Minutes:-

At the outset, the meeting started with a welcome note by the Registrar, Juvenile Justice Secretariat. The following items/issues as per agenda of the meeting were taken up:-

To consider the progress made with The Chairperson apprised all the participants about their regard to setting up of separate Homes visit to a Children Home for Mentally Challenged at for mentally challenged at Narela, Lucknow, which is funded by the State Government and Usmanpur, Dallupura & Kanjhawala. run by an NGO namely Nirvana. In the said Home every mentally challenged child is given additional oxygen daily to cope up with their physical disability. The Committee suggested that since work is in progress for setting up of separate Homes for mentally challenged at Narela, Usmanpur, Dallupura & Kanjhawala, the

Nirvana Home Model can be replicated and inputs can be taken from Nirvana (NGO). The Committee observed that the facts and figures sent by the PWD are irreconcilable with the report of the Social Welfare Department. Mr. Anshu Prakash, Chief Secretary, GNCT of Delhi assured that a proper report, collected from all the concerned departments, will be submitted to the Committee. The Committee decided to take up this issue also in the meeting to be held on 18th July, 2018. 3. To consider the matter regarding The Committee took note of the report dated 05.07.2018 infrastructural requirements of submitted by DWCD, mentioning therein that, on Specially Abled Children 15.05.2018 in the matter of WP (C) 11187/2017, Court on its own motion Vs GNCT of Delhi and Ors., Mr. Nipun Malhotra has been requested to undertake disability audit in all Child Care Institutions. Further, needful would be done to fulfill infrastructural requirements of specially abled children. Education Department of North Delhi Municipal Corporation has also submitted that there is provision of Ramps and Toilets facilities for differently abled children in the schools of North DMC. Mr. Sandeep Kumar, Secretary (Education) GNCT of Delhi, informed the Committee that out of 14 resource centres proposed for children with special needs, one at Lajpat Nagar and the other at West Vinod Nagar are ready with all the infrastructure and will be operational within two months. Further, in six other centres, civil and electrical works are over and only furniture is to be provided and the same will be operational within next four months. He further submitted that completion of the work at the remaining six centres will take some time. He apprised the Committee that it is an end to end solution from 9.00 AM to 5.00 PM with the facilities like special education, physiotherapy, speech therapy, occupational therapy, behaviour modification, counselling, hydro therapy and swimming pool etc. He submitted that these resource centres are located in the government schools and the remaining centres will also be located in the government schools. On being enquired by the Committee as to whether these resource centres are gender specific, it was informed that though as of now these centres are gender neutral, but if need be, provision for boy specific and girl specific rooms will be made and also in due course they will have 136 resource centres all over Delhi for each cluster. 4. To consider the matter regarding Mr. Sanjeev Khirwar, Secretary (Health), GNCT of functioning of One Stop Centres in Delhi and Dr. Kirti Bhushan, Director, stated that 12 one Delhi. stop centres have been set up in 12 hospitals in Delhi. On enquiry by the Committee about the staff working in these one stop centres, it was submitted by Secretary (Health) that only internal arrangements are there. The existing staff i.e. Jr. Gynaecologist, Sr. Gynaecologist, Aaya, staff nurses, Nursing Orderly, Data Entry Operator and Clerk etc. are also tending to the one stop centres. Secretary (Health) informed that regarding manpower to run these one stop centres, all hospitals have been directed to submit their proposals for creation of posts. On a query by the Chairperson as to where these centres are located in the hospital, it was informed that two rooms for the purpose besides the labour room and/or casualty have been earmarked and for the convenience of the visitors proper signages have also been placed. On a query, the Committee was also apprised that on an average two to three cases per hospital are received daily, however, sometimes there may be no case. It was informed that one stop centre each in 12 hospitals are working. Ms. Geetanjli Goel, Special Secretary, DSLSA, pointed out that there is no one stop centre in the government hospitals in South Delhi. Chief Secretary, GNCT of Delhi submitted that efforts will be made to set up at least two One Stop Centres in two hospitals in South Delhi i.e. one in Madan Mohan Malviya Hospital at Malviya Nagar and the other at government hospital in Kalkaji. Chief Secretary also assured the Committee that they are contemplating setting up of one stop centre in the 600 bedded government hospital coming up at Ambedkar Nagar in South Delhi. The Committee asked Special Secretary, DSLSA, to visit the existing 12 one stop centres to see their functioning and to ascertain if some additional manpower and infrastructural facilities are required to be provided to them. Progress made with regard to setting The Committee enquired from Secretary (Health) up of School Health Clinics GNCTD about the location of Health Clinics in the exclusively for schools children in School to which he informed that there is a proposal to Delhi. construct additional 12,000 class rooms in the schools of Delhi and two rooms in every school will be used for setting up School Health Clinics. However, in case of non-availability of rooms, provision of Porta cabins will be made. Secretary (Health) GNCTD further submitted that the proposal from the Education Department for setting up

School Health Clinics is lying with the Health Department and proposal for creation of 969 posts of Public Health Nurses and 206 Medical Officers will soon be sent to the Finance Department. Setting up of Special Training Centres On a query raised by the Committee about the minimum at Children Homes and Observation number of children/students required to have a Special Homes Training Centre, Secretary (Education) informed that there should be a minimum of 30 children to have a STC and for whom one teacher is engaged. Secretary (DWCD) informed that since the minimum eligibility criteria in terms of number of students are not fulfilled in Institutions/Homes of DWCD, the special training centres can’t be opened at children homes and observation homes. However, efforts have been made to enrol all the children in their Homes at the special training centres in the nearby areas. The Committee while referring to the database of children in CCI, furnished by DWCD, observed that in most of the Children Homes/Observation Homes, the strength of children who can be enrolled in STCs are more than 30. At this stage, Ms. Nisha Aggarwal, Deputy Director, DWCD, submitted that their department was under the impression that the special training centres are only for children with special needs and therefore, they were identifying the children with special needs i.e. children who are deaf and dumb and mentally challenged, for enrolment in special training centres. The Committee clarified that the Special Training Centres are meant not only for mentally challenged children but also for children who are slow learners and/or children who are not taking any formal education. The purpose of such STCs is to impart age appropriate learning to such children and also to bridge the learning gap of the children so that afterwards they are able to get admission to the normal schools. Secretary (Education) and Secretary (DSW/DWCD) agreed that Special Training Centres will be opened in children/observation homes for age appropriate learning of the children. In some hospitals not even a single child got admitted. He also informed that DWCD was requested to provide transportation facilities along with manpower to SPYM to pick up the substance using children from CWC, but no steps in this behalf were taken by DWCD due to which transporting these children has become very difficult. Further, it takes four to five hours for one child to get admitted in the hospital for de-addiction, therefore, hospitals may be directed to ensure that admissions are taken up in the shortest possible time frame. He also requested that clothing, shoes, dental and personal hygiene kits etc. should be provided to children brought to the hospitals for detoxification, either through Medical Superintendent concerned or SPYM. He also requested that department of Health may be asked to ensure optimum utilization of beds earmarked for substance using children in the hospitals. Secretary (Health) submitted that he would sensitise all the Medical Superintendents concerned to ensure that the children who are taken for detoxification are not refused admission and their admission is done at the earliest possible. The Committee asked Chief Secretary to ensure that vehicle facility, requisite manpower, clothing, shoes, dental and personal hygiene kits etc. are made available. The Committee also asked Chief Secretary to appoint one nodal officer from the Department of DWCD to co- ordinate with SPYM, in case of difficulties which arise to SPYM in the transportation, treatment and rehabilitation etc. of the children. The Chief Secretary, in consultation with Secretary, DSW/DWCD appointed Deputy Director, DWCD as the Nodal officer to co-ordinate with SPYM and submitted that all the facilities like transportation, manpower, clothing, shoes, dental and personal hygiene kits etc. will be taken care of by DWCD. The Committee asked Dr. Rajesh to send all the requirements to Secretary, DWCD, who will send the action taken report before the next meeting. The Committee enquired about the task force committee and asked Secretary, DWCD to submit a report before

the next meeting whether the task force committees have been constituted for execution of monitoring of the gazette notification dated 28th July, 2017.

GNCT of Delhi that as per section 9 of the RTE Act, the local authorities i.e. the three MCDs, NDMC and DCB are required to identify children, maintain

records as regards children and carry out school mapping. The Directorate of Education had also released a grant of Rs. 67 lakhs to the local bodies during the financial year 2017-18. Further, in the Academic session 2017-18, a total of 146 new STCs were opened for Out of School Children (OoSC). As per report of Education Department, North DMC, survey for out of school children is scheduled for 14.07.2018 and 15.07.2018 by all teachers and Principals of North DMC as per the mapping of Municipal and Aided schools. As per report of Education Department, SDMC, special drives/survey to find out of school children and facilitate their admission into age appropriate classes is a regular feature of the department. The teachers regularly visit the community to find out any such students and help in their main streaming. Progress report be submitted by Secretary (Education) before the next meeting. Chairperson, Juvenile Justice Committee apprised the participants that it was Dr. Rajesh, Executive Director, SPYM, who was the force behind getting started these surveys for drug abuse, which is at rise in Delhi especially among school drop-outs. Trainings were imparted to teachers/doctors to identify the children indulging in drug/substance abuse. Initially the reports were unrealistic, indicating that only 1-2 children have been identified but third year onwards more realistic reports started pouring in. The Committee further expressed that there should be a mechanism to ensure that there are no drop-outs and students seamlessly migrate from 5th to 6th standard. The Committee emphasised that the data is collected by the authorities only when Juvenile Justice Committee calls for it. Rather there should be standard operating procedures (SOPs) to ensure that such surveys, which are aadhaar linked and scientific, becomes an annual exercise. The Chief Secretary, in consultation with Secretary (Education), assured the Committee that they will institutionalise the whole process and frame the SOPs.
