No. 031)

The purpose of this Bill is to remove doubt as to validity of all levies imposed by the Building and Construction Industry Training Levy Act 1990 and paid in accordance with the Building and Construction Industry Training Fund and Levy Collection Act 1990 by retrospectively validating those payments.

Bush Fires Amendment Bill 2009* (No. 073)

The purpose of this Bill is to amend the Bush Fires Act 1954 and the Environmental Protection Act 1986 in order to address issues relating to bushfire suppression, prevention and prosecution, and will improve the coordination and collaboration of effective fire management in Western Australia.

The purpose of this Bill is to amend the Child Support (Adoption of Laws) Act 1990, in order that recent amendments to the Commonwealth legislation are reflected in Western Australia legislation, ensuring that the child support scheme can apply to and benefit all children in the State.

Co-operatives Bill 2009* (No. 024)

The purpose of this bill is to replace the Companies (Co-operative) Act 1943 and the Co- operative and Provident Societies Act 1903 with legislation that reflects the current commercial and social environment of co-operatives in Western Australia. The bill is in response to the co-operative industry’s request for more modern legislation that will facilitate interstate trade and the growth of the co-operatives sector.

Commercial Tenancy (Retail Shops) Amendment Bill 2009* (No. 081) (Hon F. Logan)

The purpose of this Bill is to amend the Commercial Tenancy (Retail Shops) Agreements Act 1985 to create the position of small business commissioner, which will provide much-needed protection for small retail business tenants in their dealings with landlords.

Criminal Code Amendment Bill 2008* (No. 014)

The purpose of this Bill is to amend The Criminal Code to provide that when a person assaults a police officer and causes the officer bodily harm the person must be sentenced to a term of imprisonment.

Criminal Code Amendment Bill (No. 2) 2009 (No. 105)

The purpose of this Bill is to amend The Criminal Code to make it a crime to cause fear or alarm to a driver either by causing an object or substance to be directed at or near, or placed in or near the path of a conveyance; or directing a laser pointer or a narrow beam of light at a conveyance.

Criminal Code Amendment (Graffiti) Bill 2009* (No. 068)

The purpose of this Bill is to amend The Criminal Code in order to strengthen the deterrent effect of the law by increasing existing statutory penalties and introducing new ones. The bill will also introduce a preventative function by curbing the availability of what the bill terms graffiti implements.

Criminal Code Amendment (Identity Crime) Bill 2009* (No. 104)

The purpose of this Bill is to amend the Criminal Code to create offences for the make, use, supply or possession of identification material with the intent that the material be used to commit, or facilitate the commission of, an indictable offence; and the possession of equipment capable of making, using, supplying, or retaining identification material with the intent that that equipment be used to either commit or facilitate the commission of an indictable offence.

The purpose of this Bill is to enable monetary compensation to be available in the following two situations; firstly to persons who have pursuant to a warrant of commitment, served more time in prison than was legislatively authorised, and secondly to persons who have, under a work and development order, undertaken additional work which also was not authorised by the legislation.

First Home Owner Grant Amendment Bill 2009* (No. 021)

The purpose of this bill is to amend the First Home Owner Grant Act 2000, firstly, to give legislative effect to the First Home Owners Boost scheme, announced by the commonwealth government on 14 October 2008; secondly, to limit the availability of the first home owner grant in the future to transactions involving a property valued at $750 000 or less; and, thirdly, to make a number of minor amendments to improve the administrative arrangements applying under the act.

Health and Disability Services Legislation Amendment Bill 2009* (No. 064)

The purpose of this Bill is to amend the Health Services (Conciliation and Review) Act 1995; and the Disability Services Act 1993; and various other Acts, to enable people with disabilities to make a complaint that a provider has acted unreasonably by not properly investigating a complaint or causing it to be properly investigated, or not taking or causing to be taken, proper action on the complaint. People with disabilities will also be able to complain when a provider has acted unreasonably by charging an excessive fee or otherwise acting unreasonably with respect to a fee.

The purpose of the Bill is to amend the Waste Avoidance and Resource Recovery Act 2007 and the Waste Avoidance and Resource Recovery Levy Act 2007 in order to increase rates of recycling in Western Australia and reduce waste going into landfill.

Water Services Licensing (Water Conservation Target) Amendment Bill 2008 (LC No. 025) (Hon P. Llewellyn)

The purpose of this Bill is to amend the Water Services Licensing Act 1995 to impose as a condition of holding specified operating licenses for water supply services an obligation to meet a specified water conservation target.

Weapons (Supply to Minors and Enhanced Police Powers) Amendment Bill 2008* (No. 022) (Ms M. Quirk)

The purpose of this Bill is to prohibit the sale of controlled weapons to persons under the age of 18 years of age, except in circumstances where the seller has an honest and reasonable belief that the controlled weapon is to be used for a lawful sporting or recreational use.

Working with Children (Criminal Record Checking) Amendment Bill 2009* (LC No. 096)

A Bill to amend the Working with Children (Criminal Record Checking) Act 2004 and Spent Convictions Act 1988 in order to strengthen the working with children legislation, including an additional consideration that must be taken into account in deciding whether to issue a person with an assessment notice in the form of a working with children card. It also proposes amendments that will reduce barriers to taking the necessary action in cases in which a person’s criminal record indicates that that person presents an unacceptable risk of harm and should not be in child-related work.
