I. Background

1. The Electricite du Laos (EdL) is implementing the Greater Mekong Sub-region Northern Power Transmission Project (GMS NPTP) with funding assistance from the Asian Development Bank (ADB) and the Export-Import Bank of Korea (KEXIM) under a co- financing arrangement. The project has a total cost of $65.32 million, including a grant of $20 million from ADB (Grant 0195-LAO); a loan of $37.88 million from the Economic Development Cooperation Fund (EDCF) of KEXIM; and government counterpart fund of $7.44 million. 1 Approved on 26 January 2010, the ADB grant became effective on 23 November 2010 and will close on 30 December 2019. 2 Likewise, the KEXIM loan will close on 30 December 2019. 3 The closing dates of ADB grant and the KEXIM loan have been extended 4 and 3 times, respectively. 4

2. GMS NPTP has 3 outputs or components, namely, (a) construction of transmission lines, substations, and medium- and low-voltage distribution networks; (b) establishment and operation of a credit to the poor scheme; and (c) provision of policy advisory. Output 2 involves electric connection to 6,000 poor households (HHs) on credit with no interest. Output 1 is divided into 3 modules.

3. Module 1 , which is funded by the ADB grant, involves the (i) construction of a 98 km single circuit on double circuit 115 kV transmission line (TL) from the 115/22 kV Nonhai Substation (S/S) in Nonhai Village of Meun District, Province, to Paklay Town, Xayabury Province; (ii) construction of a new 30 mega volt ampere (MVA) Paklay S/S; and (iii) upgrading of the 115/22 kV Nonhai S/S and the 115/22 kV Xayabury S/S in Xayabury Province.

4. Module 2 , which is financed by the KEXIM loan, includes the construction of a (i) 74.6 km single circuit on single circuit 115 kV TL from Paklay Town to the Lao-Thai border at Kenthao Town 5, Xayabury Province; (ii) 122.74 km single circuit on double circuit 115 kV TL from Paklay to Xayabury; (iii) medium- and low-voltage distribution networks of 22 kV feeders with a length of 263 km from the new Paklay S/S, 156 km from the Nonhai S/S, and 336 km from the Xayabury S/S; and (iv) connection to 7,020 HHs from the Xayabury S/S, in addition to 7,553 HHs from the Nonhai S/S and to 1,541 HHs from the Paklay S/S.

5. Module 3 , also funded by the KEXIM loan, includes the construction of a (i) 28 km single circuit on double circuit 115 kV TL from Boun Tai District 6 to Boun Neua District in

km. However, EdL and KEXIM on 24 September 2015 agreed to delete the Oudomxai section of the transmission line from the project scope due to shortfall in funds. The new 30 MVA Boun Neua S/S would instead be connected to an existing switchyard in Boun Tai resulting in a much-reduced length of 28 km of transmission line. 4

II. Objectives of the Social Monitoring Report

6. The agreed June 2014 RAP tasks the EdL, with assistance by project implementation consultants, to carry out internal monitoring of resettlement implementation. Specifically, EdL is to look into the following concerns 7 in its monitoring activities: a. Affected assets are inventoried by type, quantity and severity of impact, and that their owners are identified; b. Compensation for affected assets, including land-for-land modality, are paid according to the agreed RAP; c. Vulnerable AHs are assisted as per the agreed RAP; d. Public information, public consultation and grievance redress procedures are followed; and, e. Affected public facilities and infrastructure are restored promptly.

III. Scope and Methodology

7. This document is the second social monitoring report (SMR) for the GMS NPTP covering the period July-December 2018. It should be read as a sequel to the preceding monitoring report covering the period January 2017-June 2018. This SMR reviews the status of (i) payment of compensation and allowances of the affected households (AHs), (ii) construction works, (ii) actions taken to resolve outstanding resettlement issues and complaints identified in the previous SMR, (iii) resolution of complaints received in July- December 2018, and (iv) resolution of other social safeguard issues that cropped-up in July- December 2018.

8. Information for this report came mainly from a review of documents with the Environmental Office of the Department of Transmission Line and Substation Development (EO-DTLSD). These documents include (i) AHs’ compensation payment records, (ii) records of complaints of AHs, and (iii) Project Progress Reports for Quarter 3 and Quarter 4 of 2018.

IV. Highlights of the January 2017-June 2018 Social Monitoring Report

A. Module 1

9. EdL in January 2016 has completed payment of compensation of all AHs affected by the construction of the 115 kV Nonhai-Paklay TL and the new 30 MVA Paklay S/S. The upgrading of the 115/22 kV Nonhai S/S and the 115/22 kV Xayabury S/S did not involve land acquisition and resettlement (LAR) because all works were confined within the existing perimeters of the substations. Works on the 30 MVA Paklay S/S and the 115/22 kV Nonhai S/S were completed on December 30, 2016. The upgrading of the 115/22 kV Xayabury S/S was completed on December 21, 2017. There were no outstanding resettlement issues in Module 1.

B. Module 2

10. Preliminary construction work at locations not involving land acquisition and resettlement for the 115 kV Paklay-Kenthao TL (referred hereinafter as Transmission Line 3

The power company in April 2018 approved the compensation payment voucher of 247 AHs in Paklay and Kenthao districts whose loses included 6,527 m 2 of rice paddy, 4,496 m 2 of garden land, and 29,480 fruit and industrial trees. 11. With regards the 115 kV Paklay- Xayabury TL (referred hereinafter as Transmission Line 3 or TL2 ), construction work was 45% complete as of June 2018. In March-May 2017, EdL paid a total of 983,277,000 LAK in compensation to 427 AHs, followed by another payment to 46 AHs in August-December 2017 in the amount of 226,407,600 LAK. 8 EdL pays AHs their compensation in batches. First to be paid are those losing assets for the footings of the towers. Next to be paid are AHs with trees under the transmission line’s 25 m right-of-way (ROW). 6

C. Module 3

12. Construction work for the 115 kV Boun Tai-Boun Neua TL (referred hereinafter as TL1 ) was 51% complete as of June 2018. Construction of the new 30 MVA Boun Neua S/S had been completed but the substation was not yet connected to the transmission line primarily because construction of the Boun Tai S/S was still ongoing.

13. EdL in March 2017 paid 83 AHs their compensation money amounting to 974,217,620 LAK, followed by another payment to 2 AHs in December 2017 amounting to 87,288,000 LAK, for losses in the ongoing construction and stringing of the transmission line and in the construction of the Boun Neua S/S. Two households that the 2014 resettlement action plan (RAP) identified as losing entire homes were spared from being impacted in the construction of the Boun Neua S/S because modifications were made in the location of the substation. Due to weaknesses in database filing system at PMU, It could not be ascertained in July 2018 how many households were affected in TL3.

D. Grievance Redress Resolution

14. Complaints from AHs in Module 2 and Module 3 come about during the (a) final detailed measurement survey (DMS) that is carried out by the District Resettlement Committee (DRC) and EdL, and (b) during the construction activities of the civil works contractor. The PMU noted, however, that EO-DTLSD personnel did not systematically record and track complaints until their closure.

15. Complaints relative to the decisions of the District Resettlement Committee (DRC) on the amounts of compensation of APs are mostly resolved at the village level (i.e., first level in the grievance redress process).

16. Complaints arising from the activities of the civil works contractor (i.e., Daewoo International or DWI in consortium with Hyundai Engineering Company or HEC) usually arise when DWI-HEC (i) fails to make prior arrangements with landowners before using a strip of their landholdings to access the sites of towers it constructs, (ii) does not pay compensation to landowners whose landholdings were used as access to the tower sites, (iii) does not pay compensation for temporarily affected paddy or corn land around the footings of the towers, and (iv) inadvertently damages properties outside of the ROW during

7 the cutting of trees and stringing of power lines.

E. Other Specific Monitoring Concerns

17. Compensation for affected assets, including land-for-land, are paid according to the agreed RAP: compensation was paid for all affected assets. However, because payment records of AHs were not summarized into tables with disaggregated information on how much compensation was paid for each category of affected asset, it could not be ascertained during the preparation of the January 2017-June 2018 SMR on whether or not easement rights fees were paid for tree plantation lands traversed by the transmission lines’ ROW and whether cash allowance was given to severely affected AHs that lost 10% or more of total productive assets.

18. Vulnerable AHs are assisted as per the agreed RAP: Similar to the aforementioned, it could not be ascertained during the preparation of the January 2017-June 2018 SMR who among the AHs were vulnerable. Per entitlement matrix in the 2014 RAP, poor and vulnerable APs would be prioritized for recruitment in the project’s construction works.

F. Recommendations of the January 2017-June 2018 SMR

19. Below were the recommendations of the previous SMR that underscored the need to improve the documentation and filing system at the PMU. a. Approved payment vouchers per district should include columns for amounts paid for (i) each type of landholding, (ii) structures, (iii) easement right, and (iv) cash allowance for severely affected AHs losing 10% or more of productive assets. b. Copies of said payment vouchers in clear printed form and in electronic files should be readily available at the PMU. c. Duplicate (of original) and scanned (electronic file) copies of certificates of receipt of compensation per district should be filed along with the approved payment vouchers. d. The names of heads of AHs should be tabulated and should include basic socioeconomic information on the affected household, such as age, gender, and ethnic affiliation; and, information on whether or not the AH is poor. EO-DTLSD should keep a list of vulnerable APs who have been provided jobs in ongoing construction works. e. All complaints received by EdL field staff directly from AHs, from village authorities, or from the civil works contractor, whether in written form or verbally (in which case the staff should record this on the EdL form for complaints) should be recorded in a logbook indicating date of receipt, name of complainant, village and district of complainant, nature of complaint, action taken, and status of resolution of the complaint. The complaints logbook should be updated on a monthly basis indicating the status of resolution of each complaint until its closure.

V. Status of the Implementation of Land Acquisition and Resettlement

A. Submission of the First SMR and Follow-up Corrective Activities

20. EdL on 29 August 2018 submitted the first social monitoring report (SMR) for the project covering the period January 2017-June 2018. ADB on 9 October 2018 provided EdL its comments to the SMR. The comments of ADB and the response of EdL revolved

8 primarily on the shortcomings of the documentation and filing system of the EO-DTLSD. Specifically, ADB inquired whether or not affected households (AHs) were paid their compensation and allowances in accordance with the resettlement plan (RP), if vulnerable AHs were provided assistance, and if the grievance redress mechanism (GRM) was functioning.

21. Despite expressing uncertainty, for lack of evidence, that AHs were dutifully paid their compensation and applicable allowances (in Table IV-1 of the January 2017-June 2018 SMR 9), the PMU stated in its response to ADB that AHs were paid their compensation and allowances as required by the project entitlement matrix. The January 2017-June 2018 SMR admitted though that there was no record available on whether or not vulnerable AHs were provided assistance. Likewise, because complaints were not systematically recorded and their resolution was not coordinated at the central level (i.e., PMU and EO-DTLSD), there was no assurance that all grievances were resolved as per the project policy.

22. EDL in November 2018 remobilized the social and environmental consultants in order to arrange the data base and filing system of the EO-DTLSD as recommended by the January 2017-June 2018 SMR. It was learned during a thorough review of documents that (i) severely affected AHs at the Paklay S/S were not paid their allowances, and (ii) easement right fees were not paid to AHs whose tree plantations were traversed by the power lines’ 25 m right-of-way (see Section F below for more on this). Appendix 1 provides the original and the modified responses of the PMU to ADBs’ comments to the January 2017-June 2018 SMR.

B. Module 1

23. EdL on 14 August 2018 submitted to ADB the compensation completion report (CCR) for Module 1. 10 Similar to the January 2017-June 2018 SMR, the PMU in its response to the 18 September 2018 questions of stood by the CCR’s claim that, notwithstanding the inadequacy of information on compensation and allowances paid, (i) there was “ sufficient evidence to argue that all AHs had been paid their compensation and allowances ”;11 (ii) easement right fees were probably paid to AHs whose industrial tree plantation landholdings were traversed by the project’s transmission lines; and (iii) land certificates of AHs had been amended and remained in the names of the AHs, citing the case of Mr. Kom, a resident Vang Village of Sanakham District. 12 The PMU in its response to ADB admitted, though, that

The upgrading of the 115/22 kV Nonhai S/S and the 115/22 kV Xayabury S/S did not involve land acquisition and resettlement (LAR) since all works were confined within the existing perimeters of the substations. Works on the 30 MVA Paklay S/S and the 115/22 kV Nonhai S/S were completed on December 30, 2016. The upgrading of the 115/22 kV Xayabury S/S was completed on December 21, 2017. The 30 MV Paklay S/S and the 115 kV Nonhai-Paklay TL were energized in December 2016. 11 Para 21 of the compensation completion report. 12 Mr. Kom lost 64 m 2 of plantation land for the footing of a tower, in addition to 348 teak trees and was paid LAK15,200.000. The completion report surmised that the amount included easement right. Mr. Kom claimed that his plantation land was still under his name. 9

2 AHs at the Paklay S/S could have been severely affected by the loss of productive landholdings. The CCR was revised and resubmitted to ADB in October 2018.

24. As mentioned in para 22, it was learned in November 2018 when the social and environmental consultants had the opportunity to thoroughly review payment documents that the entitlements of AHs were not dutifully provided contrary to what the PMU earlier thought was the case (see Section F below for more on this). Appendix 2 provides the original and the modified responses of EdL to ADBs’ comments to the CCR.

C. TL1 (Boun Neua-Boun Tai Transmission Line)

25. Construction of 84 steel lattice towers, in addition to the stringing of the transmission line, had all been completed in September 2018. TL1 is to connect the new Boun Neua S/S (built in May 2018 under the NPTP) and the Boun Tai S/S, which is being constructed outside of the NPTP. The EdL carried out a final inspection of the TL in November 2018. However, while the power line from Boun Neua S/S up to the periphery of Boun Tai S/S is in place already, connection to the Boun Tai S/S cannot be completed because construction of the latter will only be completed in September 2019.

26. Payment of compensation and allowances had been completed in 2018. A total of LAK 1,046,511,620 was paid to 83 AHs and 1 organization for various losses, including 1,746 m 2 of paddy land; 7 secondary structures (i.e., not houses or shops); and 714 “other” trees (i.e., not teak). Appendix 3 gives a list of the household heads or APs. The acquired paddies were for the footings of the transmission towers, while the acquired trees were located at the footings of the towers and in the transmission line’s 25 m ROW. In addition, temporary impacts during the construction of towers and stringing of the power lines have occurred in TL1. The EO-DTLSD has tabulated 13 the names of 42 affected persons (APs) who have already been paid by the contractor (see Appendix 4 for the list). Table V-1 Summary of Compensation Paid in TL1

D. TL2 (Paklay-Xayabury Transmission Line)

27. Construction of 398 steel lattice towers, in addition to the stringing of the transmission line, had all been completed in December 2018. EdL is scheduled to make a final inspection of the transmission line in March 2019; energizing of the line will come thereafter.

28. Payment of compensation and allowances of AHs had been completed in 2018. A total of LAK 983,580,195 was paid to 426 AHs for various losses, including 9,380 m 2 of paddy land; 63 secondary structures; 3,336 m2 of plantation land; 32 m 2 of residential land; 16,109 teak trees; and 4,882 other trees (see Table V-2 overleaf for a detailed summary). Appendix 5 gives a list of the household heads or APs. The acquired landholdings were for the footings of the transmission towers, while acquired trees were located at the footings of the towers and in the transmission line’s ROW. There are pending claims for payment of compensation for temporary damages that occurred during the stringing of the transmission line. However, the EO-DTLSD has yet to receive from field personnel the details of these claims, a weakness in the GRM process that has been pointed out in footnote 14.

E. TL3 (Paklay-Kenthao Transmission Line)

29. Foundation works for all 215 towers have been completed and 207 of the towers have already been erected (i.e., 96.27% completed). By end of 2018, stringing of 34.2 km of the 72.2 km transmission line has been completed (i.e., 47.3% completed).

30. With regard payment of compensation and allowances, a total of 238 AHs and 6 organizations in 2018 have so far received their compensation amounting to LAK 1,334,475,800 for various losses, including 10,944 m2 of paddy land; 33 other structures; 384 m 2 of plantation land; 22,286 teak trees; and 6,425 other tress (see Table V-3 on page 14 a detailed summary). Appendix 6 gives a list of the household heads. The rest of the AHs are expected to receive their compensation no later than March 2019. The acquired landholdings were for the footings of the transmission towers, while acquired trees were located at the footings of the towers and in the transmission line’s ROW. There are pending claims for payment of compensation for temporary damages that occur in the ongoing construction of the towers and stringing of the power line. However, as mentioned earlier, the EO-DTLSD merely waits for details of these claims to be sent by field personnel.

F. Corrective Action Plan

31. As pointed out in para 22 and 24, severely affected AHs at Paklay S/S were not identified and, thus, not paid their subsistence allowance. Moreover, easement fees were not paid to AHs with affected tree plantations. Also, land certificates of AHs have not been amended or annotated. In view thereof, PMU on 18 December 2018 submitted to ADB a corrective action plan to address shortcomings mentioned in Sections A (i.e., January 2017- June 2018 SMR) and B (i.e., CCR of Module 1) above.

32. As of 31 December 2018, the status of the implementation of the CAP was as follows: a. PMU has yet to decide on whether or not 2 of the affected persons (APs) at the Paklay S/S, Messrs. Somdy and Sali, should be considered as severely affected by the loss of productive landholdings and, thus entitled to receive transition subsistence allowance as per the project resettlement policy. 14 The affected productive landholdings of the 2 were State land. 15 b. Tabulated summaries of AHs, information on gender of the AH heads, the AHs’ losses and amounts received in compensation have been prepared (as shown in Appendices 3 for TL1, 5 for TL2, and 7 for TL3). Socioeconomic information on the AHs was not gathered during the census of the affected people; thus, there was no information on vulnerability, with the exception of women household heads. In view thereof, it is difficult to comply with the policy objective of providing assistance to vulnerable AHs. c. Provincial governments’ decisions on unit rates used have been obtained (see Appendix 7 ). d. The PMU believes that there is no need to amend the land certificates of AHs whose landholdings were permanently acquired for the footings of towers because the AHs are allowed to continue cultivating the plots under the towers. It is for this reason that the amounts AHs pay in land taxes before and after the construction of the towers have not changed. This cannot be said, however, for AHs the lost landholdings in the construction of the Paklay S/S. The PMU will have the land certificates of these AHs amended. e. Complaints of residents and AHs are still not systematically recorded on a ledger at the project site. Information on complaints that reach the PMU till come randomly which are then summarized on tables as shown in Appendix 8. f. The files on the 5 AHs in Module 1 that complained in 2015 seem to have been misplaced; nobody in the PMU could provide the information. g. The PMU is not in the position to carry out retroactively a cadastral survey of areas traversed by the project’s transmission lines. However, based on the transmission lines’ alignment maps and the number of trees paid for each AHs, PMU can identify possible tree plantation landholdings that were affected by the project. As of 31 December 2018, PMU, with assistance from village leaders, was still verifying the names of AHs whose plantation landholdings were traversed by the transmission power lines’ ROW. h. The comments-response matrix for Module 1 Compensation Completion Report and the January 2017-June 2018 Social Monitoring Report have been amended (see Appendices 1 and 2).

The EdL resettlement specialist consultant has advised the PMU that the tenure status of the AHs have no bearing in the determination of severity of impact to livelihoods and income sources. 16

VI. Conclusion

33. As mentioned in the preceding sections, project policy on payment of compensation for permanently acquired and temporarily impacted assets, payment of easement rights for plantation landholdings traversed by the power line’s ROW, and payment of subsistence allowance to AHs severely affected by the loss of productive assets, in addition to providing assistance to vulnerable AHs by way of job opportunities for household members during the construction of transmission line, have not been dutifully observed. EdL is currently implementing a corrective action plan to address these shortcomings.

34. The need for a systematic complaints resolution tracking system remains valid. There are still a number of outstanding claims for payment for temporarily impacted assets in TL2. Construction works in TL3 is ongoing, and complaints from residents and AHs are likely to crop up. It is for this reason that the PMU will designate field-based personnel each for TL2 and TL3 to gather and record (in a logbook) outstanding and new complaints and to provide on a weekly basis the EO-DTLSD details of complaints collected. The EO-DTLSD will in turn track the complaints coming from subprojects and push for their resolution and closure in an orchestrated way.
