Executive Summary

1. This report covers safeguards implementation monitoring of both Water Supply and Sanitation Sector Project (WSSP) and Water Supply and Sanitation Sector Project – Additional Financing (WSSP-AF) from January to December 2020. During 2020 the project implementation has been impacted by the COVID-19 pandemic as the Lao government has issued a number of mitigation measures. The implementation of the projects, however continued despite restrictions on travelling and gatherings. Some of the contractors have also experienced shortage of some construction materials and limitation to mobilize specialized staff. At the end reporting period the overall progress of WSSP implementation progress is approximately 82% and for WSSP-AF implementation approximately 46%. The following chapters describe the main activities and status of the safeguard in each outputs.

2. The WSSP and (WSSP-AF of the Ministry of Public Works and Transport (Executing Agency) supports the development of small district towns through the improvement of water supply and sanitation services. Consistent with the Government’s urban water supply and sanitation sector policy and investment plan. The impact of WSSP and WSSP-AF will be expanded access to quality and reliable piped water supply and sanitation services for the urban population in the Lao PDR. The outcome will be improved performance of participating provincial nam papa (PNP) in delivering sustainable water supply and sanitation services. The Project adopts a sector approach following a prioritized list of subproject towns based on the water supply investment plan The Project will comprise of: (i) improvements to the water supply system and (ii) enhanced community action in urban water supply and sanitation.

3. The WSSP is implemented through a sector loan (L3041) from the Asian Development Bank (ADB) and WSSP-AF is financed by a grant (G0604) from ADB. The Ministry of Public Works and Transport (MPWT) and the Provincial Department of Public Works and Transport together with the PNPs or provincial water utilities (Implementing Agencies) will be responsible for identifying, prioritizing, appraising, selecting and approving subprojects in accordance with the Government and ADB’s policies and procedures.

4. The WSSP aims improving the water supply and sanitation situation of 9 subprojects in six provinces, while WSSP-AF consists of 6 subprojects in 4 provinces. Basic data of the subprojects is provided in Table 1 and Table 2 below.

5. Water supply development and rehabilitation will be carried out on existing PNP water supply systems and expand services to unserved communities in the most densely populated suburbs of provincial capitals and new systems constructed in district towns. The scope of works will cover the expansion, replacement and rehabilitation (if required) of: (a) water intakes from surface, spring or groundwater sources; (b) raw water transmission; (c) water treatment facilities; (d) distribution network; (e) service reservoirs; (f) individual metered service connections; and (g) improved office/workshop/store facilities for the PNP branch.

6. Village environmental improvements (VEI) will promote demand-driven, community- managed environmental improvements, such as construction or rehabilitation of small-scale community improvements (e.g., drains and village access roads). Core villages within a small town will be eligible to participate, including those that agree to implement, operate and maintain improvements; make a cash contribution towards the capital costs of the improvements; and select specific improvements in a participatory, socially inclusive and transparent manner.

7. New public sanitation facilities will be constructed or repaired in strategic areas where the O&M can be contracted to a nearby business or social entity. Where septage disposal facilities are not available in the subproject area, the project will provide technical assistance and grant funds for constructing septage disposal facilities at a suitable location on government land.

8. Construction water supply system and public latrines will be carried out under a civil works contract. Four out of 11 contracts financed from WSSP are completed and seven are ongoing.

Two contracts were awarded during the reporting period, namely Sanamxay civil works contract (WS-CW-36) on 26 October 2020 and rehabilitation package (WS-REHAB1) on 25 December 2020. Under WSSP-AF four out of 6 contracts are under construction, civil works contract for Viengkham WS-CW-40 was awarded on 30 December 2020 and one subproject is in procurement stage.

9. Implementation of village environmental improvements will be carried out under one civil works contract per province i.e. two subprojects in one package. The VEI works of Pha Oudom completed in May 2019 and completion of defects liability period certificate was issued on 20 July 2020, and Long VEI works were completed in September 2019 and defects liability certificate is being processed. VEI works contracts of Pakxan and Pakkading were completed in June 2020 and Xayabury and Botene subprojects civil works were completed in September 2020.

10. Summary of IEE and EMP Implementation. All subprojects being implemented are classified as Category B projects and the Initial Environmental Examination (IEE) reports and Environmental Management Plans (EMP) have been approved by ADB and disclosed on the ADB’s web page.

11. Under WSSP the Updated IEE/EMP report for Sanamxay subproject was resubmitted to ADB in December 2019 and disclosed on the ADB’s web page in January 2020. Pakxan District, Borikhamxay Province Updated Initial Environmental Examination submitted on April 2020 and approved disclosed on the ADB’s web page in June 2020. Under WSSP-AF Viengkham and Namthouam-Nambak District, Province Initial Environmental Examination submitted were submitted to ADB in September 2020. The IEE for Namthouam subproject was disclosed on the ADB’s web page in October 2020.

12. Based on the contractors’ progress reports and PIA Consultant’s observations there are no major environmental issues in the subprojects as the contractors are following most of the set requirements of the EMPs. However, construction supervisors have reminded the contractors to provide personal protection equipment and reminded workers to wear them.

13. No grievances on environmental issues or issues on occupational health and safety (OHS) or public safety have been reported, despite that contractors’ workers were not always wearing personal safety equipment.

14. IEE/EMP: Key Issues and Corrective Actions. The contractor of WS-CW-31 in Xayabury (WSSP-AF) improved waste management at the WTP construction site. The CSCs have reminded the contractors to provide and workers to wear personal protective equipment while working at the construction sites. Due to a change of location of the elevated reservoir of Pakxan subproject an amendment to the Initial Environmental Examination was prepared and disclosed by ADB in April 2020. The updated IEE/Emp for Sanamxay subproject was disclosed on ADB web page in January 2020.

15. Summary of Social Safeguards Implementation. For all subprojects being constructed IR documents have been prepared, reviewed by ADB and disclosed on ADB web page. All subprojects are classified as Category B or Category C projects for involuntary resettlement. As part of preparation of Feasibility Study (FS) reports of two new subprojects in Luang Prabang (WSSP-AF) province LAC DDR reports for Nam Thouam and Vieng Kham subprojects were submitted for review to ADB in June 2020.

16. Twelve grievances on EMP implementation were reported and resolved. No grievances on land acquisition or compensation have been reported by PIUs.

17. LACP: Key Issues and Corrective Actions. During the reporting period Sanamxay subproject an Updated Land Acquisition and Compensation Plan was approved in January 2020. Due new location of the elevated reservoir a Land Acquisition Corrective Action Plan for Pakxan was prepared by PIA Consultant and approved by ADB in June 2020.

18. A new Independent External Resettlement Monitor (IERM) to carry out monitoring and provide support to PIUs and advise Affected Persons in implementation of LACPs was hired by PCU during the reporting period. The IERM report for Xamneua and Sopbao subprojects (WSSP- AF) were completed by the previous IERM in April and June respectively. The new IERM carried out site visits to Sanamxay and Dakcheung subprojects of WSSP and Samakkhixay and Lamam subprojects of WSSP-AF in June 2020. Draft monitoring reports were submitted to ADB for review in September and are being finalized based on ADB’s comments. IERM also carried out monitoring missions to Namthouam and Viengkham subprojects of WSSP-AF in December 2020.

19. Summary of Indigenous People Implementation. The subprojects are categorized as ‘Category C subprojects’, specific actions favorable to ethnic minorities are addressed through the provisions of the project design (WSSP and WSSP-AF) providing a free water connection to all households including ethnic minorities during construction and a sanitation grant to poor households to improve their toilets. The resettlement framework also has special entitlements for seriously affected households.

20. Grievance and Redress Mechanisms Grievance Redress Mechanism (GRM) committees have been established for all subprojects during the subproject preparation phase and are in place. Following ADB’s recommendation to improve the GRM by maintaining records of all received complaints, PIA Consultant prepared a spreadsheet template for monitoring and recording complaints for use of PIUs. Grievances related to reinstatement of concrete to the premises have been made in New Namtha and Xaiyabury subprojects (WSSP) which are being resolved by the contractors.

21. Conclusions. Based on PCU request the contractors have installed moveable warning signs providing information on GRM contact details at distribution network constructions sites. CSCs have informed contractors and construction workers about the importance to wear personal protective equipment that is appropriate to the work they are doing. It is concluded that there are no material deviations in implementation of EMPs and that EMP implementation is in compliance.

22. Registering of complaints has improved and all PIUs submitted the records of grievances as of 25 December 2020 to PCU. Total number of registered grievances during the reporting period is twenty. Based on these records there are no outstanding complaints raised by affected households.

23. The new Independent External Resettlement Monitor started in June 2020 and carried out monitoring visits to Batch 3 and Batch 4 subprojects implemented under WSSP-AF and prepared draft IERM reports. IERM reports for Batch 1 subprojects of WSSP are still pending, however all compensations have been paid as per the approved LACP and therefore it is concluded that the implementation of IR safeguards is in compliance.

24. Recommendations. PIUs still need to be reminded about monitoring and reporting on the Grievance Redress Mechanism (GRM) and to continue recording of received complaints in in the new registry.

1.1 Project Impact and Outcome 25. The Water Supply and Sanitation Sector Project (WSSP) and Water Supply and Sanitation Sector Project – Additional Financing (WSSP-AF) of the Ministry of Public Works and Transport (Executing Agency) supports the development of small district towns through the improvement of water supply and sanitation services. Consistent with the Government’s urban water supply and sanitation sector policy and investment plan. The impact will be expanded access to quality and reliable piped water supply and sanitation services for the urban population in the Lao PDR. The outcome will be improved performance of participating provincial nam papa (PNP) in delivering sustainable water supply and sanitation services. The Project adopts a sector approach following a prioritized list of subproject towns based on the water supply investment plan. The project will comprise of: (i) improvements to the water supply system and (ii) enhanced community action in urban water supply and sanitation.

26. The WSSP is implemented through a sector loan and WSSP-AF through a grant from the Asian Development Bank (ADB). The Ministry of Public Works and Transport (MPWT) and the Provincial Department of Public Works and Transport together with the Provincial Nam Papas or provincial water utilities (Implementing Agencies) will be responsible for identifying, prioritizing, appraising, selecting and approving subprojects in accordance with the Government and ADB’s policies and procedures.

27. The Project was planned to support eight PNPs to improve and develop water supply systems in about two towns per province. It will provide financial support to selected PNPs that are state companies, have prepared a corporate plan, and have arrears less than 90 days. Each PNP will receive funds to rehabilitate and expand its provincial capital water supply system and to construct one new water supply system in a small district town.

1.2 Project Outputs 28. The both WSSP and WSSP-AF Projects have the following five Outputs:

Output 1: Improved sector coordination and policy implementation

29. This will continue reforms introduced under previous projects and implement new policy reforms to improve the performance of about eight PNPs. This includes (i) strengthened sector coordination, including support to help coordinate the subsector working group on water supply and sanitation under the Technical Working Group subgroup on urban development, subsector biannual meetings, annual subsector performance review with development partners, and smaller subsector coordination meetings; (ii) continued implementation of policy reforms, including service agreements between PNPs and provincial governments, PNP training on corporate planning and financial management, tariff adjustments, free connection policy, issuance of district sanitation regulations, and the use of simplified corporate plans; and (iii) expanded policy implementation, including nationalizing a free connection policy and sanitation regulations; wider coordination of NRW management, asset management, and water safety plans; and the establishment of a corporate planning helpdesk in the project coordination unit.

Output 2: Improved nonrevenue water management and water supply development

30. This will integrate a comprehensive NRW reduction program with water supply development in about six provincial capitals. The NRW program applies an integrated business approach that includes both investment for physical works and support for surveys, water audits and balances, record drawings, and registers. It addresses both real losses (leakage) and apparent losses (metering losses and water theft). Participating PNPs will be required to establish permanent leak detection and repair teams and implement disconnection and meter management policies. Experts will help these teams implement the NRW program. PNPs that participate in the NRW reduction program and the policy implementation activities under output 1 will be eligible to seek financing for water supply rehabilitation and expansion of existing provincial systems to peri- urban areas. They will be eligible to receive O&M equipment and household connections and meters.

Output 3: Developed new water supply systems in small towns

31. Safe, affordable, reliable PNP piped water supply systems will be built in the core urban areas of about nine small district towns. PNPs that have agreed to participate in Outputs 1 and 2 will be eligible for financing to build a new water supply system in a small district town in the same province, acquire O&M equipment, and offer free connections and meters to households during construction.

Output 4: Enhanced community action in water supply and sanitation

32. This will sustain the benefits from investments in small town water supply systems through complementary sanitation and awareness activities. The output includes (i) village environmental improvement (VEI) grants for core villages in a small town according to agreed eligibility criteria; (ii) improved household sanitation for the poor; (iii) constructed or repaired public sanitation facilities where O&M can be contracted to a business or social entity, and constructed septage disposal facilities where they are unavailable in the subproject area; and (iv) increased project and hygiene awareness through stakeholder consultations and community participation, and water,

12 Safeguards Monitoring Report t January – December 2020 sanitation and hygiene behavior. Activities will be coordinated by district authorities and implemented by village development committees.

Output 5: Strengthened capacity for project implementation, operation and maintenance

33. This includes consulting services support for project implementation assistance (including safeguards), capacity development and sector reform. The support is provided by the Project Implementation Assistance (PIA) consultant. Support for operation and maintenance (O&M) will be provided to participating PNPs through a proposed water operators’ partnership with a regional water utility or individual consultants. This output also includes consulting services support for information technology (IT), project accounting, safeguard monitoring, as well as incremental administration support (funding) for project vehicles, project office equipment, and PNP operations and leak-detection equipment.

2 Environmental Performance Monitoring

2.1 EMP Implementation 34. During construction phase, the implementation of the EMP is the responsibility of the contractor. The contractor’s responsibility includes the appropriate and timely application of the mitigating measures stipulated in the approved EMP. The application and implementation of the mitigation measures are to provide the safeguards that will control, reduce if not eliminate adverse impacts during the Subproject implementation.

35. Throughout the construction period, the contractor will submit monthly environmental compliance progress reports to the PNP, copy furnished to the PIU. The contractor should highlight the summary of the progress of construction, activities undertaken within the reporting period to implement the measures outlined in the EMP, record any community complaints received and how the complaint was resolved.

36. Regarding raw water quality PNP have collected water samples and taken them to a water laboratory for quality analyses to find out whether there are any major changes of raw water quality requiring to have adjustment to the water treatment process of the water supply scheme.

2.2 Environmental Monitoring by Construction Supervisor 37. During construction phase, the inspection, evaluation and recording of compliance to the EMP as implemented by the contractors are among the tasks undertaken by the Construction Supervisor (CS) in the field supported by the PIA Consultant’s international and national environmental specialists. During the reporting period PIA consultant has carried out periodical monitoring visits to the construction sites and the Construction Supervisors have carried out daily inspections and maintains records of the contractor’s mitigating measures and activities prescribed in the approved EMP of the Subproject. The responsibilities of Construction Supervisor cover the period to the end of the commissioning stage including certifying of construction materials, equipment and items and final checking and acceptance for handing over for operation.

38. The PIU will consolidate the results of the monthly environmental monitoring through a quarterly progress report that have been submitted to the PCU which is based at the Department of Water Supply and Sanitation of the MPWT. The following sections provide a consolidated summary of the main environmental implementation and monitoring findings based on the monitoring visits and contractors’ monthly reports. More details are provided in the Attachments 1 to 13 by subproject.

2.3 Summary of Compliance with EMP Requirements (Environmental Performance) 39. It is concluded that EMP implementation at pre-construction phase is in compliance with the EARF. 40. At the end of December 2020, under WSSP 10 (ten) water supply and public sanitation civil works contracts and 7 (seven) VEI works contracts have been awarded. Due to a change of location of elevated reservoir an amendment to the IEE of Pakxan subproject was prepared by PIA Consultant. No changes to the approved EMP were required and ADB approved and disclosed the IEE amendment on the ADB web page in April 2020.

41. Respectively under WSSP-AF five water supply and public sanitation contracts and two VEI contracts have been awarded by the end of reporting period. More details on submission of safeguards documents, contract award and implementation progress are presented in Table 3 to Table 5 above. Most of the EMP requirements are in compliance, however despite reminders and explanation of the importance to use PPEs some workers do not always wear provided equipment. The following Table 9 summarizes compliance status of the projects with EMP requirements during construction. Specific issues of non-compliance of Batches or a specific subproject are explained below.

2.5 Other activities 43. The national environmental expert carried out training of CSC and contractors’ staff on EMP implementation and monitoring for three subprojects commenced during the reporting period namely Dakcheung (WSSP), Lamam and Samakkhhixay (WSSP-AF).

3 Social Safeguard Implementation Progress 44. The following sections describe social safeguard implementation progress of WSSP and WSSP-AF projects made during the reporting period. Further details on preparation, categorization and approval of the safeguard documents is provided in Table 5 above.

3.1 Involuntary Resettlement Implementation 3.1.1 WSSP

45. Batch 1 and 2. The Updated LACPs for all seven subprojects have been approved by ADB. The identified AHs were compensated in cash before start of construction. , refer to Updated LACPs with receipts of payments. However, independent external monitoring reports are pending.

46. During the reporting period the location of elevated reservoir in Pakxan subproject was changed resulting in acquisition of 599 m2 or 7.3% of 8,210 m2 of governmental land within a not used school compound with no private nor communal users. Land Acquisition and Compensation Corrective Action Plan of Pakxan was prepared by PIA consultant and submitted to ADB by PCU. The LACCAP was approved and disclosed on ADB’s web page in June 2020.

47. Following ADB’s recommendation to improve the GRM by maintaining records of all received complaints, PIA Consultant prepared a spreadsheet template for monitoring and recording complaints for use of PIUs. However, some PIUs are recording complaints in the site logbooks and complaint forms.

48. Batch 3. The LADDR for Dakcheung was approved and disclosed on ADB’s web page in October 2019. Sanamxay Subproject Land Acquisition and Compensation Plan was submitted to ADB and approved; and disclosed on ADB’s web page in January 2020.

49. Sample Projects of New Project. Under the WSSP as part of FS preparation PIA Consultant conducted public consultations and prepared LACDDR for Longsane and Homedistrict towns of Xaysomboun Province and for Vang Vieng and Maed of Vientiane Province. After detailed engineering design completion field visits to the Xaisombun and Vang Vieng subprojects were carried out to prepare updated LAC documents. In Vang Vieng there is another ADB funded 2nd GMS Tourism Infrastructure for Inclusive Growth (TIIGP2) that is being implemented at the same time with some overlapping areas. Several meetings have been arranged to coordinate construction and IR activities of both projects.

50. Compliance. The preparation of LACP reports have been done in compliance with ADB’s and national guidelines and regulations as ADB has approved disclosed the Updated LACPs on ADB web-site. IERM reports for Batch 1 are still pending, however, based on information provided by PIUs there are no outstanding compensations to be paid nor major grievances made by affected people. Therefore, it is concluded that IR implementation is in compliance.

3.1.2 WSSP-AF

51. Batch 4: Xamneua and Sopbao Subproject Land Acquisition and Compensation Plan was prepared and submitted to ADB and approved and disclosed on ADB’s web page in March 2019. Construction of both subprojects is ongoing and there are no changes to changes to the approved LAC documents. IERM report for Xamneua subproject was disclosed on ADB web page in April 2020. The ERM for Sopbao was submitted to ADB in June 2020, but not yet disclosed.

52. Batch 5. Two new subprojects (Viengkham and Namthouam) have been selected for subproject preparation in Luang Prabang province. All facilities are planned to be located on public land. As part of FS preparation PIA consultant prepared draft LACDDR reports, and submitted to ADB review in June 2020. After detailed engineering design a corrective action plan for Viengkham subproject and LACP report for Namthouam subproject need to be prepared. IERM carried out monitoring visits to both projects in December.

53. Compliance. IR reports have been prepared and approved by ADB for Lamam and Samakkhixay subprojects. There are no outstanding payments nor major grievances made by affected people. Therefore, it is concluded that IR implementation is in compliance.

3.2 Indigenous Peoples Safeguards Implementation Compliance 54. The safeguards categorization for both the WSSP and WSSP-AF are for Indigenous Peoples (category B). In case indigenous peoples are found, an ethnic peoples development plan will be prepared in accordance with ADB SPS 2009 and the Ethnic Peoples Planning Framework (EPPF). If impacts on minority ethnic groups are limited to land acquisition or resettlement, special mitigation and allowance measures may be included as part of the land acquisition and compensation plans. In some instances, Indigenous Peoples plan elements may be integrated in project with a summary in accordance with the requirements outlined in Indigenous People’s safeguards, ADB’s SPS. In such instances, a separate EPP may not be required. During implementation, the EA should consult with ADB prior to the preparation of subproject feasibility studies.

55. During the subproject preparation phase for all subprojects of WSSP and SSP-AF meaningful consultations inclusive of ethnic minorities were carried out. Based on the assessment no negative impacts or disruptions are expected with respect to (i) customary rights of use and access to land and natural resources; or (ii) socioeconomic status (culture or traditions, or impact on access to cultural sites or attachment to land).

56. All the subprojects will have significant positive social and economic impacts on beneficiaries including indigenous peoples/ethnic minorities. Therefore, no separate IPP was prepared and the elements of IPP were included in the subproject design; (i) improving and providing free service connections to safe and reliable piped water supplies; and (ii) improved sanitation by providing grants to poor households including ethnic minorities who do not have a hygiene latrine or their latrine needs improvements.

3.2.1 WSSP

57. Implementation of IP safeguards of WSSP is in compliance with requirements. Construction of water supply network and installation of house connections is ongoing in five subprojects. For Batch 2 – 28 poor households in Xayabury, 10 poor households in Pakxan, and 17 households in Pakkading subproject were certified to be eligible for sanitation grants by district governors. Procurement of construction materials for the Batch 2 subprojects is ongoing.

3.2.2 WSSP-AF

58. Implementation of IP safeguards of WSSP-AF is in compliance with requirements. Construction of water supply network and installation of house connections is ongoing in Xamneau and Sopbao subprojects. Identification of poor households for sanitation grants was completed during previous reporting period, and certification of poor households by local authorities is ongoing.

3.3 External Resettlement Monitoring 59. The IERM shall carry out monitoring of implementation of the LACPs and to support and advise AHs during the implementation of the subprojects. The project has experienced delayed submission of IERM reports and the quality of the reports were not satisfactory. Therefore, the

Independent External Resettlement Monitor (IERM) was replaced during the reporting period. The new IERM started working in June 2020 and carried out site visits to Attapeu and Sekong provinces For details on submission of IERM reports refer to Table 5 above.

3.3.1 WSSP

60. The new IERM carried out site visits to Sanamxay and Dakcheung subprojects of WSSP in June 2020. Draft IERM reports are being reviewed by PCU and ADB.

3.3.2 WSSP-AF

61. The IERM report for Xamneua and Sopbao subprojects (WSSP-AF) were revised based on ADB comments and completed by the previous IERM in April and June respectively. The IERM report for Xamneua was disclosed on ADB web page in July 2020, however the disclosure of Sopbao IERM report is pending.

62. The new IERM carry out monitoring of LAC implementation in Samakkhixay and Lamam subprojects in June 2020 and submitted draft reports to PCU and ADB in September.

PIA consultant has provided on the job training during the subproject preparation stage and PIU safeguards focal points are familiar with ADB policies. During the reporting period PIA staff have supported PIA in subproject implementation and monitoring activities.

66. DRC were established during subproject preparation, refer to Table 7 above and detailed information of the committee members in the attachments 1 to 7, 9 and 11.

67. Training. No new PIUs or DRCs have been established, thus no training has been provided during the reporting period. Support in form of on the job training has been provided as required during implementation of the subprojects.

68. Finance. During implementation contractors will be responsible for compensations on impacts or damages to structures caused by contractors. The province and PNPs have allocated financial resources for effective operations budgets for LAC. All affected households have been compensated prior to contract awards. During the reporting period from January to December 2020 no new funds have been disbursed from counterpart funds.

3.4.2 Input Indicators WSSP-AF

3.4.3 Process Indicators

75. Consultation, participation and procedures in operations. During the reporting period the PIUs of WSSP and WSSP-AF have carried out day to day activities and informed village authorities and public of ongoing construction activities in the subprojects. Issues related to complaints are reported under the section 6 Grievance Redress Mechanism.

3.4.4 Output Indicators WSSP

76. Table 12 below summarizes land acquisition and paid compensations (Planned VS Actual) of the WSSP. The information in column “Planned” is based LAC documents prepared during subproject preparation phase and in column “Actual” is based on the updated LACP, LACDDR and IERM reports. More detailed information is provided in the separately submitted LAC documents for each subproject. The main reasons for deviations between planned and actual are caused by changes during detailed engineering design and changes to pipeline alignment during construction to avoid temporary and permanent impacts.

77. The biggest changes in monetary terms are under “IV Compensation and Rehabilitation items J and K”. The LACPs for Batch 1 were prepared by PPTA in 2013, which estimated compensations to business and shop owners/operators much higher than actual impacts. PIA carried out a survey on actual impacts during construction in Long subproject under Batch 1. Based on interviews of business and shop owners it was concluded that actual impacts businesses and shops during the construction phase was negligible. Therefore, during updating the LACPs much more stringent criteria for estimating compensation and rehabilitation compensations have been used.

5 Information Disclosure and Socialization Including Capability Building

5.1 Public Consultations and Meetings 80. In accordance with the Project’s Resettlement Framework public consultation meetings were held in six subproject areas. They were facilitated and attended by representatives from the PIU, district and village authorities, and with community members as the majority of the attendees. These public meetings briefed in general and informed in details about topics including but not limited to (i) Project components; (ii) subproject features, (iii) GOL’s laws and procedures on land acquisition; (iv) ADB’s policies on Involuntary Resettlement; (v) Project’s Policy Framework and Entitlements; (vi) subproject impacts and entitlements; (vii) Cut-off–Date (CoD); (viii) mitigation measures; (ix) preparation of Land Acquisition and Compensation documents, (x) budget costs, (xi) implementation schedule, and (xii) others.

81. All meetings allowed the participants to raise questions to clarify environmental concerns and resettlement policies particularly compensation and entitlements, but also provided the opportunities to actively participate in the land acquisition and compensation planning where they

82. Sample Projects of New Project, (WSSP). As part of preparation of a new ADB financed Water Supply Sector Project (Loan 53389-LAO) the PIA Consultant has assisted PCU and ADB in preparation safeguards documents for four sample subprojects. Public consultations were facilitated by PIA Consultant with assistance of PIU and district authorities for Longsane and Home subprojects in and Vang Vieng and Maed subprojects in Vientiane province under the WSSP.

83. As part of FS preparation public consultations for Longsane and Home subproject were carried out in February and March 2020. For Longsane subproject one district level meeting and 10 village consultations were attended by 565 participants (160 females and 405 males) including 362 ethnic minority representatives. Respectively for Home subproject the total number of participants of one district level meeting and 3 village consultations was in total 114 of which 35 were female and 79 male, all belonging to Hmong Mien ethnic group. There are no negatively AH, therefore Land Acquisition and Ethnic Group Due Diligence Report (LAEGDDR) was prepared. Second round of public consultations for Longsane subproject after detailed engineering was

35 Safeguards Monitoring Report t January – December 2020 carried out in December. The updated LAEGDDR for Longsane is scheduled to be completed during Q1 2021 and for Home subproject under the new ADB Water Supply Sector Project Loan 53389-LAO.

84. Similarly, the disclosure of LAC information, consultation and participation of residents in Vang Vieng and Maed as part of FS preparation took place in May 2020. However, in the context of COVID-19 lead limitation in travelling and gatherings/meetings. Only one joint district and village meeting was arranged and attended by 29 participants (3 females and 26 males) of which all belong to the Lao-Tai ethnic group. The consultations continued at DED stage for Vang Vieng subproject under WSSP and for Maed subproject under the new project (Loan 53389-LAO).

85. In Vang Vieng ADB is financing 2nd GMS Tourism Infrastructure for Inclusive Growth (TIIGP2) project which has some overlapping areas in the downtown area with the new project. Several coordination meeting with TIIGP2 have been carried out to have uniform approach for social safeguards issues. WSSP carried out public consultations after detailed engineering design in December in areas that are outside the overlapping areas. Consultations on overlapping areas will be carried out together with TIIGP2 project once common approach have been agreed.

86. Batch 5 (WSSP-AF). The Updated LACDDR for Viengkham and Namthouam subprojects based on DED and complementary public consultations carried out in Mach 2020 was submitted to ADB for review in May. Due to COVID-19 pandemic information was provided through two consultation meetings with limited representation consisting of district authorities and villagers in Nambak district office in March 2020. In total there were 15 attendees from Viengkham district women union, district cabinet Lao Front, DONRE, public health office and 7 village heads (3 female and 12 male) of which 2 belonging to Mon-Khmer and 1 Hmong ethnic groups. Respectively for Namthouam subproject combined meeting was participated by 23 attendees (2 female and 21 male) from district authorities and 15 village heads.

87. In November the IERM carried out a monitoring trip to Viengkham and Namthouam subproject areas which revealed some new information requiring complementary consultations and preparation of an corrective action plan for Viengkham and revising LACDDR to LACP report for Namthouam subproject. PIA Consultant is preparing the corrective action plan and LACP based new information and consultations with the affected households carried out in December.

88. During construction phase the CSC, PIU and contractor village head and informs the local residents on the forthcoming construction activities of pipeline section or other facilities to be constructed. Warning signs with contact details are also installed at pipeline construction sites.

5.2 Information Disclosure 89. Table 5 above provides information on preparation and disclosure of safeguard documents and key information have been disclosed to the Affected Households through the public consultation meetings and individual discussions with APs.

90. During the reporting period ADB uploaded the IEE/EMP and Land Acquisition and Compensation Due Diligence Report for Sanamxay subproject of WSSP and Addendum to IEE and Land Acquisition and Corrective Action Plan for Pakxan Subproject.

5.3 Capacity Building 91. During reporting period the PIA consultant has involved PIU members of Xaysomboun PNP and Vientiane PNP (not yet officially appointed by the governor) in the public village meetings; identification of VEI activities, protection of environment and assessment of land acquisition losses during the field surveys including the SESAH and DMS. This on the job training has increased the capacity of the PIU members in all subprojects. The local authorities including members of the district resettlement committees have also been sensitized on the Project’s safeguards guidelines during the Project Orientation Workshops, district meetings and public village meetings, refer to section 5.1 above.

92. The national environmental expert carried out training of CSC and contractors’ staff on EMP implementation and monitoring for three subprojects commenced during the reporting period namely Dakcheung (WSSP), Lamam and Samakkhhixay (WSSP-AF) subprojects.

6 Grievance Redress Mechanism 93. The Grievance Redress Mechanisms (GRM) are defined in the Project Administration Manual and ADB’s Safeguards Policy Statement (June 2009) aiming at the participation of APs throughout the various stages of Project planning and implementation of subprojects. The information for APs about entitlements, compensation and supportive mitigation options and grievance mechanisms have been provided by the Project’s relevant agencies and committees. Meetings with APs have also allowed the implementing agencies to identify the needs and preferences of APs pertaining to compensation and rehabilitation assistance and to reduce any negative potential environmental impacts caused by the subprojects. Grievances related to any aspect of the Project will be handled through negotiations aimed at achieving consensus. Complaints will pass through maximum four stages before they could be elevated to a court of law as a last resort.

94. Current practices have been that most of the complaints during construction have been received either by CSC, PIU or the contractor and solved by the contractor. During the reporting period PIA Consultant developed and introduced an Excel spreadsheet for systematic recoding of complaints by CSC and PIUs.

95. Summary of GRM Issues:

96. During the reporting period twelve new grievances were reported and solved by the PIUs. More details are given in the Attachments 1 to 15.

7 Conclusions 97. Based on the submitted information by the contractors, PIUs and the observations of the PIA consultant it can be concluded that during the reporting period:

98. Environmental Issues and EMP implementation - WSSP and WSSP-AF:

 No major issues on EMP implementation, however the contractors had to be reminded on contractor’s staff not wearing PPE and OHS issues.  No public health issues have been discovered during the construction of the subprojects.  No environmental grievances have been made.

99. The overall implementation/compliance of the WSSP and WSSP-AF to the environmental safeguards is rated as satisfactory and compliant in this reporting period.

100. Involuntary Resettlement implementation - WSSP and WSSP-AF:

 The preparation of LACP reports have been done in compliance with ADB’s and national guidelines and regulations as ADB has approved disclosed the Updated LACPs and LACDDRs on ADB web-site.  There are no outstanding payments nor grievances made.

101. The overall implementation/compliance with the involuntary resettlement of WSSP and WSSP-AF is rated as satisfactory and compliant.

102. Indigenous People implementation – WSSP and WSSP-AF:

 The impact on indigenous people are positive in all subprojects, and to support ethnic minorities are included in the Project/subproject design. As per IP framework for the Project no separate IPP was prepared.

 All ethnic minorities have similar access to projects benefits.

 There are no cases where ethnic minorities have been negatively affected.

103. The overall implementation/compliance with the indigenous peoples of WSSP and WSSP- AF is rated as satisfactory and compliant.

Water quality analysis results of raw water, Namkhan 2 River

The proposed raw water source is the Namkhan 2 River that runs through Ban Pak Mong within the project area. Namkhan 2 River is a mountain stream which joining of two tributaries, namely Namkhan 1 and Nammong. As a result of merging of two streams, this river has considerable year-round flow, with a sufficient year-round base flow for the capacity of the WTP. Being a mountain river, the water quality is good with high, but short-lived turbidity peaks during the rainy seasons. The 2019 water quality records do not indicate any parameters that the improved sand filtration system with pre-sedimentation, flocculation and sedimentation will be inadequate for meeting the Lao National Drinking Standards.

The Provincial Nampapa has taken water samples from the proposed raw water source and water quality analysis for 13 parameters have been carried out in a certified water laboratory. Details on sampling are given in the following tables.

Water quality analysis results of raw water, Nam Xeng River

The location of the intake has been chosen on a small curve portion of the river for available of water during the dry season. Intake water intake velocity (0.26m/s) at the worst case scenario is less than average dry-weather velocity (0.5-0.6m/s) of main stream and intake flow direction is perpendicular to the stream flow direction. As such less amount of silt and floating will be affected the proposed screens.

The Provincial Nampapa has taken water samples from the proposed raw water source and water quality analysis for 13 parameters have been carried out in a certified water laboratory. Details on sampling are given in the following tables.
