Introduction

In compliance with the direction of the Hon’ble Supreme Court of India vide the Order dated 15.09.2017 passed in Writ Petition (Civil) No.406 of 2013 (RE-INHUMAN CONDITIONS PREVAILING IN 1382 PRISONS), and keeping in view the models of study report adopted in and Rajasthan, a format was developed by the Odisha State Legal Services Authority (OSLSA). As per the said format, the respective District Judges-cum-Chair Persons of all the District Legal Services Authorities, conducted study in respect of the Jails within their local limits on different dates in months of October and November, 2017 and furnished reports regarding the prevailing conditions of the Jails and facilities available therein.

While conducting the study regarding the overall conditions in the Jails and the facilities available, an assessment has also been made regarding the effect and impact of the schemes framed by the NALSA relating to the Prisoners.

Hon’ble the Chief Justice of and Patron-in-Chief of OSLSA was pleased to set up a Committee under the Chairmanship of the Hon’ble Executive Chairman of the OSLSA with two other Hon’ble Judges as Members for implementation of the directions of the Hon’ble Apex Court. By the order of the Hon’ble Executive Chairman, OSLSA, there was also constituted a Sub-Committee comprising the Registrar General, Orissa High Court, District Judge, Cuttack, District Judge, Khurda at and Member-Secretary of OSLSA for the purpose of preparation of a consolidated study report basing upon the individual study reports received from the District Judges.

Basing upon the reports received from the District Judges, and on collation and analysis of the information gathered therefrom, the ultimate study report was prepared vide the accompanying separate sheets.

It may be mentioned here that the report so prepared was placed before and approved by the Hon’ble Judges Committee constituted by the Hon’ble Chief Justice, Orissa High Court, in the Meeting held on 19.12.2017.

1. Number and location of Jails in the State.

There are 30 districts and total 91 Jails including one Open Air Jail in the State of Odisha. Category wise the Jails are shown below:

Since the study was conducted by the District Judges in respect of different jails on different dates in the months of October and November, 2017, information regarding the population on a particular date i.e. 30.09.2017 was collected from the Directorate of Prisons and Correctional Services,

Odisha vide Letter No.23039 dated 21.11.2017 and basing upon the same the over population has been noted vide the above table.

In many of the Jails, the actual strength of the inmates is far less than the scheduled capacity. As on 30.09.2017, while the aggregate population of the prisoners in the State was 16,010 comprising 3,550 no. of convict and 12,460 no. of UTPs, the total accommodation capacity of all the Jails was 16,830. In the circumstance, a pragmatic relocation of the convicts amongst different Jails is necessary to check overcrowding in some of the Jails.

The sole open Air Jail at Jamujhari has only 72 inmates as against the schedule capacity of 125.

(b) Facilities for Children staying with their Mother (Prisoners) in the Jails- The total population in jails as on 30.09.2017 includes 580 women prisoners comprising 117 convicts and 463 UTPs.In some of the jails Women prisoners are accompanied by children.

With regard to the children staying in the jails with their mother- prisoners, the concerned District Judges have reported as to the facilities available in the jails for them as per the Guidelines issued by the Hon’ble Supreme Court in Judgement Dtd. 13.04.2006 in Writ Petition (Civil) 559 of 1994 (R.D. Upadhyay Vs. State of A.P and Ors).

As per the reports received, the time taken for processing and disposal of the applications for parole varies from Jail to Jail. To put in other words, no uniform or time bound procedure is followed in completing the process. A time bound procedure should be prescribed for completing the process of disposal of parole applications in all jails.

3. Staff and Security (a) Shortage of staff – In almost all the jails barring a few there is shortage of staff. As against the total sanctioned strength of 2346 number of staff in different categories of posts, the total staff in position are 1883 in the state. Shortage of staff may be taken as one of the security concerns. In the sub jails at Kodala, , Nayagarh, Ranpur, Khandapara, Daspalla and all the sanctioned posts have been filled up.

(b) CCTV camera –

In all the jails except the sub jail at Sonepur CCTV camera has been installed at strategic locations. In Sonepur Sub jail, the CCTV camera though installed, is lying dysfunctional since June 2016.

(c) Emergency Bell-

In all the jails except a few, Emergency Bell has been Provided .The exceptions are, the District jails at Puri and Sundergarh, Naribandi Niketan (Women Jail) at Sambalpur and sub jails at Kantabanjhi ,Kujanga, Barbil, ,Khandapara, Khariar and Nimapara .

(d) 4G Net Work Jammers-

In none of the jails 4G Net Work Jammer installed. 2G Net Work Jammer has been installed in a very few jails namely, District Jail, Balesore, Circle jail, Chowdwar , Special jail, Bhubaneswar , Sub- jail, Khurdha, Sub- Jail , ,Sub-jail ,Karanjia, and 3G Net Work Jammer has been installed at Circle jail, Sambalpur.

In the rest of the jails, segregation facility is lacking. The reason cited the most is, want of sufficient space / wards in the jail to make such provision. In some other jails either there are less number of convicts compared to the UTPs, or there is no convict lodged in the jail.

4. Health and Medical Facility

(a) Safe Drinking Water - In many of the jails no Acquaguard or water purifier has been provided, for which water from borewell or PHD supply is being used.

(b) Availability of Doctors/ Medical Staff

In a very few Jails there has been posted regular doctor while in most of the jails doctors have been engaged on temporary contractual basis. Some of the jails are having no doctor, either regular or contractual. As reported, in those jails doctors are being called from the nearby hospital or the inmates are being shifted to hospital, as and when required for the purpose of treatment.

There is need of appointment of full time doctor in every jail/provision of a pool of doctors at District level to address the health concerns, giving priority to the Jails having more population of women prisoners accompanied by children.

P sychiatrist is available in the circle jails at Sambalpur and Chowdwar (Cuttack), and although such a post is sanctioned in the two other Circle Jails at Baripada and Berhampur, the said posts are lying vacant. In the Circle Jail, Koraput no such post has been created. There is need of creation/ provision of one post of psychiatrist for Circle Jail, Koraput, and one post at least in every district jail and Spl. Jail in the State. The existing vacancies should also be filled up to meet the requirement. ii. Drug De-addiction Facility-

Regular facility for drug de-addiction is not available in any jail. As per the reports received, drug de-addiction is being facilitated through counselling, meditation etc. in the jails at Angul, Bargarh, Balangir, Deogarh, Sohela, Phulbani, Puri and Sambalpur. There should be provision at every jail for regular counselling and treatment of drug addicted inmates, if any. Drug de-addiction centre should be established for the prisoners at least in every Circle jail, District jail and Spl. Jail. (d) Availability of Medicines and Ambulance

There is no report regarding non availability of medicine in any jail. Medicines are being purchased from local market as per the requirement. There is availability of ambulance in the Circle Jails at Chowdwar, Koraput and Sambalpur, District Jails at Puri and Spl. Jail at Rourkela. There is need of providing ambulance at least to every Circle Jail, District Jail and Spl. Jail for being used in shifting seriously ailing prisoners to hospital or in emergency cases.

5. Hygiene and Cleanliness issues (a) Toilets and Bathrooms-

As reported, the available toilets are insufficient in the jails at Balangir, Patnagarh, Soro, Padampur, Deogarh, Berhampur, Bhanjanaar, Soroda, Jharsuguda, Dharamgarh, Keonjhar, Champua, Barbil, Khurda, Jeypore, Ranpur, Khandapada, Daspalla, Nuapada and Sonepur.

The facility of bathrooms is reportedly sufficient in the jails at Sora, Bargarh, Sohela, Salipur, , Parlakhemundi, R. Udayagiri, Kodala, Digapahandi, Jagatsinghpur, Phulbani, Baliguda, G. Udayagiri, Bhubaneswar, Banpur, Koraput, Kotpad, Ranpur, Khariar, Puri, Nuapada, Bisam Katak, Gunupur, Sambalpur, Naribandi Niketan (Sambalpur), Kuchinda, Birmaharajpur, Sundargarh and Bonaigarh. In the rest of the jails bathroom facility is found to be sufficient.

Separate bathrooms for male and female prisoners are available in the jails at Pallahara, Chowdwar, Narshinghpur, Kamakhyanagar, Jagatsinghpur, Jajpur Road, Phulbani, Keonjhar, Anandapur, Champua, Barbil, Bhubaneswar, Khurda, Banpur, Jeypore, Baripada, Karanjia, Rairangpur, Udala, Nabarangpur, Umarkote, Bisamkatak, Sundargarh, Rourkela, Bonai, Bargarh, Sohela, Salipur, Banki, Kodala, Sorada, Digapahandi, Jharsuguda, Baliguda, G. Udayagiri, Ranpur, Nuapada, Khariar, Puri, Nimapada, Gunupur, Sambalpur, Naribani Niketan (Sambalpur), Kuchinda and Birmaharajpur. In some of those jails the toilets and bathrooms are found to be insufficient on taking in to account the number of inmates.

Cleanliness is found to be maintained in the toilets and bathrooms/bathing platforms in all the jails barring the Sub-Jails at Hindol, Jharsuguda, Anandapur and Barbil.

(b) Sewerage Condition-

The Sewerage condition is rated bad in the Jails at Pallahara, Athamallik, Bhadrak, Jagatsinghpur, Balangir,Jharsuguda, Kendrapara, Champua, Bhubaneswar, Khurda, Koraput, Karanjia, Rairangpur, Udala, Nayagarh, Ranpur, Khandapada and Daspalla. Out of the aforesaid, the jails at Bhadrak, Karanjia, Rairangpur and Udala are managing the sewerage system by way of drainage only. The sewerage system in Balangir jail is damaged condition. The sewerage tanks in Sub-Jail Champua is found un- covered and the sewerage channel in Spl. Jail Bhubaneswar remains choked. Immediate action is necessary to make good the deficiency in the sewerage system of the aforesaid jails.

In the rest of the jails the sewerage system is found in good condition. (c) Kitchen and cooking area-

From Hygienic point of view, the kitchen and cooking area requires improvements in so far as the jails at Angul, Banki, Berhampur, Bhanjanagar, Aska, Kujanga, Keonjhar, Anandapur, Champua and Malkangiri, and Cleanliness was found not being maintained in the kitchen and cooking area of the jails at Naygarh, Khandapada, Nuapada and Khariar.

(d) Insecticide Spray-

Insecticide spray is not regularly used in the jails at Athamallik, Titlagarh, Kantabanjhi, Sohela, Narshinghpur, Deogarh, Digapahandi, Jagatsinghpur, Kendrapara, Jajpur Road, Jharsuguda, Baliguda, Keonjhar, Anandapur, Karanjia, Rairangpur, Udala, Khandapada, Daspalla, Kkariar, Rayagada, Bisam Katak, Gunupur, Sonepur and Birmaharajpur.

In the rest of the jails insecticide spray is being regularly used to maintain cleanliness.

(e) Washing of Cloth-

The wearing apparels and clothing of the inmates are being washed regularly in all the jails as reported.

6. Diet.

It may be mentioned here that the State Govt. has revised the Diet

Menu for prisoner per day as per the Circular under L. No. 28008 Dtd.

15.11.2016 of the Directorate of Prison and Correctional Services, Odisha.

Vide the said circular, the calorie per prisoner per day is prescribed as follows-

Although there is no specific report regarding deviation of the aforesaid circular in any of the jails, concern has been expressed in respect of some of the jails regarding the quantity of food supplied. In specific, the report of the District Judge, Angul reveals that the quantity of the food supplied to the inmates in the District Jail, Angul is not sufficient.

7. Education and Vocational Training.

(a) Basic Education/Distance Education -

(i) Appointment/Posting of teacher-

In a very few jails such as the Spl. Jail, Bhubaneswar, District Jail, Puri, District Jail, Phulbani, District Jail, Sambalpur, Naribandi Niketan, Sambalpur, District Jail, Angul, Sub-Jail Talcher, District Jail, Balasore, Circle Jail, Berhampur, Circle Jail, Baripada and Circle Jail, Chowdwar (Cuttack), teachers have been posted to impart education to the inmates. In the District Jail, Sundargarh, Spl. Jail, Rourkela, Sub-Jail, Bonai, District Jail, Keonjhar, Sub-Jail, Jeypore, Spl. Sub-Jail, Boudh and District Jail, Dhenkanal, Sub-Jail, Bhadrak although a teacher post has been sanctioned, the same is lying vacant at present. There is no provision of teachers in the rest of the jails, and in some of those jails, as per the reports received, the literate prisoners are helping in spreading literacy amongst the illiterate inmates.

(ii) Facility of Distance Education/Basic Education-

As per the reports received, in Spl. Jail, Bhubaneswar and District Jail, Angul 9 and 4 no. of inmates respectively have been given facilities to pursue education through distance education (correspondence) course. In respect of jails namely Jagatsinghpur, Birmaharajpur, Nayagarh,Khandapada, Dasapalla, Sohela, Patnagarh, Kantabanjhi, Nimapada, Sambalpur, Kuchinda, Rairakhol, Phulbani, Talcher, Athamallik, Pallahara, Balasore, Sora, Jaleswar, Deogarh, Sundargarh, Rourkela, Bonai, Berhampur, Bhanjanagar, Aska, Chhatrapur, Kodala, Sorada, Digapahandi, Bhanjanagar, M. Rampur, Dharmagarh, Baripada, Keonjhar, Barbil, Koraput,Jeypore, Kotpad, Parlakhemundi, R. Udayagiri, Boudh, Nabarangpur, Umarkote, Chowdwar, Banki, Narsinghpur, Badamba, Kamakhyanagar, Dhenkanal, Hindol,Rayagada, Bisam Katak and Gunupur, the facility of distance education is available but presently, none of the inmates is pursuing education through correspondence course.

Basic education facility is reportedly available in the jails at Bhubaneswar, Balangir, Sambalpur, Naribandi Niketan (Sambalpur) Phulbani, Talcher, Balasore, Sora, Sundargarh, Rourkela, Bonai, Berhampur, Bhawanipatna, Baripada, Keonjhar, Koraput, Boudh and Chowdwar (Cuttack). In rest of the jails, as reported, this facilities is not available. (b) Vocational Training Facilities-

In some of the jails facilities are available for giving training to the prisoners on vocational trades like Tailoring, Plumbing, Painting, Handicraft, Carpentry etc. The training facilities on any one or more of those trades is available in the Jails at Angul, Talcher, Balangir, Balasore, Boudh, Chowdwar, Bhubaneswar, Koraput, Baripada, Bhawanipatna, Keonjhar, Puri, Sambalpur, Naribandi Niketan (Sambalpur), Sundargarh, Rourkela and Bonai. This facility is not available in the rest of the jail in the State. (c) Library- Library facility is available in a very few jails, namely the jails at Angul, Talcher, Balangir, Titlagarh, Balasore, Nilagiri, Bargarh, Sohela, Bhadrak, Boudh, Chowdwar (Cuttack), Deogarh, Dhenkanal, Berhampur, Phulbani, Keonjhar, Bhubaneswar, Koraput, Malkangiri, Baripada, Gunupur, Sambalpur (Circle Jail and Naribandi Niketan), Sundargarh, Rourkela and Bonai. In the rest of the jails library facility is not available.

8. Communication & Video Conferencing Facilities

(a) Telephone Facility-

In all the jails permission is being given to the prisoners to communicate with their family and consult legal advisor personally or over telephone. Land line telephone is available in all the jails to facilitate such communication.

(b) Video Conferencing Facility-

To facilitate interaction and communication of the prisoners with their counsel or the legal services institutions in relation to status of their case/appeal or for consultation, and also for conferencing with Courts, Video

Conferencing System has been setup and made functional in some of the jails. The status of the installation and functioning of the said system is jail wise furnished here below.

9. Cultural/Recreational, Entertainment, and Environmental Facilities

(a) Meditation/ Yoga/ Spiritual up-liftment-

All the jails barring a few are having the facilities of meditation/ yoga/ spiritual up-liftment for the inmates. The exceptions are, the Sub-jails at Athamallik, Sorada, Kujanga, Kendrapara, Jeypore, Kotpad, Malkangiri, Nayagarh, Khariar and Birmaharajpur.

(b) Festivals-

Festivals are observed in all the jails barring the Sub-Jails at Narshinghpur, Hindol, Baliguda, G. Udayagiri, Khurda, Ranpur, Khandapada, Nimapara, and Spl. Sub-Jail at Bhanjanagar.

(c) Game/Sports Activities-

Outdoor/ Indoor games or sports activities are being conducted in the jails barring a few jails, namely, the jails at Khariar, Ranpur, Jharsuguda, Khurda, Rayagada, Hindol, Banki, Gunupur, Narsingpur, Badamba, Umarkote, R. Udayagiri, Jeypore, M, Rampuir, Baliguda, G. Udayagiri, Kotpad, Talcher, Athamallik, Pallahara, Nilagiri, Jaleswar, Nimapada, Titlagarh, Patnagarh and Kantabanjhi. The reason cited in respect of some of those jails is shortage of space.

(d) Play and Drama-

Play and drama activities are being conducted in a very few jails, namely the jails at Angul, Balangir, Sora, Sohela, Bhadrak, Dhenkanal, Berhampur, Jagatsinghpur, Phulbani, Keonjhar, Champua, Rayagada, Bisam Katak, Gunupur, Naribandi Niketan (Sambalpur), Sundargarh and Bonai. In other Jails those activities are not conducted.

> (e) Television-

Television set is available in all the jails.

(f) Common Room- Common room is available in the jails at Pallahara, Balasore, Soro, Boudh, Salipur, Paralakhemundi, M. Rampur, Keonjhar, Koraput, Jeypore, Kotpad, Baripada, Nabarangpur, Sambalpur (both Circle Jail and Naribandi Niketan) and Rourkela. Common room facility is not available in other jails. This deficiency may be attributed to space constraint inside the jail premises.

(g) Green Environment- Green environment is available in many of the jails. The exceptions are, the jails at Pallahara, Athamallik, Nilagiri, Banki, Badamba, Dhenkanal, Kamakhyanagar, Hindol, Berhampur, Kodala, Sorada, Digapahandi, Jagatsinghpur, Jajpur, Ragadi (Jajpur Road), Dharamgarh, Champua, Khurda, Jeypore, Malkangiri, Baripada, Rairangpur, Udala, Khandapada, Daspalla, Nuapada, Gunupur and Sambalpur. As reported in some of those jails plantation is being initiated for safe of environment.

10. Jail visits by District Judges and Collectors and Compliance of Jail Manual by jail Authorities.

(a) Jail visits by District Judges and District Collectors As per the circular issued by the Hon’ble High Court of Orissa under L. No.2348 Dtd.10.03.2000 there shall be a committee in every district consisting of the District Judge, the District Magistrate-cum-Collector and the Superintendent of Police to meet every quarter to monitor the conditions like health, hygiene and institutional treatment of the prisoners. Further, as per the L. No 174 (14) Dtd. 8.1.2008 of the Hon’ble High Court, the District Judge should make jail visit once in every month and also make surprise visit at times to find out the conditions of the jails and inmates. As per the reports received, the District Judges are visiting jails situated within their local limits. Most of them have made jail visit every month, but not strictly every jail in every month or every quarter. Regularity in visit has not been maintained by the District Collectors in respect of the jails at Titlagarh, Soro, Jaleswar, Bargarh, Padampur, Sohela, Boudh, Narsinghpur, Kamakhyanagar, R. Udayagiri, Champua, Barbil, Anandpur, Banpur, Jeypore, Karanjia, Rairangpur and Udala.

(b). Compliance of Jail Manual and compliance of Govt. Guidelines-. There is no report regarding non-compliance of the provisions of the Jail Manual in any Jail. However, as per the reports received, the Govt. Circular/Guidelines are not preserved in the jails at Malkangiri, Nuapada, Khariar, Bhanjanagar, Aska, Chhatrapur, Kodala, Sorada, Sundargarh, Rourkela, Bonaigarh, Sonepur, Birmaharajpur, Deogarh, Angul, Talcher, Athamallik, Pallahara, Baliguda, G. Udayagiri, Titlagarh, Patnagarh, Kantabanjhi, Bargarh, Nayagarh, Khandapada, Dasapalla, M. Rampur, Dharamgarh, Hindol, Banki, Salipur, Baramba, Nabarangpur, Umarkote, Boudh, Paralakhemundi, R. As reported, the atmosphere in the Spl. Jail, Bhubaneswar is conducive for committing suicidal attempt in-as-much as there is large open space inside the jail premises with big trees, availability of open sky light provisions and use of rope hangers by the inmates in their cells and barracks. The inmates are, however, reportedly sensitized by the jail officials to avert such possibility.

As per the reports received, the atmosphere of other jails in the State is not conducive for suicidal attempt.

(c) Identification of prisoners prone to commit suicide- Two prisoners, one namely Ranjan @ Anjan Kar (Convict) of Sub- Jail, Kendrapara and the other namely Gopinath Swain (UTP) lodged in Sub-Jail, Kujang were identified as being prone to commit suicide. As reported, they have been under surveillance and counselling by the jail official. No inmate of any other jail was identified as being prone to suicidal attempt. (d) Steps taken by the Jail Authority to avert suicidal attempt-

As reported, the inmates are being counselled, guarded and kept under vigilance/surveillance in the jails so as to avert suicidal attempts.

12. Effect and impact of NALSA Schemes relating to prisoners

(a) Jail Legal Aid Clinics-

In implementation of NALSA Scheme, Jail Legal Aid Clinic has been established in every jail with deployment of Legal Service Panel Lawyers and

Para Legal Volunteers to man the said clinics. The concerned District Legal

Services Authorities or Taluk Legal Services Committees, as the case may be, are deputing one Panel Lawyer for four days in a week and one Para Legal

Volunteer on two days in a week to the Jail Legal Aid Clinic to render required Legal Services to the prisoners.

In view of the resolution passed in the 15th All India Meet of SLSAs, long term convicts have been identified and trained as Para Legal Volunteers to make their fellow inmates of the jails aware of their legal rights and entitlement.

 Establishment of more Open Air Jails in the State.

 Early completion of the construction of new Jail buildings and renovation/repairing of existing jail building as required.

 Filling up of all sanctioned posts of jail staff to avert possible security concern.

 Appointment of regular doctor in every jail/provision of a pool of doctors at District level to address the health concerns giving priority to the Jails having more population of women prisoners accompanied by children.

 Establishment of District/Zone level Drug De-addiction and Counselling Centre as a reformative measure.

 Provision of Aquaguard/ Water Purifier in every Jail for the purpose of safe drinking water.

 Provision of teacher on regular basis in every Jail for imparting basic education to the inmates and the children accompanying women inmates as per the Guidelines of the Hon’ble Supreme Court in R. D. Upadhyay case.

 Enhancing the food quantity in the Jails having more tribal inmates.
