Summary

The Water S upply and S anitation S ector Project (WS S P) and Water S upply and S anitation S ector Project – Additional Financing (WS S P-AF) of the Ministry of Public Works and Transport (E xecuting Agency) supports the development of small district towns through the improvement of water supply and sanitation services. Consistent with the Government’s urban water supply and sanitation sector policy and investment plan. The impact of WSSP and WSSP-AF (the Project) will be expanded access to quality and reliable piped water supply and sanitation services for the urban population in the Lao PDR. The outcome will be improved performance of participating provincial nam papa (PNP) in delivering sustainable water supply and sanitation services. The Project adopts a sector approach following a prioritized list of subproject towns based on the water supply investment plan The Project will comprise of: (i) improvements to the water supply system and (ii) enhanced community action in urban water supply and sanitation.

The Project is implemented through a sector loan from the Asian Development Bank (ADB). The Ministry of Public Works and Transport (MPWT) and the Provincial Department of Public Works and Transport together with the PNPs or provincial water utilities (Implementing Agencies) will be responsible for identifying, prioritizing, appraising, selecting and approving subprojects in accordance with the Government and ADB’s policies and procedures.

Main Activities during the reporting period, J anuary - J une 2019

All subprojects of the Project being implemented are classified as Category B projects and the Initial E nvironmental E xamination (IE E ) reports and E nvironmental Management Plans (EMP) have been approved by ADB and disclosed on the ADB’s web page.

Construction water supply system and public latrines will be carried out under a civil works contract. The contract for Long subproject of was completed in May 2019. Five contracts under WS S P and one subproject under WS S P-AF are ongoing.

Implementation of village environmental improvements will be carried out under one civil works contract per province i.e. two subprojects in one package. The VE I works for Pha Oudom subproject were completed and the contract for Luang Namtha is ongoing.

Updated IE E /EMP report for S amakkhyxai was approved and published by ADB in J anuary 2019 and DONRE is currently reviewing the IE E /EMP of Dakcheung subproject.

Additional land had to be acquired for Botene subproject due to relocation of some treatment facilities at the water treatment plant. The PIU with local authorities agreed with one Affected Household on land acquisition and compensations. PIA Consultant prepared a Land Acquisition Corrective Action Plan (LACAP), which was approved and published on ADB’s web page in February 2019. ADB also published Updated LACPs for Xamneua and S opbao subprojects in March 2019. Updated Land Acquisition Due Diligence report for Daocheung subproject was submitted to ADB for approval in May 2019.

Preparation of Feasibility S tudy (FS ) reports of two new subprojects in province started in J anuary 2019. S ite investigations and public consultations on social safeguards have been carried out in Nam Thouam and Vieng Kham subprojects during the reporting period.

Based on the contractors’ progress reports and PIA Consultant’s observations there are no major environmental issues in these subprojects as the contractors are following most of the set requirements of the E MPs. However, construction supervisors have reminded the contractors to provide personal protection equipment and reminded workers to wear them. Also installation of safety warning signs at the construction sites were not always up to date.

No issues on occupational health and safety (OHS ) or public safety have been reported, despite the that contractors or workers were not always wearing personal safety equipment.

No grievances on environmental issues, land acquisition or compensation have been made. However, ADB noted during the review mission in May, that PIU of New Namtha should improve the Grievance R edress Mechanism (GR M) by maintaining records of received complaints.

Background Water supply development and rehabilitation will be carried out on existing PNP water supply systems and expand services to unserved communities in the most densely populated suburbs of provincial capitals and new systems constructed in district towns. The scope of works will cover the expansion, replacement and rehabilitation (if required) of: (a) water intakes from surface, spring or groundwater sources; (b) raw water transmission; (c) water treatment facilities; (d) distribution network; (e) service reservoirs; (f) individual metered service connections; and (g) improved office/workshop/store facilities for the PNP branch.

Village environmental improvements (VE I) will promote demand-driven, community-managed environmental improvements, such as construction or rehabilitation of small-scale community improvements (e.g., drains and village access roads). Core villages within a small town will be eligible to participate, including those that agree to implement, operate and maintain improvements; make a cash contribution towards the capital costs of the improvements; and select specific improvements in a participatory, socially inclusive and transparent manner.

New public sanitation facilities will be constructed or repaired in strategic areas where the O&M can be contracted to a nearby business or social entity. Where septage disposal facilities are not available in the subproject area, the project will provide technical assistance and grant funds for constructing septage disposal facilities at a suitable location on government land.

Key Issues and Corrective Actions

S evere rains occurred during J uly - August 2018 in , which caused damages to the infrastructures all over the country. The bridge over Nam Long river with a river crossing pipeline was damaged in Long subproject and a new bridge had to be constructed before the river crossing could be re-installed. Also the irrigation dam downstream of the intake was damaged and water level in at the intake lowered to a level that operation of the raw water pumps is not possible. A contract variation to build a temporary dam and to repair damages to the intake structures was negotiated and ordered. These repair works were completed and the water supply system was commissioned in May 2019.

Heavy rains also caused flash flooding of S epian - S enamnoi hydropower dam near S anamxay subproject which affected 7 villages in J uly 2018. Approximately additional 600 families or 3,000 people have to be resettled in S anamxay district town, which has impacts on the planned capacity of the water supply treatment plant and distribution network service area. DWS requested financial support from Korea International Cooperation Agency for construction of water supply in S anamxay and detail engineering design was put on hold.

During Q2 2019 KOICA replied to DWS that it will consider S anamxay subproject as a Candidate Project for 2021. Therefore, due to the urgency of providing support to the affected people and residents of S anamxay District Town the Department of Water S upply sought ADB’s concurrence to construct new water supply and sanitation facilities under the Loan 3041-LAO, Water S upply and S anitation S ector Project. During the ADB’s review mission in May it was agreed that S anamxay subproject will be implemented under WS S P. Preparation of detailed engineering designs is ongoing.

Grievances

Grievance and redress mechanisms are in place and no grievances have been made.

Recommendations

ADB noted during the review mission in May, that PIU of New Namtha should improve the Grievance R edress Mechanism (GRM) by maintaining records of received complaints.

1.1 Project Impact and Outcome 1. 2. The WS S P is implemented through a sector loan and WS S P-AF through a grant from the Asian Development Bank (ADB). The Ministry of Public Works and Transport (MPWT) and the Provincial Department of Public Works and Transport together with the Provincial Nam Papas or provincial water utilities (Implementing Agencies) will be responsible for identifying, prioritizing, appraising, selecting and approving subprojects in accordance with the Government and ADB’s policies and procedures.

3. The Project was planned to support eight PNPs to improve and develop water supply systems in about two towns per province. It will provide financial support to selected PNPs that are state companies, have prepared a corporate plan, and have arrears less than 90 days.

E ach PNP will receive funds to rehabilitate and expand its provincial capital water supply system and to construct one new water supply system in a small district town.

1.2 Project Outputs

4. The Project has the following five Outputs:

Output 1: Improved sector coordination and policy implementation

5. This will continue reforms introduced under previous projects and implement new policy reforms to improve the performance of about eight PNPs. This includes (i) strengthened sector coordination, including support to help coordinate the subsector working group on water supply and sanitation under the Technical Working Group subgroup on urban development, subsector biannual meetings, annual subsector performance review with development partners, and smaller subsector coordination meetings; (ii) continued implementation of policy reforms, including service agreements between PNPs and provincial governments, PNP training on corporate planning and financial management, tariff adjustments, free connection policy, issuance of district sanitation regulations, and the use of simplified corporate plans; and (iii) expanded policy implementation, including nationalizing a free connection policy and sanitation regulations; wider coordination of NRW management, asset management, and water safety plans; and the establishment of a corporate planning helpdesk in the project coordination unit.

Output 2: Improved nonrevenue water management and water supply development

6. This will integrate a comprehensive NR W reduction program with water supply development in about six provincial capitals. The NRW program applies an integrated business approach that includes both investment for physical works and support for surveys, water audits and balances, record drawings, and registers. It addresses both real losses (leakage) and apparent losses (metering losses and water theft). Participating PNPs will be required to establish permanent leak detection and repair teams and implement disconnection and meter management policies. E xperts will help these teams implement the NR W program. PNPs that participate in the NR W reduction program and the policy implementation activities under output 1 will be eligible to seek financing for water supply rehabilitation and expansion of existing provincial systems to peri-urban areas. They will be eligible to receive O&M equipment and household connections and meters.

Output 3: Developed new water supply systems in small towns

7. S afe, affordable, reliable PNP piped water supply systems will be built in the core urban areas of about nine small district towns. PNPs that have agreed to participate in Outputs 1 and 2 will be eligible for financing to build a new water supply system in a small district town in the same province, acquire O&M equipment, and offer free connections and meters to households during construction.

Output 4: Enhanced community action in water supply and sanitation

8. This will sustain the benefits from investments in small town water supply systems through complementary sanitation and awareness activities. The output includes (i) village environmental improvement (VE I) grants for core villages in a small town according to agreed eligibility criteria; (ii) improved household sanitation for the poor; (iii) constructed or repaired public sanitation facilities where O&M can be contracted to a business or social entity, and constructed septage disposal facilities where they are unavailable in the subproject area; and (iv) increased project and hygiene awareness through stakeholder consultations and

10 S afeguards Monitoring R eport, J anuary – J une 2019 community participation, and water, sanitation and hygiene behavior. Activities will be coordinated by district authorities and implemented by village development committees.

Output 5: Strengthened capacity for project implementation, operation and maintenance

9. This includes consulting services support for project implementation assistance (including safeguards), capacity development and sector reform. The support is provided by the Project Implementation Assistance (PIA) consultant. S upport for operation and maintenance (O&M) will be provided to participating PNPs through a proposed water operators’ partnership with a regional water utility or individual consultants. This output also includes consulting services support for information technology (IT), project accounting, safeguard monitoring, as well as incremental administration support (funding) for project vehicles, project office equipment, and PNP operations and leak-detection equipment.

2 Environmental Performance Monitoring

2.1 EMP Implementation 10. During construction phase, the implementation of the E MP is the responsibility of the contractor. The contractor’s responsibility includes the appropriate and timely application of the mitigating measures stipulated in the approved E MP. The application and implementation of the mitigation measures are to provide the safeguards that will control, reduce if not eliminate adverse impacts during the S ubproject implementation.

11. Throughout the construction period, the contractor will submit monthly environmental compliance progress reports to the PNP, copy furnished to the PIU. The contractor should highlight the summary of the progress of construction, activities undertaken within the reporting period to implement the measures outlined in the E MP, record any community complaints received and how the complaint was resolved.

12. R egarding raw water quality PNP have collected water samples and taken them to a water laboratory for quality analyses to find out whether there are any major changes of raw water quality requiring to have adjustment to the water treatment process of the water supply scheme.

2.2 Environmental Monitoring by Construction Supervisor 13. During construction phase, the inspection, evaluation and recording of compliance to the E MP as implemented by the contractors are among the tasks undertaken by the Construction S upervisor (CS ) in the field supported by the PIA Consultant’s international and national environmental specialists. During the reporting period PIA consultant has carried out periodical monitoring visits to the construction sites and the Construction S upervisors have carried out daily inspections and maintains records of the contractor’s mitigating measures and activities prescribed in the approved EMP of the S ubproject. The responsibilities of Construction S upervisor cover the period to the end of the commissioning stage including certifying of construction materials, equipment and items and final checking and acceptance for handing over for operation.

14. The PIU will consolidate the results of the monthly environmental monitoring through a quarterly progress report that have been submitted to the PCU which is based at the Department of Water S upply and S anitation of the MPWT. The following sections provide a consolidated summary of the main environmental implementation and monitoring findings

3 LAC Performance Monitoring

3.1 LAC Implementation

3.1.1 Batch 1 and 2 Subprojects

19. The Updated LACPs for all seven subprojects have been approved by ADB. The identified AHs were compensated in cash before start of construction.

20. During the construction stage of Botene subproject’s WTP 3,797 m2 of private land adjacent to the existing WTP had to be acquired due to ground water seepage causing risks to stability of some the structures. PIU and district authorities have reached an agreement on land and compensations to one AH. The Corrective Action Plan was prepared and submitted to ADB. ADB approved the Plan and published it on the web page in February 2019.

21. There are no other cases to report in relation with the construction works of mains and distributors in the right-of-way during the reporting period.

3.1.3 Batch 3 Subprojects

22. The LADDR for Dakcheung was prepared by PIA consultant and sent for approval to ADB in May 2019.

3.1.4 Batch 5 Subprojects

23. Two new subprojects have been selected for subproject preparation in . Project orientation workshops were carried out for Nam Thouam and Vieng Kham subproject in J anuary 2019. The PIA Consultant has studied options for the water supply and sanitation development in these district towns. During the reporting period public consultations on land acquisition and compensations were carried out. All facilities are planned to be located on public land.

3.1.4 LAC Overview

24. The following table provides a summary of land acquisition and mitigation measures of the sub-projects. The details are provided in the separately submitted LAC documents for each subproject.

5 Information Disclosure and Socialization Including Capability Building

5.1 Public Consultations and Meetings

27. Disclosure of information and consultations are conducted during preparation and implementation of subprojects to ensure that stakeholders are timely informed about the Project in general, environmental management, land acquisition, compensation and resettlement. The objective is an active participation of stakeholders throughout all steps and stages of study and detailed design phase, but also during construction and the final operation.

28. Therefore, consultations and information dissemination have been an integral component of the subprojects’ surveying, planning and preparation activities. S ignificant information dissemination and consultations with stakeholders have been undertaken mainly through transect walks, E A/IA coordination and technical meetings, public village meetings, focus group discussions, household surveys, random interviews with villagers, and others.

29. In accordance with the Project’s Resettlement Framework public consultation meetings were held. They were facilitated and attended by representatives from the PIU, district and village authorities, and with community members as the majority of the attendees. These public meetings briefed in general and informed in details about topics including but not limited to (i) Project components; (ii) subproject features, (iii) GOL’s laws and procedures on land acquisition; (iv) ADB’s policies on Involuntary R esettlement; (v) Project’s Policy Framework and E ntitlements; (vi) subproject impacts and entitlements; (vii) Cut-off–Date (CoD); (viii) mitigation measures; (ix) preparation of Land Acquisition and Compensation documents, (x) budget costs, (xi) implementation schedule, and (xii) others. The meetings allowed the participants to raise questions to clarify the resettlement policies particularly compensation and entitlements, but also provided the opportunities to actively participate in the land acquisition and compensation planning where they could express their preferences and concerns.

30. By the end of the reporting period Updated LACPs have been approved for all Batch 1 and 4 subprojects. Concerning Batch 3 consultations for updating the Dakcheung subproject took place during Q2 and the updated LACP report was sent for approval to ADB in May 2019 and for S anamxay subproject the consultations and submission of updated LACP are planned for Q3 2019.

5.2 Information Disclosure

The PIA consultant has involved PIU members in the public village meetings; identification of VE I activities, protection of environment and assessment of land acquisition losses during the field surveys including the S E S AH and DMS . This on the job training has increased the capacity of the PIU members in all subprojects. The local authorities including members of the district resettlement committees have also been sensitized on the Project’s safeguards guidelines during the Project Orientation Workshops, district meetings and public village meetings, refer to section 5.1 above.

6 Grievance Redress Mechanism

35. The Grievance R edress Mechanisms (GR M) are defined in the Project Administration Manual and ADB’s S afeguards Policy S tatement (J une 2009) aiming at the participation of APs throughout the various stages of Project planning and implementation of subprojects. The information for APs about entitlements, compensation and supportive mitigation options and grievance mechanisms have been provided by the Project’s relevant agencies and

Meetings with APs have also allowed the implementing agencies to identify the needs and preferences of APs pertaining to compensation and rehabilitation assistance and to reduce any negative potential environmental impacts caused by the subprojects.

36. In terms of grievance redresses, the consulted villagers have been briefed about rights to grievance and the procedures in case Project implementation would cause negative impacts. This have been and will be repeated through pre-construction meeting in villages near the site. The GR M mechanisms have been established for all subprojects.

37. Grievances related to any aspect of the Project will be handled through negotiations aimed at achieving consensus. Complaints will pass through maximum four stages before they could be elevated to a court of law as a last resort.

7 Conclusions

39. Based on the submitted information submitted by the contractors, PIU and the observations of the PIA consultant it can be concluded that during the reporting period:

Environmental Issues:

 No major issues on E MP implementation, however the contractors had to be reminded on OHS issues and need to install traffic warning signs.  No public health issues have been discovered during the construction of the subprojects.  No environmental grievances have been made. However, during the recent review mission ADB requested that recording system of grievances should be improved in the New Namtha subproject.

40. The overall implementation/compliance of the Project to the environmental safeguards is rated as satisfactory and compliant in this reporting period.

Land Acquisition and Compensation Issues:

 The preparation of LACP reports have been done in compliance with ADB’s and national guidelines and regulations as ADB has approved disclosed the Updated LACPs on ADB web- site.  During the preparation of LAC report of Dakcheung, Vieng Kham and Nam Thouam AHs households have been consulted.  There are no outstanding payments nor grievances made.

41. The overall implementation/compliance of the Project to the R esettlement Framework is rated as satisfactory and compliant.
