NOTICE OF CONFIRMATION OF AN ORDER HIGHWAYS ACT 1980 COUNTY COUNCIL PUBLIC PATH DIVERSION ORDER FOOTPATHS 29, 30 AND 39 BERDEN IN THE DISTRICT OF On 10 April 2019, Essex County Council confirmed the above order made under section 119 of the Highways Act 1980. The approximate central postcode subject to the public path changes is CM23 1AP The effect of the order as confirmed, as shown on the order map is to divert: 1) a part length of Footpath 39 commencing from a point at its junction with Byway 56 Berden north of Willow Cottage at grid ref: 54638,23008, proceeding on the south side of the stream in a general south west direction zig-zag in nature across the field to connect with Dewes Green Road, to an alternative route commencing approximately 5 metres north west of its aforementioned junction with Byway 56 Berden, proceeding on the north side of the stream to connect with Dewes Green Road opposite the track leading to Mill Hill Road 2) a part length of Footpath 30 commencing from a point at the edge of the crop field approximately 15 metres south west of Dewes Green Road at grid ref: 54604,23005 north of Arnold’s Spring, proceeding south west across field corner to enter Arnold’s Spring copse then exiting on its western side at the field edge, to an alternative route commencing from the aforementioned point at the edge of the crop field, proceeding south at the field edge to the corner of Arnold’s Spring copse, continuing at the field edge around the copse to the aforementioned point where the old route exited the copse. 3) the whole length of Footpath 29 commencing from a point at the north west corner of Arnold’s Spring copse (grid ref: 54599,22996), proceeding south west across the crop field to connect with Footpath 27 Berden at the Herfordshire boundary, to an alternative route commencing from a point at the junction with Dewes Green Road south east of Cobbins House at grid ref: 54600,23012, proceeding south west along the grass track then between the two crop fields to connect with Footpath 25 Brent Pelham & Meesden at the Boundary approximately 35 metres north of the old route junction. A copy of the order as confirmed and the order map have been placed and may be seen free of charge at Uttlesford District Council Offices, Road, , CB11 4ER and at Public Library, Market Road CM1 1QH during normal working hours. Copies are available on request from the Chelmsford Library at a charge. The alternative routes come into force on 09 May 2019, and the old routes shall be stopped up with effect from 16 May 2019, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 02 May 2019 make an application to the High Court.
